All swimming pools installed or substantially altered at a residential dwelling on and after the effective date of January 1, 2011, shall be equipped with a properly functioning swimming pool alarm. Section Definitions. For purposes of this section the terms pool alarm, residential dwelling, and swimming pool shall have the meanings established herein. Pool alarm means a device which emits a sound of at least fifty decibels when a person or an object weighing fifteen pounds or more enters the water in a swimming pool but shall not include, swimming protection alarm devices designed for individual use, such as an alarm attached to a child that sounds when the child exceeds a certain distance of becomes submerged in water. Residential dwelling means a one-family dwelling structure. Swimming pool means any structure that is intended for swimming or recreational bathing and contains water over thirty-six (36) inches deep, including but not limited to, in-ground, above ground, and on-ground swimming pools, hot tubs, and non-portable spas, but does not mean a public swimming pool (defined as spa-type) wading, special purpose pools or water recreation attractions, including, but not limited to, those operated by camps, child care facilities, cities, clubs, subdivisions, apartment buildings, counties, institutions, schools, motels, hotels, and mobile home parks to which admission may be gained with or without payment of a fee, nor does it mean a multi-family residential housing swimming pool (defined as a private swimming pool maintained by a homeowners association solely for the use and benefit of the members of the homeowners association and their guests). pg. 9

A certification from the person performing the test shall be submitted with the following information: (1) Address where test was performed; (2) Name of person performing the test; (3) Company name; (4) Date when the test was performed; and (5) Results of the test in A.C.H.; (6) Outside air required by whole house ventilation system; Actual outside air provided by whole house ventilation system. Rooms containing fuel-burning appliances. Delete this section in its entirety. Duct testing (mandatory). Delete the last paragraph in its entirety beginning with a written report and substitute the following: The test must be performed by a person certified as a Home Energy Rating Systems (HERS) rater or Duct and envelope Tightness Verifier or who possesses a current professional certification from HERS rater, Building Performance Institute or other similar entity designated by the Chief Building Official. This test cannot be performed by the prime contractor as listed on the building permit or a direct employee of the prime contractor. A certification from the person performing the test shall be submitted with the following information: (1) Address where test was performed; (2) Name of person performing the test; (3) Company name; (4) Date when the test was performed; (5) Square footage of the conditioned space; (6) Results of test in cubic feet per minute per square footage of the conditioned space; and (7) Whether the test was performed at rough-in or post construction. Duct leakage (prescriptive). 1. Rough-in test: change 4 cubic feet per minute (113.3 L/M) to read 6 cubic feet per minute (169.9 L/M) and 3 cubic feet per minute (85 L/min) to read 4cfm (113.3 L/Min). 2. Postconstruction test: change 4 cubic feet per minute (113.3 L/min) to read 12 cubic feet per minute (339.8 L/min) pg. 11

14 ORDINANCE NO AN ORDINANCE TO ADOPT A FAMILY OF BUILDING CODES RELATING TO INSPECTION ACTIVITIES OF THE CITY OF EAGLEVILLE, TENNESSEE AN ENFOREMENT OF BUILDING PROVISIONS AS PROVIDED IN SAID CODES, AMENDING ORDINANCE AND AMENDING TITLE 12 OF THE EAGLEVILLE MUNICIPAL CODE WHEREAS, it is the desire of the City of Eagleville, Tennessee to adopt an updated family of building related codes (herein, the Codes ); and WHEREAS, the adoption of these codes is done to facilitate proper inspection activities by the City of Eagleville, or its contracted source, related to construction and maintenance of building within the city limits of Eagleville and relating to public, safety, health and general welfare; and WHEREAS, the Eagleville City Council has reviewed such recommendation and had conducted a public hearing thereon. NOW THEREFORE, BE IT ORDAINED BY THE CITY OF EAGLEVILLE, TENNESSEE, AS FOLLOWS: Section 1: Be it resolved by the City of Eagleville City Council that the 2018 International Building Code as adopted by the International Code Council shall be and hereby adopted by this reference as though copied herein verbatim subject to the amendments and deletions set forth in Exhibit A attached hereto and incorporated therein by this reference. Section 2: Be it resolved by the City of Eagleville City Council that the 2018 International Residential Code as adopted by the International Code Council shall be and hereby is adopted by this reference as though copied herein verbatim subject to the amendments and deletions set forth on Exhibit B attached hereto and incorporated herein by this reference. Section 11: Be it resolved by the City of Eagleville City Council that the 2017 International Electrical Code will be the Code in effect for this city. BE IT FURTHER RESOLVED by the City of Eagleville City Council that to the extent any matters in said Codes are contrary to, or conflict with, any existing Ordinances of the City of Eagleville, then the provisions of such Codes shall prevail and any existing Ordinances to the contrary are hereby repealed and/or amended, as may be required to conform to the Codes, but shall otherwise remain in full force and effect. BE IT FURTHER RESOLVED that when reference is made in the Codes to the duties of certain individuals or named officials whose titles differ from officials in the City of Eagleville, then the designated official of Eagleville or its contracted source, whose duties correspond to those of the official named in said Codes shall be deemed to be the person responsible for enforcing the provision of said Codes. 18 ORDINANCE NO AN ORDINANCE TO AMEND SECTION OF THE CITY OF EAGLEVILLE CODE OF ORDINANCES (Amends Ordinance ) Whereas, Section of the Eagleville Code of Ordinances sets the meeting schedule for City Council meetings and for City Council Work Sessions; and Whereas, the Eagleville City Council desires to amend the meeting schedule; NOW THEREFORE, BE IT ORDAINED by the City of Eagleville Tennessee City Council that Section of the Code of Ordinances, also known as the Municipal Code, is hereby amended to read: The City Council shall adopt its regular meeting and work session schedules for the upcoming year by its preceding December meeting. It is the intent of the Council to hold regular monthly meetings at 7:00 p.m. on the fourth Thursday of each month at City Hall and hold regular work session meetings at 7:00 p.m on the second Thursday of each month a City Hall, except that the regular November meeting may be held on the third Thursday of November, and except that the regular December meeting may be held on the second Thursday of December. The adopted monthly meeting and work session schedules may be subject to change upon a majority vote of the Council present. Special meetings and work sessions may be scheduled as the need arises. Work Sessions may be canceled or incorporated into the agenda of regular monthly meetings as the need or circumstance may warrant. 19 ORDINANCE NO AN ORDINANCE TO AMEND SECTION OF THE CITY OF EAGLEVILLE CODE OF ORDINANCES (Amends Ordinance ) ADOPTION of Court Fees Whereas, Section of the Eagleville Code of Ordinances sets the Court Costs for the City of Eagleville s Municipal Court; and, Whereas, the Eagleville City Council desires to amend the Court Costs; NOW THEREFORE, BE IT ORDAINED by the City of Eagleville Tennessee City Council that Section of the Code of Ordinances, also known as the Municipal Code, is hereby amended to read: Court Costs. There is hereby established fixed court costs for all cases brought before the municipal court. Court costs shall be one hundred forty dollars ($140.00) or such other amount as shall be established by the city council from time to time. The municipal judge shall certify to the chief of police for collection, all fines, costs, and forfeitures imposed by him/her for offenses against the law and ordinances of the city. Costs in favor of any person paid a fixed salary by the city shall belong to the city and be paid into its treasury. The municipal judge shall collect and receipt for all fines imposed by him/her, and he/she shall render a bi-annual report to the city council of all costs and fines collected and of all assessed and uncollected. It shall be unlawful for any other person or officer to collect or receipt for said fines, costs, and recoveries, but the municipal judge may authorize the chief of police to collect and receipt for finds and costs. 25 RESOLUTION A RESOLUTION TO AUTHORIZE THE CITY OF EAGLEVILLE, TENNESSEE S PARTICIPATION IN THE TENNESSEE CONSOLIDATED RETIREMENT SYSTEM IN ACCORDNACE WITH TENNESSEE CODE ANNOTATED, TITLE 8, CHAPTERS BE IT RESOLVED BY THE CITY OF EAGLEVILLE, TENNESSEE, WHEREAS, Tennessee Code Annotated, Title 8, Chapter 35, Part 2 allows a political subdivision to participate in the Tennessee Consolidated Retirement System ( TCRS ) subject to the approval of the TCRS Board of Trustees; and WHEREAS, the City of Eagleville desires to participate in TCRS under the (Name of Political Subdivision) provisions of Tennessee Code Annotated, Title 8, Chapters and in accordance with the following terms and conditions: A. TYPE PLAN. (CHECK BOX 1 OR BOX 2 OR BOX 3 OR BOX 4). The Political Subdivision adopts the following type plan: (1) [ ] Regular Defined Benefit Plan. (2) [ ] Alternate Defined Benefit Plan. (3) [X] Local Government Hybrid Plan (If this Plan is chosen, the Political Subdivision MUST also maintain a defined contribution plan on behalf of its employees and pass the attached resolution that describes the type of defined contribution plan the Political Subdivision will adopt. The defined contribution plan could provide for employer contributions of 0% to up to 7% of its employees salaries). (4) [ ] State Employee and Teacher Hybrid Plan (If this Plan is chosen, the Political Subdivision MUST also maintain a defined contribution plan on behalf of its employees whereby the Political Subdivision makes a mandatory employer contribution on behalf of each of its employees participating in the Hybrid Plan equal to 5% of the respective employee s salary subject to the cost controls and unfunded liability controls of the Hybrid Plan. The Political Subdivision must also pass the attached resolution that describes the type of defined contribution plan the Political Subdivision will adopt). B. EMPLOYEE CONTRIBUTIONS. (CHECK BOX 1 OR BOX 2 OR BOX 3 - IF THE STATE EMPLOYEE AND TEACHER HYBRID PLAN IS SELECTED ABOVE, THE EMPLOYEES MUST CONTRIBUTE 5% OF THEIR EARNABLE COMPENSATION UNDER THAT PLAN AND BOX 1 MUST BE CHECKED). The Employees shall contribute: (1) [ ] 5% of the employees earnable compensation. (2) [ ] 2.5% of the employees earnable compensation. (3) [X] 0% of the employees earnable compensation. C. COST-OF-LIVING INCREASES FOR RETIREES. (CHECK BOX 1 OR BOX 2 IF EITHER THE LOCAL GOVERNMENT, OR THE STATE EMPLOYEE AND TEACHER HYBRID PLAN IS SELECTED ABOVE, COST-OF- LIVING INCREASES FOR RETIREES MUST BE GIVEN, SUBJECT TO ANY APPLICABLE COST CONTROLS AND UNFUNDED LIABILITY CONTROLS AND BOX 2 MUST BE CHECKED). The Political Subdivision shall: (1) [ ] NOT provide cost-of-living increases for its retirees. (2) [X] PROVIDE cost-of-living increases for its retirees. D. ELIGIBILITY OF PART-TIME EMPLOYEES. (CHECK BOX 1 OR BOX 2). The Political Subdivision shall: (1) [X] NOT allow its part-time employees to participate in TCRS. (2) [ ] ALLOW its part-time employees to participate in TCRS.

(CHECK AND COMPLETE BOX 1 OR BOX 2 OR BOX 3 OR BOX 4 OR BOX 5 CAUTION: IF THE STATE EMPLOYEE AND TEACHER HYBRID PLAN IS SELECTED ABOVE AND IF BOX 3 BELOW IS NOT CHOSEN, THE EMPLOYER CONTRIBUTION COULD EXCEED 4% THEREBY CAUSING THE COST CONTROLS AND UNFUNDED LIABILITY CONTROLS TO AUTOMATICALLY APPLY. ACCORDINGLY, PRIOR SERVICE IS NOT RECOMMENDED). For each employee employed with the Political Subdivision on the effective date of the Political Subdivision s participation in TCRS, the Political Subdivision shall: (1) [ ] Purchase ALL years of prior service credit on behalf of its employees. (2) [ ] Purchase NO years of prior service credit on behalf of its employees, but shall accept the unfunded liability should its employees establish ALL years of prior service. (3) [X] NOT allow its employees to establish any prior service credit with the Political Subdivision. (4) [ ] Purchase years of prior service credit on behalf of its employees and accept the unfunded liability should its employees establish an additional years of prior service credit. (5) [ ] Purchase years of prior service credit on behalf of its employees and no additional prior service credit may be established; and F. MAXIMUM UNFUNDED LIABILITY. (COMPLETE THIS ITEM F ONLY IF THE STATE EMPLOYEE AND TEACHER HYBRID PLAN IS SELECTED ABOVE). For purposes of the cost control provisions of Tennessee Code Annotated, Section (d), the Political Subdivision defines maximum unfunded liability to mean an unfunded liability of no greater than: N/A; and WHEREAS, the liability for participation and costs of administration shall be the sole responsibility of the Political Subdivision and not the State of Tennessee; and WHEREAS, the Political Subdivision has passed a budget amendment appropriating the funds necessary to meet such liability and the same is attached hereto; and WHEREAS, the effective date of participation shall be on July 1,, 2019, or on such later date as determined by the TCRS Board of Trustees, and the initial employer contribution rate shall be _5.9_%, which is based on the estimated lump sum accrued liability of $0.00. NOW, THEREFORE, BE IT RESOLVED That the City Council of the (Name of Governing Body) City of Eagleville hereby authorizes all its employees in all its departments or (Name of Political Subdivision) instrumentalities to become eligible to participate in TCRS in accordance with the above terms and conditions subject to the approval of the TCRS Board of Trustees. It is acknowledged and understood that pursuant to Tennessee Code Annotated, Section the Political Subdivision shall not make employer contributions to any other retirement or deferred compensation plans on behalf of any employee who participates in TCRS pursuant to this Resolution wherein the total combined employer contributions to such plans exceed 3% of the employee s salary, unless the Local Government Hybrid Plan or the State Employee and Teacher Hybrid Plan is adopted by the Political Subdivision for such employee. If either the Local Government Hybrid Plan or the State Employee and Teacher Hybrid Plan is adopted by the Political Subdivision, the Political Subdivision may make employer contributions to the defined contribution plan component of that Plan and to any one or more additional tax deferred compensation or retirement plans on TR 9023
