Item 5a: Approval of Board Meeting Minutes: Request the Commission approve the minutes from the following Meetings: 1) June 14, 2018 Regular Meeting 2) June 28, 2018 Budget Workshop Item 5b: Acceptance of Bills paid through June 30, 2018 Request the Commission accept the bills paid report through June 30, Item 5c: Consideration of Assessment Resolution Request the Commission approve Resolution the Annual Resolution to set the Assessment Rates for Fiscal Year 2018/2019 Title for Resolution : Item 5d: Consideration of Tenative Millage Resolution Request the Commission approve Resolution Each year the City Commission reviews the tentative budget during budget workshops and adopts a Resolution setting the tentative millage which is given to the Volusia County Property Appraiser for use in preparing the Notice of Proposed Property Taxes. The proposed millage rate necessary to fund the tentative general City budget for the City s Fiscal Year is 7.8 mills. Item 5e: Public Works Facility Update Monthly update of the status of the new facility for Public Works. For the month of June 2018, expenses totaled $7,952 and $12, (for concrete site work) in-kind donations were received. The City Commission requested the The Planning and Land Development Regulation Commission reviewed this item at their June 25, 2018 Regular Meeting and is recommending approval of the attached ordinance. 5 City of Lake Helen Agenda Memorandum Recognitions, Proclamations and Presentations Meeting Date: July 12, 2018 Item 3a: Recognitions: 1. Recognition of visiting candidates for office (2018 Election Cycle) Each major Election Year, candidates will visit the City of Lake Helen to introduce themselves to the Commission and the Public. The Mayor will provide each visitor a few moments to introduce themselves. Item 3b: Proclamations: None for this meeting Item 3C: Presentations: 1. FY 2018/2019 Assessments, Chris Roe from Brent Miller Olive The City Commission requested more information on Assessments for the FY 18/19 Budget. Chris Roe from Brent Miller Olive will continue the discussion from the May and June Meetings. At the June 28, 2018 Budget Workshop, the City Commission reached a consensus to discuss the following with Mr. Roe at this meeting: Fire Assessment to advertise a new rate range up to $325 for residential. No use of the vacancy rate for the Villas Mobile Home Park. Incorporate a cost index to the garbage assessment. Incorporate a cost index to the stormwater assessment. 2. RFP for Banking Services Presentations: a. PNC Bank b. TD Bank Following presentations staff requested the City Commission consider selecting a firm for the Request for Proposals for Banking Services. Synopsis: The City contracts with banking institutions to provide its financial services. Its current provider, Wells Fargo, no longer has a branch within the City limits. On March 6, 2018, the City issued a request for proposal (RFP) for banking services. On May 4th, the City received proposals from two national banks with service branches in the local area: PNC, and TD Bank. Background: On March 28, 2018, the City s current financial services provider, Wells Fargo, closed its Lake Helen location after nearly 40 years. As the Lake Helen s only local bank, the City established a relationship in which Wells Fargo became the City s banking and financial services provider.

6 Recognitions, Proclamations and Presentations In response to the closing of Wells Fargo in Lake Helen, the City issued a request for proposal (RFP) for banking services. This was due primarily to the proximity of the nearest Wells Fargo branch in Orange City to City Hall, and the inherent difficulties and risks incurred by Staff in conducting financial transactions at that location. Staff received proposals, and requested that PNC and TD Bank to make presentations to the Commission on their service offerings and potential benefits to the City. Recommendation: Motion to allow the Mayor and City Staff to execute a service agreement with the bank best suited to serve the City s needs. 3. WastePro Ken DeForest from Waste Pro wanted an opportunity to discuss services with the City Commission including collection of recyclables. The following assessment rates for fire rescue, stormwater and solid waste services are hereby proposed for Fiscal Year and beyond. Such rates shall be utilized by the City Administrator in preparing the Annual Assessment Resolution, the assessment rolls and the mailed and published notices contemplated by Section 3 hereof, as applicable: (A) Fire Rescue: (1) Fiscal Year : (a) Residential: $ per dwelling unit. (b) General Parcels (non-residential): $0.43 per square foot (c) Vacant Lots: $49.00 per lot. (2) For fiscal years thereafter, a maximum of: (a) Residential: $ per dwelling unit. (b) General Parcels (non-residential): [$0.62] per square foot (c) Vacant Lots: [$71.00] per lot. (B) Stormwater: (1) Fiscal Year : [$33.00] per ERU. (2) For fiscal years thereafter: a maximum increase above the prior fiscal year which shall not exceed a percentage equal to the Municipal Cost Index (available at or by contacting the office of the City Administrator.) (C) Solid Waste Assessments: (1) Fiscal Year : $ per dwelling unit. (2) For fiscal years thereafter: a maximum increase above the prior fiscal year which shall not exceed a percentage equal to the Consumer Price Index for the Orlando metropolitan area; provided, however, such increase shall not be less than 2% or more than 4% of the rate imposed the prior fiscal year.

TENATIVE MILLAGE RATE: 7.8 MILLS (WHICH IS HIGHER THAN THE ROLLED-BACK RATE OF AN INCREASE OF 7.83%) The First Budget Workshop was held on Thursday, June 28, 2018 with a second scheduled for Tuesday, July 17, 2018 at 9:00am at City Hall. Two public hearing will be held to consider the proposed millage rate and the tentative budget. The first on Wednesday, September 5, 2018, at 7:00 p.m. with a second public hearing to follow that hearing tentatively set for Thursday, September 13, 2018 at 7:00 p.m. before the Regular City Commission Meeting. Item 3b: Proclamations: Added Item: Juneteenth PROCLAMATION: Juneteenth: June 19, 2018 WHEREAS, Juneteenth is the oldest known celebration of the ending of slavery; and WHEREAS, On June 19, 1865, the Union Major General Gordon Granger proclaimed that the war had ended and the slaves were free; and WHEREAS, that proclamation took place two and a half years after the signing of the Emancipation Proclamation (which had become official January 1, 1863); and WHEREAS, Juneteenth is a time for celebrating freedom and encouraging self-development and respect for all cultures; and WHEREAS, African Americans gather with loved ones and celebrate with prayer, guest speakers, barbecues, parades, dancing, rodeos, fishing, picnics, and baseball; and WHEREAS, the State of Texas declared June 19th a legal state holiday in 1980 and since that time Juneteenth celebrations have been growing across the nation; and WHEREAS, the citizens of Lake Helen continue to celebrate, mostly in Church with family and friends; and NOW, THEREFORE, the City Commission of the City of Lake Helen hereby recognizes the importance of Juneteenth in our community. At the May 22, 2018 Historic Preservation Board Meeting, Mr. Steve Hemmerle requested the same house to be reviewed for a lot at 374 S. Volusia Avenue. The Historic Preservations Board recommended approval of a mirrored elevation with a flat finish stucco. 49 RESOLUTION NO A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAKE HELEN, FLORIDA, RELATING TO THE PROVISION AND FUNDING OF FIRE RESCUE, STORMWATER AND SOLID WASTE SERVICES IN THE CITY; ESTABLISHING THE ESTIMATED RATES OF THE FIRE RESCUE, STORMWATER AND SOLID WASTE ASSESSMENTS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018; DIRECTING THE PREPARATION OF ASSESSMENT ROLLS FOR THE FIRE, STORWMATER AND SOLID WASTE ASSESSMENTS; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE THEREOF; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LAKE HELEN, FLORIDA: SECTION 1. AUTHORITY FOR THIS RESOLUTION. This Resolution is adopted pursuant to City Ordinance No (the "Assessment Ordinance"), sections , and , Florida Statutes, and other applicable provisions of law. SECTION 2. FINDINGS. It is hereby ascertained, determined and declared that: (A) The City of Lake Helen (the "City") imposes annual special assessments, sometimes referred to as non ad valorem assessments, to fund the provision of fire rescue, stormwater and solid waste services each year. (B) The Assessment Ordinance describes the process for annual administration of the special assessments which involves adoption of an Annual Assessment Resolution during the City's budget adoption process each year. The Annual Assessment Resolution approves the rates of assessment for fire rescue, stormwater and solid waste services, respectively, for the forthcoming fiscal year and the non ad valorem assessment roll for each service, which rolls are thereby certified to the tax collection offices of Volusia County for inclusion of the assessments on the annual ad valorem property tax bill mailed each November. (C) The City Commission now wishes to authorize and direct City staff to take such actions as may be necessary or desirable in furtherance of adopting the Annual Assessment Resolution for the fire, stormwater and solid waste assessments for the fiscal year commencing October 1, 2018 ("Fiscal Year "). SECTION 3. AUTHORITY AND DIRECTION. (A) The City Administrator and other members of City staff are hereby authorized and directed to take such actions as may be necessary or desirable in furtherance of adopting the Annual Assessment Resolution for Fiscal Year , including but not limited to the following: (1) Preparing the Annual Assessment Resolution for consideration by the City Commission at its August 9, 2018 regularly scheduled meeting. (2) Preparing an assessment roll for fire, stormwater and solid waste services, respectively. (3) Mail and publish any notices required by the Assessment Ordinance. (4) Take such other actions as may be necessary or desirable in order to facilitate adoption of the Annual Assessment Resolution for Fiscal Year and imposition and collection of the fire rescue, stormwater and solid waste assessments for such fiscal year.

50 Preliminary Rate Resolution 2018 SECTION 4. PROPOSED ASSESSMENT RATES. The following assessment rates for fire rescue, stormwater and solid waste services are hereby proposed for Fiscal Year and beyond. Such rates shall be utilized by the City Administrator in preparing the Annual Assessment Resolution, the assessment rolls and the mailed and published notices contemplated by Section 3 hereof, as applicable: (A) Fire Rescue: (1) Fiscal Year : (a) Residential: $ per dwelling unit. (b) General Parcels (non residential): $0.43 per square foot (c) Vacant Lots: $49.00 per lot. (2) For fiscal years thereafter: (a) Residential: $ per dwelling unit. (b) General Parcels (non residential): [$0.62] per square foot (c) Vacant Lots: [$71.00] per lot. (B) Stormwater: (1) Fiscal Year : [$33.00] per ERU. (2) For fiscal years thereafter: an increase above the prior fiscal year which shall not exceed a percentage equal to the Municipal Cost Index (available at cost index or by contacting the office of the City Administrator.) (C) Solid Waste Assessments: (1) Fiscal Year : $ per dwelling unit. (2) For fiscal years thereafter: an increase above the prior fiscal year which shall not exceed a percentage equal to the Consumer Price Index for the Orlando metropolitan area; provided, however, such increase shall not be less than 2% or more than 4% of the rate imposed the prior fiscal year. 51 RESOLUTION A RESOLUTION BY THE CITY OF LAKE HELEN, FLORIDA, RELATING TO THE LEVY OF A GENERAL MUNICIPAL AD VALOREM TAX FOR THE TAX YEAR; PROVIDING A ROLLED BACK MILLAGE RATE FOR GENERAL MUNICIPAL PURPOSES; ESTABLISHING A PROPOSED MILLAGE RATE FOR GENERAL MUNICIPAL PURPOSES; ESTABLISHING A PUBLIC HEARING; PROVIDING FOR NOTICE TO THE VOLUSIA COUNTY PROPERTY APPRAISER; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Volusia County Property Appraiser certified the 2018 taxable values for General Municipal purposes to the City Commission of the City of Lake Helen on June 29, 2018; and WHEREAS, Section (2)(b), Florida Statutes, requires the City Commission to advise the Property Appraiser of the City's prior year millage rate, its rolled back mileage rate, its proposed millage rate and of the time, date and place at which a public hearing will be held to consider the proposed millage rate and the tentative budget; and WHEREAS, the City Commission has discussed the proposed tentative budget for the City in budget workshops for its further consideration in accordance with the controlling provisions of State law; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Lake Helen, Florida, that: 1. 57 Meeting Date: July 12, 2018 City of Lake Helen Agenda Memorandum Item 7a Subject: Ordinance Annexation of 704 Matanzas Street Synopsis: In May 2018 the City Commission passed Resolution temporarily waiving annexation fees until September 30, Staff has been working with property owner Amy Henry at 704 Matanzas Street to complete the annexation Annexation Annexation is the process of adding real property to the boundaries of the City of Lake Helen. Once annexed, the property becomes fully a part of the City and realizes all benefits and services thereof. The Florida Statutes will allow unincorporated property to be annexed only if it is contiguous with the City limits. In order for specific property within unincorporated areas to be voluntarily annexed, Chapter of the Florida Statutes requires the following criteria be met: 1. An application must be filed bearing the signatures of all property owners within the area proposed to be annexed. 2. The property must be contiguous to the municipality s boundaries and must be reasonable compact Annexed Properties Land Use and Zoning Designations All properties have Land Use and Zoning designations, regardless of their political jurisdiction. The Lake Helen Comprehensive Plan allows properties annexing into the City to convert the existing Volusia County Future Land Use designations to similar City of Lake Helen designations, provided the City s planning objectives for the area can be met. Alternatively, if the City determines the County s designations are not the most appropriate for the property, a request for City designations must be made in accordance with the Land Use Plan Amendment process. In either case, a Zoning Map Amendment request must be made to establish a City Zoning designation that is consistent with the Future Land Use designation Procedure for Annexation The owner(s) of the properties shall meet with city staff and complete the application requesting Annexation. The Application will be forwarded to the Planning and Land Development Regulation Commission for review and recommendation to the City Commission and will ensure compliance with Chapter 171of the Florida Statutes. The Planning and Land Development Regulation Commission reviewed this item at their May 21, 2018 Regular Meeting and is recommending approval of the ordinance. WHEREAS, from time to time it becomes necessary to amend the City of Lake Helen Comprehensive Plan, and WHEREAS, a Public Hearing on the question of designating a future land use classification of the property hereinafter described has been duly held in the City of Lake Helen, Florida and at such hearing, interested parties and citizens for and/or against the proposed designation of the future land use classification was heard; and WHEREAS, such amendments are permitted subject to the provisions of F.S WHEREAS, the Planning and Land Development Regulation Commission, sitting as the City's Local Planning Agency, recommended the proposed Plan Amendment at their regular meeting on Monday, May 21, 2018; WHEREAS, the City Commission feels it is in the best interests of the citizens of the City of Lake Helen to amend its Comprehensive Plan as more particularly set forth hereinafter. PART B. PUBLICATION. Notice of this proposed change to the Lake Helen Comprehensive Plan shall be published in the manner prescribed by F.S PART C. PUBLIC HEARINGS. As a condition precedent to the adoption of this ordinance amending the City's Comprehensive Plan, the City Commission shall hold at least one advertised public hearing on the proposed comprehensive plan or plan amendment pursuant to F.S for the purpose of transmitting the proposed amendment to the Volusia Growth Management Commission and Florida Department of Economic Opportunity.

64 PART E. CONFLICTING PROVISIONS. All ordinances and resolutions, or parts thereof that are in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART F. EFFECTIVE DATE. The effective date of this plan amendment, if the amendment is not timely challenged, shall be 31 days after the state land planning agency notifies the local government that the plan amendment package is complete. If timely challenged, this amendment shall become effective on the date the state land planning agency or the Administration Commission enters a final order determining this adopted amendment to comply. No development orders, development permits, or land uses dependent on this amendment may be issued or commence before it has become effective. The amendment shall not be effective until certification is received from the Volusia Growth Management Commission. PART G. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstance, such holding shall not affect its applicability to any other person, property, or circumstance. 65 Future Land Use Map Amendment 704 Matanzas Road from County R to City of Lake Helen RR Volusia County Future Land Use Designation Rural (R) This designation consists of areas which are a mixture of agriculture and low density residential development. Rural areas provide two functions, the first being a transitional use between the agricultural and urban uses and the second would be a rural community which serves as the economic focal point of a small region. Rural areas should be developed in a manner consistent with the retention of agriculture and the protection of environmentally sensitive areas. Strict limitation of development in rural areas contributes to the efficient growth and operation of public services and facilities, thus ensuring the most effective use of public resources. The natural features and constraints will be the primary determinants in deciding whether or not an area is suitable for rural type development. (1) Lands designated as rural shall be developed at a density of one (1) dwelling unit per five (5) acres. 1. This density allowance may be increased under specific conditions as follows: (a) The subject parcel is within six hundred and sixty feet (660 ) of an existing subdivision with a density less than one (1) dwelling unit per five (5) acres. In this case the Rural land may be developed at a similar density not to exceed one (1) dwelling unit per one (1) acre and with lot sizes similar and compatible with said qualifying subdivision. (b) The subject parcel is adjacent to an urban land use. In this case the Rural land may develop at a similar density not to exceed one (1) dwelling unit per one (1) acre, or intensity not to exceed a maximum Floor Area Ratio of twenty five percent (0.25 FAR). (c) In addition to the above conditions, the appropriateness of allowing densities less than one (1) dwelling unit per five (5) acres will also be subject to the following: i. Compatibility of the proposed development in the context of existing uses, including the proximity of agricultural uses; ii. Public facility capacity in the area, including the availability of paved public roads; iii. Suitability for wells and septic tank usage (i.e. existence of hydric iv. soils); The natural features of the subject parcel such as soils, vegetation, wildlife habitat and flood plain; and, v. 74 Meeting Date: July 12, 2018 City of Lake Helen Agenda Memorandum Item 7d Subject: Consideration of Land Development Code Change Consideration to change to the City of Lake Helen Land Development Code Articles 1, 3, 4, and 5 to require a certificate of appropriateness prior to final approval of a building permit for a new structure or modification of an existing structure which changes the architectural design within the Gateway Overlay. Staff Report: The City Commission, the Planning and Land Development Regulation Commission, the Historic Preservation Board, along with staff have discussed strengthening the process of exterior review within the Gateway Overlay. Currently prior to final approval of elevations for new structures or modification to structures within the Gateway Overlay a review with public input is brought before both the Historic Preservation Board and the City Commission. After input from both boards and the public, the City Administrator approves the elevations prior to issuance of a building permit. The process is working but there is still a desire the strengthen the process. There is an established process for review and approval of a new structure or modification of an existing structure which changes the architectural design within the Historic District, through issuance of a Certificate of Appropriateness. Staff recommends modifying the land development code to follow the same process by requiring a new structure or modification of an existing structure which changes the architectural design within the Gateway Overlay to be formally approved by the City Commission after receiving recommendations from the Historic Preservation Board. In order to satisfy the need for formal acceptance and approval, staff recommends the attached changes to the Land Development Code so that new structures or modifications to structures within the Gateway Overlay District receive a Certificate of Appropriateness from the City Commission (after review and recommendation from the Historic Preservation Board). Section Procedure for Review Prior to final approval of a building permit for a new structure or modification of an existing structure which changes the architectural design within the Gateway Overlay, a Certificate of Appropriateness issued pursuant to procedures in through is required. the plans and renditions shall be presented to both the Historic Preservation Board and the City Commission for the opportunity of public review and comment. Final approval for the issuance of a permit, within the Gateway Overlay shall remain with the City Administrator or his/her designee. Submission and approval of development plans and building permit applications for construction within Gateway Overlay shall conform to procedures for a Certificate of Appropriateness pursuant to through of the Code of Ordinances of the City of Lake Helen including the specification in this article. Additionally, architectural drawings (complete front, sides and rear elevations and overhead

Such drawings shall be rendered in color and shall include building elevations, roof type, colors, landscaping, building orientation, exterior construction material specifications, color charts, structure dimensions, service area and mechanical equipment locations, outdoor storage area locations, screening devices, master signage plan, master lighting plan, and any other information as determined necessary by the City to ensure consistency with the provisions of this article as well as other articles with this Land Development Code. A Certificate of Appropriateness issued pursuant to procedures in through is required prior to approval of a building permit. Final approval of all required project design, submittals shall be granted by the City Administrator or his/her designee as part of the development approval process which shall include, but not be limited to, building elevations, roof type, exterior construction materials, signage, lighting, screening, colors, landscaping and building orientation Certificate of Appropriateness A Certificate of Appropriateness shall be required for any of the following activities on properties located within the Lake Helen Historic District and the Gateway Overlay. After issuance by the City Commission, the Certificate of Appropriateness must be recorded with the Volusia County Clerk of Court prior to issuance of a building permit. SECTION 3. CONFLICTS. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared severable. SECTION 5. CODIFICATION. Specific authority is hereby granted to codify and incorporate this Ordinance in the existing Code of Ordinances of the City of Lake Helen. SECTION 6. EFFECTIVE DATE. 78 Meeting Date: July 12, 2018 City of Lake Helen Public Hearing Item 7e Subject: Consideration of Land Development Code Change Article 4, Temporary Signs Staff Report: The City Commission at the June 14, 2018 Regular City Commission meeting requested the Planning and Land Development Regulation Commission review the temporary sign code to allow for temporary signs larger than 6 square feet during construction. Staff had conducted research and suggests adding language to the temporary sign code to allow for larger signs new during construction: Temporary signs The following standards and criteria shall apply to all temporary signs located and placed within the city limits. 1. These signs shall all be freestanding signs, constructed of sturdy, all-weather materials such as hard plastic, vinyl, masonite or wood of a sufficient thickness to withstand the local weather conditions commonly experienced. (Paper and cardboard signs are strictly prohibited). 2. No temporary signage shall be placed within the public rights-of-way or on city owned property unless approved by the City Administrator or his/her designee in advance. 3. No part of any temporary sign shall be located closer than five feet (5 ) from front property line or a public right-of-way and ten (10) feet from adjacent property lines, and in no instance shall any temporary sign obstruct the visibility of any motorist, bicyclist or pedestrian from seeing oncoming pedestrians, bicyclists or vehicular traffic. 4. These signs may be double-faced, with messages on the front and back sides of the same sign, and only the sign area of one (1) side shall be used for the sign area calculations. 5. No single sign (except for during construction as described in number 6 below) shall exceed six (6) square feet in sign area, and a total of three (3) temporary signs are permitted on any one (1) property, with a maximum of eighteen (18) square feet of total combined sign area, at a maximum height of four feet (4 ) for all signs. Each temporary sign shall be permitted for up to ninety (90) calendar days. 6. Temporary signs during construction of a new principle structure on a vacant lot shall not exceed forty-eight (48) square feet in sign area, with a maximum height of six feet (6 ) with a maximum of one (1) sign per residential property and two (2) signs per commercial property. A Certificate of Occupancy will not be issued until all signs are removed from the property Temporary signs shall be removed within three (3) calendar days from the date the scheduled event has concluded, if applicable, or by the ninety-day (90) deadline defined in subsection 5 above, whichever occurs first. 80 ORDINANCE AN ORDINANCE OF THE CITY OF LAKE HELEN, FLORIDA, AMENDING ARTICLE 4 OF THE CITY OF LAKE HELEN CODE OF ORDINANCES TO ALLOW FOR TEMPORARY SIGNS OF GREATER SIZE DURING CONSTRUCTION OF A NEW STRUCTURE; PROVIDING FOR LEGISLATIVE FINDINGS; PROVIDING FOR AMENDMENTS TO ARTICLE 4; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY, PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission recognizes a need for temporary signs larger than 6 square feet during construction; and WHEREAS, while maintaining content neutrality, the City Commission described the period of time the temporary sign may be erected, not the content of the sign; and WHEREAS, the City Commission finds it would be appropriate to allow temporary signs larger than 6 square feet during construction but require removal of said signage before a Certificate of Occupancy will be issued for the project; and WHEREAS, underlined items are for insertions to the city code, strikethroughs are for deletions from the city code; NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF LAKE HELEN, FLORIDA: SECTION 1.
