16 RESOLUTION NO Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION TO ELECT TO THE POSITION OF BOARD PRESIDENT FOR 2018 RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that WHEREAS, the Liberty Township Board of Trustees met this day for an organizational meeting; and WHEREAS, as required by the Ohio Revised Code, the Fiscal Officer called for a motion to elect the 2018 President of the Liberty Township Board of Trustees; THEREFORE, BE IT RESOLVED that the Liberty Township Board of Trustees, County of Butler elect to the position of Board President for Trustee moved to approve the resolution. 31 RESOLUTION NO Board of Trustees, Liberty Township Butler County, Ohio First Reading: January 2, 2018 Second Reading: Dispensed RESOLUTION TO ESTABLISH THE 2018 ZONING FEE SCHEDULE, DISPENSING WITH THE SECOND READING, AND DECLARING AN EMERGENCY RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that WHEREAS, the Liberty Township Board of Trustees met this day for an organizational meeting; WHEREAS, the Liberty Township Board of Trustees desires to set the 2018 Zoning Fee Schedule; THEREFORE BE IT RESOLVED by the Board of Township Trustees of Liberty Township, Butler County, Ohio: SECTION 1. The Board hereby approves the attached 2018 Zoning Fee Schedule. SECTION 2. The Trustees of Liberty Township upon majority vote do hereby dispense with the requirement that this resolution be read on two separate days, and hereby authorize the adoption of this resolution upon its first reading. 62 Liberty Township Meeting Center Rental Policies and Regulations The Liberty Township Meeting Center (the Meeting Center ) is located at 6400 Princeton Road, Liberty Township, Ohio The Meeting Center may be reserved seven days per week from 8:00 a.m. until 10:00 p.m. Reservations must be made through the Reserve a Shelter/Facility button at The Liberty Township Board of Trustees ( Liberty Township ) reserves the right to grant or refuse rental of the Meeting Center to anyone, or to terminate a rental at its sole discretion. Liberty Township has first priority in scheduling the Meeting Center for Township meetings and activities. Liberty Township reserves the right to amend rules and fees at any time without advance notice to the public. Rental Fees and Security Deposit Liberty Township residents: o $50 non-refundable security deposit and $0 rental fee Non-residents: o $50 non-refundable security deposit and $100 rental fee Government Entities & Non-Profit Organizations: o $50 non-refundable security deposit and $0 rental fee Reservations: Reservations may be made up to one year in advance. For those organizations that utilize the facility on a regular basis (one (1) time per month and at least six (6) months out of the year), a $100 non-refundable annual use / maintenance fee will be collected at the time the first reservation of the year is requested. This fee will serve as the security deposit for all meetings of that organization for the year. Security Deposit and Damage Policy A non-refundable security deposit is required for ALL reservations. The security deposit will be collected through PayPal at the time the online Rental Application / Agreement is submitted to secure the reservation. The Renter shall be responsible for the facility being clean and in an orderly state after scheduled use. Should the facilities be left in such a condition to require additional cleanup or maintenance, the security deposit will be used and any additional expenses will be invoiced to the Renter. If damage to the Meeting Center occurs or the key is not returned, the cost of the repairs or to replace the lock will be deducted from the security deposit. If any damages, additional cleaning or repair costs exceed the amount of the security deposit, the Renter will be billed and responsible for payment of the balance. Any violation of the rules and regulations set forth in this Rental Agreement may result in the forfeiture of future renting privileges, as determined by the Township Administrator or its designee. Cancellation Policy If cancellation is necessary, Renter must cancel at least fourteen (14) days in advance. Any changes in rental dates and times must be submitted in writing. Rental and Usage Rules and Regulations All functions conducted in the Meeting Center must be in accordance with Township standards and, therefore, not be in violation of any Township regulations or resolutions. All renters are expected to abide by the rules and regulations set forth in this Rental Agreement and to assume responsibility for the appearance and condition of the Meeting Center. Renters must adhere to all occupancy regulations.

63 The Renter may only access the Meeting Center during their designated rental period and must be present at the Meeting Center for the duration of the rental period. The Meeting Center is not rented to minors. If minors are present during the rental period, the Renter shall provide a minimum of one chaperone over the age of 18 be present during all rental period hours. It is agreed that it is the responsibility of the Renter to ensure all chaperones are qualified and properly screened. Businesses may use the facility for training or business related purposes, but may not use the facility for business parties or the sale of any goods or services. (e.g. Mary Kay, Thirty-One, Origami Owl, etcetera). The storage area on the north of the building and the Administration office are non-public areas and are reserved for Township use only. The Renter shall ensure that no one enters these areas. No food and/or beverages are permitted to be brought into the Meeting Center. No alcoholic beverages are to be brought into or consumed at the Meeting Center. No smoking is permitted at the Meeting Center or within 50 feet of any entrance or exit door. No animals or pets are permitted in the Meeting Center, with the exception of service animals for individuals with disabilities. Owners will be fully responsible for his/her service animal. The Renter must leave the Meeting Center clean and in an orderly state after scheduled use. Any area not left in proper order and repair, in as good or better condition as it was found, will be cleaned and repaired by Liberty Township. The Renter agrees to be invoiced and shall be liable for any and all expenses in excess of the security deposit. The Renter is responsible for removing all waste and any personal items from the Meeting Center at the conclusion of the rental period. A dumpster / refuse container is available in the parking area. The Renter may not attach any decorations or fixtures, change, alter, or make additions to the walls, doors, windows, floors, or ceilings of the Meeting Center. The Renter is responsible for ensuring that all doors are closed and locked, all windows are closed and locked, and all lights are turned off at the conclusion of the rental period. Liberty Township makes no warranties as to the fitness of the Meeting Center for a particular purpose. Liberty Township staff will have access to any rented space in the Meeting Center during the rental period and may observe the Renter s use of the Meeting Center at any time without notice. All efforts will be made to be the least disruptive to the Renter and its use of the Meeting Center. All items currently in the Meeting Center are on inventory and must be accounted for when the Renter leaves. If any items are missing, they will be replaced, and the Renter will be responsible for payment for such replacement. The Renter agrees to be fully responsible for all damages, expenses, and losses, including theft and property loss, caused by any person connected with such person s use of the Meeting Center. Any such costs will be assessed and charged to the Renter. Liberty Township is not responsible for loss or damage to personal property. 64 It is the responsibility of the Renter to pick up the key prior to the rental period. The key must be returned to the offices no later than 4:30 p.m. on the business day immediately following the rental period. The Renter agrees to indemnify and hold harmless Liberty Township, and its officers, employees, volunteers, agents, affiliates, successors, and permitted assigns (the Indemnified Parties ) from and against any and all liability, claims, demands, and expenses, including court costs, and attorney fees, on account of any injury, loss, or damage of whatever kind, incurred by the Indemnified Parties, which arise out of or are in any manner connected with the use of the Meeting Center under this Rental Agreement. The Renter further waives and releases the Township, and its officers and its employees, from any and all liability, claims, demands, and expenses, including court costs and attorney fees, on account of any injury, loss, or damage, which the Renter may suffer and which arise out of or are in any manner connected with the use of the Meeting Center under this Rental Agreement. The Renter, as an individual, and / or agent for the group or organization designated, does hereby agree to comply with all the rules and regulations provided herein governing the use of the Liberty Township Meeting Center. It is further agreed, that the Renter assumes full responsibility for the payment of the rental fee and security deposit and any costs of damages done to the Meeting Center. 107 RESOLUTION NO Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION RESCINDING PREVIOUS NOISE REGULATIONS, ESTABLISHING NEW NOISE REGULATIONS WITHIN LIBERTY TOWNSHIP, AND DISPENSING WITH THE SECOND READING RESOLVED by the Board of Township Trustees of Liberty Township, Butler County, Ohio that WHEREAS, Ohio Revised Code (A) authorizes a board of township trustees to adopt regulations and orders carrying criminal penalties that are necessary to control passenger car, motorcycle, and internal combustion engine noise on streets or highways under the jurisdiction of the township; and, WHEREAS, Ohio Revised Code (B) authorizes a board of township trustees to adopt regulations and orders carrying criminal penalties that are necessary to control noise within the unincorporated territory of the township that is generated at any premises to which a D Permit has been issued by the Ohio Division of Liquor Control or that is generated within any area zoned for residential use; and, WHEREAS, Ohio Revised Code authorizes a board of township trustees of a limited home rule township to adopt regulations and orders that are necessary to control noise elsewhere and from other sources not described above within the unincorporated territory of the township; and, WHEREAS, it is the opinion of the Liberty Township Board of Trustees that unnecessary noise is detrimental to the public health and safety of the Township s residents and constitutes a public nuisance; and, WHEREAS, the Liberty Township Board of Trustees recognizes that it did previously enact similar noise regulations under Resolution No ; and, WHEREAS, it is the intent of this Resolution to rescind Resolution No in favor of new noise regulations contained exclusively within this Resolution; and, WHEREAS, it is the intent of this Resolution to prohibit noise that is unnecessary within the Township as described herein. THEREFORE, BE IT RESOLVED, by the Board of Township Trustees of Liberty Township, Butler County, Ohio:

108 SECTION 1: Definitions. As used in this Resolution, the term noise means any sound, vibration, or oscillation in air pressure. The term plainly audible means noise produced by any source that is perceptible by a person of normal hearing ability. The term amplified noise means noise generated with the aid of technology such as a speaker or other equipment intended to increase, augment, or enhance the original source of the noise. The term dba shall mean decibels, as measured on the A scale of a standard sound level meter meeting the applicable requirements for a type 2 sound level meter as defined in American National Standards Institute Standard S , or the most recent revision thereof. The term daytime refers to the time between the hours of 7:00 A.M. and 10:00 P.M. and the term nighttime refers to the time between the hours of 10:00 P.M. and 7:00 A.M. SECTION 2: Certain Noises Prohibited Pursuant to Ohio Revised Code (A) and Noise generated by passenger cars, motorcycles, or internal combustion engines shall be subject to the following maximum noise levels when operated on streets, roads, or highways under the jurisdiction of Liberty Township: (A) (B) For passenger cars: (i) When operated at a speed of 35 miles per hour or less, 70 dba; (ii) When operated at a speed of more than 35 miles per hour, 79 dba; For motorcycles: (i) When operated at a speed of 35 miles per hour or less, 82 dba; (ii) When operated at a speed of more than 35 miles per hour, 86 dba. For purposes of this Section, noise levels will be measured based on a distance of not less than fifty feet from the center of the line of travel. The Township will post signs giving notice of this regulation on all such streets or highways as the Township deems appropriate. SECTION 3: Certain Noises Prohibited Pursuant to Ohio Revised Code (B). No person in the unincorporated territory of Liberty Township, Butler County, Ohio shall make or permit any noise which by reason of volume, pitch, frequency, intensity, duration, vibration, or nature annoys or disturbs the comfort, peace, or health of a person of ordinary sensibilities, and which is generated at any premises to which Liberty Township Resolution /5

109 a D permit has been issued by the Ohio Division of Liquor Control or is generated within any area that is zoned for residential use. SECTION 4: Certain Noises Prohibited Pursuant to Ohio Revised Code In all other unincorporated areas of Liberty Township not described in the preceding Sections of this Resolution, no person shall make or permit any noise which by reason of volume, pitch, frequency, intensity, duration, vibration, or nature annoys or disturbs the comfort, peace, or health of a person of ordinary sensibilities. SECTION 5: Prima Facie Evidence and Determination of Violation. Amplified noise in excess of 75 dba during the daytime or 55 dba during the nighttime when measured at the boundary line of the property from which the noise is generated or at any other location on a property other than the property from which the noise is generated shall constitute prima facie evidence of a violation of this Resolution. Any Noise Performance Standards contained in the Liberty Township Zoning Resolution may be enforced under the terms of this Resolution. In addition to the prima facie standards set forth above, a citing police officer or court may consider the following factors when determining whether a noise is of such character as to unreasonably disturb the comfort, peace, or health of a person of ordinary sensibility: (A) (B) (C) (D) (E) (F) The area and source from which the noise originates; Complaints of neighbors regarding the noise; Time of day at which the noise takes place; The intensity and duration of the noise; The type of noise produced; and The alternative means available without excessive noise. SECTION 6: Exemptions. The provisions of this Resolution shall not apply to the following: (A) (B) Normal and customary traffic noise; Any law enforcement motor vehicle equipped with any communication device necessary to the performance of law enforcement duties or to any emergency vehicle Liberty Township Resolution /5

110 equipped with any communication device necessary to the performance of any emergency procedures; (C) (D) (E) (F) (G) (H) Noise made by a horn or other warning device required or permitted by state law, when used in accordance with state law; Any person engaging in activities described in Ohio Revised Code 1.61 (Titled: Agriculture defined ) if the noise is attributed to an activity also described in Section 1.61; Any person who engages in coal mining and reclamation operations, as defined in Ohio Revised Code (B), or surface mining, as defined in Ohio Revised Code (A), if the noise is attributed to coal mining and reclamation or surface mining activities; and Noise resulting from the drilling, completion, operation, maintenance, or construction of any crude oil or natural gas wells or pipelines or any appurtenances to those wells or pipelines or from the distribution, transportation, gathering, or storage of crude oil or natural gas. Noise resulting from customary waste or garbage collection services during the daytime. Normal and customary noise occurring on school properties, including sports, band, and other extracurricular activities. SECTION 7: Penalty. Violations of Sections 2 or 3 of this Resolution may be prosecuted as criminal violations as allowed under the Ohio Revised Code, which may include fines or jail time. Any fines levied and collected pursuant to this Resolution shall be paid into the Township s general revenue fund. Pursuant to Section of the Ohio Revised Code, the first violation of Section 4 of this Resolution will result in a $500 civil fine pursuant and each subsequent violation will result in a $1,000 civil fine. The Township reserves the right to pursue any other remedies available to it with regard to any violation of Sections 2, 3, or 4 of this Resolution, which remedies may include pursuing injunctive relief in addition to or as an alternative to the criminal and civil penalties noted above. After the passing of her husband, Christine knew she wanted to make a greater impact in her community. She wanted her fund to support parks, pets, and quality of life. In 2017, Christine lost her battle with cancer. Support economic development and sustainability. Eligibility Funding requests will only be considered if the Foundation receives the organization s Internal Revenue Service (IRS) determination letter verifying that the organization is exempt from taxation under Section 501(c)3 of the IRS code. The mission, programs and services of the organization requesting funds must be consistent with the mission and purpose funding priorities, and the CFWCL. An organization that has an active grant with the Foundation is not usually eligible to receive funding through a new grant until the conclusion of the current grant. Consideration is given to programs with demonstrated evidence of collaboration in West Chester and Liberty Township, as well as programs with multiple funding sources, non-duplication of services and nancial sustainability.
