1 The City of Andover, Kansas City Hall 1609 East Central Avenue 7:00 PM on Tuesday, Governing Body Staff AV Mayor Ben Lawrence, Council Members Kris Estes, Sheri Geisler, Caroline Hale, Clark Nelson, and Troy Tabor. Council Member Greg Schneider was sworn in. City Administrator Mark Detter, City Clerk Susan Renner, Public Works & Community Development Director Les Mangus, City Attorney J.T. Klaus accompanied by TWG Summer Intern Hope Faflick, Assistant City Administrator Jennifer McCausland, Fire Chief Chad Russell, Chief Financial Officer Donna Davis, Police Chief Michael Keller and City Engineer Steve Anderson. 2 7. Citizen Requests 7.1 D.L. Underwood, 342 N. Lioba Unit 5C, Andover Mr. Underwood provided a copy of the HOA's current utility bill for the twenty-two (22) units at Beaumont Place. Mr. Underwood requested consideration by the council to lower the fees for these units as most residents are elderly, single and living on a fixed income. Mark Detter stated the fees are the same for all residents in Andover and although some municipalities charge by the amount of water used it is the responsibility of all citizens for the maintenance and operation of the wastewater plant. Staff was directed to survey local area municipalities and report to the council. 7.2 Cub Scout Pack 584 request to camp in Central Park, Saturday, October 7, 2017 Darren Schuster, E. Tipperary Circle, Wichita, requested permission for Andover Cub Scout Pack 584 (St. Vincent De Paul) to camp in Central Park from Saturday, October 7, 2017, 2pm thru Sunday, October 8, 2017 at 9am. Motion by Nelson, second by Geisler. Approve the request as presented. CARRIED 5/0. Mr. Schuster was instructed to contact the Police and Fire Department to coordinate. 7.3 Street Closure for St. Vincent De Paul's Walk for the Poor, Sunday, September 17, 2017 Mark Benson, 1226 W. Quail Crossing Court, requested street closures directly around St. Vincent's De Paul from 9:30am-11:30am, on Sunday, September 17, 2017, for their "Walk for the Poor". Streets included are Douglas from Andover Road to Chapel Drive, north on Chapel Drive to 1st, and west on 1st to Andover Road. This is a partial closure for the walkers safety. Motion by Geisler, second by Estes. Approve the street closures as requested. CARRIED 5/0. 8. Greg Schneider sworn in as City Council Member by Mayor Lawrence. A special election was held August 1, 2017 and the position will be up for re-election November 2019 with the term expiring January 14, This fills the vacancy left by the resignation of Phil White in February Elizabeth "Annie" McCully sworn in as Police Officer by Mayor Lawrence.

PAX balloon artist, Wichita, for Friday, September, September pm, in the amount of $ Kansas Medical Center Medical Office Building mortgage (June 13, 2017) with Community National Bank and Trust of Newton, Kansas regarding Lot 1, Block 1, Cornerstone Office Addition, 2237 Keystone Circle, Andover. Motion by Estes, second by Tabor. Approve consent agenda items 10.1 through as presented. 11. Amphitheater Naming Rights 11.1 Amphitheater Naming Rights Mayor Lawrence announced the consideration of an agreement for naming rights for the amphitheater in Central Park. LK Architecture, Wichita, designed the facility, Key Construction, Wichita, general contractor started construction in July. The amphitheater concept has been in the makings for two (2) decades and part of the City Comprehensive Development Plans, with an original design accommodating people that has morphed into a seating capacity of over 10,000. Mayor Lawrence credited the CVB for stepping up and financially supporting five

4 (5) major concerts proving it a viable event center for the City of Andover. With no designated downtown area in Andover this has been looked at as creating a community gathering space in what is hoped to become the geographical center for Andover; the only way we can expand is to the east. Mayor Lawrence announced with the approval of this agreement the amphitheater will be officially named "Capitol Federal Amphitheater powered by Westar Energy." Continuing a community partnership with a company who purchased a K-9 for our Police Department, a 20' Christmas tree for the Central Park Plaza, and today offers a $750,000 sponsorship for a $1.5 million dollar facility. This will provide them exclusive title sponsorship through December 31, Westar Energy is donating the cost of the extension of power to the venue site. Rhonda Dennis, Capitol Federal Regional Vice President, stated the bank and their employees are excited and proud for this community involvement. Bridget Bowman, Westar Business Manager Bridget Bowman, stated Westar is also excited for the partnership and allowing Westar to bring positive energy to the Andover community. Motion by Tabor, second by Hale. Approve the Title Sponsorship Agreement with Capitol Federal Savings Bank, Topeka, Kansas and authorize the Mayor to sign the agreement. 12. Special Use Case SU W US Hwy An ordinance approving a special use request to establish a plumbing and restoration service contractor in the B-5 Highway Business District on certain lands located in the City of Andover, Kansas, under the authority granted by the zoning regulations of the City as originally approved by Ordinance Mayor Lawrence presented the proposed amendment and asked if any Council Member intended to disqualify themselves from participating due to a conflict of interest. No one did. Mayor Lawrence inquired if the City Clerk had received any protest petitions. She had not. Mayor Lawrence confirmed Council had received the unapproved minutes of the July 18, 2017 Planning Commission meeting. They concurred. Mayor Lawrence asked Zoning Administrator Les Mangus for a brief report of the case. Les Mangus explained Special Use Case SU was heard at the July 18, 2017 meeting of the Andover Planning Commission and was approved with the following conditions: screening fence installed along the south property line and east property line where material and equipment are stored outdoors. Applicant, Britt Moore, was in attendance.

5 Motion by Nelson, second by Geisler. Adopt an ordinance to approve Special Use Case SU for the establishment of a plumbing and restoration contractor in the B-5 Highway Business District; to include the following condition: screening fence to be installed along the south property line and along the east property line where material and equipment are stored outdoors, as approved and recommended by the Andover Planning Commissions findings and factors. 13. Yorktown Alignment Study for Design & Construction 13.1 TranSystems Corporation Agreement for Professional Services Ordinance number 1646 was assigned. Mark Detter stated the City has been talking about the improvement of Yorktown from US 54 to Douglas Avenue for quite some time. Jeff Lackey, TranSystems, presented the project and explained the contract structure. The overall study will include from US 54 north to 13th Street. The first phase; US 54 north to Douglas Avenue; second phase Douglas north to Central; and the third phase Central north to 13th Street. The development of Yorktown will allow potential development south of US 54 and adjacent to Yorktown, and more access to schools in light of the recent school bond approval. Mr. Lackey explained the benefits of looking at this as one project, in three phases, allowing the City to commit to one phase at a time but also have continuity with one plan in line with the City's Comprehensive Development Plan, US 54/400 Corridor Plan and USD 385 plans. Mr. Lackey added the contract cost anticipated the $1.1 number is a maximum amount for all phases. Motion by Nelson, second by Geisler. Approve the agreement with TranSystems in the amount not to exceed of $1,105, and authorize the Mayor to sign the agreement Bridge Inspection TranSystems Agreement 14.1 Steve Anderson explained this is for routine maintenance for inspection of bridges. Currently two-thirds (2/3) of the bridges are mandatory inspections and the other one-third (1/3) will be soon. He added the inspection of bridges is mandatory every two (2) years. Motion by Estes, second by Hale. RECOMMENDED ACTION: Approve the agreement with Transystems for 2017 Andover Bridge Inspections, in an amount not to exceed $ 9, and authorize the Mayor to sign the agreement.

Motor Fuel Dispensing Ordinance 15.1 An ordinance modifying the definition of theft in the Uniform Public Offense code to exclude dispensing motor fuel without payment when the retailer does not require pre-payment for motor fuel. Police Chief Keller explained this ordinance would address the issue of the loss of police department resources and time spent investigating customers who obtained motor vehicle fuel from a station that does not require a prepay and then leaving without paying for the fuel. Chief Keller stated the Police Department worked with the Andover stations and currently there is only one station whose policy does not require the pre-payment of fuel. After discussion staff was directed to return with an ordinance requiring the pre-payment of fuel by all stations inside the city limits. 16. Member Items Council Member Troy Tabor Announced WAMPO was looking for volunteers to count walkers/bike riders on paths on September 21 & 23, 2017; go to WAMPO.org for more information. Council Member Sheri Geisler Welcomed Council Member Greg Schneider. Council Member Clark Nelson Welcomed Council Member Greg Schneider. Thanked J.T. Klaus, Jennifer McCausland and Mayor Lawrence for the negotiation efforts with Capitol Federal. Council Member Kris Estes Welcomed Council Member Greg Schneider. Inquired about the Council Liaisons; Mayor Lawrence stated he planned to re-assign liaison positions in January. Council Member Caroline Hale Welcomed Council Member Greg Schneider and glad there is a full bench. Council Member Greg Schneider Stated he was glad to be here; he has a lot to learn and is willing. Fire Chief Russell stated Citigate, the company developing the departments Master Fire Plan, will be in Andover for a site visit on September 12 through 14. The Fire Department will contact Council Members to arrange for introductions.
