This would include curb/gutter/sidewalk improvements and undergrounding the utilities. Councilmember s asked questions and had concerns with allowing the City to be exempt from frontage improvements, yet is a requirement for any developer to complete. With Three No Votes, Failed to Move Out of Committee AB17-45 Resolution 2590 Small Works Construction Contract with Stripe Rite, Inc. for the 2017 Striping Project, Superintendent of Public Works Ryan Johnstone Superintendent of Public Works Johnstone commented the City has used Stripe Rite before and have not had any issues with their work. 5 ORDINANCE NO. D17-68 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, PIERCE COUNTY, WASHINGTON, AMENDING CHAPTER OF THE BONNEY LAKE MUNICIPAL CODE AND THE CORRESPONDING ORDINANCES NO. 1510, 1266, AND 561 RELATING TO SEWER SYSTEM REGULATIONS. WHEREAS, to protect the sanitary sewer system from the harmful effects of fat, oil, and grease (FOG) deposits, the Bonney Lake Municipal Code regulates and limits said deposits from commercial establishments including restaurants; and WHEREAS, the Bonney Lake City Council desires to update and refine the FOG ordinance to provide clarification regarding the FOG enforcement process and penalty structure; and WHEREAS, discharging stormwater into the sanitary sewer system risks overloading the sewer, and results in additional expenses to the City for sewage treatment, which are not reimbursed by rates; and WHEREAS, to improve the City s ability to enforce its Code provisions prohibiting discharge of stormwater into the sewer system, the City Council desires to update its enforcement provisions. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. BLMC Subsection H and the corresponding portions of Ordinance Nos. 1510, 1266, and 561 are hereby amended to read as follows: H. Notice of ViolationNon-Compliance, Compliance, and Violation. In the event that a grease interceptor or other grease removal device fails a visual or effluent sample analysis inspection, or any other condition exists that does not comply with this chapter, the user shall be given a written notice of the noncompliancet condition (NONC) and must take immediate steps to bring the grease interceptor or other grease removal device into compliance. The city-issued notice of violation (NOV)NONC shall set a time limit for compliance of 21 calendar days after the NOV NONC is issued; however, the NONCV time limit may be adjusted in a way that is appropriate to the nature and degree of noncompliance, the nature of the needed repairs, and whether the noncompliance creates the need for emergency repairs. The user is responsible for all associated costs to bring their grease interceptor into compliance. The City will re-inspect the grease interceptor at the conclusion of the 21 day time limit for compliance. Should the user Agenda Page 5 of 27
6 rectify the non-compliant condition and pass their re-inspection, the user shall be issued a Notice of Compliance (NOC) and no further action will be necessary. Should the user not rectify the non-compliant condition, the user shall receive a Notice of Violation (NOV) and fines will be assessed in the following manner: 1. First Violation. Upon discovery of a condition that does not comply with this section, the city shall send the violator an NOV with reference to the type of noncompliant condition. Failure to cure the noncompliant condition within the time prescribed in the NOV shall constitute a first violation and result in a $ fine. 2. Second violation within 12 months of receiving an the first NOVNONC: an additional fine of $1,000 fine. 3. Third violation within 12 months of receiving an the first NOVNONC: an additional fine of $2,000 fine. 4. To encourage regular maintenance and discourage repeat violations, the third issuance of a NONC for the same or similar noncompliant condition within 12 months of receiving the first NONC shall result in a fine of $1,500, even if the violations have been corrected. 5. Fourth and subsequent violations within 12 months of receiving an the first NOVNONC: an additional fine of $4, For purposes of this subsection, a violation shall be deemed to occur upon failure to cure a noncompliant condition within the time prescribed in any NOVNONC. The third issuance of an NOV for the same or similar noncompliant condition within 12 months shall result in a fine of $1,500, even if the violations are corrected. 6. Termination of Service. In addition to the foregoing penalties and not in any way a limitation thereof, chronic violators may be subject to termination of water service by the city if they who incur six or more NOVs in a 12-month period. may be subject to termination of water service by the city. 7. If an obstruction of the sanitary sewer collection system occurs that causes a sanitary sewer backup and/or overflow and such overflow is attributed in part or in whole to an accumulation of grease in the sanitary sewer main line, the city of Agenda Page 6 of 27
7 Bonney Lake will take appropriate enforcement actions against the generator or contributor of such grease. These actions may include a civil action for recovery of all costs associated with clean-up activities and repair of any damaged facilities. 8. Any person who knowingly makes any false statements, representation, record, report, or other document filed with the city or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this document is subject to administrative fines or facility closure as outlined in BLMC and Section 2. Section of the Bonney Lake Municipal Code and the corresponding portions of Ordinance No. 561 are hereby amended as follows: Violation Penalty. A. Unless otherwise specified Aany person found to be violating any provision of this chapter, except BLMC , shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations. B. Any person who shall continue any violation beyond the time limit provided for in the notice of violation BLMC , shall be guilty of a misdemeanor, and on conviction thereof, shall be fined in the amount not exceeding $5,000 for each violation. Each day in which any violations continue shall be deemed a separate offense. C. Any person violating any of the provisions of this chapter shall become liable to the city for any expense, loss or damage occasioned by the city by reason of such violation and a reasonable attorney s fee plus costs if legal action is necessary to enforce the city s rights herein. Section 3. The city clerk shall sign and file with the adopting ordinance a copy of the statutes and regulations referenced herein and shall also file and maintain the city clerk s office one copy of each of the adopted laws in the form in which they were adopted for use and examination by the public. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. This Ordinance shall take effect and be in force thirty (30) days from and after its passage, approval and publication, as required by law. Agenda Page 7 of 27

Administrative Recommendation: Approve Background Summary: The Department of Health mandates a goal of less than 10% Distribution System Leakage (DSL), or unaccounted for water. Since 2007 the City of Bonney Lake water system has averaged 12.38% DSL with an 10.81% average for the past 3 years (down from 11.55% ). One method used to help identify leaks and minimize water loss is through the use of leak detection services. This service utilizes state of the art technology and equipment to listen to water appurtenances for sound of underground leakage. The last 3 years the City performed a 'Point to Point' leak detection survey that listens to all water appurtenances including service lines, meters, valves, and fire hydrants. In previous years, staff worked with the contractor in areas with a history of leaks. As the City has replaced the older infrastructure, it was decided to begin conducting the leak survey on a system wide basis, with a goal of surveying the entire system on a 20%-25% per year rotation. This not only covers the older portions of the system, but also checks on newer sections that have never been covered by the survey. Water staff worked with GIS staff to create maps for use with the goal in mind. Last year's survey identified 17 leaks, 8 of which were on service lines, with an estimated leakage rate of 64 gallons per minute or 33.6 million gallons per year. The 2016 survey was conducted in the southeastern and City core portions of the distribution system covering approximately 20% of the total system. The 2017 survey will continue where the 2016 survey ended and cover the southwestern and western sections of the system.
