New Business: a) Discussion / Possible Action regarding request from the Western Avenue Association to place canvas banners on the thirteen (13) light posts located on the west side of Western Avenue between Avondale and Wilshire. Mr. Kenneth S. Howell of the Western Avenue Association to address the Council. b) Consideration / Possible Action regarding proposed fundraiser event, After Hours at The Plaza, to be held May 6, 2004 at Nichols Hills Plaza to benefit the Children s Medical Research Institute. Ms. Pat Schonwald to address the Council. c) Consideration / Possible Action to approve application by the Memorial Marathon to use the Nichols Hills banner brackets. d) Consideration / Possible Action to approve a Resolution authorizing the sale of $2,635,000 of General Obligation Bonds, Series 2004 of the City of Nichols Hills, Oklahoma; fixing the amount of bonds to mature each year; fixing the manner, time and place the bonds are to be sold; authorizing the publication of a notice of sale; approving and authorizing official statements, and providing for other aspects of the bonds and issuance of the bonds.

3 Page Three e) Public Hearing Consideration of an application for a Special Use Permit for LCC International, Inc. located on a tract of land lying in the Northeast Quarter of Section 6, Township 12 North, Range 3 West of the Indian Meridian, Oklahoma County, Oklahoma and being described as follows: Commencing at the southeast corner of Lot 2, Block 88, Nichols Hills Subdivision as recorded in Oklahoma County, Oklahoma, thence North West a distance of feet to the point of beginning, thence north east a distance of feet; thence south east a distance of feet; thence south west a distance of feet to the point of beginning. Said tract contains 400 square feet of acres, more or less and is located approximately at Pennsylvania and Hillcrest on the west side of the intersection. The application for a special use permit is to extend the existing wireless tower/tornado siren tower approximately ten (10) feet to accommodate LCC International s antennas. Also proposed is to expand the existing compound (fenced area) approximately twenty (20) feet to the west to accommodate LCC International s transmission equipment. The Planning Commission held a Public Hearing on this matter on April 6, 2004 and voted unanimously to continue the hearing until April 27, 2004 at 4:30 p.m. f) Consideration / Possible Action regarding rock entryway proposal along Western Avenue. Resident John Marshall to address the Council. g) Consideration / Possible Action in the matter of the application of First Church of Christ Scientist, Nichols Hills, Oklahoma, for a decree vacating a portion of the street and public way known as the strand, which abuts upon Lots 23, 24, 25, 26 and 27 of Block 28, to Nichols Hills, Oklahoma, and Block F of the business section of Nichols Hills, Oklahoma. h) Consideration / Possible Action to renew the Interlocal Agreement with the Board of County Commissioners of Oklahoma County for the fiscal year of City Manager recommends approval. i) Consideration / Possible Action to approve a Declaration of Covenants and Restrictions with The Oklahoma Publishing Company for I-1 zoning permitted modifications. City Manager recommends approval.

4 Page Four j) Consideration / Possible Action to approve the Easement Grant between The Oklahoma Publishing Company and the City of Nichols Hills, Oklahoma. City Manager recommends approval. k) Consideration / Possible Action to award a tort claim filed on April 2, 2004 by Paul Giasson of 6601 Grand Boulevard in the amount of $2, for repairs to his damaged sewerline. Risk Manager recommends denial of the claim and that it be forwarded to our current insurance carrier for consideration. l) Consideration / Possible Action for Amendment No. 1 on 2003 G.O., Bond Issue Emergency Sanitary Sewer Repair SC-0301 to Urban Contractors in the amount of $17, City Engineer has verified quantities and recommends approval. m) Consideration / Possible Action on Final Claim to be paid to Urban Contractors, Inc. in the amount of $70, This final pay claim should be paid out of the 2003 G.O. Bond Issue Sanitary Sewer Account No The City Engineer has completed a final inspection and recommends approval of the final payment and that the maintenance bond should be put into effect at this time. n) Consideration / Possible Action to approve lease agreement with T- Mobile. Attorney Kendall Parrish to address the Council. o) Consideration / Possible Action on request from the Public Works Department for permission to solicit bids for the annual park maintenance contract for FY p) Consideration / Possible Action on request from the Public Works Department to solicit bids for uniforms for FY q) Consideration / Possible Action regarding Nichols Hills 75 th Anniversary Committee Request to hold Anniversary Celebration on September 19, r) Consideration / Possible Action to award bid on the 2003 G.O. Bond Issue Paving Rehabilitation (7200 Block of Nichols Road and 1400 Block of Sherwood Lane) PC-0301 Project to Shell Construction Company in the amount of $411,
