1 State of Illinois ) County of Ogle ) ss City of Oregon ) Proceedings of the Ogle County Board Special Budget Hearing Call to Order Chairman Gocken calls the meeting to order at 7:00 p.m. Roll Call shows Bauer, Daws*, Hopkins* and Huntley are absent. This is followed with the Pledge of Allegiance to the Flag. (*Daws & Hopkins enters at 7:05 p.m.) Chairman Gocken asks Bill Spencer Chairman of the Finance Committee to come up front and present the FY2005 Budget. Chairman Gocken asks the board members if they have the appropriate pages for the budget? Spencer says the budget is barely under the trigger and under income just a little bit. FY2005 Budget Estimate of Probable Income The clerk reads the amounts for the estimate of probable income. The total is $10,599,700. County Clerk/Recorder & Elections Department Total: $392,000 Buildings & Grounds Department Total: $630,000 County Treasurer Department Total: $158,500 H.E.W. Department Total: $279,465 Judiciary & Jury Department Total: $284,000 Circuit Clerk s Office Department Total: $456,000 Hoekstra asks how will this office operate and how will the paperwork that is generated in this department work with this budget? Spencer says each department head was given a bottom line and they were to build their own budget. This is the budget the Circuit Clerk presented as his budget. Horner refers to a letter sent by Marty Typer to the board members regarding the payment of salaries. Spencer says the Circuit Clerk has approximately $452, 887 in funds and some counties use these funds to pay for other items. Typer says the budget does include pay-outs from the specialized funds. He pays $50,000 from funds to keep the general revenue dollars down. This budget is projected to continue that process. Typer says he pays for the computer system, file jackets as they have in the past as well as the index books from these funds. These are revenues set-up in those funds that Spencer is indicating that will pay for those things as well as the Child Support funds Page 113

2 Ogle County Board Special Budget Hearing and the cost of running those offices with envelopes, checks and postage. Horner asks Spencer if Typer has the $452,000 some place else? Spencer says he got the information from the reports and there is $452,887 that is document fees and automation fees. Typer informs the board his office has been collecting money for these two accounts to offset the cost of going into the new Judicial Center. The money will be used for the new roller files, switches for the new AS400 and these funds will be used. Typer also states this money has been accounted for expenditures within the next 24 months. Looking at the projected grand total for FY2004 and where the budget is now, it looks like the county will spend approximately $1.6 million over the next 25 days and where will the money go? Chairman Gocken states salaries for the end of the year have not been deducted, Coffman says $225,600 for the Health Department have not been deducted and there are two other expenditures that have not been deducted at this time. Chairman Gocken states according to State Statutes this Budget Hearing was held more than 15 days prior to the approval of the budget. The FY2005 Budget will be approved at the November 29 th Special County Board meeting and the budget will lay on the counter for viewing for 15 days prior to approval. Motion to Adjourn At 7:30 p.m., there being no further budget questions, Daws moves to adjourn, Swanson seconds and the motion carries on a voice vote. Roll Call: Roll Call shows Stahl* is absent. The Invocation is given by Jerry Brooks and this is followed with the Pledge of Allegiance to the Flag. (*Stahl enters at 5:40 p.m.) Approval of Minutes Chairman Gocken asks for a motion to approve the regular October 19, 2004, Ogle County Board meeting minutes. Conn moves to approve the October 19, 2004, Ogle County Board minutes. Hoekstra seconds and the motion carries on a voice vote. Approval of Reports Daws moves to accept and place on file the monthly reports of the Circuit Clerk, County Clerk/Recorder and Treasurer. Ed Rice seconds and the motion carries on a voice vote.(placed on file) Ogle County Highway Annual Report Presentation Curtis D. Cook gives a power point presentation to the county board about Highway Funding; where this money comes from and how it is to be used. Daws asks if the Motor Fuel Tax Fund has licensing fees that goes into that fund? Cook says yes, but the local agencies do not get any of the licensing fees - all we get is the gas tax. The license fees go straight to the State and the county gets their Motor Fuel Tax from the number of vehicle registrations in the county. Public Hearing - Countryside Village Apartment Project Chairman Gocken of the Ogle County Board announced that notice of a public hearing on the proposal to issue not to exceed $3,500,000 an aggregate principal amount of Multifamily Housing Revenue Bonds (Countryside Village Apartments Project) Series 2004 of The County of Ogle, Illinois. The clerk reads to resolution - RESOLUTION AUTHORIZING THE ISSUANCE AND SALE BY THE COUNTY OF OGLE, ILLINOIS, OF MULTIFAMILY HOUSING REVENUE BONDS (COUNTRYSIDE VILLAGE APARTMENTS PROJECT) SERIES 2004 IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $3,500,000 (THE BONDS ) ON BEHALF OF COUNTRYSIDE HOUSING LP; AUTHORIZING THE EXECUTION AND DELIVERY OF VARIOUS AGREEMENTS, RELATED TO THE BONDS; AND RELATED MATTERS. (the Resolution ). Mr. Glenn Weinstein from Chapman & Cutler addresses the board to answer any questions. Mr. Weinstein reviewed the information that was presented to the board at the September Ogle County Board meeting. Remhof confirms to Mr. Weinstein that there is absolutely no liability to the county if there is any default? Mr. Weinstein states that is correct, the bonds are sold under terms that they are limited obligations to the county and the sole source of payment are payments under the loan agreement. The bonds are not a general obligation to the county and in no way can the county be compelled to levy taxes to pay for debt service. There are also indemnifications in place between the county and the borrower. There was discussion regarding the amount of money to be used for the purchasing and remodeling of the units. Rice would like to know that there is no risk to the county which would include any legal costs or fees? Mr. Weinstein states that is correct that to the extent that down the line for any reason there is a need at all for the county to expend legal fees or to incur other costs to respond to something. The county isn t liable for this but that isn t to say somebody could potentially file a lawsuit. Spencer asks what happens if the buyer goes belly-up? Mr. Weinstein states if the borrower didn t pay and a default was declared, the November 16, 2004 Page -117-

6 Ogle County Board Meeting Trustee would step in. There was more discussion regarding the risks to the county if there were a default in the loan. Spencer asks what happens if this is not approved tonight? Mr. Weinstein states if this were not approved and the bonds couldn t be issued, whether or not if they would go forward on the other two developments in the county he really couldn t say. Chairman Gocken read the opinion from State s Attorney Deborah E. Ellis regarding the Countryside Resolution.(Placed on file) Gouker makes the motion to accept the resolution, Rice seconds and a roll call vote is called: YES: NO: ABSENT: Rice, Scholl, Spencer, Stahl, Swanson, Bauer, Brooks, Clayton, Colbert, Colson, Daws, Gouker, Hoekstra, Hopkins, Horner, Huntley, Nye, Remhof and Gocken Zuehl, Conn, Johnson and Kenney None PRESENT: Saunders The motion carries on a roll call vote. (Placed on file) Resignation Chairman Gocken informs the board there is a letter of resignation on file from Joe Gargano on the Lost Nation/New Landing River Conservancy District effective November 30, Horner moves to accept the resignation, Kenney seconds and the motion carries on a voice vote.(placed on file) Vacancies LN/NL River Conservancy District - unexpired term ends April 30, 2008 REMINDER: An application deadline for these appointments will be Thursday, December 30, 2004,at 4:30 p.m. in the Ogle County Clerk s Office. Ogle County Housing Authority - full term ends October 31, 2009 Ogle County Housing - 1 unexpired term ends October 31, 2005 Mental Health 708" Board - 3 full terms ending December 31, 2008 An application deadline for these appointments will be Friday, November 26, 2004, at 4:30 p.m. in the Ogle County Clerk s Office. Appointments Board of Health Chairman Gocken announces the appointments to the Board of Health will be made next month. Mental Health 708" Board Chairman Gocken announces the recommendation of Joshua K. Waddell of Rochelle be appointed to the unexpired term which ends December 31, Horner moves to accept the recommendation, Rice seconds and the motion carries on a voice vote. 7 Ogle County Board Meeting Resolution - Expansion of RC&D / EDD Area The clerk reads the resolution to allow Winnebago County to join the Blackhawk Hills RC&D/EDD Council. Conn asks if Winnebago County has agreed to contribute the $40,092 for their portion? Chairman Gocken says yes they have agreed to this contribution. Colson moves to accept the resolution, Hopkins seconds and the motion carries on a voice vote.(placed on file) Resolution - District Comprehensive Economic Development Strategy Chairman Gocken reminds the board this resolution and CEDS Report were presented last month. The clerk reads the resolution to adopt the Annual Report of the Comprehensive Economic Development Strategy. Colson moves to approve this resolution, Clayton seconds and the motion carries on a voice vote.(placed on file) Resolution - Hospital & Medical Insurance transfer of funds The clerk reads the resolution to transfer $150,000 from # Hospital & Medical Insurance budget account to # Insurance, Hospital & Medical fund. Rice moves to accept this resolution, Swanson seconds and the motion carries on a voice vote.(placed on file) Zoning - #18-04 AMENDMENT - Michael R. Bressette The clerk reads the petition of Michael R. Bressette, 1092 W. Myrtle Rd., Leaf River, IL and Mark A. & Debra M. Kunz, 1312 Quincy St., Rockford, IL for an Amendment to the Zoning District to rezone from B-1 Business District to R- 2 Single-Family Residence District on property described as follows, owned by Michael R. Bressette and being purchased by Mark A. & Debra M. Kunz: Part of Lots 15 thru 18 Block 4 Original town of Myrtle, Part E ½ NE 1/4 Section 17 Leaf River Township 25N, R10E of the 4th P.M., Ogle County, IL Property Identification Number: Common Location: 1092 W. 8 Ogle County Board Meeting Committee Reports The following committees had no additional report other than the minutes that are placed on exhibit: Buildings & Grounds, Judiciary & Circuit Clerk, Juvenile & Probation, Sheriff & Coroner, Road & Bridge, Mental Health 708 Board, ETS Board, G.I.S. Committee and Economic Development. The following had no minutes to file: County Clerk & Insurance, State s Attorney & Legislative, Blackhawk Hills RC&D, Board of Health, Illinois Assoc. of County Board Members, U.C.C.I., Illinois Risk Management, Safety Committee, IT Committee, Safety Committee, Liquor Commission and Byron Dragway County Clerk & Insurance Thanks Finance & Revenue Statement H.E.W. Flu Vaccine Update Solid Waste Electronics Recycling Event No minutes Rice thanks County Clerk Huntley and her staff for doing a great job on the election. Huntley says there was a 66% turnout county wide, with 24,000 people successfully casting their votes in Ogle County and this is the biggest voter turnout. Huntley also thanks her staff for all of their hard work and the Election Judges of Ogle County. There are a couple of Election Judges here tonight, Christine Daws and Mrs. McKnight because these judges put in a long day for public service. Huntley says if you see an Election Judge please tell them Thank You for being there on the day of the election. Huntley says her success truly comes from the Election Judges doing a good job. Spencer states no bills are to be paid that will overdraw a department s bottom line. This was discussed during the last Finance Committee meeting, this was not voted on at the committee meeting and wants the board to vote on this issue. Spencer moves to adopt the statement that No bills are to be paid that will overdraw a department s bottom line. Conn seconds and the motion carries on a voice vote. Chairman Gocken announces the Health Department has received flu vaccine and make sure you fit the at-risk guidelines in order to receive this shot. Chairman Gocken announces the Electronics Recycling Event. A new record was set with tons of electronic equipment which was enough to fill 4.5 semi trucks. 9 Ogle County Board Meeting Host Fee Report Chairman Gocken states the county has received $1,618,390 for the first 3/4 of this year and $1,344,703 to the Long Range Planning Fund. Since March of 1998, the county has received $10,503,263 from host fees from Onyx Orchard Hills Landfill and shortly the county will be receiving another $10,000 from the Onyx Orchard Hills Landfill expansion. Refund of Dues Planning Commission Meeting Tri-County Opportunities Meeting Personnel & Salary Retirement Party Long Range Planning Tom Scholl announces the next meeting will be Tuesday, November 23, 2004 at 7:00 p.m. Clayton announces the Road & Bridge Committee made their annual tour of the various Ogle County Highway Projects. No minutes Colson announces the next meeting will be on Monday in Lanark and the next CEDS meeting will be on December 9 th in Milledgeville. No minutes Chairman Gocken announces the UCCI at their October 2004, meeting voted to refund all 2004 dues. The county will be receiving a check back in the amount of $440. Tom Scholl announces the next meeting will be held on November 18 th. Bill Spencer says the next meeting will be on November 23 rd and will be held in Princeton at 7:00 p.m. Saunders announces there will be a Retirement Party for Jerry Daws and Darrell Cash to be held on Tuesday, November 23 rd at the Sheriff s Training room. Update on progress Gouker gives the following update - Water main service has been installed and tested at the Judicial Center by the City of Oregon A main stairwell to be installed in the next couple of weeks The tour of Judicial Center will be held next month November 16, 2004 Page -121-

10 Ogle County Board Meeting Stone Veneer on the South side is 90% complete, East side is 10% complete, North side is 50% complete and West side is 5% complete Membrane roofing and installation is complete Roofing is 95% complete 1 st floor electrical passed inspection today and will begin drywall Bills for approval IT Committee Meeting Executive Committee Economic Development Byron Dragway Update from States Attorney Kim Gouker reviews the various bills which have been submitted for payment. Gouker moves to approve payment of the November 2004 expenditures from the Judicial Center Project Fund in the amount of $888, Spencer seconds and the motion to approve the bills as presented carries on a voice vote. No minutes Colson announces the meeting date is changed to Thursday, November 18th due to Veteran s Day on the normal meeting day and they will discuss the County Enterprise Plan. Chairman Gocken updates the board and informs them that the Task Force has met again. The Task Force worked on Bylaws and have located a lawyer to handle the Corporation papers. They hope to be incorporated by March, since it takes 120 days to complete. An assignment was made to develop a budget and the method of financing or a business plan. When asked if there was money coming from the Ogle County Board, Chairman Gocken informed them there is no money in the budget at this time. The Executive Committee voted to have the Chairman checking the , phone messages and replying to them for the Economic Development Department. The Finance Committee voted to pay for the Economic Development account for the next six months, so they do not lose any contacts that have been made and this will come from the 2004 budget. Chairman Gocken also says she will attend the organization meetings or appoint someone to attend. No minutes Deb Ellis updates the board and says the next status hearing will be on November 23 rd and she will be leaving information for her predecessor. November 16, 2004 Page -122-

11 Ogle County Board Meeting Chairman s Comments Chairman Gocken states she, Spencer and Clayton toured the Com Ed facility yesterday and saw a lot of the new security measures that have been installed. Chairman Gocken says she, John Coffman, Bill Spencer, Shirley Clayton and Jim Harrison attended an IGA update meeting this morning and are pleased we are receiving more information than in the past. Communications Sales Tax for August 2004 was $64, and $78, Sales Tax for August 2003 was $24, and $65, Letter regarding City of Rochelle - Facilities Planning Area Modification Invitation to Retirement Party for Coroner Cash and County Board Member Jerry Daws Unfinished Business New Business Chairman Gocken states the re-organizational meeting for the Ogle County Board will be held on Monday, December 6 th at 7:00 p.m. Nye asks if the Ogle County Board meetings will remain at 5:30 p.m.? Chairman Gocken says this is determined at the re-organizational meeting. Chairman Gocken asks Don Conn to come to the front of the room and presents him with a Certificate of Appreciation for his time served on the Ogle County Board. Public Comments Motion to Adjourn At 7:20 p.m., Daws moves to adjourn the November Ogle County Board Meeting until Monday, November 29, 2004, at 7:00 p.m. for the approval of the FY2005 Budget and Appropriations. Looking at the projected grand total for FY2004 and where the budget is now, it looks like the county will spend approximately $1.6 million over the next 25 days and where will the money go? Chairman Gocken states salaries for the end of the year have not been deducted, Coffman says $225,600 for the Health Department have not been deducted and there are two other expenditures that have not been deducted at this time. Chairman Gocken states according to State Statutes this Budget Hearing was held more than 15 days prior to the approval of the budget. The FY2005 Budget will be approved at the November 29 th Special County Board meeting and the budget will lay on the counter for viewing for 15 days prior to approval.
