1 1. 3. CALL TO ORDER. The Charter Township of Orion Board of Trustees held a regular meeting on Tuesday, January 21, 2014, at the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan. Supervisor Barnett called the meeting to order at 7:10 p.m. BOARD MEMBERS PRESENT: Chris Barnett, Penny Shults, Mark Thurber, Mike Flood, Donni Steele, John Steimel. All rose for the Pledge of Allegiance by John Pender. 4. PRESENTATIONS. A. Team Alayna. Beth Shifferd announced that Alayna is coming home on January 29, 2014 after six months of hospitalization. She outlined the renovations on the family home, and requested volunteers to help with the framing this weekend. B. Orion Township Fireman Recognition. Fireman John Pender shared that on January 18, 2014, Station 4 responded to a call of a two month old baby girl, not breathing. Kevin Myszenski and Eric Florence performed CPR and saved the life of the little girl. Certificates of Recognition were given to Kevin Myszenski, Eric Florence, Tom Watson, Dan Deachin, Brendan MacDonald, Robert Hudak, Tim Gale, and John Pender. The father of the little girl was also present to say thank you to the firefighters. C. Youth Council. Orion s first Youth Council was announced. Members are: Collin Brooks, Trey Coachman, Rachel Cullon, Ryan Fox, Tyler Fox, Mary Gorsick, Kasidy Higgins, Brianne Lambrecht, Madison Reid, Jeff Snyder, Jacob Thorne. D. North Oakland Community Coalition. Postponed. 5. APPROVAL OF BILLS. Moved by Trustee Steimel, seconded by Treasurer Thurber, to authorize payment of bills dated, January 3, 2014, January 10, 2014, January 14, 2014, and December 20, 2013, in the amount of $692,840.23; and payroll dated January 15, 2014, and January 16, 2014, in the amount of $110,651.01; for a total disbursement of funds in the amount

2 of $803,491.04, as presented. AYES: Steimel, Flood, Barnett, Shults, Thurber, Steele NAYS: none ABSENT: Porter MOTION CARRIED Flood stated that the new health care premium is included in the bills this month and there is a 59% savings. Also included were payments to the Paint Creek Trailway Commission, Polly Ann Trail Management Council, the police service contract, and Baldwin Road widening project. 6. BRIEF PUBLIC COMMENT. Mary MacMaster spoke about various constitutional issues. 7. APPROVAL OF AGENDA. Clerk Shults asked to postpone North Oakland Community Coalition Presentation to a future meeting. Approve the tuition reimbursement of $ to Rebecca Minkwitz, with funds coming from D. Resolution: Ord. 41 Schedule of fees. Adopt the Amendment to Schedule of Fees & Escrow Charges Resolution, as presented. E. Temporary Sign Permit Fee Waiver Request: King of Kings Lutheran Church. Moved to 9.D. F. AYES: Barnett, Shults, Thurber, Steele, Steimel, Flood NAYS: none ABSENT: Porter MOTION CARRIED 9. PENDING BUSINESS. A. Tri Party Discussion. Jim Stevens, OHM, gave an overview of potential projects for the $150,000 available for 2014: Mill Lake Road Approach Paving. Paving approximately 100 of Mill Lake Road west from the intersection at Baldwin Road to the first driveway on the north. The estimate is based on 4 HMA over 8 21AA Aggregate. Total Project cost: $30,800. Greenshield Road re-paving to gravel line. Reconstructing Greenshield Road from Joslyn Road west to the pavement limits, approximately 350. Drainage improvements will also be incorporated into the project to alleviate the ponding that occurs on the eastbound lanes. There are two options for this estimate; one with pulverizing the existing pavement, and one reconstructing the existing roadway. Total project cost - option 1 (reconstruct): $157,000. Total project cost - option 2 (pulverize): $131,000. Crosswalk on Joslyn Road with small pathway piece to the Township Drive. Construction of an 8 wide HMA pathway along Joslyn Road from a mid-block crossing between Greenshield and the Township Hall Drive. There are two options for this estimate, one with the pathway ending past the north drive opening for Township Hall (approximately 450 ), and one ending at the fields to the southeast (approximately 650 ). The path will remain east of the existing ditch along the east edge of Joslyn Road, and a culvert with end section has been included in the estimate to account for the drainage change near the crosswalk along Joslyn Road. Total project cost - option 1 (450 walk): $35,900. Total project cost - option 2 (650 walk): $51,800. Conklin Road approach paving at Orion Road/Stoney Creek Road. Pave approximately 75 of Conklin Road north from the intersection at Orion Road and Stoney Creek Road. It is assumed that the current drainage pattern will be maintained. An under-road culvert has been included. With this proposed extension, the pavement would not extend to the existing low elevation, approximately 200 from the intersection. This may cause drainage and erosion issues to the unpaved road. Total project cost: $37,000.

4 Right turn lane on Waldon (for northbound Joslyn road traffic). The proposed work consists of creating a 500 right-turn lane from Waldon Road westbound to Joslyn Road northbound. Due to the expansion of the road to the north on this project, the existing traffic pole would be relocated. This would require the installation of a new traffic signal, included in the estimate. A meeting with RCOC will be held to verify this requirement. Total project cost: $336,000. Treasurer Thurber asked if the Waldon road could be done by lane restriping. Jim Stevens answered that standards are 11-foot lanes, and shared other complications related to restriping. Sherry Road. Removing the existing pavement and base, grading new location of roadbed footprint, installing a retaining wall in the SE quadrant of the intersection of Sherry and Summit, placing an 8 aggregate base, and topping with a 4 asphalt layer, Curb and gutter repairs would also be completed on the road as required. There are two options on this project, one extending repairs 150 south of the Summit intersection, and one stopping at the Summit intersection. Total project cost - option 1 (150 south of Summit): $130,000. Total project cost - option 2 (construction to Summit): $113,000. Supervisor Barnett stated he would like to prioritize these items. Clerk Shults stated that Waldon is terrible and wondered if there is someone at the state level to talk to about the roads. Supervisor Barnett stated that two parts of Waldon Road and Giddings Road are on the state list; he also stated that at the state level there is no funding for the roads; Waldon Road is a million dollar project. Trustee Flood stated that he is concerned that due to weather conditions, the Oakland County Road commission is already over budget, and there is discussion concerning reevaluating road projects for the year. Supervisor Barnett stated that the resurfacing on Joslyn will not be stopped because it is a federally-funded project. Trustee Flood stated that he likes the Mill Lake and Conklin Road projects. Trustee Steele asked about the pricing on the Greenshield Road, and wanted to have Pine Tree (Heights to Clarkston) Road looked at. Clerk Shults spoke about moving the parking for the sheriff closer to Greenshield Road to free up some parking for the soccer programs; however, there is some concern regarding the septic field. Also spoke about saving tri-party dollars in order to improve Gregory Road. Treasurer Thurber asked if there was a way to improve Gregory Road with limited funding. Jim Stevens responded with yes; however, it would be putting a band aid on the problem and the Township would most likely be in the same position in five years. Moved by Clerk Shults, seconded by Trustee Steimel, to authorize the Supervisor and OHM to proceed with Greenshield Road repave/reconstruct project at a cost not to exceed $131,000, and the Joslyn Road crosswalk and 450 path extension project at a cost not to exceed $35,900, using 2014 Tri-Party funding. 5 Trustee Flood asked about the crosswalk being covered with Tri-party funds. Treasurer Thurber asked for the tri-party dollar amount to be clarified. Resident Don Hickman of Gregory Road stated his frustration that Gregory Road is not part of the tri-party discussion. Mary MacMaster also commented on Gregory Road. Moved by Trustee Flood, seconded by Trustee Steimel, to authorize Supervisor and OHM to proceed with the following 2014 Tri-Party projects: Mill Lake Road approach, the Conklin Road approach, and Joslyn Road crosswalk with 450 path, at a cost not to exceed $103,700. AYES: Steele, Steimel, Flood, Barnett, Shults NAYS: Thurber ABSENT: Porter MOTION CARRIED B. Ordinance Updates. Supervisor Barnett outlined several ordinances that require updates: Ord BOCA Basic Fire Prevention Code, Ord Property Maintenance, Ord Flexible Benefits Plan, and Ord Earth Balancing and Excavation, and Ord. 78 Zoning, section 30, Planned Unit Developments. Township Attorney Dan Kelly stated that the first two amendments have been proposed by Fire Chief Bob Smith and Building Director Tom Berger. He then gave a brief outline of possible amendments: Ordinance 64. There have been numerous changes and updates to the Code, which have not been incorporated in the Ordinance. Ordinance 137. The proposed amendment of the ordinance would be to approve the most recent International Property Code and include language which would automatically update the ordinance upon changes to the underlying code. Ordinance 127. Due to changes in federal and local state health care regulations, the ordinance is out of date; investigating the need for this ordinance - the Township could eliminate the ordinance itself and adopt changes to plan documents by resolution instead, eliminating the cost of updating it every year as benefits change. Ordinance 99. It is suggested that ZBA be the body that takes a look at the ordinance and determine if amendments are necessary. Ordinance 78 section The process now allows the applicant two separate reviews by the Township Board but limits the Township Board s options. The recommendation is for the Planning Commission to work with the attorney to draft amendments to the ordinance. Moved by Supervisor Barnett, seconded by Clerk Shults, to authorize the attorney and the appropriate Department Heads to work on ordinances 64, 137, 127 to present to the board for First Reading. The Board recommends that Ordinance 99 be referred to the Zoning Board of Appeals and Ordinance 78, section 30 be referred to the Planning Commission. AYES: Steele, Steimel, Flood, Barnett, Shults, Thurber NAYS: none ABSENT: Porter MOTION CARRIED C. Purchase LED signs. Supervisor Barnett outlined the need for improved signage at the Orion Center and potentially Township Hall. As was discussed at budget workshops, he has been working with Oakland County on collaboration for the purpose of saving money on the purchase. Oakland County had requested proposals and has invited Orion Township to join. The County chose Worx Displays as they provided the best value. Total cost for one location is $12,481, plus installation, for 2.3 x 7 full color 16 mm LED display. The Township was quoted roughly

6 $1500 for installation, or it can be installed in-house. There is a five year warranty regardless of installation. For reference, the Orion Veteran s Memorial Board has been pricing LED displays and a similar size one color display was quoted over $20,000 by two different companies. Due to the highly competitive pricing, the offer was extended to the Orion Veteran s Memorial as well as the Orion Township Library. The OVM board has voted to purchase a sign, and the Library has verbally committed as well. Supervisor Barnett suggested adding signs to the Orion Center and Township Hall. Both locations could benefit from signage. At Township Hall, the signs could be placed in conjunction with the existing signs, and the costs could be shared with ONTV at the Orion Center per the existing agreement; also a possibility of having costs partially sponsored by a health care partner. Moved by Clerk Shults, seconded by Trustee Flood, to authorize the Supervisor to purchase two LED signs; one for the Orion Center and one for Township Hall, at a cost not to exceed $35,000, with funds coming from account Clerk Shults questioned if the installation could be completed by Township staff and Supervisor Barnett affirmed that this could be done. Clerk Shults also requested confirmation that ONTV s portion be included in the agreement. Temporary Sign Permit Fee Waiver Request: King of Kings Lutheran Church. Treasurer Thurber stated that he moved these items down because they are not entirely filled out, and would like them to be filled out better. Trustee Steimel said we are not approving the sign applications, and all we are doing are waiving the fee. Moved by Treasurer Thurber, seconded by Trustee Flood, to grant the annual sign permit to King of Kings Lutheran Church and reduce the permit fee to $ MOTION CARRIED E. Moved by Clerk Shults, seconded by Trustee Steimel, waive the temporary sign permit fee for the Orion Center/Crank s Catering and reduce the fee to $25.00 MOTION CARRIED

7 10. PUBLIC COMMENT. No public comment was given. 11. BOARD MEMBER COMMENTS. Trustee Steimel, encouraged everybody to stay warm, and stated that it is not just our community that has bad roads because of this weather, but that it would be nice if we could figure out a way to better maintain the roads Clerk Shults, stated that she has been watching people walk from the trailer park with the traffic and states that perhaps a safety path along Brown Road could be considered. Second annual Teen Voice on January 24, 2014 from 6-8:30 p.m. at Canterbury Village. NOCC, Lake Orion High School, local youth pastors, and crisis line volunteers from Common Ground will be there to listen and help. Also Winter Family Fun night at Paint Creek Country Club will be held from 3-7, on February 8, 2014, to be coupled with Orion/Oxford Feed our FISH fundraiser. Annual Court Night at 52-3 rd District Court will discuss teen drinking, drug use and how to stop it. Also Eve Ryan has been doing a wonderful job with the online board packets. Treasurer Thurber shared that he worked with Michigan DECA group as a judge and had the opportunity to meet a lot of our young students. Trustee Steele thanked Jim Stevens and Bill Ireland for agreeing to give the 8 th grade class from Scripps Middle School a tour of the water tower this spring. Trustee Flood was pleased to see the Youth council and is very excited about them being involved and thanked the Fire Department for their hard work. He also updated the Board concerning the bankruptcy proceedings in regards to Detroit Water and Sewer. Supervisor Barnett said he will be prepared to give a full update on property sale and purchase at the next meeting and thanked Trustee Stiemel for helping with the sign ordinance. Stated that the Township does not own any of the roads, agreed that the roads need work, and provided the phone number for the Oakland County Road Commission. Also thanked the Oakland County Sheriff for their good work in the community and thanked Beth Shifferd for Project Alayna. 12. ADJOURNMENT.
