Items of Community Interest (Wohletz) In accordance with Section of the Government Code, this agenda item provides an opportunity for City staff or the City Council to report information on items of community interest that is not posted on the agenda. Items of community interests may include expressions of thanks, congratulations, or condolence; information regarding holiday schedules; an honorary or salutary recognition of a public official, public employee, or other citizen, except that a discussion regarding a change in the status of a person's public office or public employment is not an honorary or salutary recognition for purposes of this subdivision; a reminder about an upcoming event organized or sponsored by the governing body; information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the governing body that was attended or is scheduled to be attended by a member of the governing body or an official or employee of the municipality; and announcements involving an imminent threat to the public health and safety of people in Oak Point that has arisen after the posting of the agenda. 4. Public Input. (Wohletz) This agenda item provides an opportunity for citizens to address the Council on any matter that is not posted on the agenda. The Council will hear comments on specific agenda items that are listed as public hearings prior to the Council addressing those items. There is a three minute time limit for each citizen. The City Council is not permitted to take action or engage in any discussion on presentations or inquiries concerning an item not listed on the agenda. However, in accordance with Section of the Government Code, a representative of City staff or the City Council may respond with either a statement of specific factual information relating to the inquiry or a recitation of existing policy in response to the inquiry. 5. Upon an item being proposed for discussion, the City Council will vote to determine its collective desire to schedule the item for discussion and/or action at a future meeting. A majority vote of the City Council is required to schedule an item for discussion and/or action at a future meeting. Description of Agenda Item: Each year the Daughters of the American Revolution bring awareness to the United States Constitution by requesting support from local towns and cities with a written proclamation declaring Constitution Week. This is the 227 th anniversary of the drafting of the Constitution of the United States. The attached proclamation declares September as Constitution Week in Oak Point. 5 PROCLAMATION CITY OF OAK POINT, TEXAS WHEREAS, September 17, 2014 marks the two hundred twentyseventh anniversary of the drafting of the Constitution of the United States of America by the Constitutional Convention; and WHEREAS, it is fitting and proper to accord official recognition to this magnificent document and its memorable anniversary, and to the patriotic celebrations which will commemorate the occasion; and WHEREAS, Public Law 915 guarantees the issuing of a proclamation each year by the President of the United States of America designating September 17 th through 23 rd as Constitution Week. NOW, THEREFORE, I, Jim Wohletz, Mayor of the City of Oak Point, Texas, do hereby proclaim the week of September 17 th through 23 rd as CONSTITUTION WEEK in Oak Point, Texas AND, urge our citizens of Oak Point to commemorate the twohundred twenty-sixth anniversary of the Constitution and to reflect on the privilege of being an American with all the rights and responsibilities which that privilege involves. 38 To: From: Mayor and City Council Luke Olson, City Manager Re: City Council Meeting September 15, 2014 Date: September 12, 2014 Agenda Item: Presentation and discussion of the Strategic Plan Monthly Status Report for the month of September Description of Agenda Item: On December 21, 2011, the City Council adopted a Strategic Plan in the form of a mission statement, guiding goals, and supporting strategies. The mission statement, guiding goals, and supporting strategies are intended to: Outline the City's current and future priorities and create shared commitments among the City Council, City staff, and Oak Point residents regarding the goals and strategies required to appropriately address these priorities; Help identify the resources necessary to achieve the identified goals so that these needs can be taken into consideration with each annual budget; and Guide the future of the City by providing City personnel with the concise direction that is needed to achieve the City s goals. Ideally, the City Council will formally discuss the goals and objectives on an annual basis after Council elections allowing any updates to the Strategic Plan to be considered as the annual budget is prepared. Most recently, the City Council approved a resolution updating the goals and objectives of the Strategic Plan on May 19, While the Strategic Plan is posted on the City s website, the attached Monthly Status Report provides additional information by listing the goals and strategies and summarizing the current status and anticipated next step associated with the strategies. 39 Budget Impact: N/A Legal Obligations and Review: The City is under no legal obligation to prepare and maintain a Strategic Plan. The City Council adopted a Strategic Plan and the associated mission statement, guiding goals, and supporting strategies by resolution in December As noted above, the City Council should formally discuss the goals and objectives on an annual basis after Council elections. If changes are made to the goals and strategies, the updated Strategic Plan should also be adopted by resolution. The Strategic Plan was most recently updated in May 2014 through the City Council s approval of Resolution No R. City of Oak Point FY Guiding Goals and Supporting Strategies Monthly Status Report for September 2014 Guiding Goal Provide services with P.R.I.D.E. (professionalism, responsiveness, integrity, dedication, and efficiency). Supporting Strategies Update and/or prepare policies, procedures, and standard operation guidelines with specific attention to building inspections/permitting, court, emergency management, finance, and utility billing. City staff is in the process of preparing a list of the policies and policy statements, the means by which they were approved, and the date they were approved. Several employees have been tasked with preparing SOPs to define their responsibilities at City Hall. BC 3 rd Qtr The City s Building Clerk has been assigned the task of gathering information that will be used to prepare a comparison of the Current Status City s fees and the fees of other area cities. After the information has been gathered, a comparison of fees will be presented to and discussed with the City Council. BC 2nd Qtr The City s Building/Court Clerk, Jonette Ellis, has prepared a draft of a Permits and Inspections Manual. It is expected that the Manual will be complete in the coming weeks and then posted on the City s website. (Updated September 2014) Update and maintain the Code of Ordinances. CS Ongoing Franklin Legal Publishing completed an update of the Code of Ordinances and the City Council approved an ordinance adopting the update in March The City Secretary periodically updates the online version of the City s Code of Current Status Ordinances to include changes and new ordinances. Once the budget is passed and in effect the Code of Ordinances will be updated.(last updated September 2014) Improve the organization of the City s electronic files and catalog all hard files. (Last updated December 2013) Prepare an internal inventory of ordinances, agreements, and contracts using LaserFiche. CS Ongoing LaserFiche software has been installed on the computers of certain City staff. City staff has been trained on the use of the Current Status software. The City Secretary has scanned ordinances, resolutions, and proclamations into the Laserfiche system. Agreements other documents will also be incorporated into the LaserFiche system. DPS 3 rd Qtr The Director of DPS has been assigned the task of evaluating the City s current emergency management plan. A draft of an Current Status updated plan was recently submitted to the City Manager. After the updated plan is finalized, City staff will present the plan to the City Council. (Last updated October 2013) Pursue recognition by the Texas Police Chiefs Association as a recognized Texas law enforcement agency. DPS TBD The Texas Police Chiefs Association s ( Law Enforcement Recognition Program is a voluntary process where police agencies in Texas prove their compliance with 164 Texas Law Enforcement Best Practices. These Best Current Status Practices were carefully developed by Texas Law Enforcement professionals to assist agencies in the efficient and effective delivery of service, the reduction of risk and the protection of individual s rights. The process to become a Recognized Agency will be evaluated during the course of FY (Last updated June 2014) Pursue recognized status in the Texas Fire Chiefs Association Best Practices Recognition Program. Plans include widening the road from Eldorado Parkway (former Garza Road) to U.S. 380 to a six lane median divided thoroughfare with designated left turn lanes and median openings to accommodate several existing intersections. The project has been divided into two separate projects due to conflicts between the roadway design and existing utilities. The south section of the project will extend from Eldorado Parkway (former Garza Road) to just south of Martop Road. The $15.6 million project was formally let (contract awarded) in February The construction start date is currently estimated as January2015. Actual construction Current Status start will depend on progress of utility relocations throughout the corridor. The north section of the project extends from just south of Martop Road to U.S The schedule for the north section currently projects a construction start date of March Amongst other utility relocations, sections of a wastewater force main that is part of the City s wastewater system along FM 720 must be relocated by the City due to the road widening. Freese & Nichols has completed the construction plans to relocate the force main. Representatives from Oak Point, Little Elm, Mustang SUD, and various utility companies continue to meet on a monthly basis with TxDOT to discuss the status of utility relocations and other various aspects of the project. CM Ongoing In September, Monarch Utilities I, L.P. notified the City of Oak Point and Crescent Oaks residents of a requested change (increase) in their rates for the water that it provides through its Midway Water Utility system operated by SouthWest Water. The requested rate increase involves a two phase increase with a 9.9% increase in January 2014 and another 4.5% increase in July After the City s utility rate consultant and attorney reviewed the supporting documentation that was submitted by Current Status Monarch, the City Council conducted a public hearing on the requested rate increase at the City Council meeting on Monday, November 18. After conducting the public hearing, the City Council discussed the request and approved an ordinance denying the rate increase. Monarch has appealed the City Council s decision to the TCEQ. A settlement agreement has been presented to Council and was discussed with the City attorney, the final settlement approved at the July 21 meeting (Updated August 2014) Examine opportunities to more efficiently provide wastewater service. CM FY City staff is evaluating the potential sale of the City s wastewater system and sewer CCN to Mustang Special Utility District. The proposed details of the sale and the legal aspects of the sale were discussed with the City Council at their meeting on Current Status March 17. With City staff and Mustang staff having agreed to the general terms for the sale, an agreement approved by City Council on July 21. A special election will be held in May 2015 for voter approval. The budget was filed with the City Secretary on August 1 and includes both the EDC and MDD proposed budgets. The budget includes the proposed tax rate and other revenue and expenditure sources. City staff recommended that the City Council conduct the public hearing on the budget and after the hearing City staff recommended that the Mayor announce the next public hearing on the tax rate. Mayor Wohletz opened the public hearing at 6:14 p.m. Leslie Maynard asked if the tax rate was remaining the same as previous years. Mayor Wohletz stated the tax rate was remaining the same. (Savage) Chapter 26 of the State s Tax Code requires the City Council to hold two public hearings on the proposed tax rate when the proposed tax rate exceeds the rollback rate or the effective rate. The Denton County Tax Office has calculated the City s adjusted rollback rate as $ per $100 of property valuation and the effective rate as $ per $100 of valuation. With a proposed maintenance and operations (M&O) rate of $ and a proposed interest and sinking (I&S) rate of is $ , the total combined proposed tax rate is $0.573 per $100 of taxable assessed value. At each hearing, the governing body must announce the date, time and place of the meeting at which it will vote on the tax rate. State law also requires that the City publish a Notice of Public Hearing on Tax Increase in its official newspaper, the Little Elm Journal, and post the same notice on its website. (Bockes) Amy Bockes, City Secretary, presented information related to the boundary agreement with Little Elm releasing a portion of the City s ETJ to Little Elm as stated in the previously approved agreement. The portion of the ETJ to be relinquished to Little Elm is located in Hilltown in which City boundaries were redone and are in Little Elm s City limits. As part of the agreement, Little Elm commits to construction of road improvements within the agreement. City staff recommended that the City Council approve the resolution. Deputy Mayor Pro Tem Palmer motioned that the City Council approve the resolution releasing, relinquishing, and allocating certain designated extraterritorial jurisdiction to the Town of Little Elm as agreed upon in the amended Boundary Agreement; motion seconded by Council Member Sweet. 65 To: From: Mayor and City Council Amy Bockes, City Secretary Re: City Council Meeting September 15, 2014 Date: September 12, 2014 Agenda Item: Consider and act upon a resolution designating an official newspaper of the City of Oak Point for publication of required notices for FY Description of Agenda Item: The Local Government Code, Section , requires the governing body of a municipality to contract annually with a public newspaper for the publication of its legal notices, ordinances, and other matters as required by law. The Denton Record Chronicle and the Little Elm Journal are two local newspapers available to residents of Oak Point. The Denton Record Chronicle is published daily and the Little Elm Journal is published weekly on Fridays. Both newspapers meet the requirements set forth in the Local Government Code relating to official newspapers of a municipality. Currently, the City uses the Little Elm Journal for its official publications. When designating the official newspaper, there are several items to consider. In comparing standard publication rates for notices, the Denton Record Chronicle is slightly less expensive than the Little Elm Journal. However, there is another variable to consider regarding the publication rates for ordinances. The Local Government Code states each ordinance that imposes a penalty, fine, or forfeiture shall be published in: Two (2) consecutive issues if the official newspaper is a daily paper; or One issue of the newspaper if the official newspaper is a weekly paper. Since the Denton Record Chronicle is published daily, ordinance notices must be published for two consecutive days. The Little Elm Journal is published weekly; therefore ordinance notices would only have to be published for one day. Because there is no fixed number of ordinances adopted by the City Council, the overall costs relating to publications can vary. Agenda Item No. 8 Page 1 of 2

66 Another item to consider is the local coverage provided by each newspaper. Denton Record Chronicle covers stories within the City of Denton and areas located within Denton County, including Oak Point. The Little Elm Journal primarily covers items relating to Little Elm, Lakewood Village, Oak Point, and some surrounding areas. Budget Impact: There is $1,750 budgeted in the proposed FY budget for legal publications. Legal Obligations and Review: As noted above, the Local Government Code, Section , requires the governing body of a municipality to contract annually with a public newspaper for the publication of its legal notices, ordinances, and other matters as required by law. The City Council is authorized under Section and of the Texas Transportation Code to adopt local traffic regulations governing the maximum speed of vehicles on Shahan Prairie Road. With the addition of the Wildridge development and more traffic in the area of Oak Point Elementary the developer and City staff has determined that the current speed limit on Shahan Prairie during the hours when the elementary school is in session would create and unreasonable or unsafe condition. Therefore, it is recommended to be lowered from twenty five (25) to twenty (20) miles per hour on Shahan Prairie during hours posted for the school zone. City staff communicated with the Principal, Mrs. Clark, to determine the start and end time for the schools. The school start time is 7:40 a.m. and the ending time is 2:40 p.m. Buses and students start arriving at school around 7:00 a.m. and some are coming in earlier than the buses. Oak Point Elementary would like provide enough time for the buses and kids to get in safely and have requested the school zone time in the mornings be from 7:00 a.m. until 8:00 a.m. and in the afternoons from 2:15 p.m. until 3:15 p.m. Budget Impact: Penalty amounts were set with the previous Ordinance and will remain the same the penalty for a person who violates the Ordinance will be fined upon conviction of not less than one dollar ($1.00) and not more than two hundred ($200.00). UNTIL 8:00 A.M. AND 2:15 P.M. UNTIL 3:15 P.M. ON SCHOOL DAYS; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City Council of the City of Oak Point, Texas ( City Council ) is authorized under Section of the Texas Transportation Code to establish prima facie maximum reasonable and prudent speeds within its corporate boundaries for vehicles on streets and highways; and WHEREAS, the City Council has determined that the speed limit currently applicable on Shahan Prairie Road during hours when the elementary school is in session creates an unreasonable or unsafe condition on that portion of the City s roadway system; and WHEREAS, the City Council therefore desires to establish regulations governing he maximum speed of vehicles on a portion of Shahan Prairie Road during hours when school children will be traveling to and from school, as set forth herein; and WHEREAS, the City Council hereby by finds that the adoption of this Ordinance is in the best interest of the health, safety and welfare of the citizens of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OAK POINT, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Ordinance Code of Ordinances Chapter 12 Section Chapter 12 of the Code of Ordinances, Division 2, Speed limits states that Ordinances establishing special speed limits for specific streets are not included in this code, but such ordinances are on file in the city secretary s office. Ordinances establishing special speed limits are specifically saved from repeal upon adoption of the Code of Ordinances. State law references Authority to establish or alter prima facie speed limits, V.T.C.A., Transportation Code, sec (12); authority of municipality to alter speed limits, V.T.C.A., Transportation Code, sec Code of Ordinances will not be amended. 1

71 SECTION 3: Savings/Repealing Clause: Oak Point s Code of Ordinances shall remain in full force and effect, save and except as amended by this or any other Ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed, but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinance shall remain in full force and effect. SECTION 4: Severability: Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Oak Point hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 5: Penalty Provision. Any person commits an offense if the person operates or drives any vehicle at a speed great than 20 miles per hour, this speed being the prima facie maximum speed limit; any speed in excess thereof shall be prima facie evidence that such speed is not reasonable or prudent and that it is unlawful on any of the following streets or portions thereof during posted hours of 7:00 a.m. unitl 8:00 a.m. and 2:15 p.m. until 3:15 p.m. when school zones are in effect on school days: Shahan Prairie Road from 1,953 feet east of the centerline of FM 720 to 3,503 feet east of the centerline of FM 720. A school day is defined as any day Monday through Friday when school is in session. p.m. School Zone hours are set from 7:00 a.m. until 8:00 a.m. and 2:15 p.m. until 3:15 SECTION 6: Publication Clause: The City Secretary of the City of Oak Point is hereby directed to publish in the official newspaper of the City of Oak Point, the Caption, Penalty Clause as required by Section of the Texas Local Government Code. The effective tax rate is a calculated rate that would provide the taxing unit with about the same amount of revenue it received in the year before on properties taxed in both years. If property values rise, the effective tax rate will go down and vice versa. The rollback rate is a calculated maximum rate allowed by law without voter approval. The rollback rate provides the taxing unit with about the same amount of tax revenue it spent the previous year for day to day operations, plus an extra eight (8) percent increase for those operations, in addition to sufficient funds to pay debt in the coming year. If a unit adopts a tax rate higher than the rollback rate, voters can circulate a petition calling for an election to limit the amount of the tax increase. The proposed FY budget is based on a combined tax rate of $0.573 per $100 of taxable assessed value, the same tax rate as last year. The combined tax rate consists of an interest and sinking (I&S) rate of $ and a maintenance and operations (M&O) rate of $ The combined tax rate is less than rollback rate, but more than the effective rate. Because the tax rate exceeds the effective rate, the City was required to hold two public hearings on the tax rate. The hearings were held on Monday, August 18 and Tuesday, September 2. The attached ordinance will adopt the proposed tax rate. 74 Legal Obligations and Review: Chapter 26 of the State s Tax Code requires the City Council to hold two public hearings on the proposed tax rate if the tax rate exceeds the effective or rollback rate. Because the tax rate exceeds the effective rate, the City was required to hold two public hearings on the tax rate. The hearings were held on Monday, August 18 and Tuesday, September 2. Section 26.05(b) of the Texas Tax Code requires the vote on the ordinance setting a tax rate that exceeds the effective tax rate to be a record vote and the associated motion to adopt the ordinance must also be in accordance with the form specified within the Tax Code. Because the ordinance will set a tax rate that will impose an amount of taxes to fund maintenance and operation expenditures that exceeds the amount of taxes in the preceding year, Section of the Tax Code requires the ordinance to include the following statement: "THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE." in type larger than the type used in any other portion of the document. Because the tax rate also exceeds the effective maintenance and operations rate, the ordinance also contains the following statement: "THE TAX RATE WILL EFFECTIVELY BE RAISED BY 12.52% PERCENT AND WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY APPROXIMATELY $2.85." Upon the approval of the ordinance, Section of the Tax Code also requires that the following statements be added to the home page of the City s website: THE CITY OF OAK POINT ADOPTED A TAX RATE THAT WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE; and THE TAX RATE WILL EFFECTIVELY BE RAISED BY 12.52% PERCENT AND WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY APPROXIMATELY $2.85. The taxes assessed and levied hereby are payable anytime after the approval and publication of this Ordinance and not later than January 31 st of the year following the year in which the taxes are assessed. Penalties and interest shall accrue as provided by law. However, if the entire taxes due as provided herein are paid in full by January 31 st of the year following the year in which the taxes are assessed, no penalty or interest shall be due. SECTION 4: Penalties and Interest. A delinquent tax shall incur the maximum penalty and interest authorized by law. SECTION 5: Place of Payment/Collection. Taxes are payable at the office of the Denton County Tax Assessor/Collector. The City shall have available all rights and remedies provided by law for the enforcement of the collection of taxes levied under this Ordinance. SECTION 6: Tax Roll. The tax roll, as presented to the City Council, together with any supplement thereto, is hereby accepted. SECTION 7: Rollback Taxes. All rollback taxes collected during the 2014 fiscal year shall be deposited only in the General Fund of the City of Oak Point, Texas and said funds shall not be allocated, in whole or in part, to the Debt Service fund of the City. SECTION 8: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed; but such repeal shall not abate any pending prosecution for violation of the repealed Ordinance, nor shall the repeal prevent prosecution from being commenced for any violation if occurring prior to the repeal of the Ordinance. After receiving input and direction from the City Council at the budget work session, the proposed budget was finalized. The proposed budget is based on a combined tax rate of $0.573 per $100 of taxable assessed value, the same tax rate as last year. The combined tax rate consists of an interest and sinking (I&S) rate of $ and a maintenance and operations (M&O) rate of $ The combined tax rate is less than rollback rate ($ ), but more than the effective rate ($ ). The Sinking Fund shall consist of two percent (2%) of the gross base salary due and owing the City Manager through September 30, 2015, as referenced in the Employment Agreement, or any other amount approved by the City Council. Further, the proceeds placed into the Sinking Fund for this fiscal year (FY14 15) shall be from the City s ad valorem tax and there shall be annually assessed and collected in due time, form, and manner, a direct and continuing ad valorem tax on all taxable property within the corporate limits of the City at a rate from year to year, within the limitations prescribed by law, on each one hundred dollars valuation of taxable property as will be sufficient to provide funds to satisfy any obligations under the Employment Agreement during the fiscal year. Description of Agenda Item: In February 2010, the City Council adopted Resolution No R establishing rules of order and procedure for meetings of the City Council and City boards and commissions. Section 8.1 states that the City Council will review and revise the Rules of Order and Procedure as needed, and at a minimum, every two (2) years. In 2013 the City Council updated the Rules of Order and Procedures with the following items. At the August 18, 2014 City Council meeting Council voted to place a review and potential amendment of the policy on the September 15 th agenda. The 2013 changes to the Rules of Order and Procedure be modified to formally addressed the following issues. Canvassing of Election Results Section of the Texas Election Code requires that results of an election held on the uniform election date in May be canvassed by the City Council not later than the 11th day after election day and not earlier than the later of the third day after election day; the date on which the early voting ballot board has verified and counted all provisional ballots, if a provisional ballot has been cast in the election; or the date on which all timely received ballots cast from addresses outside of the United States are counted, if a ballot to be voted by mail in the election was provided to a person outside of the United States. In the past, City staff has scheduled the canvassing ordinance for the next regular City Council meeting if the next meeting is scheduled within this time frame. If the canvassing ordinance cannot be acted on at a regular meeting within this time frame, a special meeting has been Agenda Item No. 15 Page 1 of 2

113 scheduled to act on the canvassing ordinance, administer Statements of Elected Official and Oaths of Office, and present Certificates of Election. City staff is unaware of any City ordinances or State laws that specify the order in which these items are to be placed on an agenda. City staff is proposed a revision to Section 3.1 of the Rules of Order and Procedure to address the placement of these items on a meeting agenda. Scheduling of Agenda Items Section 2.1 of the Rules of Order and Procedure states, The City Manager shall be responsible for determining the need for a meeting and preparing the meeting agenda. In addition to items of routine business that the City Manager places on the meeting agenda, each regular meeting agenda now includes the following agenda item to allow City Council members to request that topics be scheduled for discussion at future meetings. Consider and act upon topics to be scheduled for a future City Council meeting. The City Council is not permitted to take action on or engage in any discussion regarding an item not listed on the agenda. However, this agenda item provides an opportunity for any member of the City Council to propose that a topic be scheduled for a future meeting. Upon an item being proposed for discussion, the City Council will vote to determine its collective desire to schedule the item for discussion and/or action at a future meeting. A majority vote of the City Council is required to schedule an item for discussion and/or action at a future meeting. To formally document the process by which agenda items are scheduled for City Council, board, and commission meetings, this information has been added to Section 2.1 of the attached Rules of Order and Procedure. Budget Impact: None. Legal Obligations and Review: Section of the Texas Local Government Code allows the City Council to determine the rules of its proceedings.
