1 MINUTES OF THE REGULAR CITY COMMISSION MEETING HELD APRIL 15, 2009 /0 The governing body met in regular session on April 15, 2009, at 5:30 p.m. in the City Commission Room at City Hall, with the following members being present: Mayor Hattan, Commissioners Jindra, Johnson, Lanoue, and Hosie. Other Offiers: Interim City Manager Uri and City Clerk Crum. Mayor Hattan delared that a quorum was present and alled the meeting to order. Visitors: Jessia LeDu, Toby Nosker, Ted Collins, Roy Wilson, Megan Murdok, Ron Copple, Sara Hiks, Danny Parker, Sr. Judy Stephens, Roye Bruntzel, Ron Deal, Don Lanoue, Maria Allen, Janet Eubanks, Mallory Gilliland, Brenda Gilliland, Marvin Copple, Denise de Rohefort-Reynolds, James Ganson, Larry Eubanks, Linda Sutton, Joe Fakler, Ruth Fakler, Larry Remmenga, Ruby Maline. There was no invoation. The Pledge of Allegiane was reited. Mayor Hattan asked for hanges on the agenda. There were no hanges. COMMISSION REORGANIZATION: ELECTION RESULTS Interim City Manager Uri read the report from the Cloud County Clerk and Eletion Offier Linda Bogart, ertifying the results for the City Commission of Conordia held April 7, 2009 to be as follows: Charles B. Johnson 582 Phil Gilliland 5 Joe Streker 7 Art Slaughter 4 Twenty-two (22) people reeived one (1) vote eah. Charles Johnson was delared the winner for another three (3) year term. OATH OF OFFICE City Ordinane presribes that eleted offiials take the Oath of Offie before entering into the duties of his/her offie. City Clerk Crum administered the Oath of Offie to Charles Johnson for a three (3) year term. Mayor Hattan reessed for refreshments. ANNUAL COMMISSION REORGANIZATION Commissioner Jindra voied his opinion that things have been running smoothly with the ommission as it is, and moved that Mayor Hattan ontinue as mayor. Commissioner Lanoue seonded. Motion arried. Commissioner Johnson moved to elet Commissioner Lanoue as mayor pro-tern. Commissioner Jindra seonded. Motion arried. APPROVAL OF MINUTES APPROVED There were no omments. Commissioner Johnson moved to approve the minutes of the April 1, 2009, meeting. Commissioner Lanoue seonded. Motion arried unanimously. APPROPRIATION ORDINANCE NO. #7 APPROVED Commissioner Hosie asked if the Blue Cross bill was for one month. Interim City Manager Uri answered that it was for one month, plus the employees that were omitted on last month's billing. Commissioner Johnson asked about the League LEAPS payment, whih is for the seond payment of the ity manager searh, and did we already make two payments? Interim City Manager Uri said he would look into it. Commissioner Hosie moved to approve appropriation ordinane #7. Commissioner Johnson seonded. Motion arried unanimously. PROCLAMATIONS: FAIR HOUSING MONTH MayorHattan read a prolamation and delared April as Fair Housing Month.
2 ARBOR DAY 107 Mayor Hattan prolaimed April 24, 2009 as Arbor Day. KANSAS JUNIOR MISS Mallory Gilliland was reently named Kansas Junior Miss. Mayor Hattan read a prolamation of ongratulations to Miss Gilliland. Miss Gilliland was on hand for pitures with the mayor. PUBLIC COMMENTS There were no publi omments. APPOINTMENTS Denise de Rohefort-Reynolds, of the library, asked for the reappointment of MaryDean Nelson to another four year term. Frank Burwell, who had served two terms and ould not be reappointed, was reognized for his years of servie, and several projets were listed that had been aomplished during Mr. Burwell's tenure. Commissioner Hosie moved to appoint MaryDean Nelson to the library board. Commissioner Lanoue seonded. Motion arried unanimously. NEW BUSINESS: SPONSORSHIP OF GRANT APPLICATION FOR SMALL BUSINESS DEVELOPMENT CENTER The Small Business Development Center has been housed at Cloud County Community College for several years, and is moving downtown. They are requesting a grant of $2000 from the Dulos Foundation. One of the requirements of the Dulos Foundation is that grants must be sponsored by a non-profit organization or a muniipality. Commission Johnson said that the Dulos Foundation was set up to help families and private individuals in need of funds, and he felt that this did not fall into that ategory, whether they have inome guidelines or not. He said he would like to see the sponsorship disapproved for this reason. Mayor Hattan said it is the Dulos board's deision who reeives the money. The Small Business Development Center helps small businesses get started, so he felt that indiretly the Dulos Foundation was helping the needy in that way. Commissioner Jindra agreed that it is not the ommission's job to determine who gets the funds. Commissioner Jindra moved to approve the sponsorship of the grant for the Small Business Development Center and to authorize the mayor to sign it. Commissioner Lanoue seonded. Motion arried by the following vote: Aye: Nay: Commissioners Hattan, Jindra, Hosie, and Lanoue. Commissioner Johnson. FUND BALANCE-FINANCIAL SOFTWARE ANNUAL MAINTENANCE AGREEMENT Interim City Manager Uri explained that Fund Balane is the ompany providing the finanial software, and as the billing is over $5000, was asking for approval. Commissioner Lanoue asked if GASB is being used. Interim City Manager Uri said that Ruby Maline was starting to utilize that, and it will be used in the future. Commissioner Johnson didn't think it was a neessary omponent. Ms. Maline explained that the reent monthly finanial reports that she has been providing have been generated by GASB 34. Commissioner Lanoue also stated that she felt the GASB program was unneessary, as ity assets are reorded in a book. Interim City Manager Uri said that the ollege intern working for the ity this semester is in the proess of inputting all asset data into the omputer. Commissioner Hosie moved to approve the finanial software annual maintenane agreement. Commissioner Johnson seonded. Motion arried unanimously. GAZEBO DONATION Joe Fakler talked of the antiipated donation of a gazebo for the ity park by Boy Souts Troop 31. The gazebo would be built by Peltier's Foundry and additional volunteer help, at a ost to the Troop of $10,000. Projeted ompletion is September. The ity would be responsible for the onrete base, sidewalks, eletrial outlets and lighting. The hoie of loation by the Troop is the south edge of the park, with the removal of the old girl sout building. Mayor Hattan said he thought that the area between the tennis ourts and the pool would enable the gazebo to be used more. After disussion, it was deided that this area ould be onsidered. Commissioner Hosie moved to aept the donation of the gazebo from Boy Souts Troop 31. Commissioner Lanoue seonded. Motion arried unanimously.
3 MANAGER'S REPORT m C Interim City Manager Uri updated the ommission on reent news on the flood ontrol projet with the Corps of Engineers. The ity is ready for the next phase, and should be hearing from the Corps in a few weeks. Disussion inluded the possibility of this projet being part of earmarked government money. Interim City Manager Uri disussed the employee handbook, and the newest additions. is her last week. Interim City Manager Uri thanked Ruby Maline for her servie and said she would be missed. This week MAYOR/COMMISSIONER COMMENTS AND REPORTS Commissioner Jindra talked about his reent partiipation with a lobbying group in Washington D.C. He has had ontat with Congressman Jerry Moran's offie and the flood ontrol projet is his number one priority projet. Commissioner Jindra made a motion to ontat Congressman Moran's offie to request a representative of the Corps of Engineers be in Conordia to answer questions. Commissioner Hosie seonded. Motion arried unanimously. In response to reent disussion on ash found at City Hall in a manila envelope, Commissioner Jindra requested an agenda item for the next meeting to disuss poliies and proedures to assure this won't happen again. Commissioner Johnson asked about the progress in the ity manager searh. The ommission had agreed to disontinue the searh until after the budget proess is over. Commissioner Johnson felt that Interim City Manager Uri's ontrat would expire before someone was hired if we aren't atively looking now. He also asked if we have reeived appliants for Ruby Maline's position, and Interim City Manager Uri updated the ommission on the progress. Commissioner Hosie asked for explanation on understanding the purhasing ard statement. Commissioner Hosie also felt that the ity manager searh should ontinue to be on hold until after the budget proess. He asked that Interim City Manager Uri update the ommission on the latest with the ash found. A opy of the hek had been reeived from one of the hek stubs found in this envelope, showing that the hek had been endorsed before being deposited into the ity's aount. In this proess, apparently the hek was traded for ash out of the ash drawer before being plaed in the envelope in the City Clerk's offie. Commissioner Lanoue thanked Frank Burwell for his library servie. Mayor Hattan ehoed Commissioner Lanoue's sentiments for Frank Burwell. He thanked Interim City Manager Uri for a job well done, and said that all ity employees were doing the ity proud. The ommissioners thanked Ruby Maline for her servie and the job she'd done during her tenure with the ity, and wished her well in future endeavors. STAFF COMMENTS Larry Eubanks talked about last year's grant for a new fire truk through the CBDG (Community Blok Development Grant), whih was obtained after doing an LMI (low to moderate inome) survey in the ity. This grant of $168,720.00, whih is 50% of the ost of a fire truk, was awarded to the fire department. With these grant funds, the ity has purhased a new fire truk. Ron Copple updated the ommission on the money reently awarded through the Reovery At A seletion ommittee must be organized to selet an engineering firm. Isadore Bombardier and Mr. Copple would make up the ommittee, and Mr. Copple asked for a member of the ommission to be inluded. Commissioner Johnson volunteered. Larry Remmenga talked about the reent atrazine sare, and assured the ommission and the publi that the ity's water is safe. ADJOURN Mayor Hattan announed there would be a study session following the adjournment of the meeting. James Ganson addressed the ommission on the whole wall projet that has reently begun, and gave an update on the progress.
