Moore to forced labor or services by causing or threatening to cause physical harm to minor, C. Moore, and did cause injury to minor, C. Moore; contrary to MCL b(2)and in committing the violation did commit criminal sexual conduct or attempt to commit criminal sexual conduct on minor, C. Moore; contrary to MCL i. [ I] FELONY: Life or any term of years COUNT 3: CRIMINAL SEXUAL CONDUCT - FIRST DEGREE (PERSONAL INJURY) On or about January 2011, in the City of Detroit, Sedrick Leman-Issac Mitchell did engage in sexual penetration to-wit: vaginal penetration with minor, D. Jackson, causing personal injury to said victim and using force or coercion to accomplish sexual penetration; contrary to MCL b(1)(f). [ B1F] FELONY: Life or any term of years; Mandatory AIDS/STD testing; DNA to be taken upon arrest.
2 COUNT 4: CRIMINAL SEXUAL CONDUCT - FIRST DEGREE (Relationship) On or about January 2011, in the City of Detroit, Sedrick Leman-Issac Mitchell did engage in sexual penetration to-wit: vaginal penetration, with minor, D. Jackson, the victim being at least 13 but less than 16 years of age and the defendant coerced the victim to submit by exerting his/her authoritative position; contrary to MCL b(1)(b). Moore, the victim being at least 13 but less than 16 years of age and the defendant coerced the victim to submit by exerting his/her authoritative position; contrary to MCL b(1)(b). COUNT 7: PROSTITUTION/PANDERING On or about July 2010, in the City of Detroit, Sedrick Leman-Issac Mitchell did induce, persuade, encourage, inveigle or entice a female, minor, C. Moore, to become a prostitute; contrary to MCL [ ] FELONY: 20 Years; AIDS/STD testing required unless court finds testing is inappropriate and documents its reasons.
3 COUNT 8: PROSTITUTION/ACCEPTING EARNINGS On or about January 2011, in the City of Detroit, Sedrick Leman-Issac Mitchell did knowingly accept, receive, buy or appropriate money or other valuable thing without consideration from the earnings of a prostitute, minor, D. Jackson; contrary to MCL [ ] FELONY: 20 Years COUNT 9: PROSTITUTION/ACCEPTING EARNINGS On or about July 2010, in the City of Detroit, Sedrick Leman-Issac Mitchell did knowingly accept, receive, buy or appropriate money or other valuable thing without consideration from the earnings of a prostitute, minor, C. Moore; contrary to MCL [ ] FELONY: 20 Years COUNT 10: ASSAULT WITH A DANGEROUS WEAPON(FELONIOUS ASSAULT) On or about August 2010, in the City of Detroit, Sedrick Leman-Issac Mitchell did make an assault upon minor, C. Moore with a dangerous weapon, to-wit: a pistol, but without intending to commit the crime of murder or to inflict great bodily harm less than the crime of murder; contrary to MCL [750.82]. FELONY: 4 Years and/or $2,000.00; DNA to be taken upon arrest. COUNT 11: WEAPONS - FELONY FIREARM On or about August 2010, in the City of Detroit, Sedrick Leman-Issac Mitchell did carry or have in his/her possession a firearm, to-wit: a pistol, at the time he/she committed or attempted to commit a felony, to-wit: felonious assault; contrary to MCL b. [ B-A] FELONY: 2 Years consecutively with and preceding any term of imprisonment imposed for the felony or attempted felony conviction; Mandatory forfeiture of weapon or device [See MCL ] SECOND OFFENSE NOTICE: Althought the People are not required to nitify the court or defendant of prior convictions that may result in an enhanced sentence, we are voluntarily information the court that according to our current information, the defendant was previously convicted of violating MCL b on or about March 2001, and therefore, upon conviction, may be subject to an enhanced sentence under MCL b. [ B-B] FELONY: 5 consecutively with and preceding any term of imprisonment imposed for the felony or attempted felony conviction; Mandatory forfeiture of weapon or device [See MCL ] COUNT 12: WEAPONS - FIREARMS - POSSESSION BY FELON On or about August 2010, in the City of Detroit, Sedrick Leman-Issac Mitchell did possess a firearm when ineligible to do so because he or she had been convicted of possession of controlled substance less than 25 grams; MCL A5, a specified felony, and the requirements for regaining eligibility had not been met; contrary to MCL f. [ F] FELONY: 5 Years and/or $5,000.00; Mandatory forfeiture of weapon or device [See MCL ] COUNT 13: CRIMINAL ENTERPRISES - CONDUCTING On or about July 2010 through January 2011, in the City of Detroit, Sedrick Leman-Issac Mitchell being a person employed by or associated with an enterprise, to wit: a prostitution ring, did knowingly conduct or participate in the affairs of the enterprise directly or indirectly through a pattern of racketeering activity, consisting of two or more of the following incidents of racketeering, to wit: on or about January 2011, in in the City of Detroit, defendant did commit the following offense for financial gain, to wit: did induce, persuade, encourage, inveigle or entice a female, minor, D. Jackson, to become a prostitute; contrary to MCL [ ]; and on or about July 2010, in the City of Detroit, defendant did commit the following offense for financial gain, to wit: did induce, persuade, encourage, inveigle or entice a female, minor, C. Moore, to become a prostitute; contrary to MCL [ ], and on or about January 2011, in in the City of Detroit, defendant did commit the following offense for financial gain, to wit: did knowingly accept, receive, buy or appropriate money or other valuable thing without consideration from the earnings of a prostitute, minor, D. Moore; contrary to MCL [ ], and on or about July 2010, in in the City of Detroit, defendant did commit the following offense for financial
4 gain, to wit: did knowingly accept, receive, buy or appropriate money or other valuable thing without consideration from the earnings of a prostitute, minor, C. Moore; contrary to MCL [ ], and on or about January 2011, in in the City of Detroit, defendant did commit the following offense for financial gain, to wit: did knowingly subject or attempt to subject minor, D. Jackson to forced labor or services by causing or threatening to cause physical harm to minor, D. Jackson, and did cause injury to minor, D. Jackson; contrary to MCL b(2), and in committing the violation did commit criminal sexual conduct or attempt to commit criminal sexual conduct on minor, D. Jackson; contrary to MCL i. [ I] and on or about July 2010 through August 2010, in in the City of Detroit, defendant did commit the following offense for financial gain, to wit: did knowingly subject or attempt to subject minor, C. Moore to forced labor or services by causing or threatening to cause physical harm to minor, C. Moore, and did cause injury to minor, C. Moore; contrary to MCL b(2) and in committing the violation did commit criminal sexual conduct or attempt to commit criminal sexual conduct on minor, C. Moore; contrary to MCL i. [ I] financial gain, to wit: did make an assault upon minor, C. Moore with a dangerous weapon, to-wit: a pistol, but without intending to commit the crime of murder or to inflict great bodily harm less than the crime of murder; contrary to MCL [750.82]., financial gain, to wit: did carry or have in his/her possession a firearm, to-wit: a pistol, at the time he/she committed or attempted to commit a felony, to-wit: felonious assault; contrary to MCL b. [ B-A], financial gain, to wit: did possess a firearm when ineligible to do so because he or she had been convicted of possession of controlled substance less than 25 grams; MCL A5, a specified felony, and the requirements for regaining eligibility had not been met; contrary to MCL f. [ F], which had the same or a substantially similar purpose, and which amount to or pose a threat of continued criminal activity; contrary to MCL i(1). [ I1] FELONY: 20 Years and/or $100,000.00; criminal forfeiture of proceeds, substituted proceeds, and instrumentalities of racketeering listed on attached notification (see MCL j(4)); court may order court costs, costs of investigation, and/or costs of prosecution Upon conviction of a felony or an attempted felony court shall order law enforcement to collect DNA identification profiling samples. HABITUAL OFFENDER - THIRD OFFENSE NOTICE Take notice that the defendant was twice previously convicted of a felony or an attempt to commit a felony in that on or about January 30, 2003, he or she was convicted of the offense of possession of controlled substance less than 25 grams in violation of MCL AF in the 3rd Circuit Court for Wayne County, State of Michigan; And on or about March 18, 2008, he or she was convicted of the offense of felony firearm in violation of MCL B-A in the 3rd Circuit Court for Wayne County, State of Michigan. Therefore, defendant is subject to the penalties provided by MCL [769.11] PENALTY: Twice the maximum sentence on primary offense or lesser term The complaining witness asks that defendant be apprehended and dealt with according to law.
