3 ANNEX 1 Declarations in accordance with Articles 3 (1), 5 (4) and 21 of the Framework Decision Article 3 1 Competent Authorities Competent Authority as issuing State: Public prosecutor attached to the Court competent for enforcement of the decision. Competent Authority as executing State: Court of Appeal of the district where the sentenced person is lawfully and habitually residing at the time of forwarding of the measure to the judicial authority or where the sentenced person has manifested his/her intention to transfer his/her lawful and habitual residence (see attached list). Direct forwarding between Judicial Authorities is possible. Alternatively, forwarding can take place via the Central Authority (Ministry of Justice, Ufficio II, International Judicial Cooperation). The Ministry of Justice shall forward and receive the judgments and decisions and the certificate, as well as deal with all correspondence pertaining thereto; it shall also deal with all correspondence concerning any other request that does not have to be directly satisfied by the competent judicial authority. Article 5 4 Conditions for Forwarding a Decision Forwarding to the competent authority of a member State other than the member State where the sentenced person is lawfully and ordinarily residing is allowed, on condition that this latter authority gives its consent.
