BILL LUTHER BOARD MEETING ROOM Mayor Jackie Warner called the regular meeting of the Hope Mills Board of Commissioners to order on Monday, at 7:00 p.m. GOVERNING BOARD MEMBERS PRESENT Mayor Pro Tem Bob Gorman, Commissioner Pat Edwards, Jerry Legge and Bryan Marley. STAFF PRESENT Town Manager Melissa Adams, Interim Town Clerk Deborah Holland, Finance Director Drew Holland, Inspections Ray Reeves, Parks & Recreation Director Kenny Bullock, Public Works Director Hector Cruz, Deputy Fire Chief Steve Lopez, Police Chief Joel Acciardo, Stormwater Administrator Beth Brown and Development & Planning Administrator Chancer McLaughlin. Also in attendance were Town Attorney Dan Hartzog, Jr. and Ed Byrne of Cumberland County Planning Board. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was led by Commissioner Legge, followed by the Pledge of Allegiance by Mayor Warner that followed with a brief moment of silence for the passing of Former Mayor and Commissioner Al Brafford. 1. APPROVAL OF AGENDA ADDITIONS OR DELETIONS. Motion made by Commissioner Legge, seconded by Mayor Pro Tem Gorman and carried unanimously, to approve the agenda as presented with the removal of 7. New Business: Item c; Consideration of recommendation by the Police Department to install speed reduction devices on Yates Ranch Road due to the high traffic volume average violations recorded and addition of Consent: Item j; Consideration of approval of amended Resolution requesting the Board of Elections to conduct a Malt Beverage Election to include the date of November 7, 2017 for the election date and New Business: Item k; Discussion of décor at center of Hope Mills Lake in reference to Mr. Wyatt PRESENTATIONS: a. 2 9/11 National Day of Service and Remembrance In an unprovoked and senseless act of terrorism four civilian aircraft were hijacked on September 11, 2001, and crashed in New York City, Pennsylvania and the Pentagon, resulting in a momentous loss of innocent U.S. lives of all heritages. In observance of the 16 th anniversary of the September 11, 2001 attacks on America, we hereby adopt the following Proclamation in tribute to those lost and injured on 9/11, and the many who gave of themselves in service to their communities and to this country in the aftermath of the attacks: WHEREAS, people of all ages and walks of life, across America, and around the world, collectively witnessed an event of immense tragedy on September 11, 2001; and WHEREAS, the events of that day instantly transformed nearly everyone s lives, some through personal loss, and others through an unfamiliar sense of individual and national vulnerability; WHEREAS, while we still continue to recover from the loss of innocent lives, the spirit of the U.S. has been revitalized, giving way to expressions of patriotism; and WHEREAS, inspired by the heroism of our firefighters, rescue and law enforcement personnel, military service members and other, our nation found unity and strength; and WHEREAS, from the tragedy of September 11, 2001 emerged a stronger nation, renewed by a spirit of national pride, and a true love of country; and WHEREAS, September 11, 2001 will never, and should never be just another day in the hearts and minds of all Americans; and WHEREAS,, will be the 16 th anniversary of the 9/11 attacks on America and many citizens may wish to memorialize September 11 th by engaging in, or making a plan to engage in personal and individual acts of community service, or other giving activities, as a part of a solemn day of remembrance and tribute; and WHEREAS, the President of the United States, on September 11, 2009, issued the Patriot Day Proclamation officially and permanently designating September 11 th as a National Day of Service and Remembrance, and calling upon all interested Americans to participate in this observance through moments of silence, the flying of the flag of the United States at half-staff, as well as community service and charitable activities in tribute and remembrance. NOW, THEREFORE I, of the Town of Hope Mills, do hereby proclaim September 11 th, as a voluntary Day of Service and Remembrance, and 2

3 furthermore, call upon all citizens and organizations to consider joining in this observance and to engage in activities of tribute, solemn remembrance and charitable service. This the 11 th day of September, Mayor Warner read the Proclamation for 9/11 National Day of Service and Remembrance and requested a moment of silence to follow for the many lives lost in the 9/11 Tragedy. b. Proclamation for American Gold Star Mothers Day September 25, OFFICE OF THE MAYOR TOWN OF HOPE MILLS, NC PROCLAMATION WHEREAS, the service rendered the United States by the American mother is the greatest source of the Country s strength and inspiration; and WHEREAS, we honor ourselves and the mothers of America when we revere and give emphasis to the home as the fountainhead of the State; and WHEREAS, the American mother is doing so much for the home and for the moral and spiritual uplift of the people of the United States and hence so much for good government and humanity; and WHEREAS, the American Gold Star Mothers suffered the supreme sacrifice of motherhood in the loss of their sons and daughters in wars and conflicts through the years; NOW, THEREFORE, BE IT RESOLVED that I, of the Town of Hope Mills, do hereby proclaim September 25, 2017, American Gold Star Mothers Day in the Town of Hope Mills in tribute to the American Gold Star Mothers and urge all citizens to join in the expression of appreciation to the many American Gold Star Mothers in our community who have given so much in our behalf in times of both war and peace. Presentation of Certificate of Recognition to Taylor Culver for winner of Young Miss North Carolina in August Mayor Warner presented the Certificate of Recognition to Taylor Culver and Miss Culver briefly thanked her hometown of Hope Mills for their continuing support. c. Presentation of Certificate of Recognition to Alizdair Ray for acceptance into the Early College High School program. Mayor Warner presented Alizdair Ray with the Certificate of Recognition for acceptance into the Early College High School Program and commented Mr. Ray will be graduating high school at the age of 17 and has already accumulated some college credits. d. Bill Bowman of Up & Coming Weekly presentation to the Board of Commissioners. Bill Bowman commented as of tomorrow, September 12, 2017, Up & Coming Weekly will officially be the Hope Mills newspaper and showcased the newest prototype newspaper dispenser featuring Hope Mills logo. Mr. Bowman commented Up & Coming will be working in conjunction with the Cumberland County School System and begin placing a newspaper rack in all the high schools throughout the county in an effort to involve the next generation and showcase their achievements. 3. PUBLIC HEARINGS: NONE. 4. PUBLIC COMMENTS: Rex Johnson, 3636 Lakeshore Dr, spoke on his concern for the proposed Lake Pier/Dock draft Ordinance. Mr. Johnson feels the Ordinance is a copy of the Lake Waccamaw Ordinance and does not suit Hope Mills Lake as it is much larger body of water. Mr. Johnson suggested the Lake Lure Ordinance as a more appropriate example for Hope Mills to base theirs off. Rod McLean, 5435 Fountain Lane, spoke on the cypress trees in the middle of the lake that serve as a buffer for his property expressing his dismay for the way the topic was handled during the Special Meeting on September 6, CONSENT AGENDA: a. Consideration of approval of minutes from August 21, b. To amend the General Fund, the appropriations are to be changed as follows: Police Department C/O Equipment , Fire Department Vehicle Maintenance , Fire Department Special Fire Supplies , $ - $ 22, This will result in a net increase of $22, in the appropriations of the General Fund. To amend the General Fund, the appropriations are to be changed as follows: Rental & Lease Bldgs , $ - $ 3, This will result in a net increase of $3, in the appropriations of the General Fund. To provide the additional revenue for the above, the following revenues will be increased. Infrastructure Inspection Fees , $ - $ 3, Section 2. To amend the Project Fund, the appropriations are to be changed as follows: Prof Services Crenshaw Drive , Operating Transfer , $ - $ 85, This will result in a net increase of $85, in the appropriations of the Project Fund. To provide the additional revenue for the above, the following revenues will be increased. FEMA Reimbursement , Operating Transfer , $ - $ 85, Section 2. 8 Town of Hope Mills, North Carolina Budget Ordinance Amendment Fiscal Year Amendment #8 BE IT ORDAINED by the Board of Commissioners of the Town of Hope Mills, North Carolina, that the following amendment be made to the annual budget ordinance for the fiscal year ending in June 30, 2018: Section 1. To amend the Stormwater Fund, the appropriations are to be changed as follows: Operating Transfer Out , $ - $ 62, This will result in a net increase of $62, in the appropriations of the Stormwater Fund. To provide the additional revenue for the above, the following revenues will be increased. Appropriation from Fund Balance - 62, $ - $ 62, Section 2. Consideration of BA#9 in the amount of $62, for McGill Associates Construction, Engineering and Inspection for U-5528A Rockfish Road Sidewalk Project and authorize the Town Manager to execute the contract. Town of Hope Mills, North Carolina Budget Ordinance Amendment Fiscal Year Amendment #9 BE IT ORDAINED by the Board of Commissioners of the Town of Hope Mills, North Carolina, that the following amendment be made to the annual budget ordinance for the fiscal year ending in June 30, 2018: Section 1. To amend the Powell Bill Fund, the appropriations are to be changed as follows: Rockfish Road Sidewalk , $ - $ 62, This will result in a net increase of $62, in the appropriations of the Powell Bill Fund. To provide the additional revenue for the above, the following revenues will be increased. Appropriation from Fund Balance , $ - $ 62, Section 2. 10 g. Consideration of BA#10 in the amount of $35, for McGill Associates for the construction engineering and inspection of repairs to River, E. Patterson, Davis and Thoroughbred Streets and authorize the Town Manager to execute the contracts. Town of Hope Mills, North Carolina Budget Ordinance Amendment Fiscal Year Amendment #10 BE IT ORDAINED by the Board of Commissioners of the Town of Hope Mills, North Carolina, that the following amendment be made to the annual budget ordinance for the fiscal year ending in June 30, 2018: Section 1. To amend the General Fund, the appropriations are to be changed as follows: Contract Services Hurricane Matthew , $ - $ 35, This will result in a net increase of $35, in the appropriations of the General Fund. To provide the additional revenue for the above, the following revenues will be increased. FEMA Reimbursement , $ - $ 35, Section 2. Copies of this budget amendment shall be furnished to the Clerk to the Board of Commissioners, and to the Budget Officer and the Finance Officer for their direction. Consideration of Change Order #01 Adcock Street Stormwater project in the amount of $125, to replace Adcock Street as part of the original approved project and authorize the Town Manager to execute the change order. i. Consideration of Change Order #1 to Sandy s Hauling and Backhoe Service, Inc. existing contract for $7, to repair eroded invert in the catch basin at corner of William Bill Luther and Edwin Deaver Streets and authorize Town Manager to execute the change order. j. Consideration and approval of amended Resolution requesting the Board of Elections to conduct a Malt Beverage Election to include the date of November 7, 2017 for the election date. A RESOLUTION REQUESTING THE BOARD OF ELECTIONS TO CONDUCT A MALT BEVERAGE ELECTION FOR ON PREMISES SALES IN PURSUANT TO N.C. GEN. STAT. 18B-602. RESOLUTION NO WHEREAS, The Town of Hope Mills has already voted to permit the sale of off premises malt beverages in 1977; and WHEREAS, The Town of Hope Mills is requesting the Cumberland County Board of Elections to conduct an election on November 7, 2017 authorizing the sale of on premises malt beverages; and NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF HOPE MILLS: Section 1. The Town of Hope Mills requests an election to authorize the Town of Hope Mills on premises sale of malt beverages pursuant to N.C. Gen. Stat. 18b-602(a)(2); The foregoing resolution, having been submitted to a vote, received the following vote and was duly adopted this 6 th day of September, Ayes: Noes: Absent or Excused: Attest: 11

12 Deborah Holland, Interim Town Clerk Motion made by Commissioner Edwards, seconded by Commissioner Legge and carried unanimously, to approve the consent agenda as read. 6. OLD BUSINESS: a. Consideration/Discussion of recommendations for members to the Town of Hope Mills Recreational Complex Master Plan Stakeholders Committee. Town Manager Adams commented Mayor Warner suggested a member of the Cumberland County Board of Commissioner be included in the Stakeholders Committees and Chairman Adams indicated he is willing to serve in that capacity. Town Manager Adams commented she was asked to look into whether Terry Dahl lives within Town limits and it was confirmed he lives in Fox Meadow subdivision. Mayer Warner volunteered to serve as Board Liaison to the Hope Mills Recreational Complex Master Plan Stakeholder Committee. Motion made by Commissioner Edwards, seconded by Commissioner Marley and carried unanimously, to approve the Stakeholder Committee list and Mayor Warner as Board Liaison. 7. NEW BUSINESS: a. Case No Consideration of the Hope Mills Marketplace, LLC & Waffle House; Zero Lot line Subdivision and C2(P) (AOD) Site Plan Review. Development and Planning Administrator Chancer McLaughlin presented Case No commenting the developer is requesting approval to subdivide one of the existing outparcels within the Hope Mills Marketplace into two outparcels and approval of a Waffle House restaurant to be located on the new lot. Town of Hope Mills staff is recommending approval of the proposed site plan review, however due to a current issue with the overall storm water pond for the entire development; building permits will be held until this issue is rectified. Commissioner Legge inquired if Town Attorney Hartzog could research whether open access easement is an option for the heirs to the existing cemetery that is located at the rear of the subject property. Town Attorney Hartzog looked into the matter and responded it cannot be gated off. Motion made by Commissioner Edwards, seconded by Mayor Pro Tem Gorman and carried unanimously, to approve Case No with Zero lot line Site Plan Review 12

13 and building permits will be held until the storm water pond development issue is rectified. b. Consideration of appointment by Mayor Warner of Commissioner Marley to the Air Quality Stakeholders Committee effective. Motion made by Mayor Pro Tem Gorman, seconded by Commissioner Edwards and carried unanimously, to appoint Commissioner Marley to the Air Quality Stakeholders Committee. d. Consideration of Mayor Warner s recommendation to form a Committee made up of Student Government Association members from each of the three high schools; South View, Jack Britt and Grays Creek. Mayor Warner commented she will organize this new committee which will consist of two members from each school and meet prior to the second Board of Commissioners meeting each month. Mayor Warner will visit the schools once a month to meet with the SGA to open dialogue about Hope Mills. The committee s goals would be to give our youth an opportunity to learn more about our town government to allow them to share their opinions and ideas about their vision for the future of Hope Mills. Motion made by Mayor Pro Tem Gorman, seconded by Commissioner Marley and carried unanimously, to approve Mayor Warner to appoint the three high schools SGA committee members. e. Consideration of setting a date for a public hearing on Monday, September 25, 2017 for the Proposed Business Registration Ordinance. Town Manager Adams commented since the General Legislature has repealed the laws governing Schedule B Business Licenses, the Town has no way to track businesses that open and close within the Town of Hope Mills. The purpose of the proposed Ordinance is to create a working list of businesses operating within the Town in order to assist the Police Department and Fire Department in their abilities to perform their duties. Town Manager Adams commented the main reason for this proposed Ordinance is for the Fire Department when conducting Fire Inspections and change of occupancy compliance. Motion made by Commissioner Legge, seconded by Commissioner Edwards and carried unanimously, to approve a public hearing for Monday, September 25, 2017 at 7:00 for the Proposed Business Registration Ordinance. f. Consideration of setting a date for a public hearing on Monday, September 25, 2017 for the Piers, Dock & Bulkhead Ordinance. Town Manager Adams commented the Lake Advisory Committee will be reviewing the proposed Ordinance at their meeting tomorrow, September 12, 2017 and will present their thoughts on the Ordinance during the public hearing. 13

14 Mayor Pro Tem Gorman commented he feels it is very important to take the Lake Advisory Committee and citizen s opinions into consideration regarding the proposed Ordinance. Motion made by Commissioner Legge, seconded by Commissioner Edwards and carried unanimously, to set date of Piers, Dock & Bulkhead Ordinance public hearing for September 25, 2017 at 7:00 p.m. g. Consideration of approval of the new ordinance for naming of public facilities by the Town of Hope Mills. Motion made by Commissioner Marley, seconded by Commissioner Edwards and carried unanimously, to approve the new ordinance for naming guidelines of public facilities by the Town of Hope Mills. h. Consideration of BA#11 & BA #12 in the amounts of $49, each for engineering approvals for Odessey Court from Freese and Nichols Engineering for the repair to Odessey Court and initial soil survey for Hunting Ridge as approved on the list of projects presented at the Board Retreat in March, 2017 and approve Resolution No and request authorization for Town Manager to execute the contracts. To amend the Project Fund, the appropriations are to be changed as follows: Prof Services Odessey Court , $ - $ 49, This will result in a net increase of $49, in the appropriations of the Project Fund. To amend the Stormwater Fund, the appropriations are to be changed as follows: Operating Transfer - Out , $ - $ 49, This will result in a net increase of $49, in the appropriations of the Stormwater Fund. Adopted this 11 th day of September ATTEST: Deborah Holland, Interim Town Clerk A RESOLUTION FOR EXEMPTING ENGINEERING FOR STORMWATER INVENTORY UPDATES FROM THE REQUIREMENTS OF G.S. CHPT. 143, ART. 3D RESOLUTION NO WHEREAS, G.S (a) requires that North Carolina municipalities select firms to provide architectural, engineering, surveying and /or construction management at risk services on the basis of demonstrated competence and qualification for the type of professional services required without regard to fee other than unit price; WHEREAS, G.S authorizes the Hope Mills Board of Commissioners to exempt in writing and project from the requirements of G.S. Chpt. 143, Art. 3D, which includes G.S , where the estimated professional fee is an amount less than Fifty Thousand 00/100 Dollars ($50,000.00); WHEREAS, the Town would like to engage an Engineer to design a functional Stormwater system on Odessey Court and complete soil survey on Hunting Ridge; and WHEREAS, the estimated cost is less than Fifty Thousand 00/100 Dollars ($50,000.00); NOW THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF COMMISSIONER OF THE TOWN OF HOPE MILLS: Section 1. The Engineering services for Odessey Court design and Hunting Ridge soil are exempted from the requirements of G.S. Chpt. 143, Art. 3D. 16

17 Section 2. All provisions of any town ordinance or resolution in conflict with this resolution are repealed. Section 3. This resolution shall become effective upon adoption. Consideration of the guidelines for pressure washing the CSX Railroad Bridge Underpass on Main Street and authorize Town Manager to proceed with submittal process, negotiate and execute a contract to pressure wash the bridge underpass. Discussion of décor at center of Hope Mills Lake in reference to Mr. Wyatt s . Mayor Warner commented she received an from Wayne O. Wyatt of Fort Bragg Mission Training Complex requesting the Town create a structure for the center of the lake that would highlight the seasons. Discussion pursued and the consensus among the 18

19 Board was to direct the Lake Advisory Committee to discuss this item at their meeting on Tuesday, September 12, REPORTS AND INFORMATION ITEMS: a. Update report on the Hope Mills Lake/Dam project. Town Manager Adams reported since the last meeting, ASI has placed an approximate total of 5,093 cubic yard of dam structure concrete to date and is 98% complete with all dam concrete. ASI plans to finish earthwork on the left embankment and start and complete placement of rip rap for the left embankment as well as ramping up clearing operations in the upper reservoir. Jessie Bellflowers spoke in reference to the proposed Pier/Dock Ordinance and questioned its purpose. Mayor Warner responded the Lake Advisory Committee and citizens will be able to voice their opinions concerning this matter during the public hearing on September 25, Unless otherwise noted, the Monthly Dam Progress Meeting is the Second Tuesday of every month at 11:00 a.m.-11:15 a.m. at the Hope Mills Lake Gazebo. b. Manager s update. Update on Pier Dock Bulkhead at Lake Park. Town Manager Adams updated the Board that we are still awaiting the bid specification documents from Fleming & Associates and anticipate them being in the Town s possession by the end of the week. Public Works Director Hector Cruz will solicit bids and once received, the Board should consider holding a special meeting to award the bid. Update on pressure washing & painting of pedestrian bridge at the Lake. Town Manager Adams commented we ve received a quote in the amount $1, to pressure wash the pedestrian bridge. The Town will need to rent an all-terrain lift to facilitate under the structure access and we are awaiting a quote on the cost to paint the pedestrian bridge and will need the Board s input on paint color. Update on the Lake Park Improvement Concept Plan. Town Manager Adams commented WithersRavenel is still working on the final concept as they are awaiting the final drawings of the pier to be completed by Fleming & Associates and once received, will incorporate it into the final concept. Town Manager Adams updated on the following updates 19

20 1. Street Paving Project - signed contract sent on September 5, Date of Notice to Proceed has not yet been received. 2. Johnson Street Sidewalk in the process of researching right-of-way issue and Town has asked for legal research before we can proceed. We have two models for conceptual sidewalk and are considering one-way traffic due to utilities, right-of-way and safety issues. 3. Damaged areas from Hurricane Matthew Scheduling bid openings for September 14, 2017 and expect to bring recommendations back to Board on September 25, 2017 meeting. 4. Golden Leaf Grant Public Works Director Hector Cruz only received two bids for the removal of debris in the creek bed and reposted a second bid date for September 14, PWC Has an upcoming sewer line replacement project in Englewood subdivision, Town Manager Adams will send a notification to Board once work begins. 6. Georgetown Estates Amicable to street repairs and have submitted for reinspection for week of September 11-15, Valley End subdivision has not been in cooperation in bringing streets to Town standards. 7. Generator for Town Hall A back-up generator has been installed at Town hall in the event of a hurricane or any power outage. 8. Heritage Park Reengagement Public Works Hector Cruz met with Kurt Pfeifer of WithersRavenel and walked the area to survey and discuss what s required. Town Manager Adams anticipates receiving a proposal for the development of concept with construction plans by the end of the month. 9. Hope Mills Congestion Management Plan Meeting scheduled for Tuesday, September 12, 2017 at 6:00 p.m. at Parks & Recreation. Town Manager Adams encouraged citizens to visit hopemillsplan.org. 10. Staff in process of researching and applying for 2018 Pedestrian Planning Grant and FAMPO is preparing a resolution for their board to adopt. Town Manager Adams requested a motion to authorize her to submit the grant application once staff has completed it. 11. Heroes Homecoming Press conference scheduled for Wednesday, September 13, :00 a.m. at Veterans Memorial. 12. Hope Mills Fire Department was nominated for the Grange Fire Department of the Year by Lieutenant Colonel Matthew J. Dansberry, a member of the Cape Fear Grange Chapter. Hope Mills Firefight Wesley Metcalf was awarded state Firefighter of the Year. 13. Richard and Christine Cox - issues reported at last meeting on Brown Street. The Hope Mills police department has met with the landlord and the landlord is cooperating to eliminate issues that were reported. 14. Town Manager Adams attending UNC School of Government from September 12-15, Second session of Citizens Academy was extremely successful and now has 18 students. Erica Walls of Up & Coming Weekly is attending. 20

21 16. Food Truck Rodeo will run twice for the month of October due to the success of the first. U.S. Army 82 nd Airborne Chorus will be performing at the second Food Truck Rodeo in October. Commissioner Gorman - Historic Preservation Commission & Lake Advisory Committee Mayor Pro Tem Gorman updated the Board he will be attending a Historic Preservation Commissioner meeting on Wednesday, September 13, The Lake Advisory Committee met on August 8, 2017 to discuss the disposal of the lakebed debris and upper reservoir clearing. The Lake Advisory Committee will meet again tomorrow, September 12, Commissioner Edwards - Appearance Committee Commissioner Edwards reported the Appearance Committee did not meet due to lack of quorum. Commissioner Legge - Parks & Recreation Advisory Committee Commissioner Legge reported the Parks & Recreation Advisory Committee discussed the Master Plan for the golf course property and another public interaction regarding the Master Plan that will take place on October 21, The group will be set up with questionnaires similar to the way they did at the National Night Out gathering. Commissioner Marley - Veterans Affairs Commission & RLUAC Commissioner Marley reported the Veterans Affairs Commission met on August 24, 2017 and will hold a memorabilia display at the Hope Mills library. Commissioner Marley reported during the RLUAC meeting on August 17, 2017, Benchmark Planning Consultants were there to discuss the joint land use study they are conducting with Fort Bragg. 21
