1 OFFICIAL PROCEEDINGS OF THE ALPENA COUNTY ROAD COMMISSION The Board of County Road Commissioners of the County of Alpena met in regular session on the above date. The meeting was called to order by the Chairman, Fred Sterns, at 3:00 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ROLL CALL Present: Commissioners Sterns, Heise, and Spaulding. Absent: None Staff present: Larry Orcutt, Managing Director; Curt Gonyea, Superintendent; Julia Patterson, Finance Director/Board Secretary; Jim Mazrum, Road Commission Attorney. Others Present: Jerry Leschinger, Ossineke Township Trustee; Ken Lobert, Ossineke Township Supervisor; and Nico Tucker, Transportation & Resource Planner, NEMCOG; Andrew Sundin Thunder Bay Transportation Authority, and Ron McDonald, County Commissioner. AGENDA Moved by Spaulding, seconded by Heise, to adopt the agenda as presented. PUBLIC HEARING FOR FEDERAL TRANSPORTATION PROJECTS A public hearing was held to hear input on improvement projects being considered for funding using the Federal Surface Transportation program during the period of 2019 through Managing Director Larry Orcutt welcomed those in attendance and explained that the selected projects will be submitted for consideration at the annual meeting of the Region 9 Rural Task Force scheduled for Friday, November 9, Mr. Orcutt explained the task force will be meeting to review and prioritize projects for each of the eight regional counties. He reviewed the funding allocations and eligibility of roads for use of the funds. Rural cities and villages and public transit are also eligible for use of these funds. The following proposed projects for utilization of Rural STP and State TEDF-D funds were presented: 2019-French Road-.5 mile South of Bloom to Lacomb Wolf Creek Nicholson Hill Road to 1 mile South 2019-Wolf Creek-1 mile South to Scott (2020 Const.) 2021-Cathro Rd.-Long Rapids Rd. to 0.25 N. of Boilore 2022-Cathro Road-Boilore-Lacomb Road 2023-Spruce Road-Nicholson Hill to Scott Road Several illustrative projects, which are smaller in scope, were also proposed to utilize any additional funds if it appears all task force funds are not going to be used in the fiscal year. Moved by Managing Director Larry Orcutt, seconded by Andrew Sundin, to approve the Alpena County task force projects presented at the public hearing.

2 Page 2 There being no further comments, the Chairman declared the public hearing closed at 3:12 p.m. MINUTES Moved by Spaulding, seconded by Heise, to approve the minutes of the regular meeting of October 2, Motion carried unanimously. COMMUNICATIONS A. Sonja J. Scheurer, Administrator, MDOT Office of Operations Administrative Services, a letter informing the Alpena County Road Commission of the adjusted Fiscal Year 2018 Capital Equipment Advance computation. B. Straits Area Council, a memo dated October 24, 2018, announcing the next regular meeting of the Straits Area Council to be held, Tuesday, at Audie s Restaurant in Mackinaw City. Moved by Spaulding, seconded by Heise, that the above communications become a part of the minutes. Motion carried unanimously. CITIZENS APPEARING BEFORE THE BOARD Lois Hall, 2553 Hobbs Drive, appeared before the Board to express her gratitude for the maintenance of Hamilton Road Nature Trail. Ms. Hall also in concerned about the water in her yard at her Hobb s Drive residence. She states a culvert needs to be put in. Managing Director Larry Orcutt explained that the ground table level is high and why the water runs down to her yard. Road Superintendent Curt Gonyea will check the elevations of the culverts in the area and report back at the next meeting. Terry Thibault, 5850 Rouleau Road, appeared before the Board to state that Rouleau Road is in need of limestone gravel. There is a discrepancy regarding its status of a county road or private road. Managing Director Larry Orcutt responded that part of the road is not part of our public road system and is not on our certification map. Mr. Orcutt will research the certification issue and report back to the Board at the next meeting. MANAGING DIRECTOR REPORT Managing Director Larry Orcutt presented a brief update on the following: Preparing projects for Grade inspection is scheduled for Herron Road and should have a March bid letting. Draft plans have been submitted. French Road Overlay was submitted to MDOT and waiting on Category D funds. The project should be in January bid letting. Herron Road draft plans submitted. Wolf Creek Road draft plans should be submitted this month and could be in the March or April Bid letting. Devil s Road Bridge still waiting on the final redesign. Three Special Assessments survey has been completed. Working on a possible Lake wood/grand Lake Special

3 Page 3 Assessment project. Meeting with Alpena Township Supervisor Nathan Skibbe and their attorney regarding the administrating of the project. Alpena Township may administer the assessment and the Road Commission would oversee the construction. COUNTY ROAD REPORT The Superintendent presented the County Road Report for the period September 24, 2018, through October 28, SEPTEMBER FINANCIAL REPORT The Finance Director presented the Cash/Cash Equivalents Financial Report for the month ended September 30, Moved by Spaulding, seconded by Heise, that all reports become a part of the minutes. 6 Page 6 loads; and WHEREAS, It is a fact in Alpena County and throughout all Northern states that roads become soft in the spring as frost melts, and applying unrestricted 164,000-pound truck loading and traffic on soft roads, whether paved or unpaved, is poor public policy that defies common sense when it comes to road preservation, and will lead to significant damage to the road system, economic damage in Alpena County and increased risk to drivers in our region; and WHEREAS, SB-396 also grants exemptions to the forest industry that will allow the hauling of forest products and transport of equipment on the public road system without obtaining proper permits from road authorities at all times of the year; and WHEREAS, the provisions of SB 396 will result in costly damage to the public road system which is the opposite of what the Michigan Legislature and the people of Michigan called for in the 2015 Michigan Transportation Package; and WHEREAS, the provisions of SB 396 will negatively impact the traveling public accessing the road system, resulting in burdening road authorities with expensive reactive maintenance repairs and significantly increased taxpayer costs and township contributions to maintain the public road system; and WHEREAS, the provisions in SB 396 and subsequent impacts to the local road system will negatively impact the health, safety and welfare of Alpena County residents and the traveling public; and WHEREAS, Alpena County Commission and the Alpena County Road Commission work closely with the logging industry to accommodate this valuable contributor to the Michigan economy, while also continuously monitoring road conditions and permitting the logging industry to move equipment and material on roads when the roads can structurally support such loading without negatively impacting the road system and the traveling public; THEREFORE, BE IT RESOLVED, that the Alpena County Board of Commissioners hereby strongly opposes SB 396; and BE IT FURTHER RESOLVED, that a vote hereon be taken by aye and nay and spread at large on the minutes of the Board. The Board of Road Commissioners of Alpena will be holding a 2019 Budget Workshop on Tuesday, November 27, 2018 at 1:00 p.m. The next meeting will be Tuesday, November 27, 2018 at 3:00 p.m. in the lower level of the Road Commission building.
