C., Monday, Ma.y 3, 1971 Time: 7:OO p.m. Minutes of the regular meeting of the Council held in the Council Chamber on Monday, May 3rd at 7:OO p.m. All the members were present; also present were the Manager, Assistant Manager, Chief Inspector and the Deputy Clerk. Before dealing with the regular Council Agenda the Mayor welcomed the special guests attending the Council meeting. Mrs. P.W. King was present with the First Cedar Hill Girl Guides. TheI'Miss Surrey"contestants were also present, as well as the 1970 "Miss Surrey", Miss Eymundson. I -iy A. Phillips of rd Avenue read a lengthy submission concerning a drainage problem affecting the Livingstone Ditch in front of his property. This ditch was created in 1932 and assists the Erickson Ditch, which was constructed in 1924, in taking the drainage water from the Port KePls area and the lower lands to the River. Mr. Phillips stated that as development takes pla.ce and more homes are built more water is diverted to the drainage system causing an erosion problem. Five feet of the Livingstone Ditch banks have been washed away eliminating the approach to the bridge giving access to his property. He mentioned that the Engineering Department has carried out an investigation and has estimated that it w i l l cost $3, to rebuild the bridge and between $ and $ to repair the banks. Mr. Phillips stated that in 1965 a plug was placed in the Erickson Ditch diverting water into the Livingstone Ditch and no improvements were made to the Livingstone Ditch to accommodate the added water. He stated that the water is now low and as he requires access to his property he requested that Council approve of road and bank repairs. He asked for the digging of a new diversion ditch, removal of the plug from the Erickson ditch and cleaning of the Livingstone Ditch. He read a news item from the "Surrey Leader" regarding the passage of legislation by the Provincial Government, which makes it practical for the Surrey Municipality to take over the dyking districts, and he suggested that this area should be considered for improvements under the new legislation.

4 2. Mr. G. Hanssen and Mr. P. Messina of the North Shore Excavating Ltd. were to have been present regarding the contract for the North Slope Sewer, but they did not appear. 3. Miss Dorothy Martin of th Street asked for the widening and reconstruction of 164th Street from 32nd Avenue north to 36th Avenue. She stated that the first part of the road is constructed to a width of thirty-three feet and snow drifts last winter had created a bottle neck in this section. During the past one and a half years further development had taken place to the north and a dust problem has developed. Miss Martin stated that a petition had been supplied in January, 1970 for improvements to this road but no definite indication received as to when the work might be undertaken. She specifically asked for road widening, gravelling and ditching since no ditching had been carried out on this section since The Mayor stated that he did not think this work was provided for in the 1971 Budget, but that she would be advised of Council's decision on her request. 4. Mrs. Zaprawa gave a brief outline of the history on local improvement project No involving the paving of Bedford Drive. A large Delegation from this area was also in attendance at the meeting. Mrs. Zaprawa explained that a preliminary petition had been supplied in 1969 and a formal petition in February, The property owners feel that some priority should be given to this project since there are thirty-seven houses on these streets, involving 100 cars. She complained of the dust and pot holes and of the fact that there has been no road sign giving direction to Bedford Drive since the subdivision was opened in She also asked that a "No Exit" sign be erected.

5 5. Mr. Gallimore of A Street was present to request Council to consider his claim for damages due to flooding, which had not been allowed by the Municipal Insurance Adjuster. He stated that on October 16th a water main accidently broke causing flooding, which washed the layer of peat and soil from his garden and flooded his basement. He supplied copies of letters which he had written regarding the damage caused by the dampness, which affected the floor and walls of the basement. Mr. Gallimore expressed the opinion that the twelve inch tile installed by the Municipal crews should be extended through an easement to take the water from his property. He stated that the first flooding occurred in 1969 with damages building up to October of rri 6. Mr. Melnyk read a submission outlining the achievements of the Whalley Legion Junior Band and requesting a grant to assist in financing a tour of Britain andholland. The Mayor stated that Council had dealt with the matter of grants earlier in the afternoon and a decision was made on their request. RES. NO. K Mr. Erickson was not present, although he had arranged to appear in connection with a Section 712 application, No , not approved by Council at the previous meeting. 8. Mr. I. Rusticus was present to protest the closure of the septic tank disposal outfall. Moved by Alderman Dunster That this Delegation be heard. Mr. Rusticus stated that he felt that Council had made a hasty decision, which will increase his costs from $13.00 per load to between $35.00 and $40.00 per load. He indicated that 765 animals per month are processed through his slaughter house, involving 40,000 gallons of effluent per month. When his operation was approved three years ago he received permission to utilize a

6 30,000 gallon holding tank and with the increased cost finds it difficult to compete with other operations outside the Municipality. Mr. Rusticus operates the only slaughter house in the Municipality. U 9. Mr. Struzewski was present to object to the utilization of property at th Street as a mushroom manure curing centre. Mr. Struzewski stated that the residents on 190th Street want clarification concerning the uses permitted in an A-3 zone. They feel this doesn't involve farm produce since chemicals, horse manure from the P.N.E. grounds, peat moss and other additives are brought to the site and the cured product is redistributed. 1,000 tons of mushroom manure is hauled in and out every day to create a volume of 2,000 tons. In addition to this type of use he complained of the road condition, which results from the heavy usage. The road has very little base and is muddy in winter and dusty during the summer. RES.NO.K309 One of the other neighbors also asked to speak as a Delegation on behalf of S.P.E.C. Moved by Alderman Ross That the Delegation be heard. Aldermen Fomich, Patterson, Wallace and Johnston against He claimed that the forty acres is being used for industry and has been stripped of top soil removed from the site by dump trucks. His main objection was that this use is in effect an industrial manufacturing plant. RES.NO.KS10 As Alderman McKitka was not present in the Council Chamber it was Moved by Alderman Dunster Seconded by Alderman Wallace That Council recess until the full Council is present. Alderman Ross against Alderman McKitka returned to the Council Chamber immediately.

RES.NO.K312 (1)) Moved by Alderman McKitka That the recommendations of these minutes be adopted. Alderman Fomich stated that since the Finance Committee sometimes deals with matters not referred to them by Council, the Committee system is not ahered to and these matters should properly be discussed under Any Other Competent Business. Moved by Alderman Fomich That the recommendation in these minutes concerning the construction of a Centennial Community Hall in the Whalley area be tabled. Aldermen Wallace and McKitka against

8 D. SUBMISSIONS OF DELEGATIONS LAST WEEK TO BE CONSIDERED: w 1. Mr. I. Gootfredsen and Mrs. Ogilvie had been present regarding a drainage problem and the proposed building of Felix Salvage Co. Ltd. The Manager stated that he will have Dr. Kornder and the Chief Inspector investigate further regarding the complaints. RES.NO.K315 RES.NO.K316 Moved by Alderman McKitka That the matters referred to by this Delegation be referred to the Manager for a report next Monday. The Chief Inspector reported that the present use is non-conforming but that the owner has a right to construct a building in an industrial zone. Moved by Alderman McKitka That any building permit for this property be withheld until Council has received a full report. Aldermen Dunsterand Ross against RES.NO.K M r. Sykes had been present regarding a bill of approximately $ for water shown on the meter as having gone to the premises, although a substantial portion of the water was lost through a leak in the water line. During the period when the account was accumulated the premises were not under Mr. Sykes' control, but he has since repossessed the property. Seconded by Alderman McKitka That Mr. Sykes be charged only for the water used to an amount equal to the Municipal cost of water. This motion was lost

10 2. GREATER VANCOUVER WATER DISTRICT RES.NO.K324 Moved by Alderman Dunster Seconded by Alderman McKitka That the minutes of the meeting of April 15th be received. F. MAYOR'S REPORT RES.NO.K The Mayor presented a resolution of the Vancouver - Fraser Park District giving approval for a meeting between a Committee of the Park District, the Department of Indian Affairs and the National Harbours Board to further explore the possibility of retaining the Semiahmoo Indian Reserve for future park development. Moved by Alderman Dunster Seconded by Alderman Fomich That the report be received. RES.NO.K The Mayor presented a copy of a report from Alderman E.J. Broome of the Greater Vancouver Regional District regarding the integration of the Park District with the Regional District. An expression of opinion is requested from all Councils throughout the Park District area on this matter. Moved by Alderman Fomich Seconded by Alderman Kuhn That the report be received and the matter tabled pending further discussion. This motion was lost with Aldermen Jones, Patterson, Wallace, Flather and McKitka against. 11 3. The Mayor supplied copies of proposed amendments to the Burnaby Board of Variance By-law. Moved by Alderman Johnston That the procedure outlined in the Burnaby Board of Va-riance By-law be referred to a Committee consisting of the Chairman and Vice-chairman of Planning, Chairman of the Board of Variance, Planner and the Chief Inspector. RES.NO.K The Mayor stated that he had recently received a number of complaints that newspaper delivery boxes have become litter areas and that he will be reporting further on possible solutions t o the problem. C. MANAGER'S REPORT RES.NO. K The Manager stated that Council should consider rescinding the recommendation of April 28th in Council in Committee regarding the establishment of a mill rate of 4.5 mills for the Fire Budget. Moved by Alderman Johnston Seconded by Alderman Wallace That Council reconsider Item No. 7 of April 28th Council in Committee of the Whole dealing with the Fire Budget. Moved by Alderman Jones Seconded by Alderman Kuhn That the mill rate to cover the Fire Budget be set at 4.83 mills. RES.NO.K330 RES.NO.K331 then Moved by Alderman Ross That the motion be amended to set the Fire Department mill rate at five mills. I The original motion was then put and as amended.

12 Y RES.NO.K332 then Moved by Alderman Jones That Council adopt the various Budgets considered this afternoon and establish a general mill rate of thirty-four mills. RES.NO.K333 Prior to this motion being put it was Moved by Alderman Wallace Seconded by Alderman Fomich That the mill rate be amended to thirty-six mills. RES.NO.K334 RES.NO. K335 RES.NO.K336 This motion was lost. also Moved by Alderman Flather Seconded by Alderman Ross That the motion be amended to set the mill rate at 35 mills. This motion was lost 2. The Manager suggested that Council approve a method of financing the Centennial Ice Rink and Drop-in Centre, and presented financial recommendations to implement the direction given on April 28th. Moved by Alderman Johnston That Council approve of the Manager's recommendation for financing the construction at a total cost of $471, This was -- with the following amendment: Moved by Alderman Fomich Seconded by Alderman Dunster That the amount of $471, be approved with the funds to be obtained as follows: $225, from the Federal-Provincial Loan Fund, $146, from the balance of the Centennial funds, $ 30, from Centennial Reserves from previous years, $ 70, from other Reserves. with Aldermen Kuhn and Plather against Aldcrman Fomich then left the meeting. The Manager reported that in the opinion of the Solicitor Council cannot now reconsider construction of the Police Building and addition to the Municipal Hall as funds have been arranged under Provincial-Federal borrowing, the by-law passed, and the Architect and Engineer engaged. H. CLERK'S REPORT 1. A request had been received from Apex Holdings Ltd. for approval in principle for a change in the proposed development under By-law No for apartments on 150th Street. The Planner's Report indicated that the original approval would permit 60% one-bedroom and 40% two-bedroom units and at a later date Council approved the addition of townhouses. Changes in the market for townhouses and construction now taking place have caused the developer to request a further change to delete all two a:nd three bedroom townhouses, shift the p:resent proposed apartment building westward o:n the site and add a conventional fifty suite apartment building fronting on 150th Street. A motion by Alderman Dunster, that the by-law be filed, received no seconder. then Moved by Alderman Johnston Seconded by Alderman Flather That Council approve of the change in plans and the developer be given to September 1, 1971 to complete the zoning procedures. hi RES.NO.K337 Council requested a ruling from the Solicitor as to whether this rezoning should be sent to a new public hearing. A request had been received from Village Rentals Ltd. for release of a sewer easement on Lot 17, Section 22 Range 2 Plan This lot is being consolidated with Lot 16 and the sewer easement is not now required to provide service. The Engineer reported that they had no objection to release of this easement. RES.NO.K338 Moved by Alderman Jones That the Mayor and Clerk be authorized to execute the release of this right-of-way agreement. -- RES.NO.K The Deputy Clerk reported that the petition for a water main on 112th Avenue from 154th Street to 156th Street, 154th Street from 110th to 112th Avenue, 11th Avenue from 154th to 155th and 110th Avenue from 154th to 155th Street, is sufficient.
