Also present: Interim City Manager Jared Jones and City Attorney Nevin Zimmerman. Commissioner Rader moved to approve the minutes for the May 22, 2018 City Commission Meeting. Consideration of final payment to Cathey Construction in the amount of $3, for the installation of the electric security gate at the Utilities Complex. 7.e. Consideration of final payment in the amount of $7, to RJ Gorman Marine Construction, LLC for the St. Andrews Marina floating dock project. 7 8. City Manager 8.a. Consideration of Surtax Loan and Authorization for RFP. Commissioner Nichols moved to authorize staff to send out an RFP for a Surtax loan. On a roll call vote Commissioners Nichols, Haligas, Brown, Rader and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. 8.b. Consideration of Mural Review Committee Application. Commissioner Brown moved to approve the Mural Review Committee Application with the following revisions: approving Type One Murals only and including Downtown North. On a roll call vote Commissioners Nichols, Haligas, Brown, Rader and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. 8.c. Consideration of Mural Review Committee. The Commission discussed creating a committee to review mural applications. They agreed that it should be a five person committee with a representative from each district. The Committee will begin with the following three individuals: Jayson Kretzer, Brad Stephens and Clay Keels. The additional members will be added at a later date. Commissioner Rader moved to approve creating a five person Board and approve the three currently named members. On a roll call vote Commissioners Nichols, Haligas, Brown, Rader and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. Attorney Zimmerman confirmed that a ratifying ordinance will be prepared. 8.d. Transmittal Hearing of Ordinance 2650 to adopt a Comprehensive Plan Text Amendment that creates a new Future Land Use Category entitled East Robinson Bayou (ERB). Commissioner Haligas moved to approve the Transmittal Hearing Reading of Ordinance On a roll call vote Commissioners Nichols, Haligas, Brown, Rader and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. Hachmeister, City Clerk-Treasurer DATE: June 12, 2018 RE: Notice of appointment to the Supplemental Retirement Board The terms of Henry Hooks and Carter Middlemas expire in July. Henry Hooks would like to remain on the board. Carter Middlemas would not like to remain on the board. Both seats are Commission appointed seats. We have not received any applications for this board. The Board shall consist of five Trustees. Two members of the Board shall be appointed by the Panama City, City Commission. Two members shall be members of the System and elected by a majority of the General Employees who are members of the System. The fifth member shall be chosen by a majority of the previous four Trustees and serve a two year term. Each resident Trustee shall serve as Trustee for a period of four years. The SRB meets quarterly.

Hachmeister, City Clerk-Treasurer DATE: June 12, 2018 RE: Notice of appointment to the Downtown Improvement Board Ms. Sarah O'Brennan has resigned as a member of the Downtown Improvement Board, her term expires September 1, This is a Mayor appointed position with concurrence of the City Commission. We have not received any applications for this board. The Downtown Improvement Board is an agency of the City and works towards the revitalization and growth of Downtown Panama City. To qualify for appointment to the Downtown Improvement Board and remain qualified to serve on this board, a prospective member or member already appointed shall be an owner of realty within the downtown area, subject to ad valorem taxation, a lessee thereof required by the lease to pay taxes thereon, or a director, officer, or managing agent of an owner or a lessee thereof so required to pay taxes thereon, or a resident of the downtown area, but no two (2) shall be affiliates of the same corporation, partnership or the same corporation, partnership or other business entity, nor shall any member be serving as a city officer or employee. The Mayor appoints members of this seven-member board with the concurrence of the City Commission. Board members serve three-year terms and are subject to term limitation. A member who has served eight years on this Board cannot be reappointed without a unanimous vote of the City Commission.

12 The Downtown Improvement Board meets on the fourth Monday of each month.

13 RESOLUTION NO A RESOLUTION OF CITY OF PANAMA CITY FLORIDA HONORING FIFTY YEARS OF MUNICIPAL HOME RULE IN THE FLORIDA CONSTITUTION AND COMMITTING TO AN EDUCATIONAL INITIATIVE TO HELP FLORIDIANS UNDERSTAND THIS BENEFICIAL RIGHT WHEREAS, Florida s voters placed municipal Home Rule powers into the Florida Constitution on November 5, 1968, during the regular elections as an amendment to Article VIII; and WHEREAS, this power has enabled each city, town and village across the Sunshine State to consider, adopt, revise or remove its own laws without the need to seek legislative permission from the state and has further served as the foundation upon which every municipality builds its governmental structure; and WHEREAS, the political climate within the Florida Legislature has recently included many attacks on these powers; and WHEREAS, grassroots measures calling such actions wrong and declaring that local decisions be made at the local level by local officials must continue so that all legislators clearly understand Florida s Home Rule as a constitutional power and one upheld in state statutes; and WHEREAS, a 50th anniversary is a fitting time for all municipalities to engage their respective citizens to educate them about the Florida Constitution and local laws, so that all Floridians may continue to receive the many benefits of Home Rule. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PANAMA CITY: Section 1. That this anniversary presents a tremendous opportunity to educate all citizens about Florida s Constitution, municipal government and Home Rule authority, and that all necessary resources shall be provided for such publicinformation. Section 2. That the City will actively challenge all efforts to reduce or erode this cherished right and further employ all efforts to ensure state and federal government partners understand that a one-size-fits-all approach to governance is not in the interests of Florida citizens. 1

14 Section 3. That the tradition of local decision-making in Florida is essential to protect, as it provides each municipality the ability to preserve and enhance the myriad characteristics that make each one uniquely special and that maintains its quality of life. Section 4. That the City will include this information on its website, as a regular agenda item for public discussion and within the City of Panama City services in as many outreach venues as possible. BACKGROUND INFORMATION: The property currently has a single family home and would like to continue use as such. The property s present County land use designation is Residential and zoning designation is Residential -1. The owner and applicant, Helen Holder is requesting annexation, land use & a zoning change in order to utilize City services. The Planning Board considered this item on June 11, A motion was made to recommend approval by all Board members. DEPARTMENT HEAD RECOMMENDATION: Conduct a first reading of the request for annexation. 1

Attached also for your information is the CRA Board memorandum concerning the Auditorium dated May 8, 2018, and the City Commission memorandum approving a Joint Use Agreement for the Auditorium dated June 28, The School Board approved the Joint Use Agreement during its meeting on June 28, The Downtown North CRA Plan (the "Plan") encourages the collaboration with all community partners to provide art and cultural activities for the Downtown North CRA Community. Bay High School is named in the Plan as a public school that serves the residents within the Downtown North CRA Community, and the Downtown North CRA boundaries include a majority of the land area of Bay High School and border Bay High School on the East and South. Providing cultural activities at Bay High School assist in creating a sense of place and civic pride for the residents of the Downtown North CRA community, and the new Auditorium will enhance the music, drama, dance and art programs at Bay High School, the designated high school within the Plan. The residents within the Downtown North CRA Community that attend Bay High School will also benefit from the enhanced cultural activities in the Auditorium, and through the Joint Use Agreement that allows for the City to coordinate the community use of the Auditorium all residents within the CRA Community will be afforded the opportunity to experience and enjoy the cultural activities that could be offered at the Auditorium. The Agreement provides that the City will designate the CRA as its "Designated Representative" to coordinate the use of the Auditorium during "Public Access Hours" and to ensure the offer of cultural activities and education to residents within the CRA Community as well as to all residents of and visitors to Panama City, all in accordance with the Joint Use Agreement.
