5 December 12, 2008 Dear Fellow Texans: We are pleased to submit the Sheriffs and Constables 2009 Fees listing. Pursuant to Local Government Code , our office compiled the list of fees effective Jan. 1, 2009, as reported by county officials. The 1995 Texas Legislature enacted Senate Bill 770, which amended Local Government Code (f) to require each county commissioners court to provide written notice to the Texas Comptroller s office of any changes in the fees set for services performed by the sheriffs and constables offices. These fees do not apply to criminal cases. We appreciate the cooperation of county officials throughout the state and their continued commitment to public service. 7 Foreword In 1995, the 74th Texas Legislature passed Senate Bill 770, which amended (f), Local Government Code, to require each county commissioners court in Texas to provide written notice to the Texas Comptroller of Public Accounts if there are any changes in the fees set for services performed by the sheriffs and constables offices. These fees do not apply to criminal cases. A commissioners court is allowed to adopt fees to be charged for the sheriffs and constables services. These fees must be reasonable and cannot be higher than is necessary to pay the cost of providing the services. The commissioners court must set the fees before Oct. 1 of each year to be effective Jan. 1 of the following year. The fees can only be set once during any one-year period. On or before Oct. 15, the commissioners court must provide written notice to the Comptroller of the amounts of the fees adopted. Before Dec. 15, the Comptroller must compile and publish a report on the fee information. The Comptroller must then provide a copy of the report to: each commissioners court in the state; any statewide association of counties or of officers of counties that request in writing before Dec. 15 to be informed; and the State Bar of Texas. The commissioners court is required to furnish the information to its district clerk, county clerk, justices of the peace, sheriff and constables in their respective counties.

9 Acknowledgments In August 2008, the Comptroller s office requested information from every county clerk and county judge in the state concerning the fees adopted by sheriffs and constables, to be provided by Oct. 15. Every county in the state submitted their fee information on a timely basis, and we commend them for their attention to this legal requirement.
