WHEREAS, water/sewer districts are authrized by R.C.W t prvide street lighting services fr residents within the bundaries f the district, and... --,'. WHEREAS, n ay 24, 27, the Bard f Cmmissiners f the :Dakehaven Utility District, King Cunty, Washingtn duly adpted Reslutin , setting frth the prpsed establishment f a street lighting system t serve the area knwn as, SW 34 th Street between 16 th Avenue SW and 12th Avenue SW and described in Exhibit "A" attached. WHEREAS, ntice was duly published that a public hearing n the issue f street lighting in the afresaid area wuld be held at 6:3 p.m. n the 28th day f June, 27, at st Avenue Suth, King Cunty, Washingtn, and WHEREAS, the hearing was duly and regularly held at the afresaid time and place befre the Bard f Cmmissiners and the Bard heard all persns desiring t be heard n the matters regarding the street lighting, and WHEREAS, it appears that street lighting in the area shuld be prvided, OW THEREFORE, BE IT RESOLVED by the Bard f Cmmissiners f the Lakehaven Utility District, King Cunty, Washingtn, as fllws: SECTIO 1: That street lighting fr the realty knwn as, SW 34 th Street between 16 th Avenue SW and 12th Avenue SW described in Exhibit "A" attached is hereby rdered t be prvided by the District, subject t Sectins 2-5. SECTIO 2: That prperty wners served by said street lighting will pay t the District upn the effective date f the prvisin and thereafter the sum f $ 2.25 per mnth fr the peratin and maintenance f street lights, r such ther sum as shall frm time t time be determined by the Bard f Cmmissiners. SECTIO 3: The effective date fr prvisin f service shall be July 28, 27, subject t the filing, prir theret, f a petitin in ppsitin t the street lighting system established herein by at least frty percent (4%) f vters registered in the area t be served by the system. SECTIO 4: In additin t the filing perid referenced in Sectin 3 abve, service shall be subject t the submissin f a written request fr street light activatin, signed by the prperty wners whse names appear n the petitin, which shall be prvided nt less than thirty Reslutin Page 1

2 (3) days prir t actual activatin. Unless waived by the District fr gd cause, all street lights within the system shall be activated simultaneusly. SECTIO 5: ill accrdance with R.C.W , the District shall have the same pwers f cllectin fr delinquent street lighting charges as the District has fr cllectin f delinquent water and sewer service charges. We understand that in the standard street light system cnfiguratin, where ne street light is installed t serve six lts, a mnthly service charge f $2. per lt r such sum as the Bard f Cmmissiners may determine is reasnable fr the service prvided, pursuant t inflatinary increases and lr rate increases frm Puget Sund Energy shall be levied upn frmatin f the street lighting system and expiratin f the 3 day perid fr filing appeals, which appeals must be filed with the Bard by n less than 4% f the vters registered in the area t be serviced. In circumstances where the street lights serve mre, r less, than six lts, then the amunt f the mnthly charge shall be adjusted such that the District receives the equivalent $12. cst, r such ther sum as the Bard shall establish, frm the prperties served thereby. The appeal perid cmmences upn the Bard f Cmmissiners' apprval f the street lighting system. ultiples f the mnthly sum may be charged when less than six (6) lets are paying fr a street light. Said mnthly service charge shall be cllectable by Lakehaven Utility District in the same manner as water service charges, i.e., lawsuit, terminatin f service, lien and freclsure.
