Canap.eria (Italy). on Friday 11 May 1951, under the chairmansh. In accordance with proposals o-f* the Committee on Nominations, Mr, T.J. Brady (Irel) was elected Vice-Chairman Dr. A.L. Bravo (Chile) Rapporteur. The Committee established a Legal Sub-Committee consisting of delegates from Belgium, Egypt, France, Indonesia, India, Israel, Italy, Laos, Mexico, the Netherls, New Zeal, Saudi Arabia, Switzerl, the Union of South Africa, the United Kingdom the United States of America, referred certain items to this sub-committee,. The recommendation of the sub-committee, as adapted by the Committee on Administration, Finance Legal Matters, are embodied in the reports of the Committee,, The Committee agreed to recommend to the Four''- : "world Health Assembly the adoption of the following resolutions; 1, Report of the Director-General on Administration, Finance Legal Matters NOTES the Report of the Director-General on Administrative, Financial
2 Legal Hatters"*" 2, Financial Report Accounts fo 1/ЛЮ for 1950 the Report of the External Auditor Having examined the annual financial statement the report of the External Auditor on the audit of the accounts of the World Health Organization for the financial period 1 January to 31 December 1950, as contained in Official Records lío.34; And having 2 Executive Board ; considered the report of the Ad Hoc Committee of the ACCEPTS the report of the External Auditor. 3. Arrears of Contributions The Fourth Yiorld Health Assembly, Having considered a roport on the arrears of contributions in respect of the 1948, assessments, 1. NOTES with satisfaction that certain Members have recently liquidated their arrears in respect to those years; 2. CALLS UPON Members who are still in arrears to pay their assessed contributions promptly in entirety, in order that the full programmes of the Organization may be carried out, 3. REQUESTS the Executive Board to furnish a complete report to the Fifth World Health Assembly on any Members whose assessments to the 1 Off,Roc.V/orld Hlth Org, 30, pp, Report to be annexed (A4/33)

Working Capital Fund, NOTES the status of the Working Capital Fund the advances made from that Fund as set out in the Financial Report."^ 5, Supplemental Budget for Obligations to the United Nations (1951), Having considered the report of the Executive Board on the supplemental budget estimates for 1951 to cover the expenses of TOO for relief to the civilian population in Korea; Having considered ways means in which this supplemental budget can best be financed; Recalling that Korea is one of the countries which was eligible to receive aid from UNRRA; Noting that the Executive Board $t its seventh session authorized the Director-General to withdraw the unused balances of allotments to inactive Members of the Organization to place the entire amount in the suspense account established by the Third World Health Assembly in resolution WHA3.105, II, paragraph 4-1. APPROVES the supplemental budget for 1951 by increasing Appropriation Section 5 of Part II of the Appropriation Resolution 1 Off.Rec.World Hith Org.34, p.29
4 for the financial year 1951 (WHA3.109) in an amount not to exceed 1245,344; 2. DECIDES that the funds in the suspense account shall be used, inter alia, for financing the supplemental budget, 3. AUTHORIZES the Director-General to transfer an amount not to exceed f?245,344 from the suspense account as an addition to the other income available for the financing of the Appropriation Resolution for the financial year 1951 as amended above. Supplementary Budget for 1952 to Replace the Amount used for Assistance to Refugees in Turkey, Noting the action taken by the Executive Board at its seventh session 1 with reference to assistance to refugees in Turkey, Noting that the Board authorized the withdrawal of a sum not to exceed 155,000 from the Working Capital Fund for this purpose; Noting that the Minister of Health of Turkey announced at the second plenary meeting that the Turkish Government was voluntarily renouncing 135,000 of the 155,000 allocated; Considering that there is sufficient cash in the suspense account to replace the revised amount of ^20,000 which was withdrawn from the Working Capital Fund; Off.fiec.World Hlth.0rg. 2, 21

APPROVES the increased expenditure in 1951 for this purpose by increasing appropriation section 5, of Part II of the Appropriation Resolution for the financial year 1951^ in.the amount of #20,000; 2. AUTHORIZES the Director-General to replade this amount in the Working Capital Fund by a transfer from the cash balance of the suspense account. 7* Scale of Assessment for Korea, Viet-Nam Israel, Noting the information contained in the resolution of the Executive. 2 Board at its seventh session, RESOLVES (1) that the definite assessment of Israel for the years.1949, shall be 14 units, (2) that, subject to review in respect of future years, the scale of assessments for Korea Viet-Nam for 1952 shall be as follows: Korea 5 units Viet-Nam Proposal ef the Director-General to Improve the Financial Position, Having considered a report made by the Executive Board at its seventh session on the financial position of the Organization; 1 Off.Rec. Proposal of the Director-General to Improve the Financial Position, Having considered я report made by the Executive Board at its seventh session on thg financial position of the Organization; Notwithsting the decision of the First World Health Assembly concerning the Working Capital Fund, 1. RESOLVES to transfer the 1948 budgetary surplus from the Working Capital Fund to the suspense account established by the Third World Health Assembly; 2. REQUESTS the Director-General: (1) to meet, from the suspense account, the cash deficits for the, years resulting from the non-payment of contributions by certain Members, (2) to effect an appropriate charge against the suspense account ; it being nevertheless understood that this action will in no way relieve the Member States concerned of their obligations to the Organization in respect to their contributions; 3. RESOLVES (1) to revoke the decision of the Third World Health Assembly with respect to the establishment of a building fund by cancelling paragraphs 5* 6, 7 8 of resolution WHA3«105î (2) to authorize, by using *233>645 from the suspense account, the establishment of a building fund, which shall remain available until the completion of the building operation liquidation of all obligations, notwithsting the provisions of the Financial Regulations,
7 (3) to authorize, upon the completion liquidation of the outsting obligations, the return of any remaining balances in the suspense account; 4. RESOLVES to suspend the application of Financial Regulations 13 16(e) for 1952 future years until the financial position of the Organization is such that these surpluses can be used in accordance with the Regulations; 5. REQUESTS the Director-General to place these surpluses in the suspense account established by the Ihird World Health Assembly, to be known as the assembly Suspense Account; 6. DECIDES that the status of the Assembly Suspense Account should be reviewed by each Health Assembly, 7- DECIDES further that, notwithsting the decision of the Third World Health Assembly on the amount of the Working Capital Fund, the Working Capital Fund is hereby established at S,193, Additional Funds for the Budget of ТОЮ Considering that an increase in available funds for the budget of the World Health Organization is highly desirable in order to carry out the programme which will progressively devolve upon the Organization; Acknowledging that the setting-up of a World Health Defence Fund cannot be envisaged in the present international financial situation, REQUESTS the Director-General (1) to study the possibilities of obtaining additional funds for the budget of the World Health Organization proportionate to the essential requirements of its programme, in particular, to explore the possibility of arranging an agreement with Member States, or with some of them, for the imposition of a tax on certain products, (2) to report on this subject to a later session of the Executive Board.

Admission to Membership Associate Membership; Japan ídmits Japan as a Member of the World Health Organization, subject to the deposit of an instrument of acceptance of the Constitution in accordance with Article Admission to Membership Associate Membership: Federal Republic of Germany ADMITS the Federal Republic of Germany as a Member of the World Health Organization, subject to the deposit of an instrument of acceptance of the Constitution in accordance with Article Admission to Membership Associate Membership: Spain ADMITS Spain as a Member of the World Health Organization, subjeot to the deposit of an instrument of acceptance of the Constitution in accordance with Article Action taken by certain Governments with regard to Membership of WHO» Pol Having noted a communication from the Minister of Pol at Bern notifying the Director-General that the Republic of Pol withdraws from the World Health Organization, RESOLVES that while the World Health Organization will always welcome the resumption by that Member of full co-operation in the work of the Organization, it is not considered that any further action at this stage is desirable.

Amendments to the Rules of Procedure of the World Health Assembly ADOPTS the amendments 'additions to the Rules of Procedure of the World Health Organization as proposed by the Executive Board at its sixth session set forth in Annex 12 to Official Records No. 29, with the following additional amendments! (1) Rule 14: Insert "attendance by" after the words "be open to" in the second line 1, (2) Rule 87: Delete, (3) Rule 87 bis (new rule which will become Rule 87, with the fellowing changes); In the third line substitute "two consecutive sessions"for "three consecutive sessions"; in the sixth line delete the words "for exceptional reasons". ^This applies to the English text only
