Broken Houses Two Houses of Parliament adjourned sine die on April 6 While each side is stacking the blame at the other s doorstep.
In the second part of the session, starting March 5, the productivity of both Houses was less than 10%. Against a long list of pending Bills, just one was passed by both Houses, the Payment of Gratuity (Amendment) Bill That was it for the Rajya Sabha. The Lok Sabha passed three other bills related to the Budget: the Finance Bill 2018 and two Appropriation Bills. These are money bills that do not need the Rajya Sabha s nod
Both Houses lost more than 120 hours each to disruptions It is the quality of interaction that is damaging India s democracy. A special session before the monsoon session to finish pending business has been mooted.
Inclusion and the right to dignity Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. But we need to go beyond headlines and ask why a vulnerable community took to the streets. If the leadership had faithfully discharged its mandate of representing the needs of Dalits, the represented would not be living lives that are best described as subhuman. It is time to reflect.
Policies, Literary work and Civil Society has helped in cutting the ice. Yet caste-based discrimination persists in significant areas of social interaction. Disrespect reinforces other injustices confronted by the community in everyday life. Till today what caste we belong to continues to profile social relations, codify inequalities, govern access to opportunities and propel multiple atrocities.
Indians have failed to secure justice for their own fellow citizens. Constitutional and legislative provisions and Supreme Court judgments are important, but they are simply not enough. If the right to justice is violated, citizens should be exercised and agitated about this violation. Movements in pre-independence India.
We have to shrug off indifference and shoulder responsibility. The ideology of discrimination continues to dominate despite a multitude of constitutional provisions, laws, affirmative action policies and political mobilisation. One of the most essential goods human beings are entitled to, the right to respect, has not been realised.
Smoke in the woods Forest Policy was last revised in 1988, changes are perhaps overdue. India s diverse forests support the livelihoods of 250 million people, providing them firewood, fodder, bamboo, beedi leaves and many other products. The timber currently benefits the state treasury. Forests also regulate stream flows and sediment, benefitting downstream communities.
Provide global benefits of biodiversity and carbon sequestration. Forest policy in colonial India focussed on maximising products and revenues for the state through the imperial forest department as sole owner, protector and manager of the forest estate. Unfortunately, post-independence policy continued this statist approach.
1988 Forest Policy prioritised environmental stability over revenue maximisation needs of forest-dependent communities people s involvement in protecting and regenerating forests thus formally recognising the limitations of state-managed forestry Post-1988 experience Joint forest management (JFM) was initiated in the 1990s to implement the concept of people s involvement. Foresters created thousands of village forest committees but severely limited their autonomy and jurisdictions.
Forest Rights Act (FRA) of 2006 Its community forest resource provisions gave communities rights to both access and manage forests. Adivasis of Niyamgiri in Odisha: bauxite mining Supreme Court 1990s: net present value (NPV) not even a share in the NPV received by local communities 2018 Forest Policy draft: identifies production forestry and plantations as the new thrust area. Public-private partnerships (PPPs) to bring corporate investment into forest lands.
PPPs: profits ending up in corporate hands. Past replacements and its results natural oak forests with pine monocultures in the Himalayas natural sal forests with teak plantations in central India wet evergreen forests with eucalyptus and acacia in the Western Ghats All this has decimated diversity, dried up streams and undermined local livelihoods. CAMPA Act: Paris Agreement Commitment?
A case to withdraw the triple talaq Bill Shayara Bano v. Union Of India Legal point: no person can be jailed for an act that is not a crime. Three-year imprisonment Such an arbitrary exercise of legislative power is liable to be judicially reviewed and struck down for violating the principles of natural justice and rule of law.
Emotional abuse mentioned in Section 3 of the Protection of Women from Domestic Violence Act, 2005 (PWDVA). Section 31 of the PWDVA: 1 year / Rs20k fine / both. Innocent men cannot be punished. Article 21 which states that no person shall be deprived of his life or personal liberty except according to procedure established by law.
In Maneka Gandhi v. Union of India (1978), a seven-judge Constitution Bench ruled that fairness is implicit in the phrase procedure established by law and therefore, the procedure should be fair, just and reasonable, not fanciful, oppressive or arbitrary ; otherwise it would be no procedure at all and the requirement of Article 21 would not be satisfied. The court also clarified that law means reasonable law, not any enacted piece. Justice K.S. Puttaswamy v. Union of India (2017)
Memorialising our heroes India has war memorials as well as roads and lanes named after those who gave their lives for the nation. Memorials are not just a society s way of honouring the men and women who have fought for its sovereignty but also of helping a new generation understand how hardfought freedom is. Memorials are a place for both public and private grief.
Important News Non-bailable warrants issued against Nirav, Choksi A special Central Bureau of Investigation (CBI) court has issued non-bailable warrants against absconding diamond merchants Nirav Modi and Mehul Choksi, accused of defrauding the Punjab National Bank (PNB), the country s second largest lender, of over Rs13,500 crore.
Pak. plans to permanently ban JuD After being put on the grey list by the Financial Action Task Force (FATF), Pakistan is working on a law to replace the presidential ordinance which banned Hafiz Saeed s Jamaat-ud-Dawa (JuD) and its charity wing Falah-i-Insaniyat Foundation in February this year. The JuD has been banned but not put on Schedule 1, which would have made detention of its chief mandatory. Television journalist shot at outside Ghaziabad home A senior TV journalist was shot at by unidentified assailants outside his house in the Kavi Nagar area of district on Sunday evening. Prima facie, the police suspect personal enmity to be behind the attack. The journalist sustained three bullet injuries but his condition is stated to be stable.
China objects to India s transgression In a fresh incident of friction, the Chinese military last month strongly protested against the Indian Army s transgression into the strategically sensitive Asaphila area along the disputed border in Arunachal Pradesh, but India rejected the complaint, official sources said.
Oli seeks farm expertise for Nepal Nepal s Prime Minister K.P. Sharma Oli on Sunday sought the research expertise of G.B. Pant University of Agriculture and Technology in Uttarakhand to revolutionise agriculture in his country. Looking at what the Pantnagar university has done in the field of modernising agriculture in India, I think if the university and Nepal collaborate in the sector, agriculture in our country will get revolutionised through a technological boost, Mr. Oli said at a special convocation of the university. Describing India and Nepal as predominantly agricultural economies, he said though two-thirds of Nepal s population depended on agriculture, the sector s contribution to the country s economy was not as significant.
Syria chemical attack claims 49 lives U.S. President Donald Trump said on Sunday that there would be a big price to pay after medical aid groups reported that dozens of people were killed by poison gas in a besieged rebel-held town in Syria. The Syrian state denied that government forces had launched any chemical attack and Russia, President Bashar Al-Assad s most powerful ally, called the reports bogus. German attacker acted alone, motive unclear The man who drove a camper van into a group of people sitting outside a restaurant in the German city of on Saturday acted alone and appears to have had mental health problems, the regional Interior Minister said on Sunday.
Against privatisation of govt. banks: Yunus Grameen Bank founder Muhammad Yunus said that he was not in favour of privatisation of public sector banks (PSBs) as private banks had not shown any exceptional performance in many countries. Mr. Muhammad Yunus also said that ways have to be found to stop frauds in the banking sector. 4 kingfisher species sighted in Krishna sanctuary At least four kingfisher species are thriving in the Krishna Wildlife Sanctuary in Andhra Pradesh, adding beauty to the precious eco-region in India. The species have been identified as White-throated Kingfisher (Halcyon smyrnensis), Pied Kingfisher (Ceryle rudis), Black-capped Kingfisher (Halcyon pileate) and the Common Kingfisher(Alcedo atthis).
