AGENDA REVIEW STAFF PRESENTATIONS 1 Discuss proposed health plan benefit change. Council directed staff to obtain additional information in response to questions and place an item on the November 5, 2012, Pre-Meeting for further discussion. 2 Discuss Language Pay and Certification for Police Department. It was Council consensus to proceed immediately with implementation of a pilot language certification program in the Police Department, with funding language pay to be considered during the Amended Budget process. EXECUTIVE SESSION - EXECUTIVE CONFERENCE ROOM - 1:04 P.M. The met in Executive Session pursuant to Section of the Texas Government Code to consider purchase, exchange, lease or value of real property (discuss the value of property located along North Galloway Avenue and discuss the purchase of various properties for park purposes); whereupon, the proceeded to meet in the Conference Room. 2 PLEDGE OF ALLEGIANCE Andrea Esparza, Georjette Ochoa-Ramos and Kayla Robinson, fourth grade students from McKenzie Elementary School. SPECIAL ANNOUNCEMENTS (1) Mr. Noschese reminded everyone about the Cowboys and Kids 5K Run and 1-Mile Fun Run that will be held on Saturday, October 27, 2012, at the Mesquite Convention Center beginning at 7:30 a.m. This event benefits the MISD Education Foundation and the Mesquite Education Association. He encouraged fellow Councilmembers to consider participating in this fun event with a chance to win The Golden Sh Boot which will be awarded to the victor in the competition between the Mesquite ISD School Board and the Mesquite participants. He invited everyone along with their friends and family to participate in this exciting event. (2) Ms. Roberts announced the following events to be held on Saturday, October 20, 2012: (1) Pumpkin Fest will be held at 10:00 a.m. at City Lake Park, (2) the Recycling Fashion Show will take place at 2:00 p.m. at Town East Mall and (3) the 11th Annual Police vs. Fire Guns & Hoses Boxing Tournament, benefiting the families of the men and women who have lost their lives in the line of duty, will begin at 7:00 p.m. at the Mesquite Arena. She encouraged everyone to attend some or all of these events. PRESENTATIONS 3 Presentation of a plaque to Judith Zuber in recognition of her service as a member of the Board of Adjustment/Automated Traffic Signal Enforcement Advisory Committee. Mayor Monaco presented a plaque to Judith Zuber in recognition of her service as a member of the Board of Adjustment/Automated Traffic Signal Enforcement Advisory Committee from December 2010 through August CONSENT AGENDA Approval of the Consent Agenda Mr. Noschese moved to remove Item Nos. 11 and 18 from the Consent Agenda to be considered separately. Motion was seconded by Mr. Porter and approved unanimously. Mr. Pickett moved to approve Item Nos. 4-10, and 19 on the Consent Agenda, as follows. Mr. Noschese moved to authorize the City Manager to execute a contract for RFP No , Software and Implementation Services for an Enterprise Resource Planning (ERP) System, with Tyler Technologies, Inc., in the amount of $1,703, with a modification to Page 46, Section No , third line item and second column of the table to read as follows: Tyler will program conversion programs according to the accepted file submission layout. This layout must be maintained consistently for all future data submissions or additional charges may apply as provided by approved change orders in accordance with the City of Mesquite change order policies. Motion was seconded by Mr. Pickett and approved unanimously. END OF CONSENT AGENDA PUBLIC HEARINGS 20 Conduct a public hearing and consider an ordinance for Application No , submitted by Paul R. Leake on behalf of owner Ima Lawson, for a zoning change from R-3 Single-Family Residential to Planned Development - General Retail allowing for future non-residential development on a acre tract located at 1230 North Galloway Avenue. (One letter in favor of the proposed amendment has been received. The Planning and Zoning Commission recommends approval of the application with certain stipulations.) A public hearing was scheduled to be held to consider Application No , submitted by Paul R. Leake on behalf of owner Ima Lawson, for a zoning change from R-3 Single-Family Residential to Planned Development - General Retail allowing for future non-residential development on a acre tract located at 1230 North Galloway Avenue. This item was postponed at the September 4, 2012, and September 17, 2012, meetings. Mayor Monaco announced that Application No had been withdrawn by the applicant. Mr. Pickett moved to withdraw Application No from consideration as requested by the applicant. Motion was seconded by Ms. Roberts and approved unanimously. APPOINTMENTS TO BOARDS AND COMMISSIONS 21 Consider the appointment of one regular member to the Board of Adjustment for a term to expire January 1, 2014, who will also serve as a regular member on the Automated Traffic Signal Enforcement Advisory Committee. Mr. Tarpley moved to appoint Sid Agent as a regular member to the Board of Adjustment for a term to expire January 1, 2014, who will also serve as a Page 6

7 regular member on the Automated Traffic Signal Enforcement Advisory Committee, by designation of Councilmember Dennis Tarpley, Place 6. Motion was seconded by Mr. Pickett and approved unanimously. 22 Consider appointment of four regular members to the Parks and Recreation Advisory Board and Tree Board for terms to expire October 21, Mr. Pickett moved to reappoint David Burris, Gregory Dyer and Kenneth Burris as regular members of the Parks and Recreation Advisory Board and Tree Board and to change the appointment of Kenneth Goin from an alternate member to a regular member for terms to expire October 21, Motion was seconded by Mr. Tarpley and approved unanimously.
