Count 8: Armed Criminal Action (FELONY) RSMo ON 6/1/2017 Time: Place: 49XX the City of St. Louis, State of Missouri, the defendant committed the felony of Assault in the First Degree charged in Count VII, all allegations of which are incorporated herein by reference, and the defendant committed the foregoing felony of Assault in the First Degree by, with and through, the knowing use, Count 9: Assault 1st Degree Or Attempt (Class B FELONY) RSMo (SCC Y197913) The defendant, in violation of Section , RSMo, committed the class B felony of assault in the first degree, punishable upon conviction under Section , RSMo, in that on or about June 1, 2017, in the City of St. Louis, State of Missouri, the defendant shot at Dei.I. and such conduct was a substantial step toward the commission of the offense of assault in the first degree of Dei.I., and was done for the purpose of committing such assault. 4 The defendant, in violation of Section , RSMo, committed the class B felony of unlawful use of a weapon, punishable upon conviction under Sections and , RSMo, in that on or about June 1, 2017, in the City of St. Louis, State of Missouri, the defendant, knowingly shot a firearm at a motor vehicle, a Honda Civic. Count 12: Armed Criminal Action (FELONY) RSMo ON 6/1/2017 Time: Place: 49XX the City of St. Louis, State of Missouri, the defendant committed the felony of Unlawful Use of a Weapon-Shooting into a Motor Vehicle charged in Count X, all allegations of which are incorporated herein by reference, and the defendant committed the foregoing felony of Unlawful Use of a Weapon- Shooting into a Motor Vehicle by, with and through, the knowing use, assistance and aid of a deadly weapon. Count 13: Tampering With A Witness In A Felony Prosecution (Class D FELONY) RSMo (SCC Y201750) The defendant, in violation of Section , RSMo, committed the class D felony of tampering with a witness, punishable upon conviction under Sections and , RSMo, in that on or about June 1, 2017, in the City of St. Louis, State of Missouri, the defendant, with the purpose to induce Secret Witness to not talk to the police about the Murder he/she observed, the defendant did so by telling the witness not to say anything while holding the firearm he had just used to shoot multiple people. A person convicted of this offense shall not be eligible for parole. The facts that form the basis for this information and belief are contained in the attached statement(s) of facts, made a part hereof and submitted as a basis upon which this court may find the existence of probable cause. I have probable cause to believe that Jerome Leon Buress, J, a Black/African American Male DOB: 7/XX/88 Age: 28, committed one or more criminal offense(s). The facts supporting this belief are as follows: I was informed that the defendant approached a Honda Civic and shot a firearm multiple times into the vehicle. The defendant shot Jessica Garth, Derrick Irving, and Julian Hayes, who each died from their gunshot wounds. The defendant shot Den.I. age 7, in the head, causing her serious physical injury. The defendant also shot at Dei.I., age 5. Before leaving the scene of the homicide, and while still armed, the defendant told at least one individual who was standing nearby not to say anything.
