4 I. INTRODUCTION A. Background 1. The Son La Hiep Hoa (SLHH) 500 kv Transmission Line (TL) is part of the Northern Power Transmission Expansion Project (NPTEP). The SLHH-TL has a total length of km. The TL starts from the Son La 500 KV substation and ends at the Hiep Hoa 500 KV substation. The TL traversed five provinces and 18 districts/towns/city as summarized in the table below. A Resettlement Framework (RF) has been prepared to guide the preparation and implementation of resettlement plans for sub-projects, such as the SLHH TL. It sets out the objectives, principles, eligibility criteria for affected people (APs), entitlements, legal and institutional framework, modes of compensation and rehabilitation, participation and consultation procedures and grievance redress mechanisms that will be employed to compensate, resettle and rehabilitate living standards of APs. The RF also sets out the steps for preparation of resettlement plans for subprojects. 3. Implementation of resettlement activities started in March It was agreed to prepare updated Resettlement Plans (RP) for each district/town/city crossed by the TL based on final design and Detailed Measurement Survey (DMS). 4. Four (4) Resettlement Plans (RP) for the 4 districts of Son La Province were prepared and approved by ADB in 2009 (see Table 2). For the other 14 districts/towns/city the National Power Transmission (NPT) and the Northern Power Project Management Board (NPPMB) has initiated the acquisition of land for the tower foundations and relocation of houses under the TL in the absence of a resettlement plan duly approved by the Asian Development Bank (ADB). Resettlement sites were also not ready at the time of the relocation of HHs. 5. Following start of the compensation of AHs, ADB requested the preparation of a Due Diligence Report (DDR) for each of the 14 districts/towns/city where no RP was prepared and 3

5 approved by ADB. 3 DDR for 3 districts/town were prepared in 2010 and approved by ADB (See Table 2). For these 3 districts/town, a Replacement Cost Survey (RCS) was also prepared by NPPMB and send to ADB for approval. None of these RCS were however approved by ADB. 6. For each of the remaining 11 districts/towns/city, a DDR was also prepared at the beginning of 2011 by a local consultant CEFACOM and submitted to ADB for review and approval in May None of these 11 DDR was approved by ADB. 7. In October 2012, ADB conducted a review mission along the TL to review the social safeguards issues associated with the Loan 2225-VIE. The Mission s principal objective was to: (i) review status of social safeguards implementation and monitoring; (ii) identify actions required to achieve compliance with ADB social safeguard policies. The focus was on the two 500 kv transmission lines including the Son La Hiep Hoa TL. A MOU was prepared on the 15th October In this MOU. It was agreed that NPPMB will prepare a corrective action plan (CAP) on the issues raised in the MOU. 8. In February-March 2013, ADB conducted another review mission along the Son La Hiep Hoa TL. One of the purposes of this mission was to verify the measures undertaken by NPPMB to answer to the recommendations included in the October 2012 MoU. 6 B. Scope of the Due Diligence Survey 9. This DDR covers the land acquisition and resettlement along Son La Hiep Ho 500 kv Transmission line in the following 11 districts, town and city: Pho Yen district, Thai Nguyen province; Hiep Hoa district Bac Giang province; Tam Duong district, Phuc Yen town Binh, Xuyen district and Tam Dao district in Vinh Phuc Province; Yen Lap district, Tam Nong district, Phu Ninh district, Viet Tri city and Tan Son district in Phu Tho Province; 10. This report is not based on additional survey. It takes into account the findings and recommendations of the 11 DDRs already prepared and the corrective action plan based on the October 2012 MoU already prepared. This report summarizes these findings and recommendations, proposes a strategy for each issue and identifies the remaining outstanding issues. A final corrective action plan is finally proposed which will include all findings of DDRs prepared and measures implemented in the CAP based on the October 2012 MoU. 11. The report examines (i) the requirements of the approved resettlement documentation and the extent to which these requirements have been satisfied by the subproject, (ii) compliance with national laws and regulations on land acquisition and social issues; and (iii) aspects where significant discrepancies exist between the observed outcomes of the resettlement implementation and objectives of the approved Resettlement Framework. 12. We should note that compensation generally occured more than 3 years ago (beginning of 2010 for most of the districts). The 11 DDRs not approved, were prepared in March 2011 based on information available at this time. Situation has changed and the findings of these 11 DDR are often no more relevant. The findings of these DDR were however assessed. 13. In the CAP prepared by NPPMB and implemented in several corrective measures had already responded to some findings of the 11 DDR. II. PROJECT IMPACTS 14. Except for the 4 districts where a RP was prepared, there is no final data on resettlement impacts for the TL. Due Diligence Reports don t include table of impacts because at the time of the DDR all the data were not collected and completed by local authorities. Without such table of impacts, it is not possible to establish a clear DDR. 15. Local authorities have the responsibility to conduct a Detailed Measurement Survey (DMS) which serve as the basis of compensation. They also need to prepare compensation plans which establish the compensation for each affected HH. Such compensation plans were prepared based on each provincial resettlement policy. 16. In order to identify clearly impacts and needs for income restoration, NPT/NPPMB should provide a full picture of project impacts by the end of October Data needed for the SL-HH TL are summarized in the table below. 5

REVIEW OF DUE DILIGENCE REPORTS AND CORRECTIVE ACTION PLANS PREPARED BASED ON THE OCTOBER 2012 MOU A. Findings of the 11 Due Diligence Surveys 1. Methodology 17. CEFACOM Consultants was hired in January 2011 to conduct an assessment of the implementation of compensation work, allowance and resettlement in the 5 provinces traversed by the SLHH TL. 18. Methods used for field data collection were the following: - Assessment was based on reviewing 10% of DMS records sample provided by district compensation, allowance and resettlement committee. - Reviewing 10% of compensation, allowance and resettlement plan which was verified and approved by the relevant authority (applied for APs). - Coordinating with the local authority and relevant stakeholders (commune authority, APs, etc.) to review project information and dissemination; - Reviewing the complaint and complaint redress process and the situation of current complaints. - Reviewing and assessing the income restoration program for severely affected households. - Interviewing representatives of relevant mass organizations at the provincial and district levels, such as Department of Natural Resources and Environment, Department of Finance, District compensation, allowance and resettlement committee about the DMS records implementation, plan and payment of compensation, allowance and resettlement for APs, etc. - Interviewing PAHs, in particular relocated HH and severely affected for feedbacks for unit price of compensation, allowances, participation of PAHs in compensation and resettlement, forms of the project information dissemination to local people and authorities, etc. - Interviewing the likely vulnerable groups such as single female heads of household, ethnic group s members, the poor, etc. - Comparing applied policies and approved policies of the project related to compensation and resettlement; analyzing differences between applied policies in the province and the policy framework of the project 2. Policy and Standards Applied 19. The legal framework and principles applied in the implementation of the resettlement was the relevant national Government legislations and the 5 Province People s Committee Decisions. The legal documents comprise: 6

8 National Regulations Land Law no.13/2003/qh11 ratified by Congress dated 26 November 2003 and taken into effect on July 1, 2004; - Decree no.181/2004/nd-cp dated 29 October 2004 on guiding the implementation of Land Law; - Decree no.17/2006/nd-cp dated 27 January 2006 on amending and supplementing some articles of the Decree on guiding the implementation of Land law; - Official document no.7760/tc-qlcs issued by Ministry of Finance dated 7 July 2004 on the implementation of Land Law; - Decree No.197/2004/ND-CP dated 3 December 2004 of the Government, on the compensation, assistance and resettlement when the State recovers land; - Decree No.84/2007/ND-CP dated May 25, 2007 on supplementary provisions on granting land use right certificates, land acquisition, implementation of land use rights, order and procedures for compensation, assistance, resettlement when the State recovers land and redressing complaint concerning land issues; - Decree No.188/2004/ND-CP dated November 16, 2004 on methods of determining land prices and price frame of types of land; - Circular No.116/2004/TT-BTC dated December 7, 2004 issued by the Ministry of Finance on guidance for the implementation of Decree No. 197/2004/ND-CP; - Circular No.69/2006/TT-BTC of the Ministry of Finance, February 18, 2006, amending and supplementing Decree No. 116/2004/TT-BTC guiding implementation of Decree No. 197/2004/CP. - Circular No.114/2004/TT-BTC dated November 26, 2004, the Ministry of Finance guiding the implementation of Decree No. 188/2004/ND-CP. - Decree No.123/2007/ND-CP dated July 27, 2007, amending and supplementing some articles of Decree no. 188/2004/ND-CP on methods of determining land prices and frame of land prices; - Decision no.3995/2009/qd-ubnd dated 20/11/2009 of Phu Tho Province in the unit cost of compensation, assistance and resettlement, order and procedures for implementation the State recovers land; - Decision no.4209/2009/qd-ub dated 1/12/2009 on amending and supplementing Article 5, Article 16 of Provisions on compensation, assistance and resettlement, and the order and procedures for implementation when the State recovers land in the province, issued together with Decision No. 3995/2009/QD-UBND dated 20/11/2009 by the PPC; - Decree 69/2009/ND-CP to amend the process of land use planning, land acquisition costs, compensation and resettlement. However, this decree has not been updated in the compensation plan for APs of Son La Hiep Hoa 500kV T/L project. Provincial Regulations - Decision no.1541/2010/qd-ub dated of Phu Tho PPC on amendment and supplement of the compensation, assistance and resettlement as well as order and procedures for implementation when the State recovers land in the province, together with Decision No. 3995/2009/QD-UBND dated 20/11/2009 and Decision no.4209/2009/qđ-ub dated 1/12/2009 issued by Phu Tho PPC; - Decision no.4722/2009/qd-ubnd dated 29/12/2009 issued by Phu Tho PPC on land prices in Phu Tho Province. - Decision 112/2009/QD-UBND dated 28/10/2009 of Bac Giang province, on the issuance of a number of specific provisions on CARE when the State recovers land applied in Bac Giang province. 7

9 - Decision 135/2009/QD-UBND dated 21/12/2009 of Bac Giang Provincial People's Committee promulgating the land prices in 2010 in the province of Bac Giang - Decision 1577/QD-UBND dated 19/11/2010 of Hiep Hoa DPC approving the compensation plan, supported by the recovery of land clearance project to build Son La Hiep Hoa 500kV T/L in Da Hoi hamlet, Ninh Huong, Hop Thinh Commune, Hiep Hoa District, Bac Giang province - Decision No. 1707/QD-UBND dated of Vinh Phuc PPC on land acquisition for setting up the compensation plan and implementation of compensation - site clearance for construction of Son La- Hiep Hoa 500kV T/L project, passing the province of Vinh Phuc (Tam Dao and Tam Duong districts). - Decision No. 70/2008/QD-UBND dated 31/12/2008 of Vinh Phuc PPC on "Regulations on land prices in the province of Vinh Phuc in Decision No. 59/2009/QD-UBND dated of Vinh Phuc PPC on "Regulations implementing compensation, assistance and resettlement when the State recovers land in Vinh Phuc Province. - Decision No. 23/2008/QD-UBND dated of Thai Nguyen PPC issuing unit prices of compensation and other structures attached to land when State recovers land. - Decision No. 19/2008/QD-UBND dated of Thai Nguyen PPC on the adjustment of some of the contents related to unit price of compensation for crops and trees attached to land when State recovers land. - Decision No. 01/2010/QD-UBND dated 05/1/2010 of Thai Nguyen PPC on promulgating regulations on implementing compensation, assistance and resettlement when the State recovers land. - Decision No. 32/2008/QD-UBND dated of Thai Nguyen PPC for the correction of the unit prices of compensation for houses and other structures attached to land when the State recovers land in Decision No. 23/2008/QD-UBND dated of Thai Nguyen PPC. - Decision No. 37/2009/QD-UBND dated of Thai Nguyen PPC issuing unit prices of land in Thai Nguyen province in Compliance with Agreed Resettlement Framework 20. The 11 DDR identified a list of non-compliance with agreed RF. These non-compliances are summarized in the table below. According to the DDRs prepared so far, the resettlement and compensation activities have been done based mainly on government policy on resettlement since RPs were not in place. The main non-compliance issues raised in the DDR are the following: - Delay in the payment of compensation of lost assets and of some allowances; - Compensation rates applied for each subproject are compensation rates issued by PPC and not based on replacement costs survey; - Income restoration programs for HH losing more than 10% of agriculture land have not been implemented; - Socioeconomic survey has not been conducted; - Public Information Booklet not distributed; - Internal monitoring not efficient 21. Table 4 gives more information on the non-compliance identified. 8

PPC rates, which apply for the Project, are generally lower than market rates; No SES conducted in 14 of the 18 districts/town/city. Therefore no basis for monitoring and evaluation exists. No public information booklet (PIB) distributed to PAHs. APs and local authorities were consulted about the issues related to compensation and resettlement as stipulated in the current regulations of Vietnam. However, consultation process strictly focused on DMS and compensation payment. Although a grievance and complaints mechanism has been established for the project, it was not disclosed to the APs. APs met don t know where and how to raise concerns, complaints and issues. No income Restoration Program (IRP) was prepared and/or implemented. Cash assistance measures provided were: - Allowances for stabilizing life: 30 kg rice/month/head x no. of months (depending on % of recovered land and HH had to remove or not: from 6 months to 30 months) - Allowance for career change (Decree 69) of 1.5 times the PPC compensation rate for agriculture land per m 2 Some resettlement sites were not ready at the time of HH relocation Assistance only to poor HH registered at the commune level; no other vulnerable HH identified; The internal monitoring system of the DRCB has been identified as not effective and the relevant activities have not reported on periodically as scheduled. In some cases, temporarily affected land was not restored to pre-project condition. Gender issues were not integrated in the compensation and resettlement process B. Corrective Action Plan Based on the October 2012 MoU 22. The MOU prepared in October 2012, following the social safeguards review mission, also noticed a number of non-compliance and other issues for the implementation of resettlement activities for the SLHH TL as follow: - Delay in the payment of compensation of crops and trees and of some allowances; - Delay in the completion of resettlement sites lead to temporary relocation of HH waiting for the completion of RS; - Allowance of 4 to 6 months rent is not sufficient due to delay of completion of RS; - Non issuance of Land Use rights Certificates (LURC); - Some grievances not solved; 9

11 - Lack of funds at district level; - Management problems and difficulties of coordination between NPPMB and local authorities; 23. In the MOU NPPMB and NPT agreed to: a) Send member of the task force to project sites to work directly with district PCs and discuss on progress of resettlement sites (RS) construction; b) Provide additional housing rent for relocated HH who are not allocated land plots in RS until plots provided for them and plus 4 months housing rent for constructing houses; c) Review all DDR and make corrective action plan, including specific actions, budget responsible agencies/persons and deadline for each action; d) Issue LURC for all relocated HH who resettle already as soon as possible; e) Because the Project has not recruited independent resettlement monitoring agency, Local Implementation Consultant (LIC) should conduct monitoring on implementation of corrective action plan and conduct a final monitoring and evaluation after completion of all resettlement activities. Therefore, NPT and NPPMB should arrange enough budget and resources for LIC to implement these assignments; f) NPT/NPPMB should check electrification along the power line and have corrective actions as soon as possible; 24. NPPMB and NPT prepared a corrective action plan for all the issues identified during the October mission and submitted it to the ADB mission. One of the objectives of the review mission conducted in February and March 2013 was to follow-up the actions taken by NPPMB in this CAP. 25. The findings of the February-March 2013 review mission was that most of the resettlement issues raised in the October MOU were solved, in particular: - Remaining payment for affected assets (trees, crops) have been completed; - Allowance for renting houses due to delay in completion of RS have been extended until the completion of the RS; - Allocation of plots in RS have been mainly completed; - Most of the RS are now completed with full infrastructures (except 3 RS) 26. Some issues however remain; they are the following: - 3 RS have not yet been completed; - LURC have not been issued to all relocated HH; - Procedure of transfer of funds from NPPMB to DRC still hamper the resettlement activities; - Specific case of Mr. Tran Thanh Tung living under the TL still not solved 27. The table below presents the actions included in the CAP prepared by NPPMB in answers to the recommendations provided in the October 2012 MOU. 10

15 C. Summary of DDR and Review Missions Findings Compensation is now completed for all districts/towns/city along the SLHH TL. Compensation has been done more than 2 years ago now for most of the areas. Several documents have been prepared and many actions have been undertaken. 29. It is clear that the implementation of resettlement activities has been done based on provincial resettlement policies and not according to the agreed framework. Therefore implementation of resettlement activities don t always comply with agreed Resettlement Framework. 30. However even if the implementation didn t always comply most of the objectives and principles of the RF have been reached. There are four main issues related to resettlement implementation: - Compensation at full replacement costs for productive land, residential land and non-land assets; - Restoration of livelihoods - Completion of Resettlement Sites - Assistance to vulnerable 31. Compensation for productive land. Assessment of replacement cost for productive land (agriculture and forest) is quite impossible as there is few seller or buyer in the project area. In addition, few HH needs to purchase agriculture/forestry land as few HH is losing more than 10% of productive land. Therefore the PPC compensation rates are the only reference for compensation. 32. Compensation for residential land. The Resettlement Framework (RF) and the updated RPs stated that compensation of affected assets should be at replacement cost for land, structures, crops and trees. NPPMB conducted replacement cost surveys to establish market rates; however these surveys were not used for the compensation. All compensation was done using PPC rates. Each PPC issued every year compensation rates for all types of land, structure, crops and trees. PPC rates are generally lower than market rates as mentioned in the DDR. 33. HH who relocate in a RS has to purchase a plot of land and has to pay a land use fee per m 2. All districts met, during the October 2012 and February 2013 review missions, confirmed that the compensation rate received by the AHs, for their affected residential land, was equivalent to the land use fee of a plot of residential land in the RS. Therefore, with the compensation received the AH was able to buy the same area of land in the same vicinity. This corresponds to replacement cost. 34. Most of the houses which have been relocated, relocated onto remaining land. When HH have been relocated off their own property, the AHs have been able to use compensation money to purchase land in the immediate vicinity of their original house and to build a new house. 35. Compensation for non-land assets. Even if the unit rates for structures, crops and trees may have been below the market rate, the full package of compensation resulted in all interviewed households being able to live in a general better condition than previously. The AHs received compensation for the structures and no deductions were made for the value of the salvageable material from their origin al house. It was noted that new houses built were larger and of better quality than their original houses. 1 October 2012 and February/March 2013 ADB review missions. 14

16 36. Therefore compensation provided to AHs appears to be satisfactory. With the compensation received, AHs were able to buy an equivalent plot of land in a RS or at an individual site in the same vicinity. They were also able to build a larger house and of better quality. 37. Restoration of livelihoods. ADB policy requires the restoration of livelihoods of all displaced persons in real terms relative to pre-project levels. In the RF, farmers losing more than 10% of their productive land are considered as severely affected and entitled to income restoration measures. For transmission lines, agriculture land is affected only by towers and few HH are losing less than 10% of their total productive land. In addition all HH have been relocated close to their original house and therefore continue to have easy access to their productive land. The exact number of HH losing more than 10% is unknown. This makes impossible the assessment of restoration of livelihoods. 38. Delay in the completion of Resettlement Sites. Delays in the development of resettlement sites have been observed for the Son La Hiep Hoa TL. During the February - March 3 RS were still not completed. As of September 2013 only RS is still not completed. Thuan Thanh RS in Pho Yen District (Thay Nguyen Province). Delay in the building of RS is mainly due to lack of funds of DCRB due to slow process of disbursement from NPPMB to DCRB. 39. It was also noted that as required, all districts provided additional allowance to relocated HH for renting house pending the completion of RS. This allowance should be extended for HH who plan to relocate to the 3 not completed RS: Song Lo District (Dong Thin 1 RS), Tam Duong District (Dong Ban RS) and Pho Yen District (Thuan Thanh RS) until the completion of RS. 40. Assistance to vulnerable. Except poor HH, no other vulnerable HH was identified during DMS. DCRB needs to check in the DMS list and with the assistance of mass organization (Farmer s Union, Women s Union) if potential vulnerable HH: ((i) female headed households with dependents, (ii) disabled household heads, (iv) children and the elderly households who are landless and with no other means of support, and (v) landless households; are present. If any vulnerable HH are found, they should be assisted as per provision of the RF. 41. Other issues have been identified but are of less importance. The following table summarized the non-compliance found, the strategy to solve these issues and the justification for this strategy. 15

20 IV. CORRECTIVE ACTION PLAN UNDER THE DUE DILIGENCE REVIEW 42. The above findings demonstrate that further activities are required to ensure that land acquisition covered by this report is compliant with the agreed policy in the RF. Most of the resettlement activities have been conducted following provincial policy on resettlement and not following the agreed resettlement framework. 43. The implementation of these corrective measures will ensure that the resettlement implementation will meet the project resettlement principles as stated in the Resettlement Framework. 44. Thus, the below table summarizing the final corrective action plan was endorsed by NPT/NPPMB and each DCRB. 19

He considers that he is living stably and wants to be compensated as for residential land. Compensation for forest land is 35,000 VND/m 2, while compensation for residential land in RS is 70,000/m 2. He required 3 plots of land free in the RS. NPPMB/DCRB proposed to provide free one plot of land in the RS of 400 m 2 but he refused. AH have usually to buy the plot of land. He lodged a complaint to the Phu Tho Town Court which was dismissed. He is living under the operated line since one year.
