1 CITY OF MUNROE FALLS CITY COUNCIL MEETING MINUTES TUESDAY, JULY 15, 2014 Opening: Mr. lona called the meeting to order at 7:00 PM. Pledge of Allegiance: Mr. Hegnauer led Council in the Pledge of Allegiance. Roll Call: Members of Council present: Steve Stahl, John Hegnauer, Mike Barnes, Bob Pitz, Jim lona, Gary Toth, and Sam Busic. Also Present: Law Director Jack Morrison, Jr.; Finance Director David P. Bailey; Service Director James Bowery. Approval of Minutes: Mr. Toth moved and Mr. Stahl seconded the motion to approve the minutes from the July 1, 2014 Regular Council Meeting. Roll call was taken and the motion passed unanimously. REPORT OF OFFICIALS Mayor s Report: Mayor Larson is currently on vacation. Mr. lona presented the Mayor s Report, noting that the Mayor has been in constant communication with City Hall officials and members of Council. Mr. lona presented Mulberry Gardens Gracious Retirement & Assisted Living, 395 South Main Street, with July s Business of the Month Certificate of Recognition award. o Maryann Ervin, Administrator for Mulberry Gardens, said they are grateful to receive this award especially since this is their tenth year of operation in the community. Ms. Ervin indicated the residents of Mulberry Gardens were also delighted to be recognized by the City. Mr. lona was pleased to announce the City of Munroe Falls has once again proclaimed August 2014 Summit Kids Month, in recognition of the importance of early childhood care, education, health, behavioral health, family support, special needs and early intervention. Mr. Stahl noted the actual Summit for Kids Day program will be held on August 2, 2014 at the John S. Knight Center from 10:00AM to 4:00 PM. o Jill Skapin, Director of Communications for Summit County Executive Russell M. Pry, explained during the month of August, Summit County wants to shine a bright spotlight on the importance of health and education for all children and encouraged the community to become involved. Ms. Skapin stated the owner of the Munroe Falls McDonald s, Sal Baglieri, was the first phone call they received five years ago regarding this program and it was Mr. Baglieri who generously bought a $500, mobile van which provides dental services to children, three to six years of age, in the community. Mr. lona asked Service Director Jim Bowery to give Council an update on the North River Road project: o Mr. Bowery indicated he has been in contact with Sheila Rayman, City of Stow Assistant Engineer, regarding North River Road and will be meeting with her on either July 17th or July 18th. Mr. Bowery explained they will be discussing the verification of the pipe size calculations and the design drawings/recommendations for the Munroe Falls side of the roadway. o Mr. Bowery informed Council that on July 10, 2014 Bill Zawiski from the Ohio EPA sent a letter to the City of Munroe Falls and City of Stow regarding the Cuyahoga River Tributary North River Road. A stream evaluation was conducted upstream of the road culvert by Mr. Zawiski on July 7, 2014 and he made several observations/recommendations: The pipe at North River Road cannot adequately convey flow downstream. The City needs to continue to work on getting a consultant on board to examine stream hydraulics in greater detail. 2 While the pipe is undersized, Mr. Zawiski does not want to see the storage capacity in the riparian zone diminished through construction of a larger conveyance. Storage and flow must be taken into consideration in any engineering design. Consider evaluation of the road itself to serve as an overflow during very high stream flows. Mr. Zawiski recommends a partnership with Stow to jointly work on watershed issues, including resident education and outreach; it would also be considered part of compliance with the City s stormwater requirements. Evaluate possible areas in the watershed to expand floodplain and/or create off-channel storage. o Mr. Bowery explained the City received a cost estimate and a useful life estimate for North River Road for pre-storm repairs from Hammontree & Associates at just under $85,000. o According to Mr. Bowery, the application to request emergency funding was submitted on July 15, 2014 to the Ohio Public Works Commission. o Mr. Bowery said the City may require an increase of expenditures for North River Road repairs in addition to Council s approval of $75, based on: The current engineer s estimate of $85,000. Failure to receive any emergency fund reimbursement from the State of Ohio. Possible increase in expenditures based on the City of Stow Engineering Department s recommendations. o According to Mr. Bowery, the City has received engineering quotes from the following companies: GPD Group Environmental Design Group Possible quote/inquiry with Hammontree & Associates O Law Director (Jack Morrison. President of Council (Jim lona): Mr. lona confirmed he received the City of Munroe Falls Certificate of Estimated Property Tax Revenue Statement from Summit County on July 15, Motion to Council: Mr. Busic motioned and Mr. Stahl seconded the motion to accept the Certificate of Estimated Property Tax Revenue Statement. Roll call was taken and the motion passed unanimously. Next Regular Council meeting is scheduled for Tuesday, August 5, 2014 at 7:00 PM. Director of Finance (David Bailey): The State of Ohio Auditor s Office will be at City Hall during the next several weeks completing a review of the GAAP Report. Discussions followed on Resolution (A resolution declaring intent to proceed with election on the question of a tax in excess of the ten-mill limitation for Police, Fire, and Safety Forces purposes, and declaring an emergency). o Mr. Toth acknowledged the Debt Service Levy of 1.93 mills and the General Service Levy of 2.4 mills end soon. o Mr. Hegnauer recommended information regarding the levy be placed on the City s website so residents can make an informed decision on Election Day. o Mr. Bailey acknowledged the levy would need to be renewed in five years. 3 o Mr. Toth affirmed the levy is earmarking money that will be for Safety Forces (Police, Fire), and Safety Forces purposes. Service Director (Jim Bowery ): Mr. Bowery indicated the City continues to accept applications for the position of Public Works Laborer in the Service Department until at 4:30 PM. The Civil Service Commission will review all applications and will submit an eligibility list to the City in the coming weeks. According to Service Director Bowery, team members are responding to road, water, and stormwater maintenance projects, servicing City vehicles, and are following up on Zoning requests and violations. Police Chief (Thomas Pozza): Mr. Barnes noted Officers are patrolling the City, responding to calls for service, and assisting residents. Fire Chief (Lee Chafin): According to Mr. Barnes, Fire Department personnel are responding to Fire and EMS calls as well as providing necessary assistance and support within the community. REPORTS OF COMMITTEES Q CommunitylEconomic Development Committee (as reported by Chairman Jim lona): Mr. lona attended the Stow-Munroe Falls Chamber of Commerce monthly meeting on July 15, Jon Lucas, President of the Northfield Hard Rock Rocksino, was a presenter during this event. Mr. Lucas indicated they donated employee $100, over 800 to local team charities. members and during a recent preview to the grand opening night, the Rocksino The John S. Knight Foundation will host a breakfast for former University of Akron President Luis Proenza on August 5, The Kent State University 2014 Aviation Heritage Fair is Sunday, September 13, 2014 at the Kent State Airport. The City of Tallmadge s Circle Festival and Light Parade is Saturday, August 16, 2014 from 5:00 to 11:00 PM. Next Community/Economic Development meeting will be Tuesday, August 12, 2014 at 6:30 PM. FinancelAudit Committee (as reported by Chairman Gary Toth): The Finance/Audit Committee met earlier in the evening. There were no Check Registers to review. The Committee reviewed all of the end of the month financial statements for June 2014 including: Bank Reconciliation General Fund Revenue Budget Statement Mayors Court YTD Police Academy Profit and Loss Statement (8 Paid Applicants) Cash and Investments (nothing maturing until October 2014) Summary Report for the K-9 Unit (fundraiser held in June 2014), Lehner Community Center and Guise Park Lodge Mr. Toth ackno Medged receipt of the Revenue and Expenditure jail Funds Detail Reports dated June 30, Res. # (A resolution declaring the necessity to access the cost of street lighting within the City of Munroe Falls) is up for a second reading this evening. This resolution will go for three readings. Res. # (A resolution declaring intent to proceed with election on the question of a tax in excess of the ten-mill limitation for Police, Fire, and Safety Forces purposes, and declaring an emergency) has been discussed in length this evening and is up for first reading. According to Mr. Toth, the resolution needs to have emergency passage this evening. 4 Motion to Council: Mr. Toth moved and Mr. Stahl seconded the motion to approve the June 30, 2014 Bank Reconciliation Statement. Roll call was taken and the motion passed unanimously. Next Finance? Audit Committee meeting will be Tuesday, August 5, 2014 at 6:30 PM. General Government Services (as reported by Chairman John Hegnauer ): The General Government Services Committee met on July 8, Service Director Bowery gave an update on the progress being made on North River Road earlier in the evening and once he meets with the City of Stow, Mr. Hegnauer stated additional information will be provided to Munroe Falls City Council. Mr. Hegnauer noted the retaining wall on North River Road is scheduled to be repaired on July 24, According to Mr. Hegnauer, the sidewalk in front of the church on North River Road will be repaired by a private contractor. Service Director Bowery confirmed the City will remove the old sidewalk for the church and the City will use the concrete from the sidewalk for ditch restoration in the area. Next General Government Services meeting will be Tuesday, August 12, 2014 at 6:30 PM. Public Safety (as reported by Chairman Barnes): The Public Safety Committee met on July 8, Mr. Barnes confirmed total incidents are down by 8% in the Fire Department for The Fire Department s EMS will be receiving a grant from the Ohio State Highway Patrol (Seatbelt Fine Program) of approximately $2, Patrol Officer Trexler tendered his resignation from the Police Department effective July 18, Mr. Barnes informed Council that Chief Pozza will be interviewing perspective candidates to fill Officer Trexler s position in the coming weeks. o Mr. Stahl thanked Officer Trexler for his services and acknowledged that he will be missed in the community. He also noted Officer Trexler was the only Officer in Munroe Falls to be named Top Cop by the Summit County Prosecutor s Office. Mr. Barnes noted one defendant was arrested for possession of bath salts. According to Mr. Barnes, team members in the Detective Bureau are currently working one active case. The mobile data terminal units (MDT s) the City received from Summit County will be installed in two police cruisers the week of July 14, Next Public Safety meeting will be Tuesday, August 12, 2014 at 6:30 PM. Planning Commission (as report by Chairman Bob Pitz): Mr. Pitz confirmed two Applicants will appear before the Planning Commission on Tuesday, July 22, 2014: o PC : Gary Miller (Miller Garage Door Company). Mr. Miller is seeking to add onto an existing garage at 90 Carmia Road. o PC : Eva James. Ms. James is seeking to add a 12 x 18 addition onto the residence at 277 Game Drive. Next Planning Commission meeting will be Tuesday, July 22, 2014 at 7:00 PM. Parks & Recreation (as reported by Chairman Sam Busic): The Parks Board Committee met on Wednesday, July 9, 2014 at the Lehner Community Center. Ice Cream Social is Sunday, July 20, 2014 from 4:00-7:00 PM. 5 event. Additionally, musical entertainment will be provided along with a bounce house, inflatable obstacle course and game trailer for the youngsters. Guardians Advocating Child Safety and Prevention (GASP) will also be on hand to fingerprint children. Mr. Busic said the Committee is reviewing the possibility of increasing the rental rate at the Lehner Community Center. The Parks Board Committee is gathering additional documentation from other municipalities and will provide further information at an upcoming Council meeting. The Committee is reviewing the possibility of having a food truck event at the Summit Metro Parks at 521 South River Road in Next Parks & Recreation Board meeting will be Thursday, August 7, 2014 (subject to change) at 7:00 PM at the Lehner Community Center. Persons to Appear Before Council at Large: John Welfley, 448 Hiwood Avenue, Munroe Falls, Ohio: o Mr. Welfley asked for an update on the progress being made by the City to catch the water that is coming down the streets and wanted to know if the City had received any cost estimates to replace the existing inlets. Mr. Stahl explained that the City had received tentative estimates of approximately $6000 each to replace the catch basins on Hiwood Avenue. Mr. lona informed Mr. Welfley the City cannot replace every catch basin at one time due to the cost; however, the City would like to replace a couple of catch basins each year. o Mr. Welfley reported he is extremely upset and stressed he cannot use his basement, cannot sell his house, and cannot do a thing with his home because of the water issues in the area. Mr. Stahl and Mr. lona both informed Mr. Welfley the City understands his concerns. Mr. Stahl agreed with Mr. Welfley the City needs to come up with a solution. Mr. lona noted the City is waiting on the EPA s report which is due in late September/early October 2014 and the City is also looking for additional money and grants that can help the City update their infrastructure challenges. Bill Neitz, 521 Riverdale Circle, Munroe Falls, Ohio: o Mr. Neitz stated he is trying to get a clear understanding on Res. # (A resolution declaring intent to proceed with election on the question of a tax in excess of the ten-mill limitation for Police, Fire, and Safety Forces purposes, and declaring an emergency) and indicated we are in a cloud of smoke with the levy. Discussion followed regarding the verbiage in the Resolution. Mr. Stahl explained to Mr. Neitz the levy is only for 4-mills. o Mr. Neitz expressed the City of Munroe Falls has a wonderful Police Department and Fire Department; however, the City is currently funding the Fire Department and EMS strictly for salaries. He said in the 20 years the City has had the other levy, those funds were never used to fund the Fire Department or Police Department. Having said that, Mr. Neitz indicated the City has been able to keep services above par. Mr. Neitz explained the Service Department needs $400, in a five year millage. Mr. Neitz said he believes a levy is needed but thinks the City is going down the wrong avenue. Mr. Toth motioned and Mr. Busic seconded the motion to suspend the rules and omit all further readings of Res. # RoIl call was taken and the motion passed unanimously. Mr. Toth motioned and Mr. Barnes seconded the motion to adopt Res. # motion passed unanimously. Roll call was taken and the Resolutions for 2nd Reading: Res. # : A RESOLUTION DECLARING THE NECESSITY TO ASSESS THE COST OF STREET LIGHTING WITHIN THE CITY OF MUNROE FALLS. Resolutions for 3rd Reading: Old Business: None New Business: Mr. Stahl reported on July 8, 2014 he attended the Kent State University Airport Master Plan community meeting. He said Kent State University has owned the airport since 1942 and uses the facility to support its Aeronautics Program. In 2006, university leaders anticipated the most common plane to be utilized at the airport would have been a business jet; however, in 2014 they realized they were not going to be that type of facility and switched to using a Cessna plane for their flight training school. Mr. Stahl explained the committee is not proposing to expand or widen the runway but recommended they meet with the City of Munroe Falls when the topic of a retention basin and drainage system was discussed.
