2 Dear Friend of Freedom, On behalf of the board of directors of Idaho Freedom Foundation and our dedicated team of policy analysts and reporters, it is my honor to present you with our 2013 Idaho Freedom Index Report. The Idaho Freedom Index examines legislation for free market principles, constitutionality, regulatory growth and other defined metrics. The examination then results in a numeric value being assigned to each bill having an impact on economic freedom and growth of government. We then take those numeric values and tally each legislator s House or Senate floor votes to see whether that legislator, in total, supported or opposed economic freedom. Before the Idaho Freedom Index came along, it was nearly impossible to speak knowledgeably about a legislator s commitment or opposition to free market ideals. We basically had to take politicians at their word regarding their cumulative voting performance. Today, voters, taxpayers and other interested observers can use our data to see whether lawmakers vote in support of bigger or smaller government, economic liberty or statism. Legislators routinely check our Freedom Index analyses before they cast their votes, and members of the public also check the Index to see how their legislators are performing. Our policy analysts worked tirelessly throughout the session to make sure lawmakers and the public had timely, accurate and substantive information during the 88-day legislative session. 7 uring the legislative session, as bills were introduced, our policy research staff D read and analyzed every bill for possible inclusion in the Index. If the bill answered one or more of the following criteria questions, then an analysis was written and provided for the legislators and the public to gain a better understanding how the proposed legislation impacted the free market and individual liberty Freedom Index Rating Criteria Tier 1 Three Point Level: This category includes legislation that creates or eliminates a new agency, program, or function, creates new regulatory burdens or is hostile to constitutional principles. 1) : Does it create or eliminate an agency, program or function of government? 2) : Does it give the government new power to prohibit or restrict activities in the free market? Examples may include licensure and other restrictions on legal business practices. 3) : Is it unconstitutional or does it do violence to our concepts of federalism or separation of powers? Does it restrict property, speech, gun or other constitutionally-recognized rights or freedoms? Conversely, does it restore balance between the state and federal government, resume state authority over an issue under the 10th Amendment, or remove restrictions on constitutionally-protected rights? Tier 2 One Point Level: This category includes legislation that interacts with the free market or expands or contracts existing government functions (without creating new ones). 1) : Does it redistribute wealth, or use tax policy or other incentives to reward specific interest groups, including politicians or government employees, with special favors or perks? Conversely, does it eliminate special favors and perks in the tax code or public policy? 2) : Does it perform a function that can and should be performed by the private sector, or does it restore functions to the private sector? 3) : Does it grow or shrink the regulatory scope of an agency, increase or decrease control of the private sector through rules, regulation or statute? 4) : Does it directly or indirectly create/reduce taxes, fees or other assessments? 5) : Does it increase or decrease long-term debt, or override or restore statutory or constitutional protections against long-term debt? 6) : Does it restrict access to information that should be in the public domain or does it promote government transparency? 7

8 Senate summary T he Senate members had 74 bills impact their Freedom Index score, with a total of 194 possible points. Index scores of 12 senators indicate a voting record of favoring economic freedom, while 23 senator records favored expansion of government or statism. 8

Three senators obtained the most points possible and three senators voted against all points opposed to free markets and expanded government. 9
