1 UNITED NATIONS NATIONS UNIES WORLD HEALTH ORGANIZATION THIRD WORLD HEALTH ASSEMBLY COMMITTEE ON ADMINISTRATION, FINANCE AND LEGAL MATTERS ORGANISATION MONDIALE DE LA SANTÉ A3/AFL/28 23 May 1950 ORIGINAL: ENGLISH DRAFT NINTH REPORT OF THE COMMITTEE ON ADMINISTRATION, FINANCE AND LEGAL MATTERS I 1 Programme and Budget for Procedure for consideration of the Programme and Budget at the Fourth World Health Assembly The committee recommends to the Third World Health assembly that it adopt, Having reviewed the procedure adopted for the consideration of the Programme and 3udget for 1951 in the light-of the experience gained at that Assembly; REQUESTS the Executive Board to take note of the discussion in the Committee on Administration, Finance and Legal Matters on this subject and to put forward to the Fourth World Health Assembly proposals for an improved procedure, bearing in mind in particular the views expressed in the Committee as to the desirability of establishing suitable machinery, during the early part of the Assembly, (l) for a detailed examination of the budget and programme, in addition to any arrangements to be made for a review of the broad financial aspects of the programme and budget and the total amount thereof,

(-2)>-f or; adequate, consideration of legal and administrative questions 1.2 Form of Presentation of Programme and Budget Estimates The committee recommends to the Third World Health Assembly that it adopt Considering the necessity for the presentation of the annual Programme and Budget Estimates in a form specially adapted to the character and requirements of the Organization - REQUESTS the Executive Board and the Director-General to proceed, if necessary in the light of similar measures adopted by other specialized agencies, to a thorough study of modifications likely to improve the form of presentation of the annual Programme and Budget Estimates of the Organization and, if possible, to adopt such improved presentation for the year 1952 INVITES the Director-General in so far as possible to develop a uniform system of programme and budget justification for each project proposed. 1.3 Reimbursement by UNICEF to WHO for services beyond the limitations of its available resources ' The committee recommends to the Health Assembly that it adopt the following resolutions Whereas the First Tforld Health Assembly recommended the establishment by the World Health Organization and by the United Nations International Children's Emergency Fund of a Joint Committee on Health Policy to regulate the health, programmes and projects of UNICEF, and Whereas this Joint Committee on Health Policy was established and has laid dcwn principles and policies governing the co-operative relations of WHO and UNICEF, ivhich have been approved by the respective Executive Boards of WHO and UNICEF, and
3 Whereas the Second World Health Assembly approved a report submitted by the Ш0 members of the Joint Committee on Health Policy on certain aspects of these relations, and Whereas the Second World Health Assembly reaffirmed the resolution adopted by the First World Health Assembly that the health projects of UNICEF fall within the competence of the World Health Organization and that the World Health Organization is ready and willing to handle these projects, and Whereas the Director-General has submitted a statement indicating the activities' undertaken by the Organization in connexion with IVHO/UNICEF programmes, for which reimbursement is made by UNICEF The Third Yiorld Health Assembly, 1. NOTES with satisfaction the continued progress made in improving cooperation with UNICEF on the basis of the- principles adopted by the Joint Health Policy Committee at its third session; 2. APPROVES the action taken by the Director-General in accordance with the intent of paragraph 4 (c) of the Charter of UNICEF" 3 ",.in providing international health experts for the implementation of WHO/UNICEF programmes and in obtaining reimbursement from UNICEF in accordance with paragraph (e) of the principles agreed by the Joint Health Policy Committee and approved 2 by the Second World Health Assembly; 3- INSTRUCTS the Director-General to negotiate with UNICEF concerning the provision of a grant to be administered by WHO, which shall be available for appropriate expenditures incurred in connexion with positions technically approved by WHO and included in plans of operation prepared by governments which have been approved by the UNICEF Executive Board or other positions to ^ General Assembly Resolution'57 (I) of 11 December Off, Rec. 4 3/AFÍ./2Í page 4 advise governments in planning UNICEF health programmes reimbursement for which has been authorized by the UNICEF Executive Board, and that personnel assigned to such positions will be paid the same emoluments and allowances as other WHO staff members in accordance with the provisions of paragraph (e) of the Principles adopted by the Joint Health Policy Committee at its third 3 session, and approved by the Second World Health Assembly. 4. AUTHORIZES the Director-General to accept such a grant or funds and to administer it ;in accordance with the Staff and Financial Regulations of WHO; 5. REQUESTS the Director-General to continue co-operation with UNICEF on the basis of these Principles and to negotiate a written agreement to provide the implementation of this resolution and to report to the Executive Board at its sixth and seventh sessions concerning the results of such negotiations. 1.4 Appropriation resolution for the financial year 1951 The committee recommends to the Third World Health Assembly that it adopt RESOLVES to appropriate for the financial year 1951 an amount of $7,300,000 as follows; I Appropriation Section Part Is Purpose of Appropriation ORGANIZATIONAL MEETINGS Amount US$ 1. Administrative Services. 1,133,764 Total Part HI 1,133,764 TOTAL ALL PARTS. 7,300,000 ' _ _ II Amounts not exceeding the appropriations voted under paragraph I shall be available for the payment of obligations incurred during the "eriod 1 January 1951 to 31 December 1951 in accordance with the provisions of Financial Regulations 1С and 12, Notwithstanding the provisions of this paragraph the Director-General shall limit the obligations to be incurred during the financial year 1951 to the expenditure ceiling which may be established by the Executive Board or the Fourth Health Assembly. III The appropriations voted under paragraph I shall be financed by contributions from Members after deduction of the amount of $202,475 available from the UNRRA Snecial Fund and after adjustment in accordance with the provisions of Financial Regulation 16 and any modification thereof adopted by the Third World Health Assembly. 6 IV The Director-General is authorized^._with the - prior concurrence of the Executive Board or of any committee to which it may delegate appropriateauthority, to transfer credits between sections-., V Notwithstanding the provisions of Financial Régulation 13, the Director- General is authorized to transfer to the ensuing year the unexpended balance of the allotments made to countries (in accordance with the provisions of Financial Regulation 10) for Fellowships, under section 5, chapter 90, item 91. VI With respect to Operational Supplies'-provided for under section 5, f chapter 50, item 54, and with respect to Operational, Equipment provided for.. "i under section 5 5 chapter 80, item 82, the Direсtor-General shall, in consultation with the receiving governments, take steps to_ recover the depreciated value of non-expendable equipment which may be left in the country after a demonstration team completes its work and such part of the cost of expendable materials and supplies as the government's are willing to repay, which repayment may be made by governments in their own currencies. The Director-General prior to the furnishing of these services should, if possible, reach agreement in advance as to the willingness of governments to make such payments under the. provisions of this paragraph. VII With respect to Supplies for Governmental Programmes provided for under section 5, chapter 50, item 55 3 such services shall be furnished on the basis of criteria and in accordance with procedure established by the Executive Board. VIII With respect to Printing of Publications provided for under section 4, chapter 50, item.51, notwithstanding the provisions of Financial Regulations 12,' 13 and 16 the Director-Qeneral is authorized to charge to the Budget of 1951 the cost of publications' for which complete manuscripts shall have been delivered to and received by the printer prior to 31 December \
7 1.5 Appropriation resolution for the Financial Year 1950 The committee further recommends that the Third World Health-Assembly amend the I95O appropriation resolution by the addition of the following paragraph: "Notwithstanding the provisions of Financial Regulations 12, 13 and 16, the Director-General is authorized to charge to the Budget of 1950 the cost of publications for which complete manuscripts shall have been delivered to and received by the printer prior to 31 December 1950." 1.6 Suspension of Financial Regulations 13 and 16 (e) The committee recommends, to the Third World Health Assembly that it adopt " The Third World Hèalth Assembly RESOLVES, following the recommendations of the Executive Board, to suspend the application of Financial Regulations 13 and 16 (e) in regard to the unused balance of the 1949 appropriations. 2. Financial Regulations - Report of the Director-General The committee recommends to the Third World Health Assembly that it adopt the following resolution: After considering the report of the Director-General, " RESOLVES that the present Financial Regulations shall' continue in force for one more year; 4 Gff - World Hlth 0r %' 13) 311

REQUESTS the.djrector-^genepal-to-furnlsh copies of the proposed -uniform Regulations as approved by the Administrative Committee on Co-ordination to all Member States and further to provide for these to be considered by the Executive Boar'â, and reported for consideration at the Fourth Health Assembly. 3. Principles governing admission into official relations of non-governmental organizations The committee recommends to the Third World Health Assembly that it adopt the following resolution; APPROVES- the wording principles governing the admission of nongovernmental organizations into official relations with the World Health Organization as amended, with the deletion of paragraph (vii). 4. Principles.to govern.relations between WHO and regional and national nongovernmental organizations The committee reccmmeads; to the Third World Health Assembly that it adopt APPROVES the principles governing the relations between the World Health Organization and regional and national non-governmental organizations. 5 Off- Rec.
