1 Jammu and Kashmir Legislative Assembly B U L L E T I N Tuesday, March 31, 2015 The House met at A.M in the J&K Legislative Assembly Hall, Jammu. Mr. Kavinder Gupta, Hon ble Speaker in the Chair. Note: I. At the commencement of the day s proceedings all Hon ble Members of Opposition stood up from their seats and raised the issue of loss of 16 lives allegedly at village Laden Budgam District due to the House collapse of the other day besides the losses occurred at other places in Kashmir valley due to the recent landslides /land erosion and demanded that immediate preventive measures should be taken tostop any further losses. In the meanwhile Hon ble Member Mr. Ali Mohammad Sagar, informed the House that they had already brought to the notice of the Government the House Collapses of the House where 16 persons were buried under debris, adding that their life would have been saved if timely rescue operation would have been initiated there. Hon ble Member Mian Altaf Ahmad alleged that the media had highlighted the landslide/land erosion of the said village but rescue team was not deputed for timely action there. Responding to the issue, Mr. Abdul Rehman Veeri, Hon ble Minister for Horticulture, Haj and Auqaf said that the Hon ble Members Mr. Ali Mohd. 2 in the previous Government and they are aware of the fact that the concerned Minister is able to give as much information as is provided by the officers concerned adding that the Government was not in a position to provide the exact information unless the operation would get completed, adding that the available information was given to that extent only In the meanwhile Hon ble Members Mr. Zahoor Ahmad Mir and Mr. Mushtaq Ahmad Shah stood up from their seats and demanded the Government to provide all possible assistance such as pumps and other requisite measures to meet the challenges ahead particularly at Pampore and subsequently they also staged a walkout from the House. Note: 2. In response, Syed Basharat Ahmad Bukhari, Hon ble Minister for Law, Justice and Parliamentary Affairs informed the House that the concern of Hon ble Members is equally the concern of the Government and it should be given some time to collect the latest information so that the House could be informed accordingly. Note: 3. All the Hon ble Members belonging to N.C, Congress, CPI (M) staged a walkout from the House in protest alleging that they are not satisfied with the reply of the Government. Note: 4. All the Hon ble Members of BJP also raised the issue of the damage caused to the standing crops in Jammu Province due to recent rains and hailstorm joined by the members of Ladakh region demanded the Government to access the loses on this account and compensate the effected people. MOHD AKBAR LONE called the attention of the Hon ble Minister Incharge Consumer Affairs and Public Distribution towards a matter of urgent public importance namely; the situation that has arisen due to the shortage of food grains in the valley especially flood hit areas of Sonawari Constituency. The Hon ble Minister Incharge CAPD read out reply statement. ii. MR. M. Y. TARIGAMI called the attention of the Hon ble Minister Incharge Health and Medical Education towards a matter of urgent public importance namely; the situation that has arisen due to the recent spate of deaths caused by the H1N1 influenza across the State. 5 The Hon ble Minister Incharge Health and Medical Education read out the reply statement. iii. MR. G. M. SAROORI called the attention of the Hon ble Minister Incharge Finance towards a matter of urgent public importance namely; the situation that has arisen due to the non-regularization of the casual labourers who have completed seven years service. The Hon ble Minister of State for Finance read out the reply statement. Mr. G.M Saroori staged a walkout from the House as he was not satisfied with the reply of the Hon ble Minister iv. MR. MUSHTAQ AHMAD SHAH called the attention of the Hon ble Minister Incharge Public Health Engineering towards a matter of urgent public importance namely; the situation that has arisen due to the delay in completion of filtration plant at Charsoo in Tral Constituency causing hardships to the people there. The Hon ble Minister for CAPD on behalf of Hon ble Minister for PHE, Irrigation and F.C read out a reply statement. Note: Calling attention at S.No. 5 of list Business was not taken up due to the absence of the Hon ble Member concerned: 2. BILL RETURNED BY THE GOVERNOR. Secretary Assembly read out the following message:- In pursuance of kind orders, I inform the House that the Bill Viz; The Jammu and Kashmir Reservation (Amendment) Bill,2014 (L.A Bill No. 18 of 2014) passed by both the Houses of the Legislature during the last session and presented to the Hon ble Governor, J&K State for his assent has been returned by him on 5 th January, 2015 for reconsideration of the Legislature under proviso to Section 78 of the Constitution of Jammu and Kashmir. Accordingly, the above mentioned Bill alongwith the Message is laid on the Table off the House in terms of Rule 130 of the Rules of Procedure and Conduct of Business in the Jammu and Kashmir Legislative Assembly. 6 Note: At this stage; Syed Basharat Ahmad Bukhari, Hon ble Minister made a statement in the House regarding the status of the incident of land erosion in village laden Teshil Chandoora, 3. MOTIONS FOR ELECTIONS TO COMMITTEES i. SYED BASHARAT AHMED BUKHARI, HON BLE MINISTER FOR LAW, JUSTICE AND PARLIAMENTARY AFFAIRS moved the following Motion:- That the Members of the House do elect in accordance with Rule 344 of the Rules of Procedure and Conduct of Business in the Jammu and Kashmir Legislative Assembly, eleven members to serve on the Committee on Public Accounts for the period ending 31 st March, The motion was carried by the House with voice vote. ii. SYED BASHARAT AHMED BUKHARI, HON BLE MINISTER FOR LAW, JUSTICE AND PARLIAMENTARY AFFAIRS moved the following Motion:- That the House recommends to the Legislative Council to agree to elect according to the principle of proportional representation through single transferable vote, two members from Legislative Council to associate with the Committee on Public Accounts of the House for the period ending 31 st March, 2016 and communicate to this House the names of the Members, so elected. The motion was carried by the House with voice vote iii. The motion was carried by the House with voice vote. 4. PRIVATE MEMBERS BILLS FOR INTRODUCTION (1) SYED FAROOQ AHMAD ANDRABI AND MR. 8 Jammu and Kashmir to offer higher learning in various streams. The University will be set up by utilizing the surplus funds of NGOs namely Society of Educational Assistance and Training (SEAT) and Society of Managerial Assistance Research and Technical Educational (SMART) (L.A. Private Members Bill No. 1 of 2015) Mr. Abdul Haq Khan, Hon ble Minister for RDD opposed the motion. SYED FAROOQ AHMAD ANDRABI spoke in support of his motion. Mr. Abdul Haq Khan, Hon ble Minister for RDD replied the points raised by the Hon ble Member and requested him to withdraw his Bill. The Motion was withdrawn with leave of the House. (2) Mr. Nazir Ahmad Gurezi, on behalf of MR. MOHD AKBAR LONE moved for leave to introduce The Constitution of Jammu and Kashmir (Amendment) Bill, 2015 (L.A. Private Members Bill No. 2 of 2015) Mr. Abdul Haq Khan, Hon ble Minister for RDD opposed the motion. Mr. Nazir Ahmad Gurezi spoke in support of his motion. Mr. Abdul Haq Khan, Hon ble Minister for RDD replied the points raised by the mover and requested him to with draw his Bill. The Motion was withdrawn with the leave of the House. (2) Mr. Nazir Ahmad Gurezi, on behalf of MR. MOHD AKBAR LONE moved for leave to introduce A Bill to provide for prohibiting child labour in the State (L.A. Private Members Bill No. 3 of 2015) Mr. Abdul Haq Khan, Hon ble Minister for RDD opposed the motion. Mr. Nazir Ahmad Gurezi spoke in support of his motion.
