1 March 17, 2008 REGULAR CITY COUNCIL - MINUTES Mayor Winfred Shoopman called the regular Clinton City Council meeting to order on March 17, 2008, at Clinton City Hall at 5:31 p.m. Councilman Scott Burton, Councilman Larry Gann, Councilman Charles Lyons, Councilman Jerry Shattuck, and Councilman Clay Wright were present for the meeting. Councilman Jim McBride was absent. Hutchins Tim Bible Councilman Jerry Shattuck made a motion to approve the agenda, and Councilman Clay Wright seconded the motion. The motion carried unanimously. Mayor Shoopman led the meeting in prayer. Councilman Clay Wright led the pledge. Councilman Charles Lyons made a motion to approve the February 18, 2008 minutes as received, and Councilman Scott Burton seconded the motion. The motion carried unanimously. Committee Reports School Board Report Vickie Violette, Superintendent of Schools, reported the following items to Council: 860 students are currently enrolled in the City School System and 20 pre-school students for a total enrollment of 880. The City School Staff selected the following for the teacher of the year: Cathy Haun, Marie Dean, and Janie Jackson. The teachers will be recognized on March 25, 2008 at the Anderson County Chamber of Commerce Teacher of the Year Banquet which will be held at the Junior Achievement Facility

2 Several staff members have volunteered to be museum guides when the Smithsonian traveling exhibit arrives at Green McAdoo Cultural Center. The Federal Education Grant for Literacy has been submitted with a request for $281,360. The grant will be awarded in the summer. About $100,000 will be used to purchase books and media for the library and the remaining money will be used for software programs, new computers in the library, smart-boards, to extend the library hours in the summer, technology training for staff, to fund an additional technology position, and infrastructure that is needed to provide adequate technology services for each of the three schools. Ms. Violette thanked Mr. Jones for his support in helping get letters from Congressman Zach Wamp and Senator Bill Corker. The sixth grade graduation speaker will be City Manager Steve Jones. Ms. Violette provided Council a packet of information with budget amendment #2. The budget amendment of $18,508 is actually funds shifted from one line item to another to pay for cafeteria tables that were needed at Clinton Elementary School. Councilman Jerry Shattuck made a motion to approve the Clinton City Schools budget amendment #2, and Councilman Charles Lyons seconded the motion. The motion carried unanimously. Ms. Violette explained that the Schools budget will now be included in the Council Members packets so Council will be able to look over the information prior to the meeting. Clinton Regional Planning Commission Report Councilman Clay Wright reported the Board of Zoning and Appeals and Clinton Regional Planning Commission met on March 10, The Board of Zoning and Appeals approved a height application for a variance to build a garage to 19 feet for John Lassuy. Star Bucks was approved to increase the square footage of their sign by 61 square foot. Richard Von Hatten Development withdrew their requests. At the Clinton Regional Planning Commission, Von Hatten Development withdrew their request. Clinton Utilities Board Report Councilman Charles Lyons reported that Clinton Utilities Board met on March 13, The paid vouchers were approved for $7,187,137 leaving a net income of $392,225. Underground conductors have been replaced at City Hall costing $4,300. A pumping station was upgraded in the Clinton area at a cost of $45,420. Also Councilman Lyons reported two automatic air breakers on Carden Farm Drive were installed at a cost of $42,331. There will be an 8.9% increase in electric rates beginning April. The increase is due to TVA s price increase. The costs have increased due to the drought last year which

3 reduced hydroelectric generation, and this is our chief source of power. Currently the average bill of 1200 kilowatts costs $96.72 and will increase to $ The national average of rates is 10.5 per kilowatt, and CUB is at 7.9 per kilowatt. Mayor s Commission Councilman Jerry Shattuck referred most of his report to City Manager Steve Jones. The Football Field/ Town Springs Project is under way. The first major project on our greenways is also under way with the trail addition at Lakefront Park. Green McAdoo Cultural Center has been extremely busy with school groups and church groups. The City of Clinton is getting ready to host the traveling Smithsonian exhibit from May 3 June 15, The theme of the exhibit is new harmonies relating to different types of music that originated in America. Green McAdoo is not only hosting the exhibit, but it will also be organizing and presenting local exhibits to go with the national exhibit. A blues program will feature JoAnn Allen Boyce, one of the original Clinton 12, who is a renowned blues singer in the Los Angeles area. The Mayor s Commission will have a meeting in the near future to discuss some housekeeping details regarding the color schemes and decorative aspects of the two projects that are underway. Retail Task Force Steve Jones reported the Retail Task Force had not met. CITY MANAGER S REPORT GENERAL INFORMATION 1. Clinton City Hall and City offices will be closed on Friday, March 21, 2008 in observance of the Good Friday/ Easter holiday. 2. Mr. Jones requested scheduling the first City Council budget workshop for Thursday, April 17, 2008 starting at 5:30 at the Green McAdoo Center. 3. The Tennessee Municipal League s Legislative Conference is scheduled for April 14-15, 2008 in Nashville, Tennessee. Any Council Member interested in going needs to let Mr. Jones know by the end of March. This is a good opportunity to see what TML does for the cities of Tennessee and to sit down with legislatures and let them know what is important to you

4 CURRENT PROJECTS AND ACTIVITIES 1. CLINCH RIVER WALKING TRAIL PHASE 1 Construction is underway on this project. We expect that construction will be completed by June 1, 2008, if not earlier. 2. HOME ENHANCEMENT PROGRAM No changes to report. 3. CLINTON STADIUM / TOWN SPRINGS RENOVATION PROJECT Construction is underway on this project. We expect construction of the bleacher portion of the project to begin May 1, 2008 with a completion date by June 1, Once the bleachers are completed, the balance of the other improvements will begin, and we plan on doing everything possible to assure completion by the beginning of football season. 4. TRAFFIC SIGNAL CHANGES We have hired a consulting traffic engineer to work with our Public Works Director and Police Chief for improvements to traffic control devices and pedestrian safety at key locations, particularly near our school zones. Due to the high volume of pedestrian traffic during school hours, the signalized intersection at Broad and Hicks Streets has recently been converted to a fourway stop design. At the sidewalk near Clinton High School, a pedestrian crossing WALK-DON T WALK signal is being installed at the intersection of Hillcrest Street and Sulphur Springs Road. The Community Center will have new crosswalk warning signs installed on South Hicks Street. The crosswalk on Market Street has been marked with new signs, and other crosswalks are being scheduled for traffic control device upgrades. We estimate approximately $20,000 in expenditures for engineering, pedestrian signal construction, and sign materials, being paid from the Public Works Department s annual operating budget. Councilman Jerry Shattuck asked if the City would still have officers at the intersection at Broad and Hicks. Mr. Jones said these officers/ crossing guards would still be there. Councilman Larry Gann asked if the City had provided adequate warning to people regarding these changes. Mr. Jones noted that TDOT guidelines have been followed. The amount of traffic at this intersection no longer warrants a four-way signal. A gate will be installed at the right turn lane to be used only by the buses. The crossing guard will operate this gate. 5. TDEC GRANT FOR USED OIL COLLECTIONS The City of Clinton has been successful in obtaining a grant to purchase equipment used for collecting used motor oil. The grant is for $14, and will include the purchase of a storage tank, canopy, pad, waste oil heater, and pump to be housed at the Clinton Public Works Garage. We will issue a press release to inform the public as to when this service becomes operational. The

5 grant is 100% made available under a legislation passed last year. Councilman Scott Burton asked who would be able to use this service. Mr. Jones stated that this would be open to the public, but he wasn t sure whether commercial businesses could use this. Councilman Charles Lyons asked if the oil heater would furnish heat. Mr. Jones stated that the heater would furnish heat in the Public Works garage and actually reduce the heating costs. DEPARTMENTAL ACTIVITIES ADMINISTRATION Finance Report: Finance Director Fagan reported the following: total available funds are 73%; the City is approximately 67% into the year; total appropriations and expenditures are 71%. In Section II of the financial report, property taxes are 93%; sales taxes are 64% which is approximately $123,000 more than budgeted; licenses and permits are 84%; state funds are 64%; recreation charges are 67%; court revenues are 63%. In Section III, general government expenditures are 69%; public safety is 69%; public works is 65%; and recreation is 71%. CODES ENFORCEMENT / BUILDING INSPECTIONS DEPARTMENT 1. Codes Enforcement Officer Curtis Perez reports that the AISIN Automotive Castings expansion and all other development activity continue to be on schedule. 2. Mr. Jones informed Council that the 911 Board approved the new street name into the Fox facility, Eugene Fox Boulevard. This street will provide access to future development. Councilman Larry Gann made a motion to approve this new street name, Eugene Fox Boulevard. Councilman Scott Burton seconded the motion. The motion carried unanimously. FIRE DEPARTMENT We are in the final stages of the USDA grant / low interest loan that we have been working on over the past year for the I-75 First Responder substation. The Finance Director and Mr. Jones have been in weekly contact with both the State and Federal offices exchanging last minute details

6 PUBLIC WORKS DEPARTMENT 1. At the February 2008 Clinton City Council meeting, City staff asked the City Council to approve the low bid for a one ton truck from Ray Viles Ford for the price of $27, After a purchase order was delivered to Ray Viles Ford, we were notified that a mistake had been made calculating the bid price and instead of $27,701.33, the actual price would be $31,580.33, a difference of $3, We declined to pay the increased price, so Ray Viles Ford asked to withdraw their bid proposal (letter included in Council packet). Since no other vendors replied to our public notice and invitation to bid, we were forced to rebid. Therefore, Mr. Jones requested that Clinton City Council rescind their previous action regarding the bid award from the February 2008 meeting and allow Ray Viles to withdraw their February bid proposal as requested. City staff would also request Clinton City Council s approval of a one ton truck from Lance Cunningham Ford at a cost of $29, with proceeds coming from the City of Clinton Lease Purchase agreement. Councilman Jerry Shattuck made a motion to rescind the prior action in awarding the bid for this one ton truck to Ray Viles Ford and instead purchase a one ton truck from Lance Cunningham Ford at a cost of $29, with proceeds coming from the City of Clinton Lease Purchase agreement, and Councilman Charles Lyons seconded the motion. Councilman Lyons asked if Alexander Automotive had a state bid for the truck. Mr. Jones stated that a state bid was not available for a one ton flatbed truck. The motion passed unanimously. 2. Public Works continues to provide construction inspection for the two new city streets within the Fox Development near I-75. We are also providing inspections and coordination for the new turn lanes and associated traffic signals at Highway 61 and Hillvale Road, as well as the construction of the new four-lane portion of Hillvale Road, including the city portion of Tanner Lane leading to the Wal-Mart. 3. Spring Clean up Day will be on April 7 th this year. Public Works trucks will visit each residential area within our City limits and will haul away old furniture and appliances to the sanitary landfill free of charge. Anyone with questions may visit the city website at and find the link for SPRING CLEAN UP DAY or call the Public Works Department at The Public Works Department has been assisting with the walking trail by stabilizing the bank in the old marina area. This wasn t part of the project, but it was something that needed to be done. This work has saved taxpayers thousands of dollars. Our operators have done a fabulous job with the project

7 ORDINANCES AND RESOLUTIONS A. FIRST READING OF NEW ORDINANCE Ordinance # 538 (proposed) An ordinance to adopt the property tax freeze program as provided for in 2007 Public Chapter 581 and T.C.A Councilman Clay Wright made a motion to approve Ordinance # 538 on first reading, and Councilman Larry Gann seconded the motion. The motion carried unanimously. Councilman Jerry Shattuck noted that this ordinance will not be pertinent unless taxes are raised. The income limits are set by the state. Vickie Fagan informed Council that once this ordinance is passed a certified copy must be sent to the State Comptroller. B. SECOND READING C. RESOLUTIONS OLD BUSINESS Albert Turner, 407 W. Broad Street, asked why the audit is still not available. Finance Director Vickie Fagan informed Mr. Turner that the audit for the City Schools has not been finalized due to the investigation. The audit for the City can be finalized when the City Schools audit is complete. Mr. Turner asked Councilman Charles Lyons the status of City sewer being provided for Virginia Reed on Lanes Bluff Road. Councilman Charles Lyons has been told by CUB that a pump system is needed and can be installed at a cost to Ms. Reeves of $2,000. CUB would maintain this line once it has been installed. Ms. Reeves has decided to wait until she needs sewer service. VISITORS Shirley Pruitt, 531 W. Broad Street, owner of Tow Right Wrecker Service asked why Chief Scarbrough has put them on suspension. Mrs. Pruitt stated they were not notified of the suspension. Mrs. Pruitt stated the lot had to be moved, but currently they are located in South Clinton and have a business license and insurance. City Manager Steve Jones said that he is usually notified of any suspension but is unaware of this. Mrs. Pruitt can file a formal complaint, and Mr. Jones will then be able to answer all of her questions

8 William Pruitt, 531 W. Broad Street, also owner of Tow Right Wrecker Service stated there are two wrecker services that are not in compliance because they do not have a secured gate. Mr. Pruitt was at the meeting on the 28 th of February to ask why he wasn t notified of the suspension and was told to leave by Lt. Queener. Mr. Pruitt was also at the meeting on the 29 th of February, met with Chief Scarbrough afterward, and still doesn t know why he was suspended. Mr. Jones announced he had been notified that 2 3 wrecker services were not in compliance with the new wrecker policy that was passed at last month s Council meeting and had been given warnings. Mrs. Pruitt said their wrecker service has not been inspected. Jeremy Pruitt, 531 W. Broad Street and is the son of William and Shirley Pruitt, stated he believes there is a vendetta against his father. Albert Turner, 407 W. Broad Street, suggested that in order to suspend a wrecker service they should be called in, talked to, written up, and then be given a copy of the written suspension. NEW BUSINESS Councilman Clay Wright informed Council that the Anderson County Fair Association has received the agricultural grant for fairground improvements. Councilman Charles Lyons asked if there was a code regarding the amount of advertisement papers distributed door to door. City Manager Steve Jones reported that last week he had spoke with the source of that advertisement and was assured it would be corrected. If this continues, a more formal approach will be taken. Councilman Scott Burton inquired about alternate routes to industrial parks in the City through residential streets. Mr. Jones said the plants in Eagle Bend have been notified to encourage their truck drivers not to use Eagle Bend Road. Councilman Burton suggested GPS remove this road from their programs. Mr. Jones stated he would bring this problem up at the plant managers meeting next month. Councilman Larry Gann has been contacted by citizens interested in starting an Environmental Quality Advisors Board. Mr. Jones said this was a good idea, and he will research other cities as to what has and has not been successful and provide this information to Council next month. COMMUNICATIONS FROM MAYOR Mayor Winfred Shoopman had the following appointments for Council approval: John Miller to the Community Action Commission and Roger Byrd to the Clinton Citizen s Advisory Committee. Mayor Shoopman also requested the following reappointments that will be up in July: Robert Jameson to the Clinton Utility Board; Archie Brummitt, Rick

9 Scarbrough, and Vickie Fagan to the 911 Board; and Anderson Halcomb for the Clinton Housing Authority. Councilman Larry Gann made a motion to approve the mayoral appointments, and Councilman Scott Burton seconded the motion. The motion carried unanimously.
