4 MPSCS Memorandum of Agreement memo The MPSCS Integration Agreement and Memorandum of Agreement, covers the credits received by the County of St. Clair from the State of Michigan for its implementation and investing in the infrastructure of the State-wide 800 MHz radio system. In 2007, the County received $1,389, in credits, which per the terms of the agreement, were guaranteed until September 2017 or until exhausted, whichever came first. The remaining balance of those credits, $923, will expire September 1, The amendments as of September 1, 2010, extend an additional irrevocable credit, in the amount of $1,389,066 and the term of the agreement to September 1, 2020 or until exhausted, whichever comes first. The credits can be used to add talk groups to the system, pay onetime radio activation fees for any new radios, and for any templates changes in excess of more than once a year. They cannot be used for hardware or any other infrastructure improvements or purchases. Credits that have been used since January 2016 include: 1. Radio Activation fee - $250 one time only. 2. Port Huron, Michigan Dear Mr. Conger: BILL SCHUETTE ATTORNEY GENERAL June 27, 2017 Re: Amendment of Michigan s Public Safety Communications System 2007 Integration Agreement and Memorandum of Agreement with the County of St. Clair, Michigan Enclosed is Amendment No. 1 to the September 21, 2007 MPSCS Integration Agreement and Memorandum of Agreement (MOA) with St. Clair County. DTMB/ MPSCS requested that the 2007 Integration Agreement s term be extended to coincide with the 2010 amendment of the MOA. The 2010 amendment s purpose was to add credits to St. Clair County for MPSCS fees and to extend the MOA s term by 10 years. The new Term and Effectivity section in the enclosed Integration Agreement Amendment No.1 extends its term to coincide with the purported 2010 MOA s term extension. Unfortunately, the 2010 MOA amendment, while drafted, appears to have never been signed by the Parties. To correct this oversight, I drafted a new amendment to the MOA to replace the 2010 drafted version. The enclosed Amendment No. 1 to the MOA references the 2007 credits, the 2010 credits, the current credit balance, and the credit amount subject to expiration unless otherwise used by September 1, Please have an authorized person sign the agreements and return to me. 7 AMENDMENT NO. 1 TO THE SEPTEMBER 21, 2007 MPSCS MEMORANDUM OF AGREEMENT WITH ST. CLAIR COUNTY, MICHIGAN This Amendment No. 1 (Amendment) amends the September 21, 2007 Memorandum of Agreement (2007 MOA), entered between the State of Michigan by its Department Technology, Management and Budget (DTMB), successor to the Department of Information Technology, for Michigan s Public Safety Communications System (MPSCS) and the County of St. Clair (St. Clair). The Parties agree that all provisions in the 2007 MOA that have not been modified by this Amendment remain in effect as written. This Amendment modifies the 2007 MOA s following titled sections: 1. The following is added to the 2007 MOA s Statement of Purpose paragraph: 1. STATEMENT OF PURPOSE. The purpose of this Amendment is to acknowledge and compensate St. Clair for its additional infrastructure investment in the Radio Sub-System, related to capacity and functionality. This Amendment supersedes the terms of the Member Subscriber Agreement between the Parties relating to the payment of MPSCS fees. 2. The following is added to the 2007 MOA s Consideration paragraph: 4. CONSIDERATION. In consideration of St. Clair s $2,778,133 infrastructure investment, which provided additional benefits and enhancements to the MPSCS, DTMB recognizes, acknowledges, and forever grants St. Clair, as of September 1, 2010, an additional one-time irrevocable credit and setoff against MPSCS fees, for the duration of the MOA and any extension or renewal of the MOA in the amount of $1,389, The Parties acknowledge that as of the date of this Amendment, and including the September 21, 2007 and September 1, 2010 credits, the credit balance is $2,312, And that $923, of the credits are scheduled to expire unless used before September 1,

8 3. The following replaces the 2007 MOA s Term paragraph: 6. EFFECTIVITY AND TERM. This Amendment will be effective as of September 1, 2010 upon DTMB s execution of the Amendment. The Term of this Amendment shall be for a maximum of 10 years after September 1, 2010, or when the $1,389, credit is exhausted, whichever occurs first. 4. The following is added to the 2007 MOA s Entire Agreement and Order of Priority paragraph: 13. ENTIRE AGREEMENT AND ORDER OF PRIORITY. Except to the extent expressly indicated in this Amendment, the MOA contains the entire and final agreement of the Parties, and all prior negotiations and agreements are integrated and merged into the Amendment. Neither party, nor its agents, has made any representations except those expressed in the Amendment. 12 AMENDMENT NO. 1 TO THE SEPTEMBER 21, 2007 MICHIGAN S PUBLIC SAFETY COMMUNICATIONS SYSTEM INTEGRATION AGREEMENT WITH THE COUNTY OF ST. CLAIR, MICHIGAN This Amendment No. 1 (Amendment), amends the September 21, 2007 Integration Agreement entered between the State of Michigan, by its Department Technology, Management and Budget (DTMB), successor to the Department of Information Technology, for Michigan s Public Safety Communications System (MPSCS), and the County of St. Clair (St. Clair). The Parties agree that all provisions in the Integration Agreement that have not been modified by this Amendment remain in effect as written. This Amendment modifies the Integration Agreement s following titled sections: 1. Paragraph 3 Initial Term and Renewal Terms is deleted entirely and replaced with the following new Term and Effectivity section: 3. TERM AND EFFECTIVITY. This Amendment is effective, as of September 1, 2010, upon DTMB s execution of the Amendment. The term of this Amendment shall be for a maximum of 10 years after September 1, 2010 or when the $1,389,066 credit stated in the contemporaneous Amendment to the Memorandum of Agreement (MOA), between the parties is exhausted, whichever occurs first. The Parties also may agree to extend the Integration Agreement, as amended by this Amendment No Paragraph 6 Notices is deleted entirely and replaced with the following new Notices section. 6. NOTICES. All written notices required under this Agreement, as amended, shall be delivered by U.S. certified mail, return receipt requested. 13 3. Paragraph 13 Entire Agreement and Order of Priority is deleted entirely and replaced with the following new Entire Agreement and Order of Priority section: 13. ENTIRE AGREEMENT AND ORDER OF PRIORITY The 2007 Integration Agreement as amended by this Amendment No. 1 (Amended Integration Agreement), the 2007 Memorandum of Agreement as contemporaneously amended by its amendment No. 1 (Amended MOA), and the MPSCS Member Subscriber Agreement (together the Agreements) represent the entire and final agreement between the Parties and supersede all proposals, prior agreements, (oral or written), and all other communications between the Parties relating to the matters covered in the Agreements. The Agreements shall be read to be consistent with one another. However, if there is a conflict between the terms of the Agreements relating to the payment of MPSCS fees, the terms of the Amended MOA shall take precedence, followed by the terms of the Amended Integration Agreement, with the terms of the MPSCS Member Subscriber Agreement having the lowest priority. Additionally, all prior negotiations and agreements relating to the Integration Agreement are integrated and merged into this Amendment. Neither party, nor its agents, has made any representations except those expressed in this Agreement. The duly authorized representatives of the Parties approved and executed this Amendment No. 1 to the September 21, 2007 Integration Agreement on the date below each signature. 25 Narrative for Victim Rights Prosecutor /19/2017 Agency: St Clair County of Prosecutors Office Application: Victim Rights Prosecutor-2018 State House Discticts State House District Mission Statement It is the continued mission of the St. Clair County Prosecuting Attorney's Victim Rights Unit to ensure all fundamental rights for Crime victims as outlined in the William VanRegenmorter Victim Rights Law of To ensure, encourage, and support victims in their pursuit of justice utilizing the Crime Victim Rights Act, Community services, victim rights unit staff and the prosecuting attorney office. Under the Victim Rights Act we will provide: notification, attempt phone contact with every victim, participation, education, protection, counseling, links to community agencies, and continued support through each case. It is the goal of the St. Clair County Victim Rights Unit to empower, educated, make whole financially and mentally, and assist victims of crime through the judicial and appellate process to restore as much as possible the ability to successfully continue with their everyday lives. 8. Project Resources Provide a general description of staff needed to implement Victims Rights in your county. Identify the most critical activities that you perform when providing victim rights. Our county currently has 2.5 fte's funded through our state victim rights contract. However, I believe that 3.5 is needed to properly provide services to the citizens of St. Clair County. One of the full time advocates provides services to the victims of felony cases. Generates initial letters, makes phone contact supports in court, assists in referrals, lodgings, and support through the entire court process. The other full time supported advocate provides services to the victims of misdemeanor and juvenile cases. Generates the letters, makes phone contact, supports in court, assists in referrals, lodgings, and support through the entire court process. The.5 Victim Rights Coordinator generates all initial letters, works to contact victims by phone, oversees all internal and external Victim Rights Activities, generates all necessary report documents, and also works with Capitol case victims and any victim as needed by generating the letters, making phone contact, support in court, assist with referrals, lodging, and support through the entire court process. The.5 person also handles the generation of reports for the state, supervision and support, and all appellate matters. If you utilize the services of volunteers in the provision of Victim Rights, please explain how this is accomplished. We do not currently have a scheduled volunteer. 9. Michigan Victim Information and Notification Everyday (MI-VINE) Does your agency participate in MI-VINE? Yes No Provide the number of victims registered to use MI-VINE in your county for court events during the past calendar year. 0 To obtain statistics for number of Victims Registered with MI-VINE visit the website Please describe your programs efforts to utilize MI-VINE. We are waiting for our jail to complete the process...have been working with Beth Adcock whenever requested to link our jail with the vendor to get process going. Our office is involved with many community services and projects. We are on the board at Safe Horizons(DV shelter) and work frequently with staff on mutual clients, coordinate subpoena service, and assist with grant writing. 2. Community Coordination Activity 2 - Describe any community activities, projects, or coordination councils that your office is involved in to promote Victim Rights and services. We work/coordinate with the Child Abuse and Advocacy Center to assist child victim through the court process our prosector's are involved weekly in viewing forensic interviews of children 3. Community Coordination Activity 3 - Describe any community activities, projects, or coordination councils that your office is involved in to promote Victim Rights and services. We also work with the local non-profit agency PSYMH(P.S. You're My Hero). In conjunction with this agency we provide VR week activities, we are put on an annual run fundraiser for St. Clair County Victims, we use funds to promote VR and assist victims during the court process.
