1 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, PIERCE COUNTY, WASHINGTON DESIGNATING THE TACOMA NEWS TRIBUNE AS THE SOLE SOURCE OFFICIAL NEWSPAPER FOR A PERIOD OF ONE YEAR. WHEREAS, BLMC requires the City to call for bids for the services of an official newspaper; and WHEREAS, RCW sets out the minimum qualifications for official newspapers; and WHEREAS, BLMC Section further provides that bids may be dispensed with and competitive bidding requirements waived pursuant to RCW (J)(a) if the City Clerk determines that only a single newspaper meets the qualifications; and WHEREAS, the City Council affirms that daily publication of its official newspaper and circulation for the Zip Code in excess of 3,750 Monday - Saturday and 4,500 for Sunday are desirable qualifications; and WHEREAS, the City Clerk's Office has conducted a telephone survey of local newspapers and determined that only one newspaper, the Tacoma News Tribune, meets the publication and circulation criteria. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, WASHINGTON, THAT: Section 1. There exists a single source of supply meeting the City'S qualifications for its official newspaper. Section 2. The bidding requirements of BLMC and RCW are hereby waived. Section 3. Bonney Lake Municipal Code requires the City annually In year's past the City has determined that in addition to the qualifications included in the Revised Code of Washington, that daily publication and a local zip code circulation in excess of 3,750 Monday - Saturda{ and 4,500 on Sunday were desirable qualifications. After a phone survey of the Tacoma News Tribune, Puyallup Herald, Enumclaw Courier-Herald and Seattle TimelPI it was determined that the Tacoma News Tribune is the sole source provider meeting the City's qualifications. Of interest is the announcement that the Enumclaw Courier-Herald intends to begin publication of a weekly newspaper in Bonney Lake in November of this year. In 2003, the City budgeted $4,000 for advertising. Through June 2003, the City had nearly spent $5,000. Estimated expenditure due to continued employment recruitment and development-related advertising is $10,000. 6 City of Bonney Lake Request for Qualifications Official Newspaper July 2003 The City of Bonney Lake, Pierce County, Washington is soliciting the interest of qualified newspapers to serve as the City's official newspaper. Requirements: * Must meet minimum qualifications defined by RCW 65.l * Must publish 7-days per week. * Must have circulation for Zip Code of at least 3,750 for Monday-Saturday circulation, and at least 4,500 for Sunday circulation. * Must be able to profile City of Bonney Lake activities, issues, profiles, or other stories of interest. * Must be able to provide 1 original affidavit of publications for all legal publications submitted by the City Clerk's office. * Must be able to apply City payments to corresponding invoices. * Must be able to confirm receipt of faxes or s submitted for legal publications as requested. * Publisher must have at least 3 years expedence in providing daily newspaper services. Contract Period: It is anticipated the period of the bid will be 1 year with annual bid process after the initial 12-month pedod.

7 Bonney Lake Municipal Code Chapter 1.20 OFFICIAL NEWSPAPER Sections: Call for bids Designation of official newspaper Call for bids. The city shall, at least annually, call for bids for the services of an official newspaper for the publication of all required public notices. The call for bids shall require that all bidders meet the minimum qualifications set out in RCW ; provided, that the call for bids may specify additional qualifications as deemed necessary, including, without limitation, publication more frequently than once per week; and provided further, that the call for bids may be dispensed with and competitive bidding requirements waived pursuant to RCW (l)(a) if, after reviewing the city's needs and the qualifications that would otherwise be included in the call for bids, the city clerk determines that only a single newspaper meets such qualifications, in which case such newspaper shall be designated the official newspaper pursuant to BLMC (Ord , 2001; Ord ,2000) Designation of official newspaper. Following the annual bid procedure required in BLMC , or waiver of such procedure as provided for therein with respect to single sources, the council shall award the annual contract for publication of official notices to the lowest responsible bidder meeting the requirements specified in the call for bids, or in the case of a single source, to the single newspaper meeting such qualifications. The council shall by resolution designate such newspaper as the city's official newspaper for the following one-year period. All city notices required to be published, either by law or ordinance, shall be published in the official newspaper; provided, that such notices may also be published in additional newspapers. The qualifications of a legal newspaper are that such newspaper shall have been published regularly, at least once a week, in the English language, as a newspaper of general circulation, in the city or town where the same is published at the time of application for approval, for at least six months prior to the date of such application; shall be compiled either in whole or in part in an office maintained at the place of publication; shall contain news of general interest as contrasted with news of interest primarily to an organization, group or class; shall have a policy to print all statutorily required legal notices; and shall hold a peiiodical class mailing permit: PROVIDED, That in case of the consolidation of two or more newspapers, such consolidated newspaper shall be considered as qualified if either or any of the papers so consolidated would be a qualified newspaper at the date of such legal publication, had not such consolidation taken place: PROVIDED, That this section shall not disqualify as a legal newspaper any publication which, prior to June 8, 1961, was adjudged a legal newspaper, so long as it continues to meet the requirements under which it qualified.
