4 SD Association of County Commissioners Gary Jaeger, Deuel County Commissioner I would like to wish each and every county commissioner, county official, and county employee a Happy New Year and may your dreams and wishes come true in this year of Also I would like to welcome all new county commissioners, county officials, and employees who will be reading the Presidents Comments and articles for the first time in your County Comment newsletter. Kris does a wonderful job with this publication. This publication keeps all its members informed on what s happening with meetings, workshops, and how we conduct business and ourselves during meetings with Roberts Rule of Order, which keep meetings moving forward orderly. Sometimes you will see how emotions play a large part of these meetings. Remember to try and come to the Commissioner s Workshop in March. It s very beneficial for networking with your colleagues and getting to know how your Association works for you. I will be touching on other topics in this article: the counties have an obligation to pay for court-ordered mental evaluations for both Adult Justice and Juvenile Justice. This is part of the Mental Evaluations Reform Act from the Supreme Court Chief Justice Gilbertson, and funded through Dept. of Social Services and administered through the South Dakota Association of County Commissioners. This competency evaluation is to see if the defendant is mentally stable enough to stand trial, not part of the sentencing or during probation period. While working on this committee with Greg Sattizahn, Unified Judicial System director of policy and legal services and Executive Director Bob Wilcox and going through the applications, we still need to get the word out to counties that this tool is available to use for every county. Some of the past legislation has had good intentions but some flaws in the working mechanism have been found and are being corrected as I write this article. Some of it is in the coding or a lack of of understanding about what s covered and what isn t. This is why Executive Director Bob Wilcox and Deputy Director Kris Jacobsen are very busy staying in contact with all parties necessary to look out for the interests of your county s association. Your Association President has been on the road attending District Meetings and if you have a District Meeting coming up, contact me by text to , or G.54jaeger@ icloud.com, I have also attended the Agland Assessment Tax Force meeting in Pierre, Transportation Alternatives that are safe alternatives for school children, adults walking to and from school work or for recreational purposes. Kris and I took in the South Dakota Towns and Townships, listening and networking with other associations on how we can work together on commons interests in this 2019 Legislative session. I think I have rambled on enough. I hope these comments find everyone safe now that it looks more like winter outside for snowmobiles, the livestock producers, and those who have to work outside keeping roads open. Remember, now the days are getting longer. 5 SD Association of County Officials Raynelle Mueller, Grant County Treasurer Greetings, everyone!! Happy New Year!! Appreciation for what we have had in the past and anticipation for what is to come with the New Year is another way to say out with the old, in with the new. We have a new Governor, Cabinet heads, state employees, new legislators, new county Commissioners, and new local elected officials. I would like to express my appreciation and thanks to all of the elected officials and Commissioners who have started or continue with their terms of office. I would also like to express my thanks and best wishes to those elected officials who have retired from their positions. Your years of service and knowledge are very much appreciated and your wisdom will be missed. Best Wishes on your future adventures!! I am writing this article on the 11th hour. My schedule got a little wonky after the calendar page flipped with more tasks to accomplish than time available. I would like to thank all of you for the opportunity to travel to Washington, DC for the President s and Executive Director s Meeting. We left South Dakota on the morning of Tuesday, January 9th, and returned on Friday afternoon, January 11th. It was quite an adventure Gary was very patient with me, making sure we both got through the checkpoints, and on the same plane. (Footnote: I am not a world traveler unless it is in a pickup hooked up to a cattle trailer full of Holsteins and tack, headed for a show!) Bob was a fantastic travel coordinator when we arrived. Thank goodness we had taxi drivers who knew how to get where we needed to be. It was an awesome experience, learning from the speakers, meeting other Presidents and Execs from across the nation, sharing our knowledge and experiences of our positions. Amazing networking opportunity.. and some sightseeing along the way. Thank you again!! In keeping in tune with in with the new, I am going to include an abbreviated version of the Interview Questions that have been done in previous issues of The Comment, so those who want to know a bit more about me will be able to, so here goes: I was appointed the Grant County Treasurer on April 1st, 2003, and have not had opposition for my position since. Three people I would like to invite to dinner would be my Dad, his Dad, and my Mom s Dad (all deceased). I think it would be great for them to be able to meet the family they haven t. A dream of mine is to be able to finally get the boxes unpacked from our closets that got stashed when we moved into our new house in You might be surprised to learn that I was a Senate page during the 1974 Legislative Session. The most adventurous thing I ve ever done is agree to chaperone 80 4-H youth ages on a weeklong trip over the 4th of July on a bus to Washington, DC, not just once, but twice!! The bus ride was 26 hours long, the kids were great, and they let me have dibs on the center alley of the bus to stretch out for a nap!! (This was over 20 years ago, but great memories). My favorite way to relax in the summer is to jump on my riding lawn mower and do the task for several hours, or in the winter to grab my latest crochet project. I am most proud of my family: hubby, 3 kids/their spouses, and our 12 grandchildren, and not to forget the 62 head of Registered Holsteins that call us to the barn twice a day. As we have begun a new year I m guessing most of us have established some resolutions or goals, both personal and professional. The start of a new year is a wonderful time to reassess the hectic nature of our lives and reflect on what we want to accomplish or change in the coming months. I don t know about you but for myself goals and resolutions always seem to be much easier to set than to accomplish. This year, I ve decided to tackle my resolutions and goals by breaking them down into small steps. Hopefully they will be easier to achieve, working toward the bigger picture. I ve also decided to write down my steps to those goals, the old-fashioned way, with pen and paper. This helps to visualize and remember what my intentions are. But with all the technology available at our fingertips today, setting reminders on a phone, tablet, computer or other device are also convenient ways to revisit goals and reflect on what has been accomplished and what is yet to be achieved. To reach those goals and resolutions we need to be open to change and progress. Change happens in every aspect of our lives and all too often we are apprehensive and fearful of those changes. A great way to work through that apprehension is to acknowledge the change and realize that change is a constant part of life. Change prevents our lives from becoming mundane and offers new challenges and opportunities for growth and learning. Be flexible and embrace the changes that are destined to come our way. 7 SD Assoc of County Highway Superintendents Dirk Rogers, Brown County Highway Superintendent Snow came down between the holidays, so that was a bit of a goat-rope. I don t dream of a White Christmas. Actually, if anyone plays that crap song in my house during the holidays, one of your presents gets taken away. But the snow came anyway. Now this wasn t any kind of an apocalyptic event, but the two storms did drop about a foot of snow and mixed in some wind for good measure. That represented the most snow we have had to deal with at one time in the last five years. Recent winters have been relatively tame with minimal plowing. When you couple your normal employee turnover with a few mellow winters in a row, you end up with some good, moderately experienced operators that have very little snow plow experience. Similar to operating a Motor Grader maintaining surface gravel, there is really no way to properly experience and train for plowing, other than getting in the seat. The other awesome part of the Holiday Snow Event is the plow operators align themselves into two groups: The first group is the gonna be out of town group. They want to get snowed OUT of the area altogether. They let you know ahead of time that they will be gone. The second group is the Please call me group. These guys want to come plow snow because the holiday alternative is watching the in-laws hula lesson video from last year s vacation. These guys come early and stay late. All in all, we were able to cover everything daily. The general public is the wildcard component of the snow fighting process. Public awareness of slick road surfaces seems to have improved a bit over the years, but I will never understand why someone thinks their 2004 Camry is going to make it through a 4 foot deep, 100 foot long drift. Trying to get to town in a blizzard for a non-emergency is a selfish act and jeopardizes safety for hundreds of people. Since I hate snow, I am going to quit talking about it and transition into the hand holding- kumbaya singing part of my column. I would like to acknowledge a couple of people who I learned a lot from early in my career. The first is the retiring Brown County Auditor Maxine Fischer. Max has been the Auditor in Brown County since 1991 and worked in the office since Max helped me a lot early in my career to understand the funding and lack thereof. We have had disagreements over the years but nothing that wasn t manageable. Having heard some horror stories about auditor/highway supt. relationships, I have always considered myself fortunate. Personally Maxine and I have a lot of common beliefs and I have enjoyed our conversations outside of the County topics. Thank you very much Maxine. Good luck, and good karma. The other acknowledgement I would like to make is the passing of Bobby Meister. Bobby started in 1973 as the Union County Highway Superintendent and moved to Minnehaha County in He was in Minnehaha until 2011 when he retired. Bob was the largest advocate I have met for local roads, was a champion of standardized bridge plans (which we still have not figured out), and was a key driver in making the SDACHS a viable organization. Bob was an available, albeit crabby, resource for any young superintendent to tap. He was an active lobbyist for the counties and had the right mix of savvy and swagger to be effective. In 2013 Bob was appropriately inducted into the South Dakota Transportation Hall of Honor. I am grateful that he impacted my career. Thoughts and prayers to Mary and the family. Michael Blaska, Parliamentarian & Former Chief of Staff, Wisconsin Counties Association A previous Call to Order article discussed the process of setting the agenda. However, questions are often raised regarding how specific an agenda item must be. Further, what is the proper wording of common agenda items. Subject matter of agenda should be described in a way that is reasonably likely to apprise the members of the public and new media thereof. In other words, the general topic of the subject to be discussed should be clear in the agenda item. An agenda item such as Highway Superintendent s Report may not be sufficient. If the highway superintendent is reporting on a controversial construction of a new highway garage, the public has a right to know well in advance. There could be other public officials, contractors, and interested citizens that would attend the meeting if that agenda item were known. A proper agenda item for that example might read, Highway Superintendent s Report - New Highway Garage. In this situation, the highway superintendent is free to report on other routine issues, but has made it clear that the highway garage will be part of the report. A common practice in preparing the agenda is to number and title resolutions and ordinance amendments. They are numbered in order of introduction along with the year, such as The title should be specific enough for the public to discern the subject matter to be discussed. An agenda item such as Resolution New Highway Garage may be sufficient; however, Resolution Authorizing the Construction of a New Highway Garage is preferable. It is also wise to include the action to be taken, such as Consideration of... or Adoption of... The term Consideration of... is less presumptive than Adoption of... when the body may prefer to defeat or deny the proposal. Many agenda include the phrase Discussion and Action of: prior to the subject matter. In this situation, it is not necessary to include the word Discussion because the body always has the right to discuss the matter. If the intent is to just discuss the matter and not take a vote then the agenda item should only read Discussion of... An interested party may not attend the meeting if the body will only discuss the matter as oppose to taking-action. Many counties include the action of the committee and the vote as part of the agenda item. For example, Consideration of Resolution Authorizing the Construction of a New Highway Garage (Highway Committee recommends adoption 5-2). Some counties have a policy that the motion before the body is the recommendation of the committee; this effectively negates the need for a member to make a motion. It is advised against vague agenda items such as Old Business, New Business, and Such other Business as Allowed by Law. The terms are generic and do not provide specific topic of the subject to be discussed. Placing one of these terms or phrases, such as Such other Business as Allowed by Law on the agenda does not violate the law, but what is discussed under the item may. For example, discussing the construction of a new highway garage would be a clear violation. That said, it is not a violation to request the distribution of a report, suggest a speaker for the next meeting, or thank a department head for a job well done. One of the purposes of the Open Meeting Law is to ensure the public has the fullest and most complete information regarding the affairs of government. The subject matter on an agenda should provide the public with a reasonable description of the business at hand. 10 Tips, Trends and Resources SDPAA - A Year in Review By: Dave Pfeifle, Executive Director The Year 2018 marked the 31st anniversary of the South Dakota Public Assurance, which was formed during the 1980 s insurance crisis when local governments could not secure affordable liability insurance, if any, from private insurance companies. Out of necessity, visionaries from local governments across South Dakota successfully spearheaded enabling legislation through the SD Legislature to create their own risk sharing pool to provide property and liability coverage for their fellow local governments. Today, the SDPAA has expanded to 427 Members across South Dakota, including counties, municipalities, townships, and special districts. From its inception, the SDPAA has distinguished itself by providing exceptional services to its Members. As part of their Membership, SDPAA Members receive free loss control surveys and property valuations. At any time, SDPAA Members can also consult with experienced and knowledgeable SDPAA staff, who are public employees with a unique appreciation of the risks faced by local governments in South Dakota. The SDPAA has proven to be the best option for coverage for local governments in South Dakota by providing stable pricing and the broadest coverages available that are uniquely tailored to meet the specific needs of our Members. The key to the SDPAA s success is simple: it was formed by, it is for the benefit of, and consists entirely of local governments in South Dakota. We are not beholden to outof-state shareholders. As we approach the Year 2019, we will not rest on our laurels. We will continue to look for new and innovative ways to provide exceptional service to our Members. We are proud to announce a new service starting in 2019 for our Members who have liability coverage: SDPAA offers Government Practices Hotline: Currently, SDPAA Members who have liability coverage may contact the Employment Practices Hotline (EPH) free of charge for up to one hour to consult with local expert attorneys on employment law topics. Approximately 100 calls are made every year to the EPH by SDPAA Members. Starting in 2019, the SDPAA will offer a similar hotline for any governmental-related questions, which will be called the Government Practices Hotline (GPH). Similar to the EPH, the GPH will provide SDPAA Members who carry liability coverage up to one hour of free legal advice from South Dakota Legal Experts on a wide variety of civil legal issues, including: elections, planning/zoning, open meetings, public records requests, environmental compliance, and Tax Incremental Financing. At the SDPAA s Annual Membership meeting in Pierre in October, Mike Wiese, Brown County Commissioner, and Mike Hall, City of Sioux Falls Risk Manager, were reelected to three-year terms on the Board. Each of these attorneys has extensive experience in local government law to assist our Members. This service is intended to support, not replace, your existing legal advisor. GPH attorneys will be encouraged to work with you and your existing legal advisor to provide the necessary advice for you to effectively and legally serve your constituents. SDPAA will offer enhanced training opportunities: The SDPAA already provides its Members with thousands of hours of training opportunities as part of their Membership. The SDPAA also co-hosts a Safety and Loss Control Training Conference each year providing hundreds of attendees training seminars on a variety of subjects. This past year, the SD- PAA, through Safety Benefits, Inc., one of its service providers, provided 496 hours of training through 127 training sessions to 3,463 attendees throughout the state. Thus far this year, SDPAA also provided on-line training to 60 Members with 3,186 courses. Through a shared Media Library, 36 Members have been provided with 136 training videos. The SD- PAA will expand these opportunities in 2019:. The SDPAA is a co-sponsor of new Crisis Intervention Training for all law enforcement officers throughout South Dakota. A combination of class-room and on-line training will assist law enforcement officers in dealing with those who may have a mental illness. This training is a joint effort of the SDPAA, the State of South Dakota, the South Dakota Sheriff s Association, and the Minnesota Sheriff s Association.. The SDPAA is seeking to provide additional law enforcement training for those communities who may address civil disobedience issues in the near future. More to come. The greatest lesson I learned was to have patience and understanding for others who are not familiar with a process. (Last week put me in those shoes!) I enjoy doing public service as it gives me an opportunity to help others accomplish their goals, and see them be happy after reaching them. The changes in our county over the next 5 years will include alternative energy sources. My favorite South Dakota attraction would be the memorials surrounding the State Capitol in Pierre, especially the one honoring the Korean veterans. (I was able to take my Dad to see it be unveiled). I would describe myself as conservative, shy, cautious, and loyal to my friends. For someone who is thinking of running for public office I would tell them it is very fulfilling and challenging all in the same moment. The hardest issue as Treasurer that I have had to deal with is the tax deed process, as you are expected to follow SDCL, yet have a heart when dealing with property owners. 14 County News How to Track a Bill Online During the 2019 Session Step 1 Go to the Legislative Research Council website at: Step 2 Click on Session on the top of the page and then select 2019 Bills or the green button marked "2019 Bills". Step 3 If you click on Quick Find you are able to type in the bill number. If you aren t sure of the bill number then you can do a text search or look through the subject index. Step 4 After you ve found the bill you want to track, you can click on the bill and see a page like the one here You ll see the sponsors of the bill, a short explanation of the bill, the date it was first introduced and the committee it was assigned to. If the bill is scheduled for hearing you will see that date next. The information following the hearing will indicate the dates and any action taken debate and/or action in a committee, possible amendments to the bill, debate and/or action in the Full Senate or House, etc. Within the page of the bill you can view many other things. If you click on a vote total you can view how a Legislator voted. If you want to listen to the actual testimony/debate click on the Public Broadcasting symbol to the right. 16 County News SD FIT Leaps Into 2019 With Enhanced Service and Performance By: Your SD FIT Team As the New Year exits the gate, citizens across our Great State look to many horizons. Within each of our organizations, we look to annual goals on how we can make a difference for kids, our seniors, and everyone in between. The times are challenging, but the resolve of the Mount Rushmore State is rock solid. Here at the South Dakota Public Funds Investment Trust (SD FIT), our horizon is the financial health and success of cities, counties, and schools across the State. For 2019, we are excited about an enhanced partnership within the SD FIT program that we believe will make a difference for all of South Dakota. Beginning this past December, the SD FIT Board of Trustees expanded our partnership with PMA Financial Network to include investment management and administration of the SD FIT program. Along with their longstanding work on fixed rate investments, PMA now partners with every aspect of the program to bring the highest level of service to our communities. What does this mean? It means that SD FIT has a new web interface that provides cutting edge reporting and transaction capability. It means that SD FIT has a professional investment team managing the portfolio that has years of experience managing public funds (a balance of over $7 billion as of September 30, 2018), with a diverse team of professionals, many of whom have served in the public sector. It means that our sponsors the South Dakota Municipal League, South Dakota Counties, and the Associated School Board of South Dakota have new tools and an enhanced team for member education. Under this expanded partnership with PMA, SD FIT now has a seamless and efficient suite of capabilities for South Dakota.
