1 Minutes of 15 th meeting of the Empowered Committee held under the Convenership of Commr/Secretary to Government, Finance Department on 24/06/2011. Subject: Regularization of Adhoc/Contractual/Consolidated employees. Reference: Jammu & Kashmir Civil Services (Special Provisions) Act, Government Order GAD-1423 of 2009 dated: 14/10/ th meeting of the Empowered Committee was held on at 12:15 PM under the Convenorship of Com/Secretary, Finance eptt. Other officers who attended the meeting are:- (i) Commr/Secretary, Member Forest Department. (ii) Director (Codes), Member Secy. Finance Department (iii) Dy. Secretary, Repr. General Administration Deptt. (iv) Dy. Director, Repr. Accounts & Treasuries. 2 9 State Forest Corporation, Jr. Asstt. 01 (Consolidated) 10 State Pollution Control Board 26 (Adhoc/Contractual) 11 Range Officers Forest (Territorial), Adhoc 07 Total: 217 Decisions of Empowered Committee: Territorial Forest (Adhoc Foresters): Since the EC has already discussed the issue with regard to DDR trained Foresters in its 10 th ECM, Forest Deptt. should accordingly proceed ahead in the case of present incumbents too and determine their eligibility vis-à-vis recruitment rules applicable. IWDP/ SFC/SPCB/ (Football players, Photo interpretation Div. Jammu): As per J&K Civil Services (Special Provisions) Act, 2010, those Adhoc/Contractual/Consolidated employees are eligible for regularization whose appointment has been made against clear vacancies. As far as the instant cases are concerned, after discussions it was found that the original appointment orders of the incumbents are not against clear vacancies. Therefore, EC advised the Forest Deptt to clarify as to whether these employees are eligible in terms of the said Act, if so then only department shall resubmit their case files to the EC for consideration. Moreover, Deptt. needs to proceed in these cases as per clause-3 (b,c &d) of the Act and decide about eligibility issues in the first instance. Social Forestry Deptt (Consolidated): All cases pertaining to Social Forestry are not covered under the provisions of the Act. Hence the case files need to be returned. State Forest Research Institute (Consolidated): Not covered under the provisions of the Act. Territorial Forest: In case of Class- IV employees, almost all the cases were found deficient to varied degrees. As such department has been advised to fulfill the deficiencies at earliest. Deficiencies have been shown against each in the Annexure. Forest Protection Force: All the three cases of Law Officers were found deficient and with unattested documents, however EC decided to

3 consider these cases provided attested documents are furnished and deficiencies fulfilled. In respect of the case of Mrs Neeru Pandita at 16, she was found eligible. However, EC advised the department to remove the deficiencies and decided to return the cases of those employees who do not complete 7 years of service at this juncture. Range Officers (Adhoc): In case of Range Officers, it was found that some of the appointees s. no. 4 to 7 have drawn HRA/MA/CCA and have even contributed towards GPF, when Adhoc employees are not entitled to these allowances during adhoc period of service. The department is advised to clarify as to how these appointees have drawn allowances and how they have contributed towards GPF. In respect of s.no. 1 to 3 department has to furnish the requisite documents as mentioned in annexure to these minutes. A/105(10)-805 Dated: Sd/- (Dr. M.
