1 REGULAR MEETING February 20, 2018 The Common Council of the City of Michigan City, Indiana, met in Regular session on Tuesday evening, February 20, 2018 at the hour of 6:30 p.m., local time in the Common Council Chambers, located in the lower level of the City Hall Building, 100 East Michigan Boulevard, Michigan City, Indiana. The meeting was called to order at 6:30 p.m. by Council President Przybylinski. Roll call was authorized and the following were noted present and/or absent. PRESENT: COUNCIL MEMBERS Tim Bietry, Pat Boy, Sharon Carnes, Bryant Dabney, Ron Hamilton, Don Przybylinski, Candice Silvas, Gene Simmons and Johnny Stimley (9). ABSENT: COUNCIL MEMBERS None (0). A QUORUM WAS NOTED PRESENT ALSO PRESENT: Jim Meyer Council Attorney, City Clerk Gale Neulieb and Deputy Clerk Kim Sliwa APPROVAL OF MINUTES President Przybylinski inquired whether there were any corrections, deletions, or additions to the minutes of the Regular Meeting of February 6, Councilman Hamilton made a motion to approve the Regular meeting minutes held on February 6, 2018; second by Councilman Hamilton. The minutes were approved as printed. REPORTS OF STANDING COMMITTEES Councilman Bietry presented the following Finance Committee meeting minutes: Finance Committee Meeting Tuesday, February 13, 2018 Present: Chairman Tim Bietry, Committee Members Don Przybylinski and Bryant Dabney, Councilman Gene Simmons, and Asst. Chief of Police Royce Williams. The Committee was called to order at 5:00 p.m. by Chairman Bietry. The purpose of the meeting was to discuss a request for an additional appropriation in the budget of the Riverboat Fund for the purchase of Tasers for the Michigan City Police Department. Asst. Chief Williams discussed the background for the request. The police department currently has 22 X-2 Tasers in operation. They were approved for an additional 30 for this year to help phase out the older model X-26. However, the vendor failed to disclose to Asst. Chief Williams last year that the X-26 model is no longer being serviced and is considered obsolete with no replacement parts available. The older model X-26 has been in service for more than 5 years and is beyond the Useful Life Recommendations of its manufacturer, placing officers at risk bodily and legally. Accordingly, the additional appropriation would provide an additional 31 X-2 model Tasers which would bring the full complement of Tasers to 83, equal to our current manpower figure. The warranty program will also provide for free replacement of the 61 Tasers at the end of the five year Useful Life period. Committee Member Przybylinski moved to recommend support for the request, seconded by Committee Member Dabney. The vote in favor was unanimous. 2 Page 2 February 6, 2018 Councilman Bietry presented the following Finance Committee meeting minutes: The Finance Committee was called to order this evening at 6:05 p.m. by Chairman Bietry to review the claims filed since the February 6, 2018 meeting. Committee members Bietry and Dabney were present as well as Council members Simmons and Carnes, and Controller Richard Murphy. Claims reviewed totaled $46, from the Boyd Development Fund and $219, from the Riverboat Fund for a total of $265, There were no outstanding issues to discuss. Councilman Dabney moved to recommend payment of the claims, seconded by Councilman Bietry. Approval was unanimous. The meeting was adjourned at 6:07 p.m. The summary of claims was as follows: From the Boyd Fund: $ to the News Dispatch for various postings and notices $3, to Butler, Fairman and Seufert for staking and Right of Way Services for the Singing Sands Lighthouse Trail $ to Chicago South Shore Freight Railroad for engineering services for the Singing Sands Trail $7, to Ideas in Motion for ad placement $33, to Kendig Keast Collaborative for data collection and consulting services for the Comprehensive Plan From the Riverboat Fund: $122, to Butler, Fairman and Seufert for architectural, and engineering services for the Hwy 20 project adjacent to the municipal airport $23, to Haas & Associates for sidewalk engineering and resurfacing services $ to James Meyer & Associates for legal services $72, to MiMH Enterprises for repairs to the Old Lighthouse Museum President Przybylinski asked if there were any other Standing Committee Reports; there was no response. REPORTS OF SPECIAL OR SELECT COMMITTEES President Przybylinski asked if there were any reports of special or select committees; there was no response. REPORTS of OTHER CITY OFFICERS and DEPARTMENT President Przybylinski asked if there were any reports of Other City Officers and Departments. Ron Miller, President, Community Enrichment Corporation, addressed the Council giving a brief update; commenting on an upcoming appointment to the Community Enrichment Corporation and their current member, Jack VanEtten; asking the Council to support him; commenting on the upcoming banquet where they will award the grants; advising the Council that this would be his last year with the Community Enrichment Corporation and that he has appreciated the support from the Council over the past six (6) years. President Przybylinski thanked Mr. Miller for his hard work; also, thanking the members of the Community Enrichment Corporation for all their hard work. President Przybylinski introduced Chief Mark Swistek, Michigan City Police Department.

3 Page 3 February 6, 2018 Chief Mark Swistek, Michigan City Police Department, addressed the Council presenting the 2017 Crime Report; thanking the Council for their continued support of the officers of the Michigan City Police Department, the Mayor and his administration, Chief of Services, Royce Williams, Chief of Operations, Kevin Urbanczyk and all of his officers. Discussion ensued between Chief Swistek and Councilmembers Simmons, Bietry, Boy and Przybylinski regarding M.O.U. s to provide services to other communities; clarification that the equipment provided to the officers not only keeping them safe, but also keeping the citizens safe; and thank you s to the men and women of the Michigan City Police Department; and community involvement. Chief Swistek stated they are currently under contract with the Town of Pottawattomie; also providing an officer to the M.C.A.S. and an officer to the Internet Crimes Against Children for the LaPorte County Prosecuting Attorney s Office. President Przybylinski asked if there were any other reports of Other City Officers and Departments; there was no response. CLAIM DOCKETS President Przybylinski stated the Claims for Fund #2042 Riverboat is $219, and Fund #2031 Boyd Development $46, President Przybylinski asked if there were any comments and hearing none, a motion was made by Councilman Bietry, second by Councilman Hamilton and approved. Motion carried 9 0. PETITIONS There were no petitions received. COMMUNICATIONS There were no communications received. RESOLUTIONS The Clerk read the following proposed resolution by title only, MICHIGAN CITY COMMON COUNCIL RESOLUTION NO RECOGNIZING THE ESSENTIAL ROLE OF WOMEN IN HISTORY DURING WOMEN S HISTORY MONTH WHEREAS, 88 percent of women in the United States between the ages of 25 and 29 have obtained high school diplomas and 31 percent of that same population have earned bachelor's degrees, outpacing men in the same age group, yet according to the American Association of University Women (AAUW), Hoosier women make only 74% of what their male counterparts make for the same work, a gender gap worse for women in Indiana than in 45 other states; and

4 Page 4 February 6, 2018 WHEREAS, The World Economic Forum predicts the gender gap won't close entirely until years more than previous estimates; and WHEREAS, while the 19th Amendment to the U.S. Constitution was passed by Congress on June 4, 1919 and was ratified by the States on August 18, 1920, a US Supreme Court decision was needed to ensure that women could vote throughout the Country, and 95 years ago, on February 27, 1922, the US Supreme Court upheld the 19th Amendment, which guaranteed the right to vote could not be denied based on sex, and Leser v. Garnett ensured that no matter what any state constitution said, women could vote; and WHEREAS, American women were leaders in securing their own rights of suffrage and equal opportunity, but were also leaders in the abolitionist movement, the emancipation movement, the industrial labor movement, the civil rights movement, and other movements especially the peace movement helping to create a fairer and more just society for all; and WHEREAS, a few of the many notable women and firsts include: Carrie Chapman Catt, who served as president of the National American Woman Suffrage Association (NAWSA) , and again from 1915 through the passage of the Nineteenth Amendment in 1920; and Alice Paul, who broke away from the NAWSA and founded the National Woman's Party (NWP) in 1917, organized the first picket of the White House in January 1917, where suffragettes with banners stood at the gates on and off throughout the year; and Alice Hamilton, who in 1918 became the first, and for many years, the only woman on the Harvard faculty. While teaching pathology at Northwestern University, she came to know Jane Addams and other reformers who encouraged her to find a way to apply her scientific knowledge to social problems. As an assistant professor of industrial medicine, she conducted pioneering research of industrial disease helping to promote safety in the American workplace; and Dr. Mae Jemison, who was the first African American woman in space, worked as the Area Peace Corps Medical Officer, managing the health care system for Sierra Leone and Liberia in West Africa. She was selected by NASA for the astronaut program and in 1992, was selected as the science mission specialist for an eight-day mission on board the Endeavour, logging over 190 hours in space; and Sheila Brillson, who was an educator and the first woman Mayor of Michigan City, serving She developed the Michigan City Community Enrichment Corporation which distributes over 600 thousand dollars worth of grants yearly to nonprofits across the Michigan City Area School District, co-founded the Michigan City Economic Development Corporation, and developed the Safe Harbor After School program for learning and talent development for students K-9; and Evelyn Baker, who was the first woman elected to serve on the Michigan City Common Council, she held office continuously for 32 years and was instrumental in securing the needed funds for the creation of the Michigan City Senior Center in the late 1990s; and Gale Neulieb, who was the first woman elected to serve as City Clerk for the City of Michigan City; and State Senator Anita Bowser of Michigan City, who was the first woman to act as a House Speaker (Deputy Speaker Pro Tempore) in the history of the State. She was also a founding member of and the first female teacher at Purdue University North Central; and Becky Williams, who was a Michigan City resident, child advocacy proponent, founder and executive director of H.O.P.E. (Helping Our People Excel). She worked tirelessly to help young people succeed; and Hazel Thomas, who was one of the first graduates of Ivy Tech School of Practical Nursing in Michigan City, practiced nursing at Memorial Hospital for 34 years; but is best remembered for her resilient persistence to the commitment she made to serve the community through volunteer services and political action; and Asst. Chief Mary Sue Yadavia, who was the first and only merit Captain of the Michigan City Police Department; and Sgt. Nora Werner, Michigan City native and first female Indiana State Police trooper to patrol the Indiana Toll Road, Werner said that the most satisfying thing was working with the younger troops and emphasizing that they need to do the right thing no matter what, ; and

5 Page 5 February 6, 2018 Sylvia Bankoff, who was a Michigan City social activist, founded the Sinai Forum, and as a more than 50-year member of the LaPorte County League of Women Voters, championed the implementation of an urban renewal program in Michigan City and was instrumental in changing the Michigan City Area Schools board from an appointed body to an elected board; and Mattie Sue McMillan-Dunlap, who was born in 1910, a longtime resident of Michigan City and LaPorte County, helped to found the LaPorte County NAACP in 1958; and Dorothy Jurney, who was born in Michigan City in 1909, began her career at the Michigan City News and was women s editor at the Miami Herald, Detroit Free Press, and Philadelphia Inquirer. She shifted the focus of women s pages from society news to serious issues, such as the women s movement, female political candidates, and women in the workplace; and Harriet Colfax, who was the lighthouse keeper in Michigan City, served from her appointment in 1861 until her retirement at age 80 in During those 43 years, the light never failed once. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Michigan City, Indiana that it 1) recognizes the achievements of these and many other remarkable, tenacious women who have led the way for others, and: 2) celebrates the social, economic, cultural, and political achievements of women because visibility and awareness help drive positive change for women; and 3) recognizes and honors the women in the United States and in other countries who have fought and continue to struggle for gender equality and women's rights; and 4) thanks the members of the Michigan City Commission for Women for all their efforts in support of women; and 5) encourages women to run for elected office and apply to serve on boards and commissions; and 6) proclaims and celebrates the month of March, 2018 as Women s History Month; and 7) hereby recognizes that March 8, 2018 is the 106th International Women s Day in Michigan City, Indiana. This Resolution shall be effective upon passage by the Common Council and approval by the Mayor. Councilman Simmons asked to add Mrs. Linda Simmons, who was an owner/operator of multiply McDonald s in Chicago from and the first female African American from Michigan City to own and operate McDonald s restaurants; as well as Shirley Lubeznik who played a huge part in restaurant management; Shirley and her husband Jack owned 25 McDonald s in this area, opening their first McDonalds in 1961 on Franklin Street here in Michigan City; further commenting on the Lubeznik family and their businesses. Discussion ensued between President Przybylinski and Councilman Simmons regarding additions to the proposed resolution and the Council s rules/procedures. Councilman Bietry asked to be added as a Co-Sponsor. Councilman Dabney asked to be added as a Co-Sponsor. Councilwoman Boy thanked the members of the Women s Commission who are present this evening to support this resolution; asking that the members stand and be recognized. President Przybylinski thanked the Women s Commission for all that they do in promoting women and their rights/equality. Councilwoman Boy made a motion to approve the proposed resolution; seconded by Councilwoman Carnes. President Przybylinski asked if there were any other questions or comments from the general public or Council and hearing none the proposed resolution was adopted by the following vote: AYES: Council Members Przybylinski, Silvas, Simmons, Stimley, Bietry, Boy, Dabney, Carnes and Hamilton (9). NAYS: None (0). ORDINANCE The Clerk read the following proposed ordinance on first reading by title only, AMENDING SEC (d)(1)(f), SEC (e), SEC (c)(6) IN THE MICHIGAN CITY MUNICIPAL CODE TO REQUIRE THE SUBMISSION OF SEMI- ANNUAL AND ANNUAL ACTIVITY AND SPENDING REPORTS FROM THE WOMEN S COMMISSION, PUBLIC ART COMMISSION, AND THE COMMISSION OF THE SOCIAL STATUS OF AFRICAN-AMERICAN MALES TO THE MICHIGAN CITY COMMON COUNCIL Introduced by: Don Przybylinski President Przybylinski advised as author he would be withdrawing the proposed ordinance; asking if any other Councilmember would like to sponsor the proposed ordinance; there was no response and the proposed ordinance was withdrawn.

7 Page 7 February 6, 2018 The Clerk read the following proposed ordinance on first reading by title only, CREATING SECTION IN CHAPTER 2 OF THE MICIGAN CITY MUNICIPAL CODE REGARDING THE CUMMULATIVE CHANNEL MAINTENANCE FUND Introduced by: Don Przybylinski Johnny Stimley President Przybylinski commented that the Channel Maintenance Fund is a fund that was established back in 1995; explaining how the funding is collected and what the funds are used for; further explaining what the Board members of the Port Authority want to use this funding for; and if the proposed ordinance is passed they would like to utilize funding to install safety cameras along the pier and in lot 1 in Washington Park to monitor the lakefront. President Przybylinski asked if the author had anything to add. Councilman Stimley advised that the Port Authority is on board with this; and believes this will be a good thing for public safety and will be very beneficial when it comes to saving lives. Tim Frame, Harbor Master, Michigan City Port Authority, addressed the Council commenting on public safety; lifesaving efforts along the lakefront; the installation of safety equipment along the pier; the installation of cameras along the pier/beachfront; monitoring by the Police Department and 911 Center; preventative steps that can be taken; the cameras usefulness in locating victims along the beachfront; usage of the Cummulative Channel Maintenance Fund; jurisdiction of the channel/waterway by the Port Authority; and this being a worthwhile use of funds. Discussion ensued between Mr. Frame and Councilmembers Przybylinski, Carnes, Hamilton and Larry Butcher, Director, LaPorte County Emergency Management, regarding the installation of cameras in the north end of lot 1 in Washington Park to watch the beachfront for safety; 911 Center and the Michigan City Police Department monitoring the cameras; staffing for monitoring the cameras; cost of the cameras; the Beach Safety Committee still working on putting together an estimate on this; the capabilities of the camera system; locations that will be monitored; other locations that will be monitored by the 911 Center; this being a system that can grow as the need arise; the video being recorded and the length of time the recordings will be held; if this system is being used anywhere else along the great lakes; Frankfort Michigan and their beach safety programs; Arcellor Mitel providing the City of Michigan City with grant funding for the purchase of safety rings that were installed along the pier last year; and pier/beach safety programs. President Przybylinski asked if there was anyone from the public who wished to speak on the proposed ordinance; there was no response. President Przybylinski asked if there were any comments from the Council; there was no response; advising the proposed ordinance would be held over for second reading at the Council s March 6, 2018 meeting. The Clerk read the following proposed ordinance on first reading by title only, AMENDING ORDINANCE NO COMMONLY KNOWN AS THE 2018 SALARY ORDINANCE TO CREATE THE POSITION OF SEASONAL ZOO MAINTENANCE CRAFTSMAN IN THE PARK DEPARTMENT Introduced by: Johnny Stimley President Przybylinski asked if the author had anything he would like to add. Councilman Stimley stated this is very essential for the Washington Park Zoo right now; commenting on the Zoo sharing a maintenance person with the Park Department;

8 Page 8 February 6, 2018 further commenting on the number of buildings located in the Zoo that need to be maintained; asking for the Council s support. Councilman Dabney asked to be added as a Co-Sponsor to the proposed ordinance; commenting on maintenance personnel for the Park Department. President Przybylinski asked if there was anyone from the public who wished to speak on the proposed ordinance; there was no response. President Przybylinski asked if there was anyone from the Council who wished to speak on the proposed ordinance. Councilwoman Boy asked if this was for a full-time or part-time position; and if it was seasonal or all year. Discussion ensued between Jamie Huss, Washington Park Zoo, and Councilmembers Boy and Przybylinski regarding the position being a seasonal/part-time position; hourly wage/no benefits; length of season being from March to October. President Przybylinski asked if there were any other comments from the Council. President Przybylinski commented on the job specifications; hourly wage being paid; salary ordinance for future increases for seasonal positions; and the skills needed for the job of craftsman including concrete finisher, carpenter, and electrician. President Przybylinski asked if there were any comments from the Council; there was no response; advising the proposed ordinance would be held over for second reading at the Council s March 6, 2018 meeting. The Clerk read the following proposed ordinance on first reading by title only, APPROVING ADDITIONAL APPROPRIATION IN THE BUDGET OF THE RIVERBOAT FUND TO PROVIDE FUNDING TO THE MICHIGAN CITY PUBLIC ART COMMISSION, THE MICHIGAN CITY COMMISSION ON WOMEN, AND THE SOCIAL SATUS OF AFRICAN-AMERICAN MALES COMMISSION TO SUPPORT THEIR RESPECTIVE PROJECTS AND PROGRAMS Introduced by: Candice Silvas Bryant Dabney (DECREASE Riverboat Fund # 2042 Unappropriated balance $ 30, INCREASE ACCOUNT: Public Arts Committee Donation - Fund #4150 $10, Commission on Social Status of African American Males Donation - Fund #4151 $10, Commission for Women Donation - Fund #4154 $10,000.00) President Przybylinski asked if the author had anything to add. Councilman Dabney commented on the proposed ordinance and the three (3) commissions who will receive the funding and the work they do for the citizens of Michigan City; explaining why he wanted to be a sponsor of the proposed ordinance. President Przybylinski asked if there was anyone from the public who wished to comment on the proposed ordinance; commenting that members of each perspective commission were invited to attend this evenings meeting and address the Council. Shannon Eason, Assistant Park Superintendent and Treasurer for the Michigan City Public Art Committee, addressed the Council, thanking the Mayor for the proposed funding; commenting on the Public Art Committee s use of funding for their projects and scholarships; thanking the Council for their support. President Przybylinski commented on the commissions receiving funding through appropriations and those commissions reporting to the Council periodically throughout

9 Page 9 February 6, 2018 the year on their spending/funding of projects and programs; asking those commissions to appear at the March 6, 2018 meeting to report on their financials and projects/programs that were funded in Mrs. Eason advised the Council that she did send a copy of M.A.C. Annual Report to the City Council, Mayor and Redevelopment Commission on February 15, 2018 that does have a detailed financial report at the back of the report that includes a breakdown of how their money was spent; advising they would be happy to do a presentation on March 6, President Przybylinski advised the City Attorney will be making an amendment to the proposed ordinance to include reporting from the receiving commissions at the 1 st Council meeting in March going forward. Kathy Dennis, 30 Tryon Farm Lane, President of the Michigan City Women s Commission, addressed the Council, stating on behalf of the commission and its members, several of whom are present this evening, thanked the Mayor and the City Council for considering an additional appropriation to the Women s Commission; also thanking the City Council for their designation of Women s History Month; commenting on upcoming events sponsored by the Women s Commission for Women s History Month; further commenting on women s issues throughout LaPorte County and Indiana. Marty Corley, Treasurer for the Michigan City Commission on the Social Status of African American Males, addressed the Council commenting that he did bring the treasurer s report dating up to February 2018; thanking the Mayor and Council for the proposed funding; explaining how the commission has utilized the funding. President Przybylinski asked if there were any Council comments on the proposed ordinance. Councilman Bietry commented on serving as Liaison to the Commission on the Social Status of African American Males; commenting that he enjoyed it very much; further commenting on what a fantastic job Mr. Corley does as treasurer for that commission; and the work that the commission does for Michigan City residents. President Przybylinski asked if there were any other Council comments on the proposed ordinance; there was no response; advising the proposed ordinance will be held over for second reading at the March 6, 2018 meeting at which time there will be a Formal Public Hearing. The Clerk read the following proposed ordinance on second reading by title only, APPROVING ADDITIONAL APPROPRIATION IN THE BUDGET OF THE RIVERBOAT FUND FOR THE CONSTRUCTION OF THE SEWER PROJECT ON U.S. HIGHWAY 12 WEST OF MEER ROAD Introduced by: Gene Simmons (DECREASE Riverboat Fund #2042 Unappropriated balance $ 150, INCREASE ACCOUNT # Infrastructure $ 150,000.00) President Przybylinski asked if the author had anything to add. Councilman Simmons advised he did not have anything to add at this time. President Przybylinski advised this evening they would hold a Formal Public Hearing on the proposed ordinance; asking three (3) times - is there was anyone from the public who wished to comment on the proposed ordinance; there was no response and the Formal Public Hearing was closed. President Przybylinski asked if there were any Council comments on the proposed ordinance.

President Przybylinski asked if any other authors had anything to add; there was no response. President Przybylinski advised this evening they would hold a Formal Public Hearing on the proposed ordinance; asking three (3) times - is there was anyone from the public who wished to comment on the proposed ordinance; there was no response and the Formal Public Hearing was closed. President Przybylinski asked if there were any Council comments on the proposed ordinance. Councilman Simmons asked again to suspend the Council s rules and have second and third reading this evening; supported by Councilman Bietry. President Przybylinski asked if there were any objections by the Council to have third reading this evening; there was no response; advising the Council would have third reading tonight on the proposed ordinance; asking Clerk Neulieb to read the proposed ordinance on third reading. President Przybylinski advised next under Unfinished Business the Council has one (1) appointment to the Animal Control Board term expires: February 21, 2018; Incumbent: Ms. Karen Edwards; asking if there are any nominations. Duane Parry, 2206 Maple Street, addressed the Council regarding the Resolution he asked the Council to write/pass condemning the proposed N.I.P.S.Co. s natural gas rate increase and demanding a rate reduction based on the economic health of Michigan City; commenting on the Council s duty to protect their constituency, the people of Michigan City; further commenting that more utilities have withdrawn their rate increases or reduced their rates; continuing to comment on the matter.
