1 Minutes Granbury City Council Regular Meeting December 5, :00 p.m. City Hall, 116 W Bridge St. Granbury, Texas The City Council of the City of Granbury, Texas, convened in regular session on December 5, 2017, at 6:00 p.m. in the Council Chambers of City Hall, 116 West Bridge Street, with the meeting being open to the public and notice of said meeting, giving the date, place and subject thereof, having been posted as prescribed by V.T.C.A., Government Code, Chapter 551, with the following members present, to-wit: Nin Hulett, Mayor Place 1 Tony Allen, Councilmember Place 2 Gary Couch, Councilmember Place 3 Trish Reiner, Councilmember Place 4 Tony Mobly, Mayor Pro Tern Place 5 Greg Corrigan, Councilmember Place 6 Chris Coffman, City Manager Jeremy SoRelle, City Attorney Carla Walker, City Secretary CALL TO ORDER Mayor Hulett called the meeting to order at 6:00 p.m. announcing that all Councilmembers are present. INVOCATION Fred Orcutt, Coordinator of Hood County Prayer Task Force, gave the invocation. PLEDGE OF ALLEGIANCE AND TEXAS PLEDGE The Pledge of Allegiance and Texas Pledge were recited. CITIZEN PARTICIPATION JC Campbell, Acton Highway, asked that the Council put their trust in its citizens as the citizens have put their trust in them. Campbell asked that the Council members listen to citizens when they have a comment. CONSENT AGENDA 1. Consider approving City Council meeting minutes: November 20, 2017, Special Meeting and November 21, 2017, Regular Meeting. 2. Consider approving the renewal for the Microsoft Volume Licensing Enrollment agreement with Software House International (SHI) for the quoted price of $52, per year, for a period of three years, through the Texas DIR contract. 3. Consider approving, executing and filing of three electrical easements necessary for the new runway at the City of Granbury.
2 4. Consider adopting Resolution authorizing designated City employees to volunteer their services and equipment during work hours to assist Hood County Christmas for Children, Inc. 5. Consider approving sponsorship letter and fundraising efforts for the Run for Your PEEPS 5k run/walk. 6. Consider approving donation letter and fundraising efforts for the Community-Wide Easter Egg Hunt. 7. Consider adopting Resolution amending and restating the deferred compensation plan in the form of the ICMA Retirement Corporation 457 Governmental Deferred Compensation Plan & Trust, to include all associated amendments. 8. Consider approving an lnterlocal Rental Agreement between Hood County and the City of Granbury for the property located at 220 N Travis St., otherwise known as the American Town Hall, to be used as a library facility. Councilmember Allen made a motion to approve the consent agenda as presented. Motion seconded by Councilmember Couch. Motion carried with 5 ayes and O nays. DELIBERATION AGENDA 9. Presentation by Scott Bean, of Hawes Hill and Associates LLP, concerning Economic Development Incentive tools known as Public Improvement Districts (PID) and Tax Increment Reinvestment Zones (TIRZ). Scott Bean, Hawes Hill and Associates LLP, explained the process of creating a Public Improvement District (PID}. Bean identified that the residents of the area are responsible for paying the PID tax and those funds are reimbursed to the developer. The tax amount, the reimbursable amount, and the term of the tax is negotiated during the setup. Bean highlighted that a Tax Increment Reinvestment Zones (TIRZ} does not have an extra tax to the property owners, the city agrees to forgo tax towards reimbursing certain infrastructure. Mayor Pro Tern Mobly asked if property owners are notified of the PID requirement before purchasing. Bean stated that there is a required disclosure notice to purchasers so they can make an informed decision. Mayor Hulett asked if there was anything that could go wrong with a PID. Bean stated that the assessment could be too high and the lots may not sell. In that case, can lower the tax amount. Councilmember Reiner asked for an example of where a PID was successful in a small town. Bean stated that many small cities already have an extra tax for Municipal Utility Districts (MUD}. A PID is more desirable to homeowners than a MUD. Councilmember Allen asked what the general timeline is for a PID and TIRZ. Bean stated that TIRZ are typically setup for 30 years, a PID could be from 15 to 30 years. Allen asked if TIRZ would be successful for the old Kroger Building and shopping center. Bean stated that project is not large enough to setup a TIRZ. With no further discussion, Mayor Hulett closed the agenda item. No action taken. 10. a) Public hearing and consider approving the following requests of Mitch Breeden to: Execute a Facilities Improvement Agreement (FIA 17-08), by and between the City of Granbury and Mitch Breeden, for the construction of approximately 1529 l.f. of Acton Municipal Utility District (AMUD) waterline, 580 l.f. of private retaining wall for drainage and 10 l.f. of private storm drainage. The approximate cost of the construction is $112, The Developer has chosen to provide a Performance Bond and Payment Bond which covers 120% of the approximate total cost, and; Granbury City Council Meeting Minutes 2 I t > <1 n e
3 b) Final Plat a acre tract of the Joshua Minett Survey, Abstract# 352 as Lot 1, Block 1 of the Acton Storage Addition. The property is located generally northwest of the intersection of Acton Hwy. and Fall Creek Hwy. Scott Sopchak, Community Development Director, explained that the proposed use is for self-storage mini warehouses, and storage for RV's, cars, boats and trucks. The preliminary plat, the zoning change to Heavy Commercial (HC} and the Specific Use Permit were approved by City Council on September 5, The following variances were approved by City Council on September 5, 2017 under the preliminary plat application to support the preliminary plat proposal as presented. Variance to Section to not provide sidewalks along Fall Creek Hwy Variance to Section 3.9 and 4.5 to not improve sewer to an 8 inch standard on Acton Hwy and Fall Creek Hwy Variance to Section 3.9 and 4.6 to not upsize water on Acton Hwy All Development Review Committee comments have been addressed. The Facilities Improvement Agreement (FIA) has been reviewed and signed by City Staff, it appears to meet all the requirements of the Subdivision Ordinance. The City Engineer has reviewed the final plat and has no further comments. There are no variances requested as a part of this application. The Planning and Zoning Commission unanimously voted to approve the final plat. Public hearing and consider adopting Ordinance approving a request of The Lodge of Granbury to amend the existing Planned Development/Light Commercial Multiple Family (PD/LCMF} adopted Ord. # to allow an amendment to the site plan for the addition of carports. The property is addressed as 401 E. Pearl St. Councilmember Couch recused himself from discussion due to a conflict of interest at 6:28 p.m. Scott Sopchak stated that the change in the Planned Development would allow for 14 additional covered parking spaces. The Planned Development Variances Listed on the Development Plan are: 1. Variance to Section 11.7.B.10 to permit no masonry on the exposed steel carport(s) support columns. 2. Variance to Section 12.2 (Carports Definition) to permit no restrictions on the number of vehicles sheltered and the length of the longest side. 3. The Development Plan will be attached to the ordinance. This request was tabled at the October 16, 2017, Planning and Zoning Commission (P&Z) meeting and reheard on September 20, 2017; the applicant was requested to reconsider the location of the covered parking or carports. P&Z unanimously recommended approval of the Development Plan with reasonable design modifications and, approval of the ordinance amending the Planned Development district [PD/LCMF] (rezoning) with the aforementioned design modifications. 4 The design modifications include: 1. Two bollards with a no parking sign need to be installed by the east fire hydrant. (It is the one with the single carport.) 2. A 10 foot space is required from any fire hydrant on the property to the column of any carport. 3. Locate water lines before penetrating the parking lot surface to anchor the support columns of the carport. Mayor Hulett opened the public hearing for this item at 6:33. With no one present who requested to speak, Mayor Hulett closed the public hearing at 6:33 p.m. Councilmember Allen asked what the columns will be constructed of. Sopchak stated that it is requested is to be raw iron, no rock or brick on columns. Mayor Pro Tern Mobly asked why this location does not have rock columns while others are required to. Sopchak stated that the ordinance requires rock columns so if a citizen wants a permit for a carport, City staff will require rock. Citizens have the option to go before P&Z and Council and request a variance through a Planned Development or submit a variance request to the Zoning Board of Adjustment. Mobly specified that he wants the minutes to reflect that there will not be anything placed next to the street. It was requested previously, but there is an easement. Sbpchak stated that if approved as presented, the Development Plan will be tied to the adoption ordinance which identifies the location of carports. Any other location will not be permitted. Mayor Pro Tern Mobly made a motion to adopt Ordinance approving a request of The Lodge of Granbury to amend the existing Planned Development/Light Commercial Multiple Family (PD/LCMF} adopted Ord.# to allow an amendment to the site plan for the addition of carports, along with the approval of a variance to Sections 11.7.B.10 and 12.2, under the condition that a Development Plan be attached to the ordinance with the design modifications as presented. Motion seconded by Councilmember Reiner. Motion carried by a record vote of 4 ayes and O nays. Councilmember Couch returned to the meeting at 6:42 p.m. 12. Public hearing and consider approving a request of Paul & Judy Irwin to Replat Lots , Block 1 of the Mallard Pointe Addition as Lot 116-A, Block 1 of the Mallard Pointe Addition. The property is addressed as 700 Goldeneye Dr. Scott Sopchak explained that the homeowner in this residential subdivision, located in the Extraterritorial Jurisdiction, desires a larger lot and needs to replat to expand the existing lot. There is a residence at 700 Goldeneye Drive owned by the applicant and the lot being re-plated is undeveloped. All Development Review Committee comments have been addressed. The City Engineer has reviewed the variances and is recommending approval. The Planning and Zoning Commission unanimously recommends approval of the replat. 1. Variance is to Section 4.8 street lights Variance is to Section 3.9 and 4.6 water lines 3. Variance is to Section 3.9 and 4.5 sewer lines 4. Variance is to Section 3.1.E and 4.10 urban street standards 2. 5 Councilmember Corrigan made a motion to replat Lots , Block 1 of the Mallard Pointe Addition as Lot 116-A, Block 1 of the Mallard Pointe Addition with variances to Sections 3.1.E, 3.9, 4.5, 4.6, 4.8, and 4.10 as presented. Motion seconded by Mayor Pro Tern Mobly. Motion carried with 5 ayes and O nays. 13. Consider adopting Ordinance amending the budget for the General Fund for Fiscal Year ; and ratify the total construction cost of the Town Square Streetscape Project. Chris Coffman, City Manager, explained that the original estimated construction cost for the Town Square Streetscape project was $2,598,607, plus an additional $75,000 for contingency. Total additional construction cost for the project billed by Fain Group was $406,467. Furthermore, the estimated Direct State Cost for TxDOT, including the preliminary engineering, environmental cost, and construction related costs, is $98,560. Therefore, the total projected construction cost for the Town Square Streetscape project is $3,103,634. On April 16, 2017, Council approved the additional expense related to the NE corner of Bridge and Crockett in the amount of $49,999. The majority of the construction cost was paid and accrued in Fiscal Year ($2,953, billed through September 30, 2017 including retainage). Total impact and requested budget amendment for Fiscal Year for the General Fund - Fund Balance is $150,185. Coffman quoted the contract price portion of the contract with Fain Group which states; "Owner shall pay Contractor for completion of the Work in accordance with the Contract Documents for the unit prices shown in the Bid Form. Bidder acknowledges that estimated quantities are not guaranteed, and are solely for the purpose of comparison of Bids, and final payment for all unit price bid items will be based on actual quantities, determined as provided in the Contract Documents." Coffman highlighted deficiencies in quantities from the bid documents drafted by the City's engineers as compared to the final estimate from Fain Group. Councilmember Allen asked what portion of the project was funded by TxDOT. Coffman answered $1,619,200. Councilmember Reiner stated that the project is completed and understands that there will be overages in large projects such as this, but asked if it is possible to negotiate with the engineering firm on the overages. Coffman stated that could be discussed in executive session. Mayor Pro Tern Mobly expressed that since the project is over, the bills must be paid but asked who was in communication and made aware of the overages throughout the project. Coffman stated that we were in communication with the contractors, the City was billed based on quantity as outlined in the contract. Mobly added that there should be one contact with the City and that Council cannot be project managers. Councilmember Couch asked if there are grants available to fund the overages. Coffman explained that he asked the engineer who stated that it could be possible but there are no funds currently available. Councilmember Allen pointed out that the project was bid with bad data and a department had to of known. Coffman stated that staff had no control over the lack or overage estimated on quantity. The City should be able to rely on the engineer. Councilmember Couch made a motion to adopt Ordinance amending the budget for the General Fund for Fiscal Year , and ratify the total construction cost of $3,103,634 for the Town Square Streetscape Project. Motion seconded by Mayor Pro Tern Mobly. Motion carried with 4 ayes and 1 nay by Councilmember Allen. 14. Consider making a recommendation of one member to serve on the Visit Granbury, Inc. 6 Mayor Hulett stated that the seat was vacated by Rose Myers. Councilmember Couch made a motion to recommend Councilmember Reiner to serve on the Visit Granbury, Inc. Board of Directors as a City of Granbury representative to fill an unexpired term. Motion seconded by Councilmember Allen. Motion carried with 5 ayes and O nays. EXECUTIVE SESSION Mayor Hulett announced at 7:16 p.m. that the City Council would recess to meet in closed session, and that all Councilmembers were present. Pursuant to the Texas Open Meetings Act, Chapter 551 of the Texas Government Code, the City Council may convene in Executive Session to deliberate regarding the following matters: Sec Consultation with Attorney- Deemer Lawsuit Sec Deliberation regarding real property- Granbury ISO Land Donation Sec Deliberation regarding economic development negotiations RECONVENE IN OPEN SESSION Mayor Hulett reconvened in open session at 8:53 p.m. announcing that no action was taken in closed session. Mayor Pro Tern Mobly made a motion to authorize the City Manager to negotiate with Granbury ISD on the Decker Gym property and land donation (at 210 N.
