SUPPORTING INFORMATION: The following items are required to be included in your proposal (See Code Change Submittal Example Pages 3 and 4): 1. The proponent shall clearly state the purpose of the proposed code change. 2. The proponent shall provide a logical explanation which clearly shows why the current Code provisions are inadequate or overly restrictive, specifies the shortcomings of the current Code provisions and explains how such proposals will improve the Code. 3. The proponent shall substantiate the proposed code change based on technical information and substantiation. A minimum of two copies of all substantiating information shall be submitted. 4. The proponent shall submit a bibliography of any substantiating material submitted with the code change proposal. REFERENCED STANDARDS: List any new referenced standards that are proposed to be referenced in the code and provide a minimum of two copies. Additional copies will be required for the Building Standards Commission. COST IMPACT: The proponent shall indicate one of the following regarding the cost impact of the code change proposal: 1) The code change proposal will increase the cost of construction; or 2) The code change proposal will not increase the cost of construction. The proponent should submit information that supports their claim. Any information submitted will be considered by the Building Standards Commission. 7 Code: IBC CODE CHANGE SUBMITTAL EXAMPLE INTERNATIONAL AND NEC CODES Proponent: John Doe, P.E., Acme Building Corporation, Inc., representing himself Revise as follows: General. Each portion of a building separated by one or more a fire walls that comply complies with the provisions of this section Section 705 shall be considered a separate building. Reason: A fire wall complying with Section 705 establishes the equivalent of separate buildings on either side of the fire wall. This proposal provides text that more succinctly states this purpose of a fire wall. Cost Impact: The code change proposal will not increase the cost of construction. 8 CODE CHANGE SUBMITTAL EXAMPLE FOR GEORGETOWN MUNICIPAL CODE OF ORDINANCES Code: GMCO 2012 Chapter 15 - Sec Proponent: Jane Doe, P.E., Acme Building Corporation, Inc., representing herself Revise as follows: Sec Section N Amended. The International Residential Code, Chapter 11, entitled "Energy Efficiency", is hereby amended and adopted as follows: Section N Duct insulation "All portions of the air distribution system shall be installed in accordance with Section M1601 and shall be thermally insulated. All supply and return-air ducts and plenums installed in unconditioned spaces, attics or outside the building shall meet a required R-Value of R-6 8 for supply and R-4 for return. For ducts located in conditioned spaces, such as floor/ceiling assemblies between stories, the R- Value of R-4 shall be required. When located within a building envelope assembly, at least R-6 8 shall be applied between the duct and that portion of the assembly furthest from the conditioned space." Exceptions: Exhaust air ducts and portions of the air distribution system within appliances. Reason: When the International Energy Conservation Code was adopted as a local and statewide code, the required R-Value for air ducts was R-8. However, the duct manufactures did not manufacture R-8 air duct. Therefore, an exemption was granted that R-6 could be used. Since R-8 is being manufactured, there should not be a problem in obtaining the code required R-8 value material. Installing the R-8 valued Duct would then meet the intent of energy conservation within the built environment. Cost Impact: There would be a minimal cost of construction by installing the R-8 duct material. The minimal cost depends upon the type of duct installed. The cost increase from R-6 to R-8 could range from $0.52 to $1.00 per square foot. 13 Code: IBC-2012 Chapter 1 Section 104 [A] Proponent: Dave Hall, CFM, Building Official, Inspection Services representing City Of Georgetown Revise as follows: [A] Flood hazard areas. The building official shall not grant modifications to any provision required in flood hazard areas as established by Section unless a determination has been made that: 1. A showing of good and sufficient cause that the unique characteristics of the size, configuration or topography of the site render the elevation standards of Section 1612 inappropriate. 2. A determination that failure to grant the variance would result in exceptional hardship by rendering the lot undevelopable. 3. A determination that the granting of a variance will not result in increased flood heights, additional threats to public safety, extraordinary public expense, cause fraud on or victimization of the public, or conflict with existing laws or ordinances. 4. A determination that the variance is the minimum necessary to afford relief, considering the flood hazard. 5. Submission to the applicant of written notice specifying the difference between the design flood elevation and the elevation to which the building is to be built, stating that the cost of flood insurance will be commensurate with the increased risk resulting from the reduced floor elevation, and stating that construction below the design flood elevation increases risks to life and property. Refer to Title 15, Chapter 15.44, and entitled Flood Damage Prevention of the City of Georgetown Code of Ordinances. Reason: The City of Georgetown has a Flood Damage Prevention Ordinance and governs the requirements for a variance. To avoid any potential conflicts between the two ordinances this section needs to be deleted from the building code and reference made to Chapter of the Georgetown Code of Ordinances. 14 Code: IBC-2012 Chapter 16 Section Proponent: Dave Hall, CFM, Building Official, Inspection Services representing City of Georgetown, TX Revise as follows: Establishment of flood hazard areas. To establish flood hazard areas, the applicable governing authority shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal Emergency Management Agency in an engineering report entitled The Flood Insurance Study for [INSERT NAME OF JURISDICTION], City of Georgetown, Texas, dated [INSERT DATE OF ISSUANCE], September 28, 2008, as amended or revised with the accompanying Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodway Map (FBFM) and related supporting data along with any revisions thereto. The adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this section. Refer to Title 15, Chapter 15.44, and entitled Flood Damage Prevention of the City of Georgetown Code of Ordinances. Reason: By inserting the jurisdiction name and the date of the flood hazard boundary study as accepted by the local jurisdiction, this is a provision confirming that the City of Georgetown has had FEMA study performed, with an accompanying Flood Damage Prevention Ordinance. The local jurisdiction FEMA FIRM or Flood Insurance Rate Map and ordinance shall be the governing requirements. This section is a tool that can be used for Inspection and plan review purposes while meeting the minimum requirements of FEMA 44 CFR for Flood Plain Management. These regulations shall be known as the Building Code of [NAME OF JURISDICTION] City of Georgetown, Texas hereinafter referred to as this code. Reason: The purpose of this section is to identify the IBC will be the adopted regulations by inserting the name of the adopting jurisdiction into the code. 16 Code: IBC-2012 Chapter 1 Section 105 [A] Proponent: Dave Hall, CFM, Building Official, Inspection Services representing City of Georgetown, TX Revise as follows: [A] Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building: 1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area is not greater than 120 square feet (11 m2). 2. Fences not over 7 feet (2134 mm) high. 3. Oil derricks Retaining walls that are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or IIIA liquids Water tanks supported directly on grade if the capacity is not greater than 5,000 gallons (18 925L) and the ratio of height to diameter or width is not greater than 2:1. 6. Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade, and not over any basement or story below and are not part of an accessible route Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work Temporary motion picture, television and theater stage sets and scenery Prefabricated swimming pools accessory to a Group R-3 occupancy that are less than 24 inches (610 mm) deep, are not greater than 5,000 gallons ( L) and are installed entirely above ground Shade cloth structures constructed for nursery or agricultural purposes, not including service systems Swings and other playground equipment accessory to detached one- and two-family dwellings Window awnings in Group R-3 and U occupancies, supported by an exterior wall that does not project more than 54 inches (1372 mm) from the exterior wall and do not require additional support Non-fixed and movable fixtures, cases, racks, counters and partitions not over 5 feet 9 inches (1753mm) in height. Reason: The City of Georgetown has a Unified Development Code which would regulate the location of detached accessory structures, fences, oil derrick locations and sidewalks. Therefore, a building permit would be required to verify compliance within the development code for these types of structures. Cost Impact: The cost of construction would be that of the required permits from $25-$35 per permit application. Public Hearing: Commission: AS AM D

17 Code: IBC-2012 Chapter 1 Section 113 [A] Proponent: Dave Hall, CFM, Building Official, Inspection Services representing City of Georgetown, TX Delete as follows: BOARD OF APPEALS [A] General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The board of appeals shall be appointed by the applicable governing authority and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business. Reason: The City of Georgetown has a Building Standards Commission enacted that hears and decides appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code.
