1 ALLEGANY COUNTY BOARD OF LEGISLATORS REGULAR SESSION OCTOBER 23, 2017 CALL TO ORDER: The regular meeting of the Board of Legislators was called to order at 2:05 p.m. by Chairman Curtis W. Crandall. PLEDGE OF ALLEGIANCE TO THE FLAG: The Pledge of Allegiance was led by former United States Army Sergeant Wesley Fortney. INVOCATION: The Invocation was given by Legislator Stockin. ROLL CALL: 14 Legislators Present: Scott Burt, Curtis Crandall, Philip Curran, David Decker, Dwight Fanton, Karl Graves, Dwight Mike Healy, Judith Hopkins, Charles Jessup, Kevin LaForge, Aaron McGraw, Debra Root, Philip Stockin, Norman Ungermann, Jr. Absent: Timothy O Grady APPROVAL OF MINUTES: The Board meeting minutes of October 10, 2017, were approved on a motion made by Legislator Decker, seconded by Legislator Stockin, and carried. The Committee of the Whole meeting minutes of October 10, 2017, were approved on a motion made by Legislator Root, seconded by Legislator Curran, and carried. PUBLIC HEARING: Chairman Crandall closed the regular meeting to hold a public hearing on Local Law Intro. No , entitled A Local Law to Provide Increases in the Compensation of Certain County Officers. There being no one desiring to speak, the public hearing was declared closed and the Board reconvened in regular session. PRIVILEGE OF THE FLOOR: Chairman Crandall presented a certificate to Wesley Fortney, former United States Army Sergeant, in grateful appreciation of his service to our country. Mr. Fortney s service dates were from September 24, 2007, to March 2, Following Basic Training at Fort Sill, OK, assignments included: Fort Bliss, TX; Fort Benning, GA; Vicenza, Italy; and Afghanistan. Commendations he received included: Army Commendation Medal, Army Achievement Medal with four Oak Leaf Clusters, Army Good Conduct Medal, National Defense Service Medal, Afghanistan Campaign Medal with two Campaign Stars, Global War on Terrorism Service Medal, Army Service Ribbon, Overseas Service Ribbon (two awards), Northern Atlantic Treaty Organization Medal (two awards, given for international service), Combat Action Badge, Parachutist Badge, Driver and Mechanic Badge. Mr. Fortney led the Pledge of

2 Page 2 of 11 Allegiance to the Flag at the beginning of the meeting as part of the Veterans Honorary Pledge of Allegiance Program. Cancer Services Program Coordinator Madelyn Thornton addressed those in attendance in recognition of Breast Cancer Awareness Month. Ms. Thornton stated that statistically 39.6 women in Allegany County will be diagnosed with breast cancer this year. She would like to help women understand the importance of screenings. She remarked that with early screenings and early detection, there is a better cure rate. NYS residents can get screened for free. Diagnostic services aren t usually covered in full, but the Cancer Services Program here in Allegany County can help. She mentioned that Allegany County Cancer Services offers a great deal of support to residents as well. She encouraged everyone to get their screenings and to remind family members to do so as well. County Treasurer Terri Ross filed a copy of the Allegany County Financial Statements dated December 31, 2016, prepared by EFPR Group, in the Clerk of the Board s Office on October 17, County Treasurer Terri Ross filed Certificates of Withdrawal of Delinquent Tax Liens for properties in the Town of Wirt in the Clerk of the Board s Office on October 20, Invitation to attend Candidates Night sponsored by the Farm Bureau on November 1. If you plan to attend, please let Clerk of the Board Riehle know by October NYMIR 2016 Annual Report 6. Reminder that the Allegany County Heroin and Opioid Abuse Ad Hoc Committee will be holding a Next Steps Strategic Sharpening Session at the Crossroads Conference Center on October 26 from 1:00 to 4:00 p.m. 7. Reminder that the Allegany County Heroin and Opioid Abuse Ad Hoc Committee, Wellsville BPO Elks, Wellsville Lions Club, and Legislator Kevin LaForge are sponsoring the viewing of The Hungry Heart, the showing of Allegany County s Voices of Addiction, and panel discussion at the David A. RESOLUTIONS: RESOLUTION NO ADOPTION OF LOCAL LAW INTRO. NO , PRINT NO.1, TO PROVIDE INCREASES IN THE COMPENSATION OF CERTAIN COUNTY OFFICERS Offered by: Ways & Means Committee 1. That proposed Local Law, Intro. No , Print No. 1, is adopted without any change in language, to wit: COUNTY OF ALLEGANY Intro. No Print No. 1 A LOCAL LAW TO PROVIDE INCREASES IN THE COMPENSATION OF CERTAIN COUNTY OFFICERS BE IT ENACTED by the Board of Legislators of the County of Allegany, State of New York, as follows: Section 1. Commencing January 1, 2018, the annual salary of the incumbents of the following County offices shall be as follows: County Clerk - $74,154 Employment & Training Director - $65,692 Personnel Officer - $73,540 Public Health Director - $81,358 Public Works Superintendent - $90,512 Real Property Tax Director - $72,296 Sheriff - $75,803 Social Services Commissioner - $84,220.

This local law shall take effect on the date of its filing with the Secretary Moved by: Mr. Jessup Seconded by: Mrs. Root 11 Ayes, 3 Noes, 1 Absent Voting No: Burt, Graves, Ungermann Comments made regarding Resolution No : Legislator Graves stated that he s always felt that our County employees are one of the best kept secrets, but he couldn t support this resolution for a few reasons. First of all, he s opposed to having elected officials receive a pay increase during their term of office. He feels the salary they are elected at should stay the same for their entire term. Also, he would like to be able to vote on these salaries individually. Finally, he would like to see the public hearing on this held in the evening as it would better serve the public. RESOLUTION NO SETTING DATE OF A PUBLIC HEARING ON 2018 COUNTY TENTATIVE BUDGET AND PROVIDING CONTENTS OF SUCH NOTICE Offered by: Ways & Means Committee WHEREAS, the 2018 County Tentative Budget has been presented to this Board together with a copy of the proposed appropriation resolution, and WHEREAS, it is necessary to hold a public hearing on the Budget before any further action can be taken on the Budget and on the appropriation resolution, and WHEREAS, it is necessary to provide notice to the public of such public hearing and to also include in such notice or in a separate notice published in the same manner and at the same time as such notice of public hearing, a statement of the maximum salary that may be fixed and payable during the year 2018 to the members of the County Board of Legislators and to its officers, now, therefore, be it 1. Chairman Crandall replied that regardless of whether it s an election year or not, historically this is the date (the second Thursday in November) it has always been held. RESOLUTION NO RESOLUTION URGING THE NEW YORK STATE CONGRESSIONAL DELEGATION TO PRESERVE THE FEDERAL INCOME TAX DEDUCTION FOR STATE AND LOCAL TAXES Offered by: Ways & Means Committee WHEREAS, Congress is giving serious consideration to eliminating the federal income tax deduction for state and local taxes; WHEREAS, this deduction, which has been in place for more than 100 years, is heavily utilized by residents of our community and our state; WHEREAS, the State and Local Tax (SALT) deduction is a fundamental principle of federalism and without it our residents would be faced with double taxation as they would be forced to pay federal income taxes on the taxes they pay to state and local governments; WHEREAS, this federal cost shift onto local governments would place extreme pressure on municipal budgets, including diminished revenue for essential local government investments, including public safety and public infrastructure; and WHEREAS, increased federal taxation and reduced municipal services will harm our local housing market, decrease home values, and erode our local tax base; now, therefore, be it 1. That the Allegany County Board of Legislators expresses its strong opposition to any tax reform proposal that would eliminate the State and Local Tax (SALT) Deduction and urges U.S. Congressional Representative Tom Reed, Senator Charles Schumer, and Senator Kirsten Gillibrand to join us in publicly opposing any such proposal, and be it

Trump, United States Senate Majority Leader Mitch McConnell, United States Senate Minority Leader Charles Schumer, United States House of Representatives Speaker Paul Ryan, United States House of Representatives Minority Leader Nancy Pelosi, and the National Association of Counties. Moved by: Mr. Jessup Seconded by: Mr. Curran Adopted: Voice Vote Comments made regarding Resolution No : Legislator Ungermann said, Well I guess we need some help somewhere. It really does pinch a lot of businesses and so forth here in Allegany County. I have to go along with it for my own personal preservation. If we could do something in Washington to change the tax code to soften this up that might not be so bad. I guess at this point; I have to support. RESOLUTION NO RESOLUTION URGING GOVERNOR CUOMO AND THE NEW YORK STATE LEGISLATURE TO ADVANCE FUNDING AND EXPEDITE COMPLETION OF THE "DANIEL PATRICK MOYNIHAN" INTERSTATE 86 PROJECTS IN BROOME, DELAWARE, SULLIVAN, AND ORANGE COUNTIES Offered by: Ways & Means Committee WHEREAS, Governor Pataki committed to a ten to twelve-year construction program to complete the Route 17 conversion to Interstate 86 ("I-86") beginning with the first designation (177 miles Chemung County West to Pennsylvania) on December 3, 1999; and WHEREAS, the designation of New York State Route 17 to I-86 provides a superhighway with connection to every Interstate Highway located within New York State and Interstate Highways leading into Pennsylvania; and WHEREAS, the upgrade and designation of Route 17 as I-86 will make the region more competitive and able to attract substantial growth in business, industry, and tourism as well as improve the safety of the traveling public; and WHEREAS, the New York I-86 Economic Development Benefit Study, issued in January, 2000, which was widely accepted and quoted at all levels of government, called for an aggressive eight-year construction period that would result in a $3.2 billion direct economic benefit to communities along the I-86 Highway Corridor once the conversion has been completed; and

7 Page 7 of 11 WHEREAS, with proper funding and resources (Fast Track/Design Build) for the remaining projects in Broome, Delaware, Sullivan, and Orange Counties, the conversion of Route 17 to I-86 could be completed many years sooner than on the present schedule providing vast economic benefits to the Hudson Valley, Southern Tier, and Western New York regions and would yield significant economic benefits for the nation by facilitating national freight flows, reducing travel times, improving safety, enhancing access to markets, creating new jobs and greater value added activity; and WHEREAS, due to the lack of funding, the current Administration has been unable to commit to a timetable for completing the conversion of Route 17 to Interstate I-86; and WHEREAS, additional funding for state infrastructure projects, specifically the modernization of roads and bridges, may be forth coming from the Federal Government; and WHEREAS, the primary economic development agencies in Orange and Sullivan Counties have formed a Coalition to promote the widening of Route 17 to six lanes over the 47 miles between Harriman and Monticello; now therefore, be it 1. That the Allegany County Board of Legislators does hereby request Governor Andrew Cuomo and the New York State Legislature to advance funding (Fast Track/Design Build) to expedite completion of the projects in Broome, Delaware, Sullivan, and Orange Counties on New York State Route 17 so that the same may be converted to I-86; and, be it further 2. That the Clerk of this Board is hereby authorized and directed to forward certified copies of this resolution to Governor Andrew Cuomo, Honorable John Flanagan, Honorable Carl Heastie, Honorable Christopher Friend, Honorable Thomas O'Mara, Honorable David Gantt, Honorable Catharine Young, Honorable Fred Ashkar, Honorable David Carlucci, Honorable John Bonacic, Honorable William Larkin, Honorable Joseph Giglio, Honorable Kenneth Zebrowski, Honorable Philip Palmesano, Honorable Karl Brabenec, Honorable Donna Lupardo, Honorable Aileen Gunther, Honorable Andy Goodell, Honorable Thomas Santulli, Inter county Association of Western New York, New York State Association of Counties, Schuyler County, and the I-86 Corridor Counties (Cattaraugus, Chautauqua, Steuben, Tioga, Broome, Delaware, Sullivan, Orange). NO (ACCEPTANCE OF BID FROM KVR SERVICES FOR OFFICE FOR THE AGING NUTRITION PROGRAM [HOME DELIVERED MEALS AND CONGREGATE MEALS]; AUTHORIZING ALLEGANY COUNTY OFFICE FOR THE AGING DIRECTOR TO SIGN SUCH AGREEMENT) was TABLED following a motion made by Legislator LaForge, seconded by Legislator Decker, and carried. Legislator LaForge stated he would like to table it for possible modifications to the agreement. AUDITS: A motion was made by Legislator Jessup, seconded by Legislator Curran, and carried, that the audits be acted upon collectively and by totals. A motion was made by Legislator Jessup, seconded by Legislator Root, and adopted on a roll call vote of, that the audit of claims, totaling $3,681, including prepaid expenses, be approved for payment as recommended by the County Administrator. (Allegany County s Local Dollar Share of the NYS Medicaid Program paid year-to-date is $7,741,105.) COMMENTS: Chairman Crandall reminded everyone of a Committee of the Whole meeting scheduled for after the Board meeting. He also acknowledged Legislator Jessup for being honored with a Regan Award at the Republican dinner held at Moonwinks on Saturday.
