Subject: Final seniority list of the officers of the Jammu and Kashmir Administrative Service, appointed to the service between 2009 and Government order No: 784 -GAD of 2014 Dated: Whereas, the final seniority list of the members of the Jammu and Kashmir Administrative Service (KAS), appointed to the service between and , was notified, vide Government Order No. 743-GAD of 2011 dated , which was, however, subject to the final outcome of the writ petition(s) pending consideration before the competent court(s); and 2. Whereas, further appointments/promotions were made to the Time Scale of the KAS between and , from amongst the members of the departmental feeding services, persons serving in connection with the affairs of the State in the departments/services other than those covered under clause (b) of Rule 6 of KAS Rules, 2008 and the Junior Scale member of the service; and 3. Whereas, consequent upon the aforesaid appointments/ promotions to the Time Scale of KAS, it was necessary to notify the seniority of these officers, in accordance with the relevant provisions of Jammu and Kashmir Administrative Service Rules, 2008; and 4. Whereas, a tentative seniority list of 151 officers (excluding the retired officers), appointed to the Jammu and Kashmir Administrative Service between and , as it stood on , was notified vide Government order No: 223-GAD of 2014 dated ; and

Whereas, in the said Government order, it was stipulated that any officer, aggrieved with the position so assigned to him/her in the tentative seniority list, may represent to the Government within a period of 21 days from the date of issue of the order, failing which it shall be presumed that the concerned officer(s) has/have no objection and the final seniority list shall be notified accordingly; and 6. Whereas, 45 representations were received against the said tentative seniority from 58 officers, in which following substantial issues were raised:- (i) implementation of rule 15(4) of the Jammu and Kashmir Administrative Service Rules 2008, (providing for making appointments from the date of occurrence of vacancy). (ii) the consequences of Judgment of the Hon ble High Court in SWP No. 757/2007 titled Abdul Rashid and others VS. State on the seniority (Catch-up rule). (iii) the implications of the various Judgments quoted by the Officers in their representations, including the judgment of the Division Bench of the Hon'ble High Court dated: , in case titled Ravi Chand vs. Rakesh Kumar in LPA No. 91 of (Promotion from the date of availability of vacancy/officiation). (iv) the position assigned to the Junior Scale KAS Officers of 2008 batch in the seniority. 7. Whereas, the said issues have been examined in consultation with the Department of Law, Justice and Parliamentary Affairs and on such examination of the matter, it has been observed that the inter-se-seniority of the officers, appointed to the service during 2012, needs further consideration, and, as a consequence, their seniority shall have to be notified separately; and 8. Whereas, it has been, accordingly, found expedient in the interest of the administration to notify the final seniority of the members of the service appointed between and as it stood on Now, therefore, the final seniority list of the officers appointed to the Time Scale of the Jammu and Kashmir Administrative Service

3 between and , as it stood on , forming Annexure to this order, is hereby notified for information of all concerned officers. The seniority list shall, however, be without prejudice to outcome of the writ petitions, if any, pending before the Competent Court(s) of law. The seniority of the members of the service appointed/promoted during 2012 shall be notified separately. 10. The date of birth recorded in the seniority list shall not be taken as authentic but is subject to verification from Service Book/Matriculation Certificate of the concerned officers.
