The Nam Ngiep 1 Hydropower Project is located along the Nam Ngiep River in Xaysomboun and Bolikhamxay Province of Lao PDR, downstream of Nam Ngiep 2 Hydropower Project. The Project is set 41 km north of Paksan, the capital of Bolikhamxay Province, which is located 145 km north-east of the national capital, Vientiane. Schedule of construction. Main construction activities of NNP1 started as scheduled in October Reservoir impoundment is scheduled for the rainy season of Electricity will be generated from Commercial Operation Date (COD), due in January 2019, over a concession period of 27 years. The Resettlement and Ethnic Development Plan (REDP). The approved Project REDP was made public and uploaded onto the Project and Asian Development Bank (ADB) websites in June The REDP provides a comprehensive background to the Project and the legal framework in which the Project functions as well as a description of the applicable social safeguards policies. It further presents all project social and livelihood restoration plans including the Compensation Policy, Zonal Resettlement Action Plans [RAPs], Livelihood and Income Restoration Plan (LIRP), Ethnic Development Plan (EDP), Public Consultation Plans leading to Broad Community Support (BCS), and describes the implementation and monitoring structures for these programs as well as a schedule and budget for their execution. Zone 2LR REDP Update. The REDP is organised by Project Impact Zone (PIZ). The PIZ consists of the areas affected by Project construction or operations, or in which the Project has environmental and social (E&S) commitments with the Government of Lao PDR (GoL). The PIZ crosses two provinces, Xaysomboun and Bolikhamxay. The Project has also identified and described impact sub-zones (see main REDP). This document is an update of Project activities addressing social impacts in Zone 2LR, including the villages of Houaypamom, Sopphuane, Sopyouak and Namyouak, which are located in Hom District, Xaysomboun province. The approved Project REDP-U2LR was made public and uploaded onto the Project and Asian Development Bank (ADB) websites in October 2016 The REDP Update Temporary Resettlement of 44 households from Sopphuane, Sopyouak and Namyouak, Zone 2LR (REDP-UTR-44) is an addition to the REDP U2LR already publicly disclosed and to the REDP Update Temporary Resettlement of 11 households from Houaypamom village in Zone 2LR (REDP UTR). The REDP-UTR-44 contains plans for the temporary resettlement of 44 households from Sopphuane, Sopyouak and Namyouak, based on their explicit request to resettle prior to the completion of the Resettlement housing in the Houay Soup Resettlement Area. Temporary resettlement was not an activity considered by the NNP1PC in any of the already published REDPs and is not an activity required for project purposes, but a response to direct requests by Project Affected People first expressed by 11 households from Houaypamom village in January 2017, and following the positive response to the request from Houaypamom, 44 households from Sopphuane, Sopyouak and Namyouak moving to the HSRA also filed a request to temporary relocate to the HSRA prior to completion of the houses. The 44 households requested to resettle to the HSRA ahead of the scheduled relocation in order to Document No. NNP1-C-K0203-RP-012 1

10 REDP-UTR of The Nam Ngiep 1 Hydropower Project Executive Summary make use of the dry season for resettlement and make optimal use of the start of the wet season for agricultural activities. House dismantling and transportation is more easily conducted in April when it is still the dry season. Temporary resettlement will also allow the households to familiarize themselves with the HSRA and make use of the opportunity to be hired as day labour at the HSRA. The REDP-UTR 44 presents the plans for facilitating the request made by 44 households from Sopphuane, Sopyouak and Namyouak villages, Zone 2LR. It details the requirements a temporary resettlement location must fulfil, the selection of a suitable site in the Houay Soup Resettlement Area and the facilities available there, the house dismantling and transportation arrangements and additional transitional support provided from the time of temporary resettlement (end of May 2017) until final resettlement to their permanent houses in the HSRA. It also provides details on the schooling arrangements for the children of the 44 households and relocation of their livestock. Amongst the 44 households, nine (9) households are considered vulnerable. The special arrangements made for these households are detailed in Chapter 2.2 Information about the project has been disseminated through consultations with affected communities for many years. Specific information regarding temporary resettlement has been disseminated through consultation with the 44 affected households when visiting the HSRA on 04 April Based on the consultations and site visit to the temporary resettlement site, all 44 households agreed and decided on the temporary resettlement site at HSRA. Additional information has been gathered by SMO technical officers from affected people as the basis for revising and amending relevant assessments and plans originally outlined in the REDP 2LR. Disclosure of information and ongoing consultations allow concerns to be addressed at an early stage and enable joint planning to find optimal replacement and compensation solutions. The Project s GRM catches remaining problems arising during the compensation process, solving potential conflicts between Project and PAPs. All activities will be funded by NNP1PC. The SMO Pre-COD estimated budget is 21,635,755 USD 2. Costs associated with the temporary resettlement are estimated to be 129,971 USD. This will be paid from existing budget for Resettlement. For those activities limited by scope, the budget may be revised upwards to reflect changing needs. Activities to date have been carried out jointly between the PAPs, GOL, and NNP1PC, and this will continue. 11 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 1 CHAPTER 1 - Introduction Project Description The Nam Ngiep 1 Hydropower Project (Project) encompasses the construction of a hydropower dam, re-regulation dam, two power houses, transmission lines, and necessary supporting infrastructure such as roads, camp sites, quarries, etc.; by the Nam Ngiep 1 Power Company (NNP1PC). The owners of Nam Ngiep Power Co., Ltd. are the Kansai Electric Power Co., Inc. (Kansai Electric) from Japan, EGAT International Co., Ltd. (EGATi) from Thailand, and Lao Holding State Enterprise (LHSE) from the Lao PDR. The Project is situated on the Nam Ngiep River, which is a left bank tributary of Mekong River. The Project will construct a 166-meter high concrete gravity dam on the Nam Ngiep River, including the main power station of 272 MW capacity capable of an annual power generation of 1,546 GWh. Once in operation, the reservoir of the main dam will have maximum surface area of 66.9 km 2, covering parts of Bolikhamxay and Xaysomboun Provinces. An effective storage of 1,192 million m 3 from the reservoir is designed to drop up to 130 m to the main power station downstream from the main dam. About the REDP Temporary Resettlement of 44 households from Zone 2LR The REDP Update Temporary Resettlement of 44 households from Sopphuane, Sopyouak and Namyouak villages, Zone 2LR (REDP-UTR 44) is an addition to the REDP UTR already publicly disclosed. This document develops plans for the temporary resettlement of 44 households from Sopphuane, Sopyouak and Namyouak, based on their explicit request to resettle prior to the completion of the Resettlement housing in the Houay Soup Resettlement area. It is complementary to already existing documents, i.e. certain sections of the overall REDP and planning documents will not be repeated in this document but referred to where relevant. A detailed description of the Project can be found in the Social Impact Assessment, Chapter 2 3. This REDP-UTR 44 describes the systematic programme of all measures to be implemented to facilitate the request made by the 44 households from Sopphuane, Sopyouak and Namyouak, either in cash or in kind. This REDP-UTR 44 does not encompass the land acquisition and resettlement arrangements already detailed in the REDP-U2LR. The location of Sopphuane, Sopyouak and Namyouak villages in Zone 2LR and the HSRA is indicated on the map in Figure Document No. NNP1-C-K0203-RP-012 3

13 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 2 CHAPTER 2 - Request from 44 Households The Project received request letters from 44 households residing in Sopphuane, Sopyouak and Namyouak in Zone 2LR requesting relocation from their current community ahead of the completion of Resettlement Infrastructure construction for 2LR households in the HSRA (Annex 2). The 44 households requested to resettle to the HSRA ahead of the completion of their permanent house in order to make full use the dry season for resettlement and make optimal use of the start of the wet season for agricultural activities. House dismantling and transportation is more easily conducted in April when it is still the dry season. Temporary resettlement allows the households to closely supervise the construction of their new houses to ensure this is as they wish, and will also allow them to familiarize themselves with the HSRA and make use of the opportunity to be hired as day labour at the HSRA. The request by the 44 households follows a similar request made by Project Affected People from Houaypamom village who opted to relocate to the Houay Soup Resettlement site in early April Following the positive response to the request from Houaypamom, the 44 households from Sopphuane, Sopyouak and Namyouak moving to the HSRA also filed a request to temporary relocate to the HSRA prior to completion of the houses. Once NNP1PC received the request letters, the possibilities were explored to expedite the house construction in the HSRA, to allow for direct resettlement by the 44 households. However, this proved not possible, and therefore NNP1PC has now developed this plan describing the measures to be undertaken to facilitate the temporary Resettlement of 44 households from Sopphuane, Sopyouak and Namyouak. Temporary resettlement was not an activity considered by the NNP1PC in any of the already published REDPs and is not an activity required for project purposes, but a response to a direct request by Project Affected People. Number of PAPs and size of temporary accommodation The number of people in each household is provided in Table 2-2 below. The size and layout of the temporary accommodation take due consideration to the size of each of the families (see Table 2-1). These 9 households will receive special attention and support for their temporary relocation, in addition to the regular support for vulnerable households as specified in the REDP-U2LR (extension of the transitional period support from 3 months to 1 year). The health team will provide regular visits to the 9 vulnerable households, to advise them on recommended health and hygiene practices and treatment facilities available in case of an emerging illness. The education team will closely follow up and provide support via various mechanisms to the students so that they can complete their current school year with an exam and enrol in the next school year. Five of the 9 households have been identified as lacking household utensils required to implement recommended health and hygiene practices. Therefore, these 5 households will be provided with drinking water storage containers, drinking glasses and mosquito bed nets. One of the 9 households has health conditions requiring the transportation of a family member by NNP1PC car One of the 9 households has many young children requiring the transportation of all family members at the same time using NNP1PC vehicle. 16 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 3 CHAPTER 3 - Temporary Resettlement site Current living conditions Sopphuane, Sopyouak and Namyouak villages are located in a remote part of Hom district. Road access is difficult in the wet season. The grid electrical system has not reached these 3 villages and only recently is there some partial phone network available. Due to the remote access, houses are constructed mainly from natural materials. However, households have also invested in more durable roofing materials over the past few years. Annex 1 provides details on the houses of the 44 households requesting temporary resettlement. Facility requirements The temporary resettlement site is expected to provide accommodation for a period of 3 months, from the time of temporary resettlement (end of May 2017) until final resettlement to their permanent houses in the HSRA expected to be completed for different households at different phases until the end of August For the selection of a suitable temporary resettlement site, NNP1PC has considered the following criteria: 1. Safe area for living 2. Access to clean water 3. Access to electricity 4. Access to sanitation 5. Accommodation in a weather proof shelter 6. Sufficient accommodation space so that the 44 households can stay together as a clan group 7. Sufficient and appropriate area and facilities for their livestock 8. Sufficient area to store materials transported by the households after dismantling their house 9. Sufficient area and facilities for households to cook 10. Access to education facilities for the children of school going age. 11. Proximity to and access to the HSRA Temporary Resettlement accommodation Construction of temporary accommodation at the Houay Soup Resettlement Area was considered as the main option for a temporary site, after the experience with the 11 households from Houaypamom, who also requested temporary resettlement and who could be accommodated in vacant land in the Hatsaykham section of the HSRA. Temporary accommodation can be quickly constructed, in 2 to 3 weeks. Several locations inside the HSRA were considered. The Infrastructure team of the SMO prepared a design of the facilities as per Figure 3-1 to Figure 3-7. The size of the temporary accommodation is adjusted to the number of people of each household. For access to electricity, a temporary electricity line will be connected to the grid at the HSRA school building. This will provide access at the temporary accommodation to grid electricity. At the same time, the 0.4 kv transmission line extension will be rescheduled and accelerated to replace the temporary Document No. NNP1-C-K0203-RP-012 8

For access to water supply the drilling of two boreholes at the location of the water treatment plant will be rescheduled and accelerated. A water tank will be installed near the boreholes and they will be equipped with electric pumps. The water tank, supplied by water from the boreholes will be connected via a pipe to the temporary accommodation and will be extended to the washing area of each accommodation. Consultation with Mr. Phonsyxion, the village chief of Hatsaykham was conducted on 04 April He informed the Project that Hatsaykham is welcoming the 44 households to their temporary accommodation, like they welcomed the 11 households from Houaypamom. Sufficient and appropriate area and facilities for their livestock Fenced grazing land will be available for cattle and buffalos. Additional feed will be provided. Large animals will be vaccinated prior to relocation. Temporary pig pens will be constructed on a suitable land plot 8. Sufficient area to store materials transported by the households after dismantling their house in Houaypamom The compound has free space for storage of materials. Additional vacant plots nearby can be used as temporary storage, see Figure 3-6 and Figure Sufficient area for households to cook There is a cooking area in each accommodation, see Figure Access to education facilities for the children of school going age. The school in the HSRA is operational for the first 3 grades of primary school. Older students can join the existing school bus to transport to the school in Hat Gniun. 11. Proximity to and access to the HSRA They are living in the HSRA. 12. Proximity to and access to the cultivation land in the HSRA The temporary housing will be constructed on vacant housing land plots, in the same area as permanent housing is constructed. This allows for the same access to cultivation land during their temporary resettlement as after their final resettlement (see Figure 3-6 and Figure 3-7). 13. Access to clean and safe place to live The temporary housing will be constructed on vacant housing land plots, in the same area as permanent housing is constructed. 23 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 4 CHAPTER 4 - House dismantling and Transportation The dismantling and transportation of household goods will follow the stipulations as outlined in the REDP-U2LR. Each household will be paid to dismantle their own house and load the material on trucks rented by the company for transportation to and unloading at the temporary resettlement site in the HSRA. In case the household cannot or prefers the company to arrange for dismantling their house, then NNP1PC will arrange for dismantling, loading, transportation to HSRA and unloading. Each household will be provided with a set of tools to dismantle their house, including a hammer, wrench, nail removing equipment and safety helmet. For packing of household goods such as cloths and bedding materials, large plastic bags will be provided. Plastic tarpaulins will be provided together with ropes to protect the transported materials from dust and rain during transportation. Because house dismantling and transportation of household goods is undertaken in late May, large trucks can cross the Nam Ngiep river at Sopyouak and drive via Bo village towards Bolikhan and then to the HSRA. Once the resettlement infrastructure is completed, each household will again be paid to load and unload their belongings unto a truck to transport it to their newly build house in the HSRA. Valuable household goods can be stored in the accommodation. Construction materials salvaged from their existing houses and transported, can be stored at the compound, which has sufficient area, as can be observed in Figure 3-6 and Figure 3-7. 24 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 5 CHAPTER 5 - Transitional arrangements Transitional Food support The REDP-U2LR outlines the transitional food support provided to each household moving to the HSRA. For the duration of the temporary resettlement, each household will be provided with the same transitional food assistance including essential nutrition items, such as cooking oil, salt, high protein items such as meat, eggs and other items as advised by a nutritional expert This will be in addition to the 3-month support, which they will receive after resettling to their permanent house in the HSRA. Transitional Rice support The REDP-U2LR outlines the transitional rice support provided to each household moving to the HSRA. For the duration of the temporary resettlement, each household will be provided with the same transitional rice assistance including rice support, milled rice, based on a provided consumption per household of 0.7 kg per day per adult and 0.5 kg per day per child (under 15 years). This will be in addition to the 5-year support, which they will receive after resettling to their permanent house in the HSRA. Transitional cash support The REDP-U2LR specifies that transitional cash support is provided to resettlers, to cover the expenses of water supply, electricity and garbage collection. At the temporary resettlement site, the Company will directly pay for the cost of electricity and water supply, because installation of individual electricity meters is time consuming and costly, and therefore only 1 meter will be installed and the cost of electricity will be directly born by NNP1PC. The PAP will have no cost for this. Therefore, no additional transitional cash support will be provided for the duration of the temporary resettlement. However, their 3-month provision will be provided after resettling to their permanent house in the HSRA. Document No. NNP1-C-K0203-RP

The numbers of these livestock are listed in Table 7-1. Reference source not found.). Some households keep their pigs in a pig pen and chickens have a chicken pen for staying during the night time, but during the day they are free range. The exception to this free-range management style is the fighting bull. The fighting bulls are highly prized animals for Hmong people and play an important role in the Hmong culture. They are well fed by the owner, using a cut- and-carry system and housed in an animal pen near the dwelling of the owner. Livestock at the Temporary Resettlement facilities The large livestock was vaccinated prior to relocation. The large livestock will be relocated to HSRA at the same time as other belongings. Grazing land is being developed in the HSRA and will be allocated to the households to be used for feeding their cattle. The area is near the grazing land area for Hatsaykham resettlers (see Figure 7-3). The cattle can graze on this newly developed grazing land area. Additional feedstuff such as a salt lick will be provided by the Company if required. The fighting bulls will be kept in a temporary animal pen near the accommodation and the owners will continue their cut-and-carry feeding system. Medium size livestock will be taken by their owners to the temporary accommodation in the HSRA. Temporary pig pens will be constructed on a suitable land plot near the accommodation, to prevent the pigs from roaming freely in the HSRA (see Figure 7-1). Chicken and ducks will be kept in the backyard area and provided with a roofed shelter to prevent Document No. NNP1-C-K0203-RP

The livestock officer of the SMO Livelihood Team is Hmong and will visit the households on a regular basis, to consult with them regarding the arrangements made and solve issues as they arise, using the principles of adaptive management. 30 REDP-UTR of The Nam Ngiep 1 Hydropower Project Chapter 8 CHAPTER 8 - Livelihoods during temporary Resettlement Day labour with NNP1PC For the development of agricultural lands in the HSRA for 2LR Resettlers, the Project intends to hire day labour. Vegetation clearance or large areas is required to establish grazing land, fruit tree plantation and cash crop areas. NNP1PC will offer the opportunity to work as day labour to the 44 households, based on the labour requirements for the works. Day labour with contractors Several construction companies are working in the HSRA to construct resettlement infrastructure. The contractors will be informed of the possible availability of day labour from the 44 households and the opportunity to work as day labour will be offered to the 44 households, based on the labour requirements for the works. Vegetable production Each household will be provided with 30 m 2 of vegetable garden for cultivation of various vegetables. A small livelihood project will be offered to the households, demonstrating composting, and application of organic fertilizers and cultivation of 3 short season vegetables, such as lettuce, morning glory, spring unions and coriander. Shade netting will be used to protect the vegetables form the sun. And transparent plastic will be provided to make a greenhouse, to protect the vegetables from the rain. Seeds and agricultural tools will be provided to the households. The produce can be eaten by the families. Start of the wet season for agricultural activities Each household will be invited to participate in the land allocation process to select the location of their different agricultural land plots. This participatory process will start at the end of May Following selection of the agricultural land plots, cultivation of crops can commence at the start of the wet season in June Tools (shovel spade, hoe, rake and big knife), rice seeds, cash crop seeds and fruit tree seedlings will also be provided to the households in June, so that they have the means to commence cultivating their agricultural lands in June 2017 Social monitoring To ensure successful adaptation to the temporary resettlement conditions, the SMO Ethnic Specialist and SMO- Resettlement preparation team will for at least the first month conduct weekly visits to the households and consult them on their stay. Issues which arise will be dealt with using the principle of adaptive management. The weekly distribution of food items is a good contact point between the resettlement preparation team and the households. Document No. NNP1-C-K0203-RP

Informal consultations with the 44 affected households (PAH), were conducted following receipt of the request letter. Information has been gathered from affected people as the basis for revising and amending relevant assessments and plans originally outlined in the REDP 2LR. A field visit to the HSRA was conducted by representatives of the 44 households on 04 April The MoM on this field visit are attached as Annex 3 Document No. NNP1-C-K0203-RP

The style of temporally house is the same as Houaypamom temporally house for 11HH, but there will be two flat houses with the road in between of two houses. The company will construct the borehole and connect electricity to temporally houses. There is wide area for animal 3. Visiting the new land levelling area for acceptance 25 HH I. The discussion on temporally a. Some villagers mentioned that in case the family member is covering 9-10 persons, so the room is small, not enough space. Infrastructure team answered that the team will collect information concerning current house and team is able to arrange enough room for big family. b. Some have no confidence staying in temporally house c. Villagers agreed with the space to be built temporally house, but the company must provide the facilities such as water supply and electricity. The company will construct the borehole and connect electricity to temporally house. II. Other issue discussed: a. After relocation to temporally house the company will provide rice and food support to the households. b. The transferring school document the company is responsible to provide. The discussion and walking around the place to be built temporally house completed at 15:00 and villagers return to their villages.
