The meeting was recessed and immediately reconvened in a closed session under Public Employee Appointment pursuant to Government Code Section (b)(1), Title: Director of Human Resources. APPROVAL OF MEETING MINUTES June 6 and 13, 2017 Motion was made by Birsan and seconded by Leone to approve the minutes of June 6 and 13, Motion passed by unanimous vote of the Council. AGREEMENT FOR PROFESSIONAL SERVICES Harris & Associates, Inc. Motion was made by Birsan and seconded by Leone to approve an Agreement for Professional Services with Harris & Associates, Inc. in the amount of $187,334 to provide design engineering and related services for the Concord BART Area Sanitary Sewer Upgrade project (Project No. 2406); authorize the City Manager to execute the agreement, subject to the approval of the City Attorney; and approve a related budget transfer in the amount of $190,000 from Sewer Capital Facility Replacement Holding Account (Project No Fund 710 Sewer Operating Funds) to the Concord BART Area Sanitary Sewer Upgrade project (Project No. 2406). Motion passed by unanimous vote of the Council. MONTH-TO-MONTH CONTRACT Contra Costa Horsemen s Association Motion was made by Birsan and seconded by Leone to approve a month-to-month contract term extension with the Contra Costa Horsemen s Association for the lease of two parcels of real property located on Grant Street. Motion passed by unanimous vote of the Council. AGREEMENT FOR PROFESSIONAL SERVICES Drake Haglan and Associates Motion was made by Birsan and seconded by Leone to approve an Agreement for Professional Services with Drake Haglan and Associates in the amount of $221, to provide construction management and related services for Farm Bureau Road Complete Streets - Phase 2, City Project No. 2354; and authorize the City Manager to execute the agreement, subject to approval of the City Attorney. Motion passed by unanimous vote of the Council. STREAMBED ALTERATION AGREEMENT California Department of Fish and Wildlife Motion was made by Birsan and seconded by Leone to approve Streambed Alteration Agreement Notification No R3 with California Department of Fish and Wildlife, which requires a $1,500 application fee; and authorize the Director of Public Works to execute the 2 Page 2 of 12

RESOLUTON NO State AB 109 Funds Motion was made by Birsan and seconded by Leone to adopt Resolution No entitled, A Resolution Authorizing a Contract with Contra Costa County Accepting and Appropriating State AB 109 Funds in the Amount of $135,720 to Partially Offset the Cost of One Police Officer to Provide Coordinated Support of AB 109 Law Enforcement Activities, and Authorizing and Directing the City Manager to Execute the Related Contract between the City of Concord and Contra Costa County. Motion passed by unanimous vote of the Council. RESOLUTION NO Consolidated Annual Performance Evaluation Report (CAPER) Motion was made by Birsan and seconded by Leone to adopt Resolution No entitled, A Resolution Approving the Fiscal Year Consolidated Annual Performance and Evaluation Report (CAPER); and Authorizing the City Manager or Designee to Submit on Behalf of the City of Concord, the CAPER, Consistent with the Program Rules which Govern the Community Development Block Grant Program as Required by the U.S. Department of Housing and Urban Development. Motion passed by unanimous vote of the Council. ORDINANCE NO Wireless Communication Facilities Motion was made by Birsan and seconded by Leone to adopted Ordinance entitled, An Ordinance to Repeal and Replace Development Code Chapter , Add Chapter , and Amending other Sections of the Development Code and the Municipal Code, in Connection with Wireless Communication Facilities. Ordinance was introduced on September 5, 2017, by reading of the title only and waiving further reading. Motion passed by unanimous vote of the Council. RESOLUTION NO Inclusive, Tolerant and Supportive Community This item was pulled from the Consent Calendar by Mayor Hoffmeister. Mayor Hoffmeister summarized the resolution stating that the resolution was a collaborative effort that reaffirms the practices and policies of the City of Concord to be an inclusive, tolerant, and supportive community for all. Mayor Hoffmeister opened a public comment period. Motion passed by unanimous vote of the Council. Mayor Hoffmeister called for a five-minute recess at 8:15 p.m. The meeting reconvened at 8:25 p.m. CONCORD TOURISM IMPROVEMENT DISTRICT Levy and Collection of Assessments Economic Development Manager John Montagh made a presentation regarding the Concord Tourism Improvement District (CTID) and noted the second step in the process of renewing the CTID for a 10 year period was to receive public testimony. He reported that the process for renewing the CTID was initiated at the City Council s September 5, 2017, meeting and a decision for renewing the CTID will be considered at the City Council s October 24, 2017, meeting as a public hearing item. Following questions from the Council, Mayor Hoffmeister opened a public comment period, and upon receiving no public comment, closed the public comment period. RESOLUTION NO Amending the Capital Budget City Engineer Robert Ovadia made a presentation regarding the Road Repair and Accountability Act of 2017 (Senate Bill 1), which was passed as a means of providing additional funding for basic road maintenance, rehabilitation, and critical safety needs on both state highways and local streets and road system. Mr. Ovadia noted the Act requires the City to submit to the California Transportation Commission a list of projects proposed to be funded by Road Repair and Accountability Act funds. 4 Page 4 of 12

5 City Council Minutes September 26, 2017 Mr. Ovadia stated that the Council was being asked to adopt Resolution No to amend the Capital Budget to incorporate two projects to be funded by the Road Repair and Accountability Act funds. He noted the two projects were Diamond Boulevard Pavement Rehabilitation Project (Project No. 2422) and Oak Grove Road Pavement Rehabilitation Phase II (Project No. 2423). period. Following questions from the Council, Mayor Hoffmeister opened a public comment George Fulmore, Concord, spoke in appreciation of the efforts to study the streets in the City and spoke in support of the Oak Grove Road project. Mayor Hoffmeister closed the public comment period. Following discussion from the Council, a motion was made by Birsan and seconded by McGallian to adopt Resolution No entitled, A Resolution Amending the Capital Budget to Incorporate a List of Projects Funded by SB 1: The Road Repair and Accountability Act and Appropriating the Funds. Motion passed by unanimous vote of the Council. APPOINTMENTS Community Services Commission, Concord/Pleasant Hill Health Care District Grant Committee, and Concord Pavilion Community Outreach Committee Motion made Obringer and seconded by Birsan to appoint to the Community Services Commission Ciel Gierke for a two-year term expiring June 20, 2019, and Robert Ferrier, Stephen Siptroth, Michael Koby and Rodalyn Guinto for four-year terms expiring June 30, Mayor Hoffmeister opened a public comment period, and upon receiving no public comment, closed the public comment period. Motion passed by unanimous vote of the Council. Motion made by Obringer and seconded by Birsan to appoint to the Concord/Pleasant Hill Health Care District Grant Committee Marshall Lewis and Norbert Schuff to two-year terms expiring June 30, 2019, and Lori Thompson and Sara Guillermo to four-year terms expiring June 30, Mayor Hoffmeister opened a public comment period, and upon receiving no public comment, closed the public comment period. Alejandra Plascencia & William Colin, Central County Regional Group, invited the Council and public to the playground celebrations, co-hosted with the City, at Meadow Homes Park and Ellis Lake Park on Saturday, October 7, starting at 10 a.m., at Meadow Homes Park. 9 City Council Minutes October 3, 2017 CONSIDERATION ITEMS RESOLUTION NO Pilot Program to allow the use of Autonomous Robots Economic Development Specialist Pedro Garcia presented a report outlining the creation of a pilot program to allow the use of autonomous robots, also known as Personal Delivery Devices (PDD), for a period of 24 months, for up to 12 PDDS with a service area of at least three square miles in and around downtown Concord. He stated that Marble Robotics planned to partner with their current retail/restaurant partners such as Yelp s Eat 24 and directly work with other local businesses to primarily focus on the delivery of food and parcels. Following questions by the Council, Vice Mayor Birsan opened a public comment period, and upon receiving no public comment, closed the public comment period. Following discussion by the Council, a motion was made by Leone and seconded by McGallian to adopt Resolution No entitled, A Resolution Authorizing the City Manager to Issue a Personal Delivery Devices (PDD) Encroachment Permit to Marble Robotics for the Intended Use of a Pilot Program Allowing the Use of the Autonomous Robots for Delivery of Goods in Downtown Concord. Motion passed by the following vote of the Council: AYES: Leone, McGallian, Obringer, Birsan NOES: None ABSENT: Hoffmeister NEGOTIATED SALE PROCESS WITH THE US COAST GUARD TO TRANSFER A 58-ACRE SITE Economic Development Manager John Montagh presented a report outlining the approximately 328 uninhabitable multi-family units formerly used to house enlisted personnel on the 58 acres of US Coast Guard (USCG) property along Olivera Road. Mr. Montagh provided a history of conversations with the USCG, starting in 2014 when the USCG contacted City staff to discuss disposing of the property through a negotiated sale, and the City reached out to developers regarding the opportunity to partner with the City. In September of 2015, the USCG informed the City staff that it decided to evaluate whether or not to retain the Property. In mid- 2017, City staff was informed the USCG had confirmed its desire to dispose of the Property. On May 19, 2017, the City Manager provided a letter to the General Services Administration (GSA) indicating the City s interest in participating in the negotiated sale process. Mr. Montagh conveyed that on July 24, 2017, the Council s Housing and Economic Development (HED) Committee heard a report from staff and recommended that the City move forward with a negotiated sale with one of the four developers identified earlier in the process. The developers are: Bridge Housing, DeNova Homes/ROEM, Integral Housing/EAH Housing, and USA Properties Fund/Foundation for Affordable Housing/Eden Housing. Manager Montagh outlined next steps and suggested a selection process through a Request for Proposal, which would have input from the HED Committee, and then the full Council. After the process is approved, staff would release the RFP to either the identified four developers, or more broadly should the Council decide to open the process up to all interested firms. Following questions by the Council, Vice Mayor Birsan opened a public comment period. Trent Sanson, DeNova Homes, thanked the Council for the opportunity, conveyed their excitement with being part of the project, and encouraged the Council to continue with the process already started and give the four firms the opportunity to refresh their proposals. Daryl Bergman, Concord, spoke of her concern over having too much extremely lowincome housing in one area. 3 Page 9 of 12

10 City Council Minutes October 3, 2017 Mark Butler, Integral Communities, introduced his firm and provided a background on his firm to the Council. Dave Egan, EAH Housing, introduced his firm and provided a background on his firm to the Council. Andy Madeira, Eden Housing, encouraged the Council to continue with the process already started and give the four firms the opportunity to refresh their proposals. Steven Gall, USA Properties Fund, stated that he was proud to be working with Eden Housing on the project and provided a background on his company. Tim Carr, Concord, suggested opening up an RFP process so Lennar could apply for consistency throughout the CNWS Project and the US Coast Guard Site Project, and spoke of increased traffic on Olivera Road. George Fulmore, Concord, spoke of the project having both market-rate and affordable housing. Vice Mayor Birsan closed the public comment period. Motion was made by Leone and seconded by Obringer to approve moving forward with a negotiated sale process for the 58-acre US Coast Guard property and initiate a competitive proposal process with the four developer teams identified by staff in 2014: Bridge Housing; DeNova Homes/ROEM; Integral Housing/EAH Housing; and USA Properties Fund/Foundation for Affordable Housing/Eden Housing; return to the Housing and Economic Development Committee to review the four proposals and bring a recommendation to the full Council. Flyer for 200 th Anniversary of the Birth of Baha u llah Celebration CLOSED SESSION REPORTS none COUNCIL AND STAFF REPORTS City Manager Valerie Barone spoke of recent concerns received by Council and staff from residents at Shamrock Condominiums regarding homeless entering the property and loitering, potential illegal activity at certain units, and insufficient parking. She noted the Police Department conducted numerous site visits to this location to evaluate these concerns, and Chief 4 Page 10 of 12

11 City Council Minutes October 3, 2017 Swanger met with the members of the homeowners association where he suggested some opportunities the association could undertake to increase security and discussed how to manage onsite parking. As a follow up, staff is evaluating the installation of angled parking rather than parallel parking on the road. PUBLIC COMMENT George Fulmore, Concord, spoke of informal and formal gatherings in the parks and suggested posting signing at gathering sites in both English and Spanish stating that the sites can be reserved. He suggested a shuttle to and from the Monument to help alleviate parking issues. David Martinez, Concord, spoke of informal and formal gatherings in the parks and requested that music be allowed for gatherings in the parks.
