Roll Call: Present: Ed Palandri, Jay Gundersen, Michelle Schaffer, Ray Pauly, and Karen Fisher. Absent: Tim Podraza and Jackie Wahl. Approval of the Agenda Moved by board member Gundersen seconded by board member Kuchera to approve the agenda as presented. Ayes: 1. Consent Agenda Moved by board member Palandri seconded by board member Gundersen to approve the consent agenda as presented. Ayes: 2. New Business a. Lakeside Mobile Home Community New sign. No one was present to represent Lakeside. Moved by board member Palandri seconded by board member Gundersen to approve the sign. Ayes: b. Mike Levell 2813 N 9 th St Addition to Tire Shop. New plans for an addition to the tire shop were presented. The building inspector has looked at the plans. They will clean up the old building to match the new. Moved by board member Gundersen seconded by board member Pauly to approve the addition. Ayes: Comments: Board member Schaffer thanked everyone for attending the meeting. Board member Palandri commented on the glare from the lights at Spearmint Rhino Club on Abbott Drive. 3 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, Oct. 15, 2012 Regular City Council Meeting 7:00 PM Regular City Council Meeting Mayor Kramer called the regular city council meeting to order at 7:00 PM. The Pledge of Allegiance I. Roll Call: Present Mayor Russell D. Kramer Council members Dave Huey, Barb Hawkins, and Ed Aldmeyer Absent Council member Barb Melonis and Tim Parker Also present City Attorney Joe Thornton and City Clerk Doreen Mowery II. Approval of the Agenda Moved by council member Hawkins seconded by council member Huey to approve the agenda as presented including the addition of Mike Levell. Ayes: III. Consent agenda The clerk corrected an error in one of the wage resolutions. Moved by council member Aldmeyer seconded by council member Hawkins to approve the consent agenda with the correction made by the clerk. Ayes: IV. New Business A. Communications from the Public 1. Courtney Harter was present from SWIPCO to present an outline of the services provided by their organization. Currently Carter Lake is a member of MAPA and the county pays the membership expense. To participate with SWIPCO the cost would be $.65 per capital for a total of $2, SWIPCO offers a housing trust fund and a transit system that are currently not available through MAPA. Courtney also addressed the benefits of belonging to WIDA and the economic development that they do with prospective businesses in southwest Iowa. The council took no action at this time. 2. Todd Dutson was present representing the VFW regarding the fence repair bill that was sent from the City. They are requesting copies of ordinances that would allow the City to bill for the replacement of a fence that is on city property. The VFW objects to having the fence, especially since not all properties on Locust have fences. The VFW has installed parking blocks so that the fence will no longer get hit. The VFW will be petitioning the council to remove the fence. Moved by council member Aldmeyer seconded by council member Hawkins to deny the appeal from the VFW. Ayes: Aldmeyer, Hawkins. Nays: Huey. B. Communications from the Departments 1. Moved by council member Aldmeyer seconded by council member Hawkins to approve an application to the fire department. Ayes: The fire department would like to have a fund raising boot drive on Sunday, Oct. 21 st from 9 AM to 1 PM. They request that the street lights at 13 th and Locust flash red to stop traffic in all directions. Moved by council member Hawkins - 1 -

4 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, Oct. 15, 2012 Regular City Council Meeting 7:00 PM seconded by council member Aldmeyer to approve changing the traffic lights during that period. Ayes: Council member Huey reminded everyone that day light savings time is coming up on the 21 st. Everyone should remember to check their smoke and carbon monoxide detectors and to change batteries if necessary. The fire department would like to host a website and Face Book that would link to the City s website. The Fire Coordinator will supervise both sites. Moved by council member Hawkins seconded by council member Aldmeyer to approve the fire department developing a website and Face Book application. Ayes: 2. Ray Pauly informed the council that the planning board met and that they were in favor of a sign that will be erected by the Mobile Home Community at the corner of 9 th and Ave. K. They also recommended approval of the building addition to Budget Tire on 9 th and Locust St. 3. Storm Committee a. Moved by council member Huey seconded by council member Hawkins to adopt a resolution approving the annual storm water report for FYE Ayes: b. The council will meet with the storm water committee and planning board at the regular planning board meeting scheduled for Monday, Nov. 12, 2012 at 7:00 PM. 4. Moved by council member Hawkins seconded by council member Huey to approve renewal of the employee health insurance package. Ayes: 5. Mike Levell has proposed an addition to his tire shop at 2813 N. 9 th St. The building inspector stated that everything is in order including the storm water. Moved by council member Aldmeyer seconded by council member Huey to approve the plans for the addition. Ayes: V. Ordinances A. Moved by council member Huey seconded by council member Aldmeyer to approve an ordinance on the third consideration that adds a chapter entitled Aggressive Solicitations. Ayes: B. Moved by council member Hawkins seconded by council member Aldmeyer to approve an ordinance amending water rates on the third consideration. Ayes: C. Moved by council member Hawkins seconded by council member Huey to approve an ordinance amending sewer rates on the third consideration. Ayes: D. Moved by council member Huey seconded by council member Hawkins to approve an ordinance amending garbage rates on the third consideration. Ayes: E. Moved by council member Aldmeyer seconded by council member Hawkins to approve a resolution placing liens for unpaid weed bills. Ayes: B. Moved by council member Huey seconded by council member Hawkins to approve a resolution placing liens for unpaid water bills.. Ayes: VII. Comments Mayor Kramer stated that he would like the council to go to the VFW to view the fence issue. The fence was part of the street scape project and we don t need to be tearing out what has been installed. The Mayor has found two outlets for steel toed shoes. Marcus Shoes offered a 15% discount to city employees and Irl Lautenschlager provided information for Mason shoes. Council member Hawkins commented that sometimes we take city services for granted. She had to use the fire department the other day and she was very impressed and feels that putting a full time person on days for first response was one of the better things the city has ever done. She thanked the department for everything they do. Their services are appreciated. Council member Huey thanked everyone for coming to the fire department open house that was held last weekend. It was a very successful and educational event. Sunday, November 11 from 3-4 PM there will be a memorial dedication at the eagle monument in front of City Hall. The event is to honor police officers and veterans. The public is invited. R. J. Brown brought up billing for 3 units of water instead of 2 units. He feels like he is getting over charged. He has requested relief by moving the minimum from 2 to 3 units. John Wallace stated the VFW is lucky to still be in business and they should not have to pay for the fence. 6 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, November 12, :00 PM Joint Planning Board, City Council and Storm Water Committee Workshop Mayor Pro-tem Barb Melonis called the workshop to order at 7:10 PM. Council members present: Ed Aldmeyer, Dave Huey, Barb Hawkins, Tim Parker, and Barb Melonis. Planning Board members present: Jackie Wahl, Ed Palandri, Michelle Schafer, and Ray Pauly. Storm Committee members present: Brad Richardson, Sherry Rydberg, Barry Palmer, Theresa Hawkins and Ron Rothmeyer Also present: City Clerk Doreen Mowery 1. The Storm Water Committee had requested a workshop to update the council and the planning board on the status of Storm Water issues in Carter Lake. A copy of the current NPDES permit for the City of Carter Lake was distributed and reviewed. This permit sets out the rules and regulations for holding a permit in Iowa. There are numerous items that the City must attend to in order to be in compliance with the permit and to avoid future fines and penalties. A publication entitled Managing Storm Water in Iowa Communities Implementing New Requirements was distributed. The Storm Water Committee reviewed the publication with those in attendance at this meeting. In June, 2012 the EPA conducted an on-site inspection and review of the NPDES permit and storm sewer program and system in Carter Lake. A copy of the letter generated by the EPA, after their review, was distributed to the members present at this meeting. The EPA audit provided recommendations for improving the Carter Lake MS4 program. The City must implement its program in full compliance with the terms of the permit, the requirements of the CWA, and EPA s implementing regulations. The Storm Water Committee needs more members on the committee. The permit requires better enforcement by the building inspector and there needs to be additional support from the council and planning board. Funds will be necessary for both on-going and future compliance with the NPDES permit. The Storm Water committee will be reviewing our rules and will be adding new rules as well as monitoring the existing rules. The committee requested planning board and city council liaisons on the storm committee. They would also like a couple of community volunteers. Council members Aldmeyer and Hawkins offered to serve as council liaisons. Planning Board members Wahl and Palandri offered to serve as planning board member liaisons. In the future all regular city council and planning board meetings will have a Storm Water Committee update on the agenda and the liaisons will report to their boards. The building inspector will be making changes to certain forms and permits to include storm water compliance. This joint workshop was adjourned at 8:53 PM. 7 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, November 12, 2012 Special City Council Meeting 6:30 PM Mayor Pro-Tem Barb Melonis called the meeting to order at 6:30 PM. Roll Call: Present Council members Ed Aldmeyer, Dave Huey, Barb Hawkins, Tim Parker, and Barb Melonis Also present City Attorney Joe Thornton and City Clerk Doreen Mowery Absent Mayor Russ Kramer 1. The City Attorney advised the council that he would like to go into closed session to discuss information regarding completion of Locust Street and related expenses. Moved by council member Aldmeyer seconded by council member Parker to go into closed session pursuant to Chapter 21.5 (b) of the Code of Iowa, to discuss strategy with counsel in matters that are in litigation or where litigation is immanent. Ayes: City Council went into closed session at 6:31 PM City council came back into open session at 7:04 PM No decisions or actions were taken by the council at this time. Approval of the Agenda The Planning Board will not be providing an update. Moved by council member Parker seconded by council member Huey to approve the agenda with the deletion of the Planning Board update. Ayes: III. Consent agenda Moved by council member Huey seconded by council member Parker to approve the consent agenda as presented. Ayes: IV. New Business A. Communications from the Public 1. M. H. Weinberg was present representing the union that represents the police department. He suggested that the council consider adding a notice provision to the contract that states if a notice is given it should be sent to both the employee and the union. It is his opinion that this would allow both parties to have a complete understanding of what is occurring and it would provide consistent treatment. Mr. Weinberg also addressed the fact that if there is a need for discipline that the contract calls for progressive discipline. In his opinion, progressive discipline provides more consistent treatment when disciplining a union member. He thinks the council should encourage progressive discipline as a way to discourage arbitration or mediation. B. Communications from the Departments 1. Eric Bentzinger updated the council on Fire Department business. Last month the department had a total of 28 calls and they are currently at 20 calls for this month. Eric also extended a special thank you to all of the Veterans who have served. He also requested that people give the volunteer fire personnel an extra thank you for their efforts. They have been putting in a lot of extra hours and energy lately. He reminded everyone to check the batteries in smoke and carbon dioxide detectors. He also suggested that everyone inspect and clean their furnaces and fireplaces. Citizens should also inspect all Christmas decorations for frayed wires, etc. The OPPD website has information on what to look for when putting up Christmas lights. Council member Hawkins thanked the department again for the good work that they do for the citizens

9 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, Nov. 19, 2012 Regular City Council Meeting 7:00 PM 2. Tina Petersen was in attendance at this time. She spoke to the council regarding a bill she received for repairs to a water stop box. She was not aware that we were going to be fixing the stop box. The City typically repairs broken stop boxes. We can repair some of the stop boxes, however this one needed to be replaced. There is usually a money savings if the City does the work as opposed to hiring a plumber. Tina will call the clerk to make payment arrangements on this bill. 3. There was no planning board update at this time. 4. There was no Storm Committee meeting update at this time. 5. Mayor Kramer would like to reappoint Michelle Schaffer to the planning board. Moved by council member Parker seconded by council member Hawkins to approve the appointment. Ayes: 6. City a. Moved by council member Aldmeyer seconded by council member Huey to approve renewal of the agreement with PeopleService. Ayes: b. Moved by council member Aldmeyer seconded by council member Hawkins to approve assignment of the fire billing services contract from Fire-Extrication-Hazmat Billing, LLP to EMS Billing Services. Ayes: c. Moved by council member Huey seconded by council member Aldmeyer to approve refunds for beer and cigarette permits to Lala, Inc. Ayes: d. The council will have a budget meeting with the department heads on Wednesday, Dec. 19 th starting at 2:00 PM. e. Moved by council member Hawkins seconded by council member Parker to approve the proposal submitted by MAPA to complete a Comprehensive Plan update for Carter Lake. Ayes: f. Moved by council member Aldmeyer seconded by council member Huey to approve and place on file the Annual Financial Report for the FYE Ayes: g. Council member Aldmeyer thanked the fire department for their improved response times and he thanked all of the volunteers that help the city out. He requested the clerk ask for budget funds to update the computer systems. The clerk thanked the two girl scouts, Madison Chaplin and Michaela Wingate, for assisting with the police and veteran dedication ceremony. 11 City of Carter Lake City Hall 950 Locust St. Proceedings: Wednesday, December 5, 2012 Special City Council Meeting 5:00 PM Mayor Russ Kramer called the meeting to order at 5:00 PM. Roll Call: Present Council members Ed Aldmeyer, Barb Hawkins, Tim Parker, and Barb Melonis. Absent Council member Dave Huey Also present Deputy Clerk Lisa Ruehle 1. The Mayor stated that he has reviewed the applications for the Parks & Recreation Director and has had several interviews. He is recommending hiring Christopher Ethan with a starting salary of $39,000 plus benefits and a 90 day review. Council member Aldmeyer expressed concern that the Council and the Parks Board were not involved in choosing the new hire. Council member Melonis suggested that in the future they put in place a procedural policy on hiring new employees. Moved by council member Hawkins seconded by council member Melonis to approve hiring Christopher Ethan as the Parks & Recreation Director. Ayes: Council members Hawkins, Parker, and Melonis. Moved by council member Melonis seconded by council member Aldmeyer to approve renewal of the liquor license for Hollywood Diner. Ayes: 2. Jerry Waltrip does not understand how the City can charge him for storm water when there is no storm drains and the City has an easement to run the water from the street through his property. Jerry expressed concerned because the City Clerk does not want to talk to him. B. Communications from the Departments 1. Moved by council member Aldmeyer seconded by council member Hawkins to approve the application for the fire department. Ayes: 2. There was no Planning Board update at this time. 3. There was no Storm Committee update at this time. 4. Mayor Kramer a. Mayor Kramer would like to reappoint Tim Kessler and Cheryl Calabretto to the Park Board and appoint Ricky Adams to the Junior Park Board. Moved by council member Hawkins seconded by council member Huey to approve the reappointments and the appointment. Ayes: b. Mayor Kramer would like to reappoint Paul Christensen and Michelle McWilliams to the Board of Adjustments. 13 City of Carter Lake City Hall 950 Locust St. Proceedings: Monday, Dec. 17, 2012 Regular City Council Meeting 7:00 PM c. Mayor Kramer would like to reappoint Bonnie Freeman to the Library Board. Moved by council member Huey seconded by council member Melonis to approve the reappointment. Ayes: 5. The City Clerk presented a letter that was submitted by PeopleService regarding some additional services that they can provide for an additional fee. At this time the council would like the information to go to the public to see if there is any interest. The clerk will publish the information in the February newsletter. V. Resolutions A. Moved by council member Parker seconded by council member Hawkins to approve a resolution placing liens for unpaid repair bills. Ayes: B. Moved by council member Parker seconded by council member Huey to adopt a resolution approving destruction of certain city records. Ayes: VI. Comments Mayor Kramer wished everyone happy holidays. Each of the Council members also wished everyone Merry Christmas and happy holidays. Council member Parker stated our thoughts and prayers are with the citizens in Connecticut. Council member Huey reminded everyone to practice safety during the holidays. Council member Hawkins thanked Donna Lautenschlager for serving as an election poll worker for 35 years. 14 City of Carter Lake City Hall 950 Locust St. Proceedings: Wednesday, December 19, 2012 Special City Council Budget Workshop 2:00 PM Mayor Russ Kramer called the meeting to order at 2:00 PM. Roll Call: Present Council members Ed Aldmeyer, Dave Huey, Barb Hawkins, and Tim Parker. Absent Council member Barb Melonis Also present City Clerk Doreen Mowery 1. The department heads were all present and submitted their budget requests to the mayor and council. The mayor and council reviewed the requests and asked questions and made suggestions. The clerk will prepare budget spreadsheets and include all of the requests as submitted. The council will meet in January to review additional budget information. Mayor Kramer would like to appoint Roger Wilson and Genevieve Hawkins to the Park Board. Moved by council member Aldmeyer seconded by council member Parker to approve the appointments. Ayes: B. Communications from the Public 1. Moved by council member Melonis seconded by council member Aldmeyer to approve renewal of Lakeside Auto Recyclers salvage permit. Ayes: 2. Moved by council member Aldmeyer seconded by council member Hawkins to approve renewal of the liquor license for the Kwik Shop. Ayes: 5. Moved by council member Aldmeyer seconded by council member Parker to approve the application from new owners for a liquor license at the Jump Start. Ayes: 6. Moved by council member Melonis seconded by council member Hawkins to approve issuing a cigarette permit to the new owners at Jump Start. Ayes: Hawkins, Parker, Melonis. Nays: Aldmeyer. 7. Jerry Waltrip had questions about why the city has started charging a storm water fee. The Mayor explained that the EPA and DNR have told us we need to control our storm water as it flows to the lake and to the river and there are costs associated with regulating storm water. Council member Parker stated that in the past the lake was impaired and we need to continue to monitor the water quality. Jerry Waltrip stated that the Attorney General in the State of Virginia filed a lawsuit against the EPA regarding storm water and the district court judge found in favor of Virginia. The City Attorney offered to look at the information Jerry brought to the meeting. C. Communications from the Departments 1. There was no fire department update at this time. 2. There was no Planning Board update at this time. 3. Council member Aldmeyer updated the council on the recent storm water committee meeting. An ordinance was presented to the council with some proposed changes in the snow removal process. Council member Parker wanted to know what brought about the request for changes. The Mayor explained that the last snow highlighted some of the issues with clearing snow due to vehicles being left on the street. There is no order in how we address snow removal. The proposal implements an odd/even program like they use in Omaha. Council member Aldmeyer was concerned that plowable snow replaced 4 inches in the proposal. He was also concerned about what time the vehicles would have to be moved. Council member Parker thought it would be best to tell everyone to get off the street and park in either the driveway or in their yard. Council member Melonis thinks there are many plowable snows that do not meet the criteria for a snow emergency. 34 CHAPTER 175 STREET USE AND MAINTENANCE merchandise of any kind upon any street or alley for the purpose of storage, exhibition, sale or offering same for sale, without permission of the Police Chief WASHING VEHICLES. It is unlawful for any person to use any public sidewalk, street or alley for the purpose of washing or cleaning any automobile, truck equipment, or any vehicle of any kind when such work is done for hire or as a business. This does not prevent any person from washing or cleaning his or her own vehicle or equipment when it is lawfully parked in the street or alley BURNING PROHIBITED. No person shall burn any trash, leaves, rubbish or other combustible material in any curb and gutter or on any paved or surfaced street or alley EXCAVATIONS. No person shall dig, excavate or in any manner disturb any street, parking or alley except in accordance with the following: 1. Permit Required. No excavation shall be commenced without first obtaining a permit therefor. A written application for such permit shall be filed with the City and shall contain the following: A. An exact description of the property, by lot and street number, in front of or along which it is desired to excavate; B. A statement of the purpose, for whom and by whom the excavation is to be made; C. The person responsible for the refilling of said excavation and restoration of the street or alley surface; and D. Date of commencement of the work and estimated completion date. Work shall be started within one week after the date of issuance of the permit. E. Each application shall contain an agreement signed by the applicant, in which the applicant agrees to perform all work in a good and workmanlike manner and in accordance with the rules and specifications established by the City Maintenance Department and on file in the office of the Clerk. If an emergency arises in which it becomes necessary to make an immediate excavation in order that the public safety be preserved, then, in that event, it shall not be necessary to secure a permit prior to making the excavation; provided, however, the permit shall be secured immediately upon termination of the emergency. 2. Public Convenience. Streets and alleys shall be opened in the manner which will cause the least inconvenience to the public and admit the uninterrupted passage of water along the gutter on the street. On main thoroughfares there shall at all times be sufficient traffic lanes open to permit a substantially normal traffic flow.
