Nationwide it is estimated that over $7.6 Billion of FHWA transportation funding is at risk. Recently, CTDOT has performed analysis of their existing programming and has determined that approximately $165 Million is in jeopardy. CTDOT has explored mitigation strategies and estimates that by revising project funding sources, via TIP actions and amendments, this amount could be reduced to approximately $38 Million. The mitigation strategy relies heavily on moving FFY and projects into and out of the STP-Urban program, which is one of the few programs that is immune to the rescission. This rescission only applies to FFY, and therefore carryforward rules are expected to return to normal after FFY. Attached are TIP action requests prepared by CTDOT. These are anticipated to contain all the actions needed to employ the mitigation strategy, however additional minor TIP actions may be requested as FFY programs progress. Also attached please find the following documents further explaining the rescission implications and mitigation strategies: CTDOT s handout from 11/6/2018 MPO coordination meeting CRCOG s General Federal Rescission Strategy graphic. By reprogramming projects from to funding sources subject to rescission, rescissions in other programs can be minimized. Conversely, in, various projects from funding sources that faced rescission would be funded using funding to attempt to restore previous solvency to that source. CRCOG staff recommends committee discussion of the rescission mitigation, and that a motion be made to approve the related TIP actions. 4 CTDOT handout from 11/6/2018 MPO coordination meeting Strategy to Mitigate FY FAST ACT Rescission Background The FAST ACT includes $7.6 billion rescission of Highway funding in FFY. There is no impact on Transit funding. The CT share of the rescission is estimated to be $96.9 million. Without any modifications to our existing Capital Plan, approximately $165 million of apportionment would be rescinded across many programs. CTDOT has developed a mitigation strategy to avoid losing $127 million of apportionment. This strategy reduces the potential rescission to $38 million. Mitigation Strategy In general, earmark funds, STP-suballocated program funds Safety funds are NOT subject to rescission. All other funds NHPP, STPA, CMAQ, TAP, BRZ and SPR ARE subject to rescission. The strategy maintains the full capital program as planned for FFY no projects are delayed, but funding sources are changed to avoid rescission. The plan involves swapping funding sources for FFY projects (primarily urban projects going to NHP and STPA) and then swapping other projects (primarily from NHP and STPA into urban) in FY. The plan uses financial tools like the AC mechanism and Fund Transfers to ensure the use of certain federal program funds, the carryforward of other program funds, and the obligation of all available ceiling. There are several funding sources that cannot be changed and where project schedules will result in likely rescission. o Off system bridge (BRZ) -- $22 million o Transportation Alternatives (TAP) suballocated funds -- $11 million The BRZ and TAP projects are municipally controlled, can t be shifted to state funds, and the funds can t be transferred out. The estimated rescission amounts are based on project schedules as of last month, and could either be greater or smaller depending on the status of the projects by July 1,. Actions Required The shifts to project funding require over 100 STIP actions. These do not require TIP/STIP amendments. To effectuate all the funding transfers, CTDOT is asking the regions to approve the changes in December. managed by municipalities that are still subject to rescission should get special focus to minimize the potential rescission.
