1 The State of Ohio, Franklin County Grand Jury Term Beginning May 13, 2016 } SS. INDICTMENT FOR: Aggravated Murder with Specification (ORC ) (UF) (2 Counts); Murder with Specification (ORC ) (UF) (2 Counts); Murder with Specification (ORC ) (UF) (2 Counts); Tampering With Evidence (ORC ) (F3) (1 Count). Total: 7 Counts. INTRODUCTION AND COURSE OF CONDUCT FINDINGS The Franklin County Common Pleas Court has jurisdiction over crimes and offenses committed in Franklin County, Ohio. The Grand Jury finds and presents, pursuant to Sections and of the Ohio Revised Code, that the offense alleged in Count Seven, is part of a course of criminal conduct between April 5, 2016 and April 6, 2016, for which the course of conduct took place in multiple counties including Franklin County and Fairfield County. Further, the course of conduct involves offenses that were committed as part of the same transaction or chain of events, or in furtherance of the same purpose or objective; to wit: After committing two homicides with a firearm in Franklin County on April 5, 2016, Mr. Jeffries did leave Franklin County with the firearm and travel to his parents house located in Fairfield County to dispose of the firearm. Count One Aggravated Murder, , UF upon their oath do find and present that late of said County, on or about April 5, 2016, within the County of Franklin aforesaid, in violation of section of the Ohio Revised Code, did purposely, and with prior calculation and design, cause the death of James Miller. SPECIFICATION ONE TO COUNT ONE - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about Count Two
2 upon their oath do find and present that late of said County, on or about Revised Code, did purposely cause the death of James Miller. SPECIFICATION ONE TO COUNT TWO - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about Count Three upon their oath do find and present that late of said County, on or about Revised Code, did cause the death of James Miller, as a proximate result of the offender committing or attempting to commit an offense of violence that is a felony of the first or second degree, to wit: felonious assault, in violation of Section of the Ohio Revised Code. SPECIFICATION ONE TO COUNT THREE - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about Count Four Aggravated Murder, , UF upon their oath do find and present that late of said County, on or about April 5, 2016, within the County of Franklin aforesaid, in violation of section of the Ohio Revised Code, did purposely, and with prior calculation and design, cause the death of Gary Ashton Francis. SPECIFICATION ONE TO COUNT FOUR - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about

SPECIFICATION ONE TO COUNT FIVE - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about Count Six upon their oath do find and present that late of said County, on or about Revised Code, did cause the death of Gary Ashton Francis, as a proximate result of the offender committing or attempting to commit an offense of violence that is a felony of the first or second degree, to wit: felonious assault, in violation of Section of the Ohio Revised Code. SPECIFICATION ONE TO COUNT SIX - Firearm Specification - 3 year, (A) The Grand Jurors further find and specify that had a firearm on or about Count Seven Tampering With Evidence, , F3 to April 6, 2016 upon their oath do find and present that, late of said County, on or about April 5, 2016 to April 6, 2016 within the County of Fairfield, as part of a course of criminal conduct occurring in Fairfield County and Franklin Counties, in which the offenses involved were committed as part of the same transaction or chain of events or in furtherance of the same purpose or objective, in violation of section of the Ohio Revised Code, did, knowing that an official proceeding or investigation was in progress, or was about to be or likely to be instituted, alter, destroy, conceal, or
4 remove any record, document, or thing, with purpose to impair its value or availability as evidence in such proceeding or investigation. All of the above conduct being contrary to the form of the statute in such cases made and provided, and against the peace and dignity of the State of Ohio.
