The five year review of the Official Plan is scheduled to be completed in These administrative amendments will be included in the Official Plan update. This report provides general information about the proposed administrative amendment to the City of Kingston Official Plan. The amendment will include corrections to section references, modification of wording in order to clarify the intent and purpose of some policies, and minor corrections and changes to schedules (maps) in the Official Plan. 96

3 Report to Planning Committee Report Number: PC February 19, 2015 Page 3 of 4 Options/Discussion: The purpose of this report is to provide the Planning Committee with general information relating to the proposed administrative amendments to the City of Kingston Official Plan. Recommendations regarding this application will be submitted to the Planning Committee and Council for consideration in a Comprehensive Planning Report, to be submitted at a future Planning Committee meeting. Staff is proposing an administrative amendment to the Official Plan to make minor corrections and provide clarification to specific sections of text and schedules (maps). The proposed administrative amendment is summarized as follows: Making corrections to some section references in the text; Modifying the wording of some of the policies so that the intent is clearer, including policies related to: a) being consistent with the 2014 Provincial Policy Statement; and b) recognizing that Low Density Residential applies to a broad range of housing types within the Low Density Residential policies; providing additional references in existing policies to related and relevant policies of the Official Plan for ease of use; Moving existing policy to sections where they can be more appropriately applied, as intended with their initial adoption into the Official Plan; and Making minor changes to various schedules (maps) in the document for accuracy and clarification, including: a) Remove reference to the former rail line on Schedules 2, 3-A and 3-D; b) Ensure that site specific Official Plan Amendments have been correctly designated and identified on Schedule 3 -D; c) Changing the Note on Schedule 3-D; d) Correction to numbering in Schedule 13; e) Schedule CN-1 amended to classify Atkinson Street and a major road ; and f) Changing the Note of Schedule RC-1 and correcting a reference in the Official Plan Amendment matrix of the schedule. /By-Law: Provincial Policy Statement City of Kingston Official Plan 98

In addition, prepaid first class mail was sent to all required public agencies. If the amendment is approved, a Notice of Adoption will be circulated in accordance with the provisions of the Planning Act. 5 City of Kingston Official Plan Administrative Amendments Exhibit A Administrative Amendments to Policy 1) Section It is the intent of this Plan to meet the provisions of the Provincial Policy Statement periodically with respect to managing and directing land use and addressing housing issues It is the intent of this Plan to be consistent with the policies of the Provincial Policy Statement. Section 3 of the Planning Act requires municipalities to make decisions relating to land use planning matters consistent with policy statements issued under the Act. The revised wording recognizes the municipality s responsibility to implement land use policies that are consistent with the Provincial Policy Statement. 2) Section 3.3.A A.2. Low density residential land uses include single detached dwellings, semidetached dwellings, duplexes, triplexes and converted dwellings that have a density up to 30 units per net hectare of land, unless an approved secondary plan establishes alternative provisions. 3.3.A.2. by adding the words such as but not limited to the policy so that it reads as follows: Low density residential shall permit residential land uses such as but not limited to, single detached dwellings, semi-detached dwellings, duplexes, triplexes and converted dwellings that have a density up to 30 units per net hectare of land, unless an approved secondary plan establishes alternative provisions. The purpose of the revision to the wording in Section 3.3.A.2. is to recognize the broad range of housing types that conform to the density and locational criteria of the Low Density Residential land use designation. 100

The existing policy in Section will be renumbered to Section to enable 3.4.A.6. to be relocated to Relocate the following policy from Section 3.4.A.6. to Section which states, In order to maintain the significance and vitality of the Central Business District, the City may limit the size or extent of uses necessary to support the CBD, such as offices and entertainment uses, in other locations in the City. Delete Section 3.4.A.6. Renumber Section 3.4.A.7. to Section 3.4.A.6. Amend the numbering of the policies by re-numbering Sections to to Sections to accordingly. The policy inserted in this section was moved from the Central Business District land use designation to the general commercial policies of the Official Plan because it is intended to be applied to commercial land use designations outside of the Central Business District land use designation and will be clearer for Plan users. 4) Sections 3.4.B.3., 3.4.C.12., 3.4.D.3., 3.4.D.4., 3.4.D.5.d., 3.4.D.9.c. and 3.4.E.8 and The abovementioned sections reference policies in Sections to of the original text and must be amended to reflect the renumbering resulting from the relocation of policy 3.4.A.6. to in the Official Plan. 101

7 City of Kingston Official Plan Administrative Amendments Exhibit A 5) Section 3.4.G.1.b. 3.4.G.1.b. b. gas bars and service stations are encouraged to locate on corner lots; Delete Section 3.4.G.1.b. and re-number Sections 3.4.G.1.c. and 3.4.G.1.d. as Sections 3.4.G.1.b. and 3.4.G.1.c. The proposed amendment will allow potential design alternatives to be considered that would improve streetscape design and site functionality, such as locating other more appropriate buildings onto the corner of a multi-building development. 6) Section 3.4.G G.7. Drive-through facilities have particular operational characteristics. The City has an interest in the form and location of such uses to ensure that such uses will be appropriate for any particular site. Land use compatibility, parking, signage, landscaping, and impacts on the streetscape and the pedestrian and vehicle environments will be key considerations in the review of new or expanding drive-through facilities. Detailed regulations for new or expanding drive-through facilities will be contained within the implementing zoning by-law. New or expanding drive-through facilities are subject to site plan control review. As part of the development review process the proponent is required to submit such supporting studies and reports as set out in Section 9.12 of the Plan as may be relevant to enable the City to fully evaluate the proposed drive-through facility. Add as per Section 2.7 of this Plan to the policy so that it reads as follows: 3.4.G.7. Drive-through facilities have particular operational characteristics. The City has an interest in the form and location of such uses to ensure that such uses will be appropriate for any particular site. Land use compatibility as per Section 2.7 of this Plan, parking, signage, landscaping, and impacts on the streetscape and the pedestrian and vehicle environments 102

8 City of Kingston Official Plan Administrative Amendments Exhibit A It is the opinion of Staff that the reference to land use compatibility should be explicitly added to identify specifically the policies that should be applied to a review of a proposed drive-through facility. The purpose is to make the policy easier to use and understand how compatibility is defined and reviewed. Referencing Section 2.7, Land Use Compatibility Principles, provides additional clarification with respect to the intent and purpose of the policy because it encompasses a number of criteria, including noise that need to be addressed prior to development. 7) Sections 3.4.A.5. & 10A A.5. New drive-through facilities are subject to the policies of Section 10A.3.6 of this Plan. 3.4.A.5. New drive-through facilities are subject to the policies of Sections 3.4.G.7. and 10A.3.6. of this Plan, where applicable. Section 3.4.G.7. of the Official Plan is a general policy identifying restrictions to this commercial use and is policy to be applied to all proposed drive-through commercial uses in the City. This will assist in ease of use of the Plan. 8) Section Proposals for the re-designation of lands for uses other than those permitted in areas of employment, or to add a range of uses to an area of employment that are primarily permitted in another land use designation, will not be approved unless it has been demonstrated to the satisfaction of Council that the land is not required for employment area uses over the long term, and that there is a need for the redesignation. The following criteria will be considered as part of the assessment of whether the proposed re-designation is appropriate: a. and b c. In addition to subsections a. and b. above, if the proposed re-designation is to a Commercial Designation then the following applies: 103

9 City of Kingston Official Plan Administrative Amendments Exhibit A a Commercial Inventory Assessment, as described in Section of this Plan, must be undertaken by the applicant to the satisfaction of the City; and If the proposed commercial development is greater than 5,000 square metres and is outside the Central Business District, the applicant must satisfy the provisions of Section of this Plan. The purpose of this change is to provide cross references to other relevant policies to assist with the ease of use of the Official Plan. Section dealing with the re-designation of employment lands should also reference policy and Section is a policy that specifically relates to the re-designation of employment lands to a commercial designation. Section is a policy that is applied to commercial developments outside the CBD that have a GFA in excess of 5,000 m 2. Referencing the related policies assists in the continuity of review. 9) Section Permitted uses in the Rural Area include all agricultural uses and agricultural related uses as permitted in the Prime Agricultural Area designation, sports and outdoor recreation activities in accordance with Section , and detached dwellings in accordance with Section and that are compatible with adjacent land uses Permitted uses in the Rural Area include all agricultural uses and agriculturalrelated uses as permitted in the Prime Agricultural Area designation, sports and outdoor recreation activities in accordance with Section and detached dwellings in accordance with Section and that are compatible with adjacent land uses. The purpose of this amendment is to correct the policy reference and references to related pertinent policies within the text. 104

10 City of Kingston Official Plan Administrative Amendments Exhibit A 10) Section Southwest corner of Sir John A Macdonald Boulevard, near Princess Street Schedule 3-D SSP No. 12 Northeast corner of Sir John A Macdonald Boulevard, near Princess Street Schedule 3-D SSP No. 12 This is a reference correction. The margin notes refer to 12 as being the southwest corner of Sir John A Macdonald Boulevard and Princess Street. However the correct reference is the northeast corner of Sir John A Macdonald Boulevard and Princess Street. 11) Section Section In addition to the uses permitted in Section 3.4.E, an indoor selfservice storage facility will also be permitted on 351 Select Drive as shown on Schedule 3-D. Self-service storage facilities will be limited to a single storey in height. The development will be oriented to the existing commercial context to the north and the buildings will be buffered from the residential uses to the south. AMEND Section by replacing the section reference 3.4.E with the section reference 3.4.E.1. The purpose of this amendment is to correct the policy reference and references to related pertinent policies within the text. 105

New drive-through facilities will not be permitted in the Downtown and Harbour Special Policy Area in order to protect and enhance the unique sense of place and the cultural heritage resources that characterize the Downtown and Harbour Special Policy Area as shown on Schedule DH-1. On prime Pedestrian Streets, as shown on Schedule DH-3, vehicle crossings of the sidewalk may be limited or restricted, in order to enhance the safety and convenience of pedestrian movement. However, there may be exceptional circumstances where a drive-through facility may be permitted where the intent of the Plan regarding the Downtown and Harbour Special Policy Area can otherwise be preserved. Applications for a new drive-through facility are subject to site plan control review and the policies of Section 9 and Section 10A.6.4 of the Plan. Add Sections 3.4.G.7. and to the policy so that it reads as follows: 10A.3.6 for a new drive-through facility are subject to site plan control review and the policies of Sections 3.4.G.7. and and Section 10A.6.4. of the Plan. Include a further policy reference for ease of use. Section of the Official Plan is a specific policy identifying criteria for site plan control review for lands with a commercial land use designation. This section is a required part of any review of a commercial development requiring Site Plan Control Approval. 106

12 City of Kingston Official Plan Administrative Amendments Exhibit A Administrative Amendments to Official Plan Schedules 1) Schedules 2, 3-A and 3-D Proposed Amendment Remove railway symbol from the Official Plan Schedules where the K&P Trail is located. Reason for Amendment The K&P Trail is still shown as a railway on Schedules. An amendment is needed for Schedules 2, 3-A, 3-D to remove rail line symbol for the K&P Trail line that are no longer in existence. 2) Schedule 3-D An amendment may be required to add a statement to Schedule 3-D. The amendment to the Notes portion of Schedule 3-D would read: The Site Specific Policies associated with the Site Specific Policy Areas can be found within Section For example, the Site Specific Policies for Site Specific Area 47 can be found in Section Reason for Amendment Schedule 3-D should make a reference to how to find the numbered parcels in the OP. 3) Schedule 13 A correction can be made to correct the map inset of Schedule 13 to change reference 11 to 12 and 10 to 11. Reason for Amendment Schedule 13 There are reference numbers that need to be corrected on the schedule. The number 12 should come off the Inset, and then in the Inset itself, the number 11 should be changed to 12 to match the chart, and the number 10 should be
