PUBLIC COMMENT Dale Burie, LeaJane Burie, Mary Hansen, Scott Lindquist support of Ordinance No ORDINANCE # AMENDING CHAPTER 17 OF THE MARINETTE COUNTY CODE OF ORDINANCES ZONING CODE The County Board of Supervisors of the County of Marinette does ordain as follows: Section One: Sections 17.05, and of the Marinette County Code of Ordinances are amended to read as follows: FORESTRY DISTRICT (1) In the Forestry District, no building, land or premises shall be used except for one or more of the following specified uses: (a) Production of forest products. (b) Forest industries. (c) Public and private parks, clubs, playgrounds, campgrounds and golf grounds. (d) Recreational camps and resorts. (e) Private summer cottages and service buildings. (f) Hunting and fishing cabins. (g) Trapper s cabins. (h) Boat liveries, fish hatcheries and fisheries. (i) Game, bird, fur and animal farms licensed by the Wisconsin Conservation Department under to , Wis. Stats. (j) Non-Metallic Mines, Stone quarries, and gravel pits. (k) Hydro-electric dams, power plants, flowage areas, transmission lines and substations, telephone and telegraph lines and offices. (l) Harvesting of any wild crop, such as marsh hay, ferns, moss, berries, tree fruits and seeds. (m) Growing of cranberries. (n) Production of agricultural crops when the land on which these crops are grown is part of a farm located in an Unrestricted or Agricultural District. (2) Any of the above uses are permitted in the Forestry District and all other uses, including farms, family dwellings, off premises signs and 19

2 yearlong permanent residences, shall be prohibited. (3) Notwithstanding any provision of the Marinette County Code of Ordinances to the contrary, nonferrous metallic mining, as defined in Wis. Stat. sec (9) is a prohibited use and shall not be considered a part of the specified uses except as allowed by a local agreement entered into pursuant to Wis. Stat. sec RECREATION DISTRICT (1) In the Recreation District, all buildings, lands or premises may be used for any of the purposes permitted in the Forestry District provided, however, that no sawmill or other wood using industry shall be established in the Recreation District within two hundred (200) feet of any public highway or of the lot lines of the property upon which it is located. In addition, filling stations, garages, machine shops, restaurants, motels and hotels, rental cabins and cottages, resorts, taverns, commercial stores, dance halls, theaters and other establishments servicing the recreation industry and family dwellings are permitted. (2) Any of the above uses are permitted in the Recreation District and all other use, including farms and off premises signs, shall be prohibited. (3) Notwithstanding any provision of the Marinette County Code of Ordinances to the contrary, nonferrous metallic mining, as defined in Wis. Stat. sec (9) is a prohibited use and shall not be considered a part of the specified uses except as allowed by a local agreement entered into pursuant to Wis. Stat. sec UNRESTRICTED DISTRICT In the Unrestricted District, any land may be used for any purposes whatsoever not in conflict with law; however, off-premises signs and nonferrous metallic mines shall be regulated as stated below. (1) Off-premises signs less than or equal to sixty four (64) square feet in area are permitted under the following conditions: (a) Shall have a maximum height not to exceed eight (8) feet above mean centerline grade of adjacent highway. (b) Shall not be located within fifty-two hundred eighty (5,280) feet (1 mile) of any other off premises sign. (c) Shall not be located in the vision clearance triangle at highway and/or railroad intersections. Vision clearance triangle shall be as required by the highway authority. (d) Shall not be lighted. (e) Shall be permitted by obtaining a Zoning Permit before commencing construction. (2) Off-premises signs greater than sixty-four (64) square feet and less than five hundred seventytwo (572) square feet are permitted under the following conditions. (a) Shall not be located beyond fifty-two hundred eighty (5,280) feet (1mile) of any incorporated municipal boundary. (b) Shall not be located within fifteen hundred (1,500) lineal feet of any other off-premises sign. (c) Shall have a maximum height not to exceed thirty-five (35) feet in height above the mean centerline grade of the adjacent highway. (d) Shall be lighted in a manner that does not cause glare or impair driver visibility. Signs may be illuminated but not flashing. (e) Shall not be located in the vision clearance triangle at highway and/or railroad intersections. Vision clearance triangle shall be as required by the highway authority. (f) Shall be engineered to withstand forty (40) pounds per square foot of wind load. (g) Shall be permitted by obtaining a Zoning permit before commencing construction. (4) Off-premises signs greater than five hundred seventy-two (572) square feet are prohibited. (5) Notwithstanding any provision of the Marinette County Code of Ordinances to the contrary, nonferrous metallic mining, as defined in Wis. Stat. sec (9) is a prohibited use and shall not be considered a part of the specified uses except as allowed by a local agreement entered into pursuant to Wis. Stat. sec Section Two: This ordinance shall be effective immediately upon passage and publication. Rob Vellella, Citizen at Large, to Civil Service Commission Don Phillips, Member of Elderly Services Board, to Aging and Disability Resource Center Governing Board Randy Peterson, representing Waupaca Foundry, to the LEPC ORDINANCE # AMENDING THE GENERAL CODE OF ORDINANCES OF MARINETTE COUNTY - COUNTY GOVERNMENT CHAPTER 7 TRAFFIC CODE The Marinette County Board of Supervisors does ordain as follows: Section One: Section 7.09 (2) is amended as follows: (2) Designation of ATV/UTV Highway Routes (b) The following roads in the County of Marinette, Wisconsin, are hereby designated as daylight ATV/UTV routes during the period commencing May 1 and ending December 1 unless designated otherwise: (24) County Highway P beginning at 37 th Road and ending at 25 th Road all in the Town of Beaver. (25) County Highway P beginning at 25 th Road and ending 200 feet west of USH 141 all in the Town of Beaver. (26) County Highway P beginning at 13 th Road and ending 220 feet east of USH 141 all in the Town of Beaver. Section Two: This ordinance as amended shall be effective on upon approval of County Board Supervisors. Motion (Zahn/Mans) to approve Ordinance # Amending the General Code of Ordinances of Marinette County - County Government Chapter 7 Traffic Code. Motion carried. ORDINANCE # AMENDING THE GENERAL CODE OF ORDINANCES OF MARINETTE COUNTY - COUNTY GOVERNMENT CHAPTER 4 COUNTY GOVERNMENT The Marinette County Board of Supervisors does ordain as follows: Section One: Sections 4.01 through 4.02 are amended as follows: 4.01 GENERAL PROVISIONS (1) Authority. This chapter is promulgated under the authority of 59.22(2)(c), Wis. Stats. (2) Purpose. The purpose of this chapter is to establish uniform county personnel policies and procedures to recruit, select, develop and maintain an effective and responsive work force for the county. (3) Policies and Procedures. Administration shall maintain a Personnel Policies and Procedures Manual HUMAN RESOURCES DEPARTMENT (1) Organization. There shall be in Marinette County Government a Human Resources Department under the jurisdiction of the Administrative Committee. 21

4 (2) Responsibility and Duties of Human Resources. (a) HUMAN RESOURCE DIRECTOR. The Human Resource Director shall: (1) assume responsibility as set forth in the Personnel Policies and Procedures Manual. (3) Policies and Procedures. Marinette County shall maintain a Personnel Policies and Procedures Manual.... Section Two: This ordinance as amended shall become effective immediately upon passage and publication. Voting no Supervisor Mailand ORDINANCE # AMENDING THE GENERAL CODE OF ORDINANCES OF MARINETTE COUNTY COUNTY GOVERNMENT CHAPTER 2 COUNTY GOVERNMENT The County Board of Supervisors of the County of Marinette does ordain as follows: Section One: Section 2.04 (2), Section 2.07 (1), 2.07 (2) and 2.07 (9) of the Marinette County Code of Ordinances are amended to read as follows: 2.04 COUNTY BOARD RULES OF PROCEDURE. (2) Standing Committee Meetings. (a) The standing committees shall meet as follows: (4) Health and Human Services Board shall meet the 1 st Thursday at 1:30 pm following the first full weekend of the month COMMITTEES OF THE COUNTY BOARD (1) Standing Committees. (a) The following committees shall be standing committees and shall be named at the biennial organizational meeting: (4) Health and Human Services (2) Committee on Committees. It shall be the duty of the Committee on Committees to nominate 22 for confirmation by the County Board, the membership of all standing committees of the County except the Health and Human Services Board, which shall be by appointment of the County Administrator upon recommendation of the Committee on Committees and approval of the County Board. The Committee on Committees, during the reorganization process shall consider supervisor requests, qualifications, and seniority to guide Committee on Committees in filling committee assignments COMMITTEES OF THE COUNTY BOARD (9) Health and Human Services Board. The composition and duties of the committee shall be: Section Two: This ordinance shall be effective immediately upon passage and publication. Approved by a majority of a quorum of the Marinette County Board of Supervisors this 29 th day of May (Main) Motion (Mailand/Behnke) to approve Ordinance # Amending the General Code of Ordinances of Marinette County County Government Chapter 2 County Government. (Amendment) Motion (Behnke/Gustafson) to amend main motion to meet on 1 st Wednesday at 1:30 pm following the first full weekend of the month. (Amendment II) Motion (Holley/Stankevich) to refer the amendment back to the Health and Human services committee for action. Motion carried. 5 at a cost not to exceed $95,000.00, subject to Corporation Counsel approval. Motion carried. INFRASTRUCTURE Motion (Mans/Sauld) to approve easement with Wisconsin Public Service for the purpose of underground electric located on Part of Lot 1 of Block 2 of I. Stephenson s First Addition to the Village (Now City) of Marinette, being part of Section 6, Township 30 North, Range 24 East, City of Marinette, County of Marinette, State of Wisconsin, pending Corporation Counsel approval. Motion carried. ADMINISTRATIVE Motion (Schroeder/Polzin) to approve tentative purchase of Crossroads Schacht Road property for fair market value contingent on reaching an acceptable agreement with the Group Home Association related to juvenile placements. Motion carried. Motion (Schroeder/Sauve) to approve 2019 Budget Policy and Schedule. Motion carried. Motion (Schroeder/Pazynski) to approve Amendment 91 to Personnel Policies and Procedures Manual Section 1.04 Definitions and 1.26 Conditions of Employment. Motion carried.
