7 Date: July 18, 2007 To: From: Subject: Management Committee Mike Flake, PE, and Dr. Khalil Abusaba, Brown and Caldwell By: Jamison Crosby, Watershed Management Planning Specialist Contra Costa Clean Water Program Presentation Item B Introductory Presentation by the Program s New Technical Services Consultant, Brown and Caldwell Recommendation: Receive presentation. Background: Brown and Caldwell was recently selected by the Management Committee to serve as the Program s technical services consultant for FY 2007/08. Brown and Caldwell has a nationwide staff of over 1,500 people, of whom 179 are located at their local Walnut Creek office. Their project team will consist primarily of five (5) in-house staff plus two (2) subconsultants, Mactec and Armand Ruby Consulting. Mike Flake, PE, will serve as the project manager. Flake was a senior manager of the Caltrans stormwater program, one of the largest stormwater programs in the country. Flake managed the overall planning and implementation of activities for complying with more than 33 different TMDLs around the state. He also managed the Caltrans BMP Pilot Retrofit Program which was awarded Best Research Project Award from the California Stormwater Quality Association (CASQA) in 2005 for its landmark achievement in developing numeric pollutant removal criteria associated with treatment controls. Dr. Khalil Abusaba will serve as lead technical support for Flake. Abusaba spent the last ten (10) years helping municipalities develop monitoring programs to meet regulatory requirements. As one of the founders of the San Francisco Bay

8 Regional Monitoring Program (RMP), he helped the RMP re-design the status and trends section of the monitoring program to more closely match the requirements of the TMDLs. Flake and Abusaba will present additional information about their background and experience, relevant projects they ve worked on, and how they plan to assist the Program in meeting our monitoring and other technical needs. Matt Graul will present Water Board staff s review comments of the Program s Fiscal Year 2005/2006 Annual Report. As reported at the February 2007 Management Committee meeting, Water Board staff s comments focus on two program components: 1) New Development & Construction Controls; and, 2) Commercial/ Industrial Inspection Activities. Introductions: Following a closed session meeting, Greg Connaughton, Chairperson, began the meeting at 1:50 pm. Self introductions were made then Connaughton proceeded immediately to the agenda. II. Presentations: A. Contra Costa Monitoring and Assessment Plan (CCMAP) Report Chris Sommers provided a PowerPoint presentation and reviewed the history of CCMAP from its inception. CCMAP has monitored sites each year for at least two (2) years for a total of 120 sites in 17 watersheds. 1

12 In 2004 CCMAP expanded to include Volunteer Monitoring Data. Sommers stated the CCMAP 2006 report was written to summarize and provide a broad overview of the 17 watersheds sampled to date from either Cressey and Associates or the Volunteer Monitors. Watersheds are evaluated using Benthic Macroinvertebrates (BMI) as a key indicator of aquatic health. A Benthic Index of Biotic Integrity (B-IBI) was calculated for creeks in Contra Costa County based on similar indices for creeks in other California regions. Results suggest 40% of creeks stations score in the very good, good or fair categories which are typically stations at the upper region of the watershed. Sommers indicated he believes the Program has established aquatic quality baselines to compare to all future monitoring activities. The Program will determine next steps. B. Summary of Polychlorinated Biphenyls (PCBs) Case Studies City of Richmond - Sommers explained PCBs are a family of 209 individual chemical compositions (congeners) that were banned in The life expectancy of PCBs is decades long and urban runoff is the leading source of PCBs to the Bay. Cutting Blvd. and Wright Ave. drainage areas are particularly high in PCBs because of the historical land uses in the area. Sommers stated sampling was conducted in 2001, 2002 and again in Sampling results suggest industry is the common source of the PCBs, and PCB level exceeds regulatory screening levels greater than 50% of the time in the two (2) sampling areas. Sommers recommends more street sweeping to reduce urban runoff and providing a copy of the PCB report to the San Francisco Bay Regional Water Quality Board to secure help in enforcement, continued monitoring and to develop a PCB abatement plan following the identification of PCB sources. Sommers also suggested conducting controlled sampling to develop a better understanding of the area. Tom Dalziel followed up by announcing a San Francisco Bay PCBs TMDL Informational Workshop on Thursday, June 28, 2007 from 1:00 to 3:00 pm at 1515 Clay St. in Oakland in the Auditorium Room. C. Fiscal Year 2006/2007 Annual Report: A. C.3 Reporting Dalziel distributed a list of projects subject to C.3 under review during 2006/2007, parts A and B. Dalziel briefly reviewed the columns in the worksheet and explained the intent of the worksheet was to track development in approved (Part A) and in progress (Part B) for the annual report. Dalziel stressed it is the decision of the municipality to define when a project is approved or in progress. 2

Status of and Experience in Preparing Municipal Annual Reports Dalziel urged new committee members who may have little or no experience to call on senior committee members who have years of experience for help or guidance. APPROVE and ACCEPT Final Contra Costa Monitoring and Assessment Plan (CCMAP) Report Jamison Crosby explained the Watershed Assessment and Monitoring (WAM) Committee has suggested a few minor changes to the final CCMAP report and recommended its approval to the Management Committee. Jeff Roubal moved/chris McCann seconded/to Approve and Accept the final CCMAP Report. Passed unanimously. B. APPROVE and ACCEPT Summary of Polychlorinated Biphenyls (PCBs) Case Studies City of Richmond Crosby requested the committee Approve and Accept the PCBs Case Studies as submitted. Jeff Roubal moved/karineh Samkian seconded/to Approve and Accept the Summary of PCBs Case Studies as submitted. Passed unanimously. C. APPROVE the Watershed Assessment and Monitoring (WAM) Committee s Recommendation to Retain and Hire Brown and Caldwell as Technical Services Consultant for an Amount Not to Exceed $50,000 for Fiscal Year 2007/08 Crosby explained the Administrative Committee requested the various subcommittees review their respective consultants and determine if any should be put out to bid. The WAM committee sent out a Statement of Qualifications and received 27 responses. Eight (8) firms were interviewed and approximately half 3

14 those firms were short-listed for consideration. The main objectives were to secure a firm with significant stormwater experience, proven ability to advocate for our Program and preferably a firm that did not represent another stormwater program. Brown and Caldwell was selected based on the aforementioned criteria. Laura Hoffmeister moved/phil Hoffmeister seconded/to Approve the WAM Committee s recommendation to retain and hire Brown and Caldwell as the Program s Technical Services Consultant for FY 2007/08. Passed unanimously. D. APPROVE the Chair and Vice-Chair of the Management Committee for FY 2007/08 Connaughton opened nominations for Chair of the Management Committee. Freitas announced Jeff Roubal had been nominated by Rinta Perkins. Karineh Samkian and Frank Kennedy also accepted nominations. Ballots were counted; and, Karineh Samkian was elected as Chairperson for FY 2007/08. Connaughton opened nominations for Vice-chair of the Management Committee. Frank Kennedy and Jeff Roubal accepted nominations. Ballots were counted and Frank Kennedy was elected. V. Staff Reports: A. Senate Constitutional Amendment (SCA 12 Torlakson) Freitas distributed a copy of a memorandum from State Senator Tom Torlakson; and, a letter of support from the Contra Costa County Board of Supervisors. Freitas requested all co-permittees to immediately pass a resolution supporting the passage of SCA 12, an amendment giving voters the opportunity to approve an additional source for funding for storm water and urban runoff management programs. Freitas also distributed a letter of support written by BASMAA. Program Staff will electronically provide a letter written by the City of Concord supporting the passage of SCA12. B. Municipal Regional Permit (MRP) Update Freitas indicated he felt the permit process after four (4) long years was finally moving in the right direction. A month ago BASMAA representatives and Regional Board staff agreed to negotiate on June 5, 8, 18 and 19, The meetings went well and Freitas is guardedly optimistic. At one point, Bruce Wolfe, Regional Board Executive Officer, asked BASMAA for draft language for certain areas of the permit. Regional Board Staff will begin drafting the Administrative Draft in July Freitas expects the final MRP will be available in late fall/early winter. Freitas urgently stated the importance of providing Information Items A and B i.e., articles from the May 31, 2007 issue of Environmental Insider titled: S.F. Bay Regional Board Releases Draft of Sweeping, Region-Wide Municipal 4

15 Permit; and, Appellate Court Orders State To Consider Whether Cities Should be Reimbursed for Costs of Stormwater Permit Compliance to their respective City Managers and City Attorneys as soon as possible. C. C.3 Implementation Activities Report Dalziel stated the C.3 legal work group began meeting again and to review Consent Item E for a summary of their activities. Dalziel informed co-permittees the Integrated Management Practices (IMP) design revisions were still moving ahead; and, the Philip Williams & Associates contract was being extended to allow time to complete needed activities. Dalziel asked if municipalities were receiving solicitations from stormwater treatment filter companies. Some municipalities responded they had been contacted by Contech. Co-permittees agreed to allow them to present their product at the July Management Committee meeting. D. Verify Regional Household Hazardous Waste Collection Facilities Michelle McCauley reviewed the status of Household Hazardous Waste (HHW) data collection activities conducted by the Program on co-permittees behalf. McCauley stated in Fiscal Year 2006/07 the Program began collecting curbside HHW data for municipalities who had given the Program the authority to do so. McCauley quickly reviewed the curbside waste haulers and their municipal affiliations and asked co-permittees to notify her if any agencies were omitted or in error. E. Fiscal Year 2007/08 (13 th Cycle) Used Oil Block Grant McCauley stated the Program had recently submitted an application for the Used Oil Block Grant for the cities of Clayton, Concord, Lafayette, Orinda, San Ramon, Walnut Creek, and the Towns of Danville and Moraga. The collective grant amount was estimated to be $98,950 and would support the activities of Mr. Funnelhead, the Captain of Clean Water, certification of used oil collection centers, cable advertising, educational programs, etc. McCauley reviewed the successes of these activities and asked municipalities to consider supporting the Program if they were not entirely satisfied with the results of the Used Oil Block Grant in their municipality. Freitas added co-permittees should look at their grant balances over the last three (3) years and donate any unspent grant funds to the Program rather than lose the unspent grant monies. F. Endangered Species Court Order Pertaining to Red Legged Frog Sensitive - Areas Elisa Wilfong reviewed a lawsuit brought against the EPA in A court ruling required the EPA to determine the effects of 66 specific pesticides on endangered species. Use of the 66 pesticides is prohibited or restricted in and around critical habitat areas and non-critical habitat sections 5

16 for the California red-legged frog. Obviously, this will necessitate considerable changes for most, if not all, municipalities. For full details and a listing of the pesticides go to The types of pesticide use restrictions are as follows: 1. Use is prohibited within and around critical habitat areas and within and around specified non-critical habitat section; 2. If a proposed application is more that 400 feet away from a critical habitat area or a non-critical habitat section, then there are no new restrictions; 3. For sites that are subject to the Injunction, the following buffer zones apply: 60 feet for ground applications; 200 feet for aerial applications. G. July Administrative Committee Change of Date Freitas explained the potential conflict with the Administrative Committee meeting and the July 4 th holiday. Co-permittees agreed to change the meeting to July 10, 2007 at 600 Main Street in Martinez. H. Program Staff Relocation to 255 Glacier Drive, Martinez Status Report - Freitas stated Public Works Department Administrative Staff projects the Program will return to 255 Glacier in September VI. Introductions. Meeting began at 10:30 II. Public Opinion Survey Update. Shelley McKenry reviewed the preliminary graphs and results from the public opinion survey with the Committee. The following are some of the significant findings: The importance of drinking water increased by 10% from 2% in 2006 to 12% in All bodies of water showed to be very important with a 10% increase. 32% of residents were aware that the contents of storm drains go directly to water bodies untreated, an 11% increase over % of residents correctly disagreed with the statement that water and other substances go to treatment plant to remove pollutants. When disposing of used motor oil, 77% of residents took used or excess oil to a certified oil collection center, a car care professional, or a toxic waste disposal site. 23% of residents have seen or heard advertisements of the Contra Costa Clean Water Program that mention the slogan Water is Life. 43% of respondents said that they have heard of the Contra Costa Clean Water program as compared to 33% in /12/2007

18 The final Public Opinion Survey will be distributed to the Committee at the next PEIO meeting. III Scope of Work. McKenry provided an overview of the scope of work. The strategic implementation plan would take place after the permit was approved, which is expected in early January. The next survey will be conducted in April Laura Wright expressed interest in producing another TV spot. McKenry recommended producing a spot that was consistent with the current Program branding. As directed by the Committee, Astone will proceed with developing creative concepts for the TV spot, as well as provide media options at the next PEIO meeting. Julie Haas-Wajdowicz suggested that the Committee look for opportunities to do local advertising with the Dish Network. Astone will continue to research opportunities to advertise locally with Dish Network; currently media purchases in the local markets with Dish Network are not available. Self-introductions were made then Dalziel proceeded immediately to the agenda. II. Consent Calendar: Approval of the May 23, 2007 NDCCC draft summary minutes was postponed pending a quorum. III. Reports: A. C.3 Implementation Update: 1. IMP Designs - Dalziel reported PWA was still working on proposed revisions to the seven (7) Integrated Management Practices (IMP)s in the Stormwater C.3 Guidebook (3 rd Edition). The draft revisions, once complete, will be modeled

20 by Brown & Caldwell to determine sizing for flow control. The point of the IMP revisions is to improve their constructability, flexibility and efficiency. The challenge in preparing the draft revisions is partially due to the desire to provide very clear and prescriptive guidance, which based on past experience, is desired, while also providing options and alternatives to maximize IMP utility and to address potential site constraints and/or opportunities. Furthermore, budget constraints limit the number of model runs that can be conducted. This requires careful selection of the most promising draft IMP designs for modeling. A key objective of this effort is to identify ways to reduce the IMPs footprint or required surface area. Dalziel described a few of the specific design challenges. One example was to reduce the surface storage depth for the in-ground planter, because the current 12 inch depth represents a potential trip/fall hazard. Following completion of the IMP designs and modeling, the next step will be to incorporate the revisions into a 4 th Edition Guidebook. As part of this effort, and in response to input from development professionals, the Program will endeavor to provide multiple examples on how the IMPs can be integrated into various development types. Dalziel will continue to provide updates to the committee as appropriate. 2. C.3 Legal Workgroup - The newly reconstituted C.3 Legal Workgroup met for a second time on June 7, Rather than developing a single approach or mechanism for ensuring ongoing operation and maintenance, the Workgroup is reviewing various example operation and maintenance agreements and Covenants, Conditions and Restrictions (CC&Rs). This effort will likely result in the development of a revised model operation and maintenance agreement, model language for CC&Rs and guidance on their use in various types of development projects. The Workgroup is also reviewing the advantages of various different funding mechanisms for operation and maintenance, and options for enforcement if required operation and maintenance is not occurring. The Workgroup s next meeting is July 5, Policy on Selection of Stormwater Treatment Measures - Dalziel stated this item was put on the agenda to facilitate discussion among committee members on the application of this policy. Several committee members indicated one or more representatives from CONTECH Stormwater Solutions, a manufacturer of proprietary stormwater treatment devices, had contacted them requesting a meeting to discuss their products. Dalziel reported the Program has had several meetings with CONTECH representatives and that two CONTECH representatives attended the June 20, 2007 Management Committee meeting but declined to speak and left the meeting early. Management Committee members suggested they be offered the opportunity to present information at the July 18, 2007 meeting. Dalziel indicated they had been contacted and had agreed to present at that meeting. Municipal staff interested in learning more about their products were encouraged to attend the July 18, 2007 Management Committee meeting. 2

June 7, 2007 BASMAA New Development Committee Meeting - Dalziel reported the BASMAA New Development Committee met on June 7, This meeting focused primarily on the ongoing planning efforts between the Bay Area Stormwater Programs, San Francisco Bay Regional Water Quality Control Board staff, and staff from the Friends of the San Francisco Estuary. A series of Joint Construction-Site Stormwater Quality Training Workshops are planned between September and December Dalziel reported the City of Walnut Creek had reserved the Shadelands Civic Arts and Education Center for September 25 th and 26 th, Committee members suggested the workshop for municipal inspectors be held on the 25 th and the developer workshop on the 26 th. Committee members confirmed their decision to provide the workshops a fresh, new perspective. Committee members were concerned that attendance would decline because inspectors felt the workshops would be the same as before. Dalziel would continue to coordinate with staff at the Friend of the San Francisco Estuary and provide updates to the committee as appropriate. The June 7, 2007 BASMAA New Development Committee was held at the Green Building Exchange in Redwood City. This new facility is a one-stop marketplace for businesses and individuals committed to and working in green building. Their grand opening is June 19, For a fee, vendors of green building rent space to exhibit their products and services. Contractors and consumer can visit the Green Building Exchange, which will also provide a variety of forums and training sessions. For more information, visit C. Stream, Wetland, and Riparian Area Protection Policies Dalziel indicated there was nothing new to report. D. State s Preliminary Draft Construction General Permit Dalziel indicated there was nothing new to report. IV. Discussion Items: A. Review BASMAA/RWQCB Discussions on the May 1, 2007 Municipal Regional Permit Administrative Draft Dalziel provided a brief background on the current status of the development of a Municipal Regional Permit (MRP). On May 15, 2007, Water Board staff released a revised MRP Administrative Draft dated May 1, The May 1, 2007 draft replaces their original draft MRP dated October 13, Revisions in the May 1, 2007 draft focus primarily on improved organization and formatting. However, the May 1, 2007 draft does contain some substantive changes. Water Board staffs substantive changes are primarily additions that provide further details/requirements, which were missing in the October 13, 2006 draft. Water Board staff agreed to meet with the BASMAA Board members to review and discuss the May 1, 2007 draft on June 5, 8, 18, and 19, These meetings did occur. A fifth meeting is scheduled for July 10, Dalziel indicated BASMAA 3

22 was cautiously optimistic Water Board staff has heard and may address at least some of BASMAA s concerns. On some issues, Water Board staff requested BASMAA provide suggested alternative language. Dalziel then reviewed the October 1, 2006 and May 1, 2007 MRP Administrative Drafts, and BASMAA s working draft proposed revisions to Water Board staff s May 1 MRP Administrative Draft. Committee members offered input and comments, which Dalziel would review with the BASMAA Board members at their next meeting. Dalziel reported the deadline for comments on the May 1, 2007 MRP Administrative Draft was extended from June 22, 2007 to July 13, At the June 20, 2007 Management Committee meeting, Program staff encouraged municipalities to review the May 1, 2007 draft and provide individual comments directly to the Water Board. BASMAA will be preparing and submitting comments on behalf of all municipalities by the July 13, 2007 deadline. BASMAA will also provide further, more detailed, comments and suggested edits to Water Board staff in early August. Water Board staff is aware of this timeline and submittal and has agreed to meet with BASMAA following its more detailed comment submittal. B. Freitas I. Introductory Remarks: Karineh Samkian, Chairperson, began the meeting at 9:35 A.M. With the addition of new sub-committee members, Tom Dalziel briefly reviewed the functions of the Administrative Committee - administration; strategic planning; personnel; budget recommendations; and, conflict resolution. Dalziel then welcomed Samkian as the Fiscal Year 2007/08 Administrative Chairperson. II. III. Election Fiscal Year 2007/08 Administrative Committee Vice-Chair: Samkian requested nominations for Vice-chair. Samkian nominated Phil Hoffmeister, David Swartz seconded. Hoffmeister accepted the nomination. Passed unanimously. Review Fiscal Year 2007/08 Committees Designations: A table showing municipal designations provided to the Program was distributed and reviewed. The Program was still awaiting designations from the cities of Oakley and San Ramon, and the Contra Costa County Flood Control & Water Conservation District. Dalziel reviewed the minimum representation guidelines and requirements outlined in the Program Agreement 2003/2010. He stated there was sufficient membership on all committees. The Program will endeavor to complete the designations table in time for Management Committee consideration on July 18, 2007.

Municipal Regional Permit (MRP) Update: Dalziel explained BASMAA representatives met with Water Board staff on June 5, 8, 18, and 19, 2007 to review and discuss the draft provisions in the May 1, 2007 MRP Administrative Draft. At the final meeting on July 19, 2007, Water Board staff agreed to prepare a table outlining all compliance timelines and deliverables, which will be useful in further discussions with Water Board staff on establishing priorities. In response to various discussions with Water Board staff on various aspects of the MRP at the above mentioned meetings, Water Board staff requested, and BASMAA agreed, to prepare and submit specific comments and suggested language on some of the issues discussed. Dalziel confirmed Friday, July 13, 2007 was the deadline for comments to the Water Board on the May 1, 2007 MRP Administrative Draft. Questions were asked and answered. V. C.3 Implementation Update: Dalziel explained the Legal Workgroup met for the third time on July 5, Much of their work is focused on developing guidance for implementing the state mandated operation and maintenance requirements on small residential subdivisions. This effort may result in the development of model language for Operation & Maintenance Agreements, and Conditions, Covenants and Restrictions (CC&Rs). The Integrated Management Practices (IMPs) in the 3 rd Edition Stormwater C.3 Guidebook are being redesigned by Philip Williams & Associates. The draft IMP designs once completed will then be modeled for sizing by Brown & Caldwell. Once this is complete the sizing tool will need to be updated. Dalziel expects the project to be completed and the new designs incorporated into a 4 th Edition of the Stormwater C.3 Guidebook by September/October VI. Annual Report Update: Dalziel reminded co-permittees the deadline for submittal of draft Annual Report sections for review by Program staff is Friday, July 13, Dalziel stated he revised the instructions for C.3 reporting in response to questions at the June 20, 2007 Management Committee. Any questions regarding this topic should be directed to him. Dalziel stated Samkian contacted Matt Graul of the San Francisco Bay Water Board. Samkian provided Graul with a copy of San Pablo s Municipal Maintenance section in which text that is repeated from year to year was highlight. Samkian is requesting input from Graul if it would be acceptable not to repeat this information from year to year, rather to refer the reader to the previous year s Annual Report. Graul had not yet responded to either Samkian or Dalziel. Committee members were hopeful this could be addressed at the July 18, 2007 Management Committee meeting. 2

Consider Rescheduling the October 2, 2007 and January 1, 2008 Administrative Committee Meetings: Dalziel explained the October 2, 2007 meeting conflicts with the Regional Monitoring Program (RMP) Annual Meeting. Co-permittees agreed to reschedule this meeting to October 9, Committee members also agreed to reschedule the January 1, 2008 Administrative meeting, which is a holiday, to January 8, APPROVE Draft July 18, 2007 Management Committee Agenda: Dalziel reviewed the draft Management Committee agenda. Committee members suggested Presentation Item B, ConTech Stormwater Solutions, be placed first on the agenda. Phil Hoffmeister moved/david Swartz seconded/to Approve the Management Committee agenda with the abovementioned change. Passed unanimously. IX. Old/New Business: Samkian announced the City of San Pablo amended its City code related to administrative penalties. San Pablo s Stormwater ordinance states that any violation of the stormwater chapter constitutes a misdemeanor (unless they determine it is an infraction), so they are able to charge $250 for first time violations, which can progress up to $1,000. Before, she was starting at $100, which is the correct amount for an infraction. Another benefit of the amended ordinance is that violations that can not be abated (e.g., the discharge already entered the creek or stormdrain), she can automatically cite the violator $1,000. This money goes back into the City s NPDES account. Karineh agreed to provide a copy of the amended ordinance to Program staff for distribution to the copermittees. X. Background: At the start of implementation of the Pool/Spa Discharge Program (Pool/Spa Program), Clean Water Program staff requested persons designated as Municipal Pool Representatives to begin tracking calls about the Pool/Spa Program, and ultimately to track the final destination (sewer or landscape, for example) of any pool water discharged under the Pool/Spa Program. Simple Excel spreadsheets were created and distributed by staff in both printed and electronic formats to assist in this tracking effort. The Clean Water Program will be reporting on the progress to date of the Pool/Spa Program in the upcoming FY 2006/07 Annual Report. 43 Date: July 18, 2007 To: From: Subject: Management Committee Jamison Crosby, Watershed Management Planning Specialist Contra Costa Clean Water Program Staff Report E Report from the PCB TMDL Informational Workshop, June 28, 2007 Recommendation: Receive report. Background: On June 22, 2007, Water Board Staff released a proposed Basin Plan amendment and supporting staff report incorporating a Total Maximum Daily Load (TMDL) for polychlorinated biphenyls (PCBs) including dioxin-like PCBs in all segments of the San Francisco Bay. These documents are available for public comment through close of business on August 6, The goal of the San Francisco Bay PCBs TMDL is to reduce these toxins in the tissues of aquatic wildlife so humans and wildlife can safely consume Bay fish. The TMDL for PCBs in San Francisco Bay is 10 kg/year. Calculation of this TMDL is based on a food-web PCBs bioaccumulation model and a long-term mass balance model. The model predicts if external sources of PCBs are reduced to 10 kg/year then the concentrations of PCBs in surface sediments will drop to 1 ug/kg (microgram/kilogram) which in turn will lead to the attainment of the numeric target 10 ug total PCBs per kg of typically consumed fish. There are two (2) types of sources of PCBs: 1. External sources include inflow from the Central Valley; atmospheric deposition; municipal and industrial wastewater discharges; and, urban and non-urban stormwater runoff.

44 2. Internal sources include movement or release of PCBs already in the Bay through dredging and in-bay disposal of dredged sediment, erosion of bay bottom sediments and in-bay contaminated sediment sites. Decreases of PCBs occur through the mechanisms of natural attenuation, out-of- Bay dredge material disposal and outflow through the Golden Gate. The Central Valley Watershed and Urban Stormwater Runoff sources contribute 42 and 40 kg/year respectively of a total of 84 kg/year annual loading. In other words, of all external sources, urban runoff and the Central Valley comprise 98% of the total annual load. Load allocations were developed by the Water Board by apportioning the 10 kg/year TMDL to external sources only (internal sources were not assigned load allocations because they are not quantified or result in a net loss). The load allocation assigned to Urban Stormwater Runoff is 2 kg/year or a 95% reduction. Of this 2 kg/year, Contra Costa County was assigned an allocation of 0.3 kg/year. The implementation plan includes three (3) general categories: control of external sources, control of internal sources, and actions to manage risks to Bay fish consumers. However, due to urban runoff s large contribution to the overall loading, implementation actions will likely focus on control of PCBs in urban runoff and cleanup of older and industrial areas where the highest levels of PCBs are measured in storm drains. Despite the large contribution from the Central Valley, the Water Board anticipates their allocation will be attained entirely through natural attenuation. Stormwater permittees shall demonstrate attainment of their wasteload allocations by using one of the following methods: 1. Quantify average annual PCB loads reduced through pollution prevention and source and treatment controls. Loads reduced as a result of actions implemented after 2001 may be used to estimate load reductions. 2. Quantify PCB loads as a rolling five-year average using data on flow and water column PCBs concentrations. 3. Quantitatively demonstrate that the concentration of PCBs in suspended sediment is below in the in-bay surface sediment concentration of 1 ug/kg.

45 Monitoring Monitoring to demonstrate TMDL attainment shall be conducted through the following means: Dischargers will continue to fund Regional Monitoring Program (RMP) monitoring of PCBs in the Bay. Monitoring to demonstrate attainment of load allocations shall be conducted by municipal and industrial wastewater dischargers and stormwater permittees as previously discussed. Monitoring to demonstrate load reductions from the Central Valley due to natural attenuation will also be conducted through discharger-funded RMP monitoring. Monitoring of allocations of other sources will be considered as potential special studies of the RMP. Achievement of the urban runoff allocation is projected to take 20 years. The Water Board will consider modifying the schedule for achievement of load allocations for urban stormwater after at least 10 years following TMDL implementation provided permitees are in compliance with their permits. The Water Board will hear public testimony on this amendment to the Basin Plan on September 12, An adoption hearing is anticipated for November 14, Fiscal Impact: None. Attachment(s): None. Background: The State and Regional Water Boards are in the process of updating their Strategic Plan. All of the nine (9) regional Water Boards sponsored outreach sessions for the public to provide their input on the content of the Strategic Plan. Program staff attended the workshop for Region 2, San Francisco Bay, on June 13, The workshop was organized by setting up multiple tables around the room each attended by one (1) staff person from Region 2 plus one (1) State Board member, rotating periodically. Water Board staff and Board members facilitated each table in discussing various aspects of the Strategic Plan including vision, mission, principles and values. Then each table presented their collective changes and comments to the entire assembled group. The Water Board will use the input and information they received in developing the draft Strategic Plan to be considered for adoption in the summer of An implementation plan will be developed and considered in winter 2007/08.
