Town of Georgina The application submitted by Forest Hill Sod (Lombardo Vincenzo Ltd.), dated September 15, 2003, for a minor exception to the Regional Tree By-law in Part Lot 3 Concession 4, Town of Georgina be approved. 2. The Regional Solicitor be directed to prepare the necessary By-law. 14. Application for Tree By-Law Minor Exception Mr. Owen Ronald Huisman Township of King The application submitted by Mr. Huisman dated October 6, 2003 for a Minor Exception to the Regional Tree By-law in Part Lot 16, Concession 2 Old Survey in the Township of King be denied. 15. Application for Tree By-Law Minor Exception Harley Food Distributor ( Ontario Ltd.) Town of East Gwillimbury The application submitted by Mr. Frank Colavecchia, on behalf of the Owners, Harley Food Distributor, Ontario Ltd., dated September 15, 2003, for a minor exception to the Regional Tree By-law in Part Lot 28 Concession 6, Town of East Gwillimbury be denied.

5 Page York Peel Water Supply Project Update Markham Water Supply and Aurora Newmarket Water Supply Projects Update Project No , 77390, 70320, 77350, and December 18, 2003, recommending that: 1. The following report be received for information by Committee and Regional Council. 2. The Regional Clerk forward copies of this report to the Clerks of the City of Vaughan, and the Towns of Richmond Hill, Aurora, Newmarket, and Markham th Avenue Trunk Sewer, Phase 2 Construction Contract Town of Markham, Project December 18, 2003, recommending that: 1. The following report be received for information by Committee and Regional Council. 2. That staff report back to Committee in February 2004 with an update on the environmental approvals process and other project details. 3. That staff report back to Committee in February 2004 on the impact of project delays on development planning and approvals. 4. Regional Council approve a financial contribution of $147,000 to the Jennings Gate Estates Municipal Water System Project, subject to the Region receiving the necessary approval from the Ministry of the Environment (MOE) and executing a contract for Phase 2 construction with McNally/Aecon Duffin Creek Water Pollution Control Plant Optimization Upgrades and Expansion Progress Update Project 79870, and December 16, 2003, recommending that: 1. The following report be received for information by Committee and Council.

6 Page Water Use Efficiency Industrial/Institutional Audit Program Staff be authorized to extend the deadline for the Industrial/Institutional Water Usage Audit Program to December 31 st Staff be authorized to offer an financial incentive as outlined in this report to encourage large volume water users to implement costeffective water saving measures. 20. Proposed Assumption of Pressure District 7 Teston Road Watermain City of Vaughan The Region advise the City of Vaughan that the Pressure District 7 (PD7) Teston Road watermain does not meet the criteria of a Regional trunk watermain and therefore the Region is not prepared to assume the watermain at this time. 21. Transmission Operations Optimization Co-Operative Study with City of Toronto The following report be received for information by the Transportation and Works Committee and Regional Council. 22. Smart Commute Initiative Transportation Demand Management Staff be authorized to take the lead in the implementation of the Smart Commute Initiative by being the recipient of the Federal funds until a permanent organisational structure and administration is set up for this Initiative. 2. Staff be authorized to discuss the terms of a funding agreement on behalf of the GTA+Hamilton with the Federal Urban Transportation Showcase Program for the Smart Commute Initiative. 3. Staff be authorized to discuss the terms of a Memorandum of Understanding with the other municipal partners of the Smart Commute Initiative to outline the respective roles and responsibilities of the municipal partners.

Staff be authorized to begin discussions with representatives of the other municipal partners of the Smart Commute Initiative to develop a permanent organisational and administrative structure for the Smart Commute Initiative. 5. Staff report back on the results of the discussions related in recommendations 2, 3 and Copies of this report be forwarded by the Regional Clerk to the Clerks of the local municipalities in York Region, the City of Toronto, the City of Hamilton and the Regions of Durham, Peel and Halton. 23. Widening and Reconstruction Warden Avenue 14 th Avenue to Apple Creek Boulevard Town of Markham, Projects 9899 and December 16, 2003, recommending that: 1. The following report be received for information by Transportation and Works Committee and Regional Council. 2. Regional staff report back to the Transportation and Works Committee on the potential for a late 2004 tender of the Warden Avenue widening work in mid The Regional Clerk forward a copy of this report to the Town of Markham Clerk s Department. 24. Highway 7 Environmental Assessment Study Update Rouge River to Sciberras Road Town of Markham, Project December 16, 2003, recommending that: 1. The following report be received for information by Transportation and Works Committee and Regional Council. 2. The Regional Clerk forward a copy of this report to the Clerk of the Town of Markham.

8 Page Infrastructure Delivery Review 151 December 16, 2003, recommending that: 1. The following report be received for information by Committee and Council. 2. Transportation and Works Committee and Regional Council refer the matter to a Council Workshop on February 26, 2004 in order to permit review and consideration of the various Infrastructure Delivery options and issues identified. 26. Pavement Management for Regional Roads An increase in funding for road resurfacing, from the $3.4 million included in the approved 2003 budget to $6.7 million in 2004 and $10.0 million in 2005, be considered for inclusion in future budget and business plans. 2. The Commissioner of Finance be directed to report to the Finance and Administration Committee regarding establishing a Roads Rehabilitation Reserve to help cover costs of future pavement rehabilitation such that contributions to the Roads Rehabilitation Reserve would be made annually from the operating budget based on the number of new lane kilometres added through the roads capital program and transfers. REPORT SUBMITTED BY THE COMMISSIONER OF TRANSPORTATION AND WORKS AND COMMISSIONER OF PLANNING AND DEVELOPMENT SERVICES 27. York Region Greening Strategy 2003 Program and Achievements Update This report be received for information as an update of the York Region Greening Strategy.

Transportation and Works Department Space Requirements Gates of York Regional Council authorize a thirty month lease agreement in the amount of $65,663 annually for the first two years and $32,831 for the remaining six months for additional office space located at the Gates of York Plaza, Yonge Street in Newmarket. 2. Staff be authorized to take all action necessary to implement this transaction. 3. The Regional Chair and Clerk be authorized to execute the lease on behalf of The Regional Municipality of York. ADMINISTRATIVE REPORTS SUBMITTED BY THE COMMISSIONER OF TRANSPORTATION AND WORKS 29. Consultant Selection For Engineering Services Hydraulic Model For York Region Wastewater System, Project No The following report be received for information by Committee and Regional Council. 30. Consultant Selection for Engineering Services Major Mackenzie Watermains Projects 74070, and Newmarket Equalization Tank, Project Aurora Equalization Tank, Project Circulated via on December 23, 2003

10 Page th Line Trunk Sanitary Sewer Extension to Stouffville Road Closure of Major Mackenzie Drive Town of Markham, Project December 11, 2003, recommending that: 1. The Commissioner of Transportation and Works be authorized to exercise any of the powers of Regional Council for the temporary closure of Major Mackenzie Drive East (Y.R. 25) between 9 th Line (Y.R. 69) and Reesor Road in the Town of Markham (see Attachment 1). 2. The Regional Solicitor be authorized to prepare the necessary by-laws to give effect to the foregoing. 32. Reduced Vehicle Loads - Spring Thaw Period Regional Roads The gross weight of commercial vehicles be restricted to five tonnes per axle for the period between March 1, 2004 and April 30, 2004 on the Regional roads, as detailed in Attachment The Regional Solicitor be authorized to prepare the by-law. 3. The Commissioner of Transportation and Works be authorized to implement and post the reduced load restriction, only when conditions so warrant. 33. Turning Restriction Exemption for Buses Major Mackenzie Drive at Frank Endean Road Bayview Avenue at Fern Avenue Town of Richmond Hill The existing through restriction, 7:00 a.m. to 9:00 a.m., 4:00 p.m. to 6:00 p.m. Monday to Friday and 11:00 a.m. to 4:00 p.m. Saturday- Sunday for southbound traffic at the intersection of Major Mackenzie Drive (Y.R. 25) and Frank Endean Road and the existing right turn restriction, 7:00 a.m. to 9:00 a.m. Monday to Friday for southbound traffic at the intersection of Bayview Avenue (Y.R. 34) and Fern Avenue be amended to exempt buses. 2. The Regional Solicitor prepare the necessary by-law. 3. The Regional Clerk forward a copy of this report to the Clerk of the Town of Richmond Hill and to the Chief of Police.

11 Page Tender Award Purchase of Snow-Plow Trucks Contract T The tender for Contract T Part A for the supply of two 2005 Sterling GVW snow-plow diesel tandem trucks, complete with winter equipment, be awarded to Ontario Sterling, in the amount of $400, The tender for Contract T Part A2 for the supply of one 2005 Freightliner GVW snow-plow diesel single axle truck, complete with winter equipment, be awarded to Galloway Motors Limited in the amount of $176, The funding for this contract be approved from the Fleet Reserve prior to the approval of the 2004 Budget and Business Plan. 4. The Director of Supplies and Services be authorized to issue the purchase orders. REPORTS SUBMITTED BY THE COMMISSIONER OF CORPORATE SERVICES 35. Acquisition of Land Various Projects 213 November 27, 2003, recommending that: 1. The following agreements be accepted and that the Commissioner of Corporate Services be authorized to complete these transactions in accordance with the terms of the agreements. 36. Compensation for Expropriation Bayview Avenue, Town of Newmarket 223 December 2, 2003, recommending that: 1. The Commissioner of Corporate Services be authorized to make the following offer on behalf of the Regional Corporation in accordance with the Expropriations Act for: a) The land required for the widening and reconstruction of Bayview Avenue (YR 34) from Wellington Street East (YR 15) in the Town of Aurora to Mulock Drive (YR 74) in the Town of Newmarket.

12 Page Expropriation of Land King City Sanitary Sewer 227 December 3, 2003, recommending that: 1. Authority be granted to apply for approval to expropriate the following lands within the Township of King, in The Regional Municipality of York: (a) A permanent limited interest in approximately 3,109 m 2 (0.768 acres), being Part 1 on Reference Plan 65R Part 1 on Reference Plan 65R Part 1 on Reference Plan 65R (b) A temporary limited interest in approximately 596 m 2 (0.147 acres), being Part 2 on Reference Plan 65R (for the purpose of constructing a sanitary sewer, expiring on December 31, 2006) 2. The Commissioner of Corporate Services be authorized to serve and publish Notice of Application as required by the Expropriations Act. 3. The Commissioner of Corporate Services be authorized to forward to the Chief Inquiry Officer, pursuant to the provisions of the Expropriations Act, any requests for hearing that may be received. 4. The Regional Council, as approving authority, approve of the expropriation of the lands described in paragraph 1, provided there is no hearing of necessity. 5. The Director of Realty Services be authorized to execute and serve any notices required by the Expropriations Act. 6. Authority be granted for the introduction of the necessary bills in Council to give effect to the foregoing.

Authority be granted to apply for approval to expropriate the following lands within the Town of Whitchurch-Stouffville, in The Regional Municipality of York: a) A fee simple interest in 9.52 ha ( acres), being Part 1 on a draft reference plan dated November 14, 2003, prepared by Sexton McKay Limited, Ontario Land Surveyors. 2. The Commissioner of Corporate Services be authorized to serve and publish Notice of Application as required by the Expropriations Act. 3. The Commissioner of Corporate Services be authorized to forward to the Chief Inquiry Officer, pursuant to the provisions of the Expropriations Act, any requests for hearing that may be received. 4. The Regional Council, as approving authority, approve of the expropriation of the lands described in paragraph 1, provided there is no hearing of necessity. 5. The Director of Realty Services be authorized to execute and serve any notices required by the Expropriations Act. 6. Authority be granted to apply for approval to expropriate the following lands within the Towns of East Gwillimbury, Newmarket and Aurora, in The Regional Municipality of York: a) A fee simple interest in approximately 361 m 2 (0.089 acres), being Part 3 on Reference Plan 65R Part 1 on Reference Plan 65R Part 1 on Reference Plan 65R The Commissioner of Corporate Services be authorized to serve and publish Notice of Application as required by the Expropriations Act.
