8 ** D R A F T ** MMWD Board of Directors meeting November 13, 2018 THE BOARD OF DIRECTORS OF MARIN MUNICIPAL WATER DISTRICT Minutes of the meeting of the Board of Directors held on Tuesday, November 13, 2018 at 220 Nellen Avenue, Corte Madera, California. Directors present: Directors absent: Larry Bragman, John C. Gibson, Cynthia Koehler, Armando Quintero and Larry L. Russell CALL TO ORDER President Quintero called the meeting to order at 7:30 p.m. AGENDA On motion of Director Gibson, seconded by Director Bragman, the agenda was adopted by the following roll call vote: Ayes: Noes: Absent: Abstain: Directors Bragman, Gibson, Koehler, Quintero and Russell PUBLIC EXPRESSION Roger Roberts said Marin Conservation League will be looking at fire management as a countywide issue and plans to develop policies and recommendations. Eric Morey, Woodacre, spoke on a variety of topics. Katherine Bryan, California Native Plant Society, spoke in opposition to the portion of the Azalea Hill Project that proposes the construction a Class 4 vehicle road at Liberty Gulch Road and Fisherman s access trail. Tom Boss, member of Marin County Bicycle Coalition and California Native Plant Society, said he was aware of California Native Plant Society members that fully support the Azalea Hill project and habitat restoration that will result. 1

9 ** D R A F T ** MMWD Board of Directors meeting November 13, 2018 Crystal Yezman, Facilities and Watershed Division Manager, stated an item on the Azalea Hill project was scheduled for the November 20, 2018 Board meeting. DIRECTORS' AND GENERAL MANAGER S ANNOUNCEMENTS Krishna Kumar said he would be meeting with the Marin County Civil Grand Jury on November 15, Director Quintero said he spoke at the National Water Resources Association meeting in San Diego. Director Koehler said she attended the National League of Cities meeting in Los Angeles and spoke with council members from cities that run water utilities about distributed infrastructure to address water supply and water quality issues. CONSENT CALENDAR (ITEMS 1-5) On motion of Director Gibson, seconded by Director Koehler, the Board approved the Consent Calendar (Items 1-5) by the following roll call vote: Ayes: Noes: Absent: Abstain: ITEM 1 ITEM 2 ITEM 3 Directors Bragman, Gibson, Koehler, Quintero and Russell Minutes of October 2, 10 and 12 meetings as presented. Three year Professional Legal Services Agreement with Bertrand, Fox & Elliot, for a not-to-exceed amount of $400, for each fiscal year. Easements - Meadow Valley Road, Corte Madera, for Fire Flow Improvement Project: Resolution No ITEM 4 Tennessee Valley Tank Rehabilitation Project: Resolution No authorizing award of Contract No to Olympus & Associates, Inc., in the amount of $669,641. ITEM 5 Easements, Mutual Benefit Agreement, Easement and Right-of-Entry Agreement with SMART for pipeline replacement on Rice Drive, San Rafael 2

10 ** D R A F T ** MMWD Board of Directors meeting November 13, 2018 ITEM 6 WATER PRODUCTION AND STORAGE REPORT Mike Ban, Engineering and Environmental Services Division Manager, presented the staff report and noted average daily production was 24 mgd, total water production was just over 11,326 acre-feet, total stream releases were 3,500 acre-feet and reservoir storage was at 57,608 acre-feet. A question and answer period followed. Director Quintero suggested the District look into reporting fuel moisture levels. ITEM 7 APPOINTMENT OF GENERAL MANAGER AND APPROVAL OF HIS AT-WILL EMPLOYMENT AGREEMENT Board President, Armando Quintero, presented the staff report requesting Ben Horenstein be appointed the District s General Manager with an annual salary of $255,000, the use of a District vehicle and unless specified, the same benefits as Division Managers. Ben Horenstein thanked the Board for their confidence and said he looked forward to serving in his role as General Manager and overseeing the District s mission to provide safe, reliable, high quality water. On motion of Director Bragman, seconded by Director Gibson, the Board appointed Ben Horenstein as the District s General Manager and approved the General Manager s At-Will Employment Agreement by the following vote: Ayes: Noes: Absent: Abstain: Directors Bragman, Gibson, Koehler, Quintero and Russell A recess was taken at this time for refreshments and the meeting reconvened at 8:10 p.m. ITEM 8 CHANGE IN EMPLOYER CONTRIBUTION RATE FOR HEALTH INSURANCE FOR 2019: A. RESOLUTION NO. 8514; B. RESOLUTION NO Charlie Duggan, Administrative Service Division Manager/Treasurer, presented the staff report requesting the employer contribution rate for 2019 health insurance premiums be set at $ for a single subscriber and $1, per month for two or more subscribers. A brief question and answer period followed. On motion of Director Bragman, seconded by Director Russell, the Board approved Resolution Nos and 8515 by the following vote: 3

She noted the position title was modified to include Parks Manager in the title which would facilitate the District s eligibility for various grant funding opportunities. A discussion on the title modification and timing for filling the position followed. On motion of Director Bragman, seconded by Director Russell, the Board authorized the General Manager to recruit and hire a Watershed Resources and Parks Manager by the following vote: Ayes: Noes: Absent: Abstain: Directors Bragman, Gibson, Koehler, Quintero and Russell ITEM 10 FUTURE AGENDA ITEMS Krishna Kumar presented the list upcoming meetings. 12 Item 3 December 4, 2018 Mike Swezy WHEREAS, THE BOARD OF DIRECTORS OF THE MARIN MUNICIPAL WATER DISTRICT (MMWD) WISHES TO RECOGNIZE Mike Swezy for 23 years and six months of dedicated service to the District and its customers in Marin County; and WHEREAS, Mike began his career at MMWD as the Natural Resource Program Manager in May of 1995 and was promoted to Watershed Resources Manager in July of 2008, where he served until his retirement in December 2018; and WHEREAS, after earning a Little League Baseball certificate in September of 1966, Mike earned his Bachelor's Degree in Forestry from UC Berkeley in 1977, he earned his Professional Forester certificate from the State of California in July of 1982 and earned a Master's Degree in Fire Ecology from The University of Washington in 1988; and WHEREAS, within weeks of starting at MMWD, Mike was overheard many times mumbling to himself, "I am gonna run this place some day!"; and WHEREAS, Mike embarked on his career in watershed management by bringing his skills to the great lakes of Tahoe, Crater and finally the lakes of MMWD; and WHEREAS, Mike was instrumental in promoting watershed-wide fire prevention and forest resiliency efforts, and as a founding member of Fire Safe Main developed fire prevention partnerships with local fire departments, County, State, Federal and non-profit and private agencies. It is no accident that the BIG ONE has not happened on Mike's watch; and WHEREAS, Mike, with a Depredation Permit in hand, was one of the first Resource Managers in Marin County to pursue, trap and transport the ever pervasive and evasive wild turkey from MMWD lands while muttering under his breath, "there'll be no sanctuary status on my watch" and "I never met a captured, cooked gobbler I didn't like" and "the only good wild turkey is found in a bottle"; and WHEREAS, Mike has made a valiant effort to eradicate non-native plants from District lands and adopted and implemented erosion control measures of roads and trails throughout the Mt. Tamalpais watershed, thus actually saving our bacon with rolling dips and the Road and Trail Management Plan, leaving a legacy of preservation, conservation and resource protection second to none; and WHEREAS, despite some trepidations, Mike successfully led negotiations for the District on the operations of Marin Stables, improvements at West Point Inn and the opening of the year-round Leo T. Cronin Fish Viewing area; and WHEREAS, Mike is ever evolving as an ecologist and understands the good idea/bad idea realities of resource management; like putting tires into Phoenix Lake for fish habitat and then removing them years later; and WHEREAS, Mike has assembled a highly professional and well respected Watershed staff who lead countywide efforts in vegetation and weed management, fisheries restoration, water quality improvements, visitor protection, fire prevention, volunteer outreach, road management and visitor contact; and

13 Item 3 December 4, 2018 WHEREAS, during Mike's tenure, Sky Oaks grew from a rustic ranger outpost heated by a wood burning stove into a sprawling state of the art Sky Oaks Headquarters with WiFi; and WHEREAS, Mike has successfully communicated with a diverse array of public resource agencies and has navigated previously uncharted bureaucratic waters while continuously working towards improving MMWD watershed lands, securing grant funding and championing many collaborative efforts and plans on continuing to do so into his retirement by rebuilding and restoring the West Peak of Mt. Tamalpais; and WHEREAS, Mike's faithful execution of the 1995 Mt. Tamalpais Area Vegetation Management Plan resulted in the construction and maintenance of over a 1000 acre complex of fuel breaks that form a protective halo around our watershed and local communities; and WHEREAS, Mike does see the forest for the trees, looking at a very tall majestic redwood tree on Mt. Tamalpais with a forester s eye, seeing biomass and board feet, he then takes a deep breath and acts as a carbon sequestrationist; and WHEREAS, Mike diligently coached his staff to attempt insertion of bacon into all media interviews, most recently during the rains of 2017, when Mike says on national, actually local TV, the atmospheric rivers of 2014 "saved our bacon" with the delivery of twenty-two inches of rain in one weekend; and WHEREAS, Mike s emphasis on safety went beyond wildfire preparedness and road maintenance; where his safety topic at the Tuesday staff meetings was always "wash your hands"! Mike knew how to bring the team together with comradery, communication and listening; and WHEREAS, Mike s vision came to fruition with the uniting of the National Park Service, State Parks, Marin County Parks and the Golden Gate Parks Conservancy into the OneTam Partnership with MMWD ; and WHEREAS, Mike has never seen an unpaved road he didn't want to decommission, or a meadow he didn't want to burn or a mountain top he didn't want to restore; and WHEREAS, Mike would not leave the Mt. Tamalpais watershed until he knew its safety was entrusted to a new generation of stewards; and WHEREAS, Mike begins the next phase of his life, knowing he can be proud of his accomplishments and shall ever be recognized for his professionalism, his insight and his integrity which have contributed to the betterment of the Marin Municipal Water District and Marin County; and WHEREAS, last but not least, Mike had one of the worst commutes to and from work, five minutes up hill and two minutes down! NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF DIRECTORS expresses its sincere appreciation to Mike Swezy for his services and contributions to the Marin Municipal Water District and wishes him good fortune, continued good health, winning tennis championships, and many more memorable adventures with his wife Susan and wonderful daughters Camille and Anabelle.
