2 PRESENT: Dan Ericksen, County Judge Sherry Holliday, County Commissioner Bill Lennox, County Commissioner Kathy McBride, Administrative Assistant At 9:01 a.m. Judge Ericksen called the Regular Session of the County Court to order. There was no one from the public in attendance so the meeting was opened to County Departments. Todd Cornett, Planning & Development Director, informed the Court that he attended the Land Conservation and Development Commission's Grants Meeting last Friday in Salem, Oregon. There was no conversation about the Scenic Area Grant that comes to the three Oregon Gorge Counties. Mr. Cornett has budgeted to receive $45,000 per year during the Biennium. This money is not a guarantee until it gets through the state's budget process. Mr. Cornett noted that the Department has received a lot of calls in regards to the delay in current planning due to the need to process Measure 37 Claims within the required timeline. Mr. Cornett stated that the County has received 1 0 waivers for the 30 Measure 37 Claims, which were filed on the last day in December, Mr. Cornett discussed with the Court the proposed legislation before the state in regards to Measure 37 Claims. Mr. Cornett noted that the County Court will be appointed as a Special Advisory Board for the Oregon Department of Energy for the processing of the Cascade Wind Application. Judge Ericksen noted that the process paper for the siting process before the Oregon Department of Energy is available in the County Court's Office. At 9:20 a.m. Tyler Stone, Wasco County Employee & Administrative Services Director, requested that the Court appoint Laura Comini to the unexpired term of Frank Bonn on the Wasco County Civil Service Commission.

3 PAGE2 {{{Commissioner Lennox moved to appoint Laura Comini to fill the unexpired term of Frank Bonn on the Wasco County Civil Service Commission. Commissioner Holliday seconded the motion; it was then passed unanimously.}}} At 9:24 a.m. Marty Matherly, Wasco County Roadmaster, met with the Court to update them on various road projects. Mr. Matherly noted that the County has received three bids for the Chenowith Water lntertie and Storm Drain Project, which is a joint project with Chenowith Water People's Utility District and Wasco County Public Works Department. The low bid is from Crestline Construction. The engineer's estimate for the County share of the project is $178,000. Under the Crestline Bid the County's share is $130,000. Mr. Matherly would recommend that the County continue with the joint project. This is a project on the County's Capital Improvement List. The shared project will save the County money. Commissioner Holliday asked Mr. Matherly what affect the Chenowith Water lntertie and Storm Drain Project will have on other unfinished projects, such as Wamic Grade. She stated that the citizens want to know when the Wamic Grade Project will be completed. Mr. Matherly responded by stating that the Chenowith Water Project is a more technical project, which the Public Works Department should not be doing. However, the Wamic Grade Project is a project that the Department can do, which they are good at. Mr. Matherly stated it will be an expensive project due to labor and equipment costs, fuel and potential reduction in manpower. He stated it will be difficult to maintain the County roads and do capital improvements at the same time. Some discussion occurred regarding the Wamic Grade Project. Mr. Matherly stated that they were hoping to do the project over three phases. They are estimating that the project will cost one million dollars. The cost is in the guardrail and the replacement of the asphalt. Mr. Matherly noted that Phase II includes finishing the lower fill and trying to stabilize the slope by planting grass seed. The Public Works Department would like to maintain the existing road and improve the guardrail. It will take a few years to finish with the new alignment. Kathy McBride asked when the County would be going through the prioritization of County Roads Process for the Capital Improvement Plan.

4 PAGE3 Mr. Matherly indicated that the process should have happened last fall, but with the change in leadership it has been pushed back. He is hopeful that the priority process will occur sometime this fall. Some further discussion occurred. ***It is the consensus of the County Court to go forward with our share of the Chenowith Water lntertie and Storm Drain Project***. The Court and Marty Matherly briefly discussed the recent letter received from Lane County Board of Commissioners, dated March 19, They are seeking financial support from Wasco County and other forest counties. [[[A copy of the letter from Lane County Board of Commissioners, dated March 19, 2007 is hereto attached and made a part of this record.]]] {{{Commissioner Holliday moved to support the request from Lane County Board of Commissioners that Wasco County participate in providing funding assistance to Lane County in the effort to get the United States Congress to reauthorize P.L the Secure Rural Schools and Communities Self Determination Act of 2000; said support is with the understanding that the General Fund and Public Works Fund will each pay an equal share of the funding request. Commissioner Lennox seconded the motion; it was then passed unanimously.}}} At 9:52 a.m. Karen LeBreton Coats, County Clerk, and Tim Lynn, Assessor/Tax Collector, met with the Court. Mr. Lynn informed the Court that he spoke to the Oregon Department of Revenue yesterday regarding the Positions of Appraiser Ill and Appraiser Trainee. The Department of Revenue is willing to allow Wasco County to under fill the Appraiser Ill Position with an Appraiser Trainee Position. The County would take out the Appraiser Trainee Position from next year's budget and pay the Trainee out of the Appraiser Ill category. Discussion occurred. The Court recessed at 9:58a.m. The Court reconvened at 10:05 a.m. Judge Ericksen called to order the Public Hearing on the request by Virgil M. and Frances P. There were nine people in attendance. Judge Ericksen went over the procedures for today's Public Hearing. Judge Ericksen asked if there was any member of the Court wishing to declare any factual information obtained outside the information provided by County Staff. He also asked if any member wished to disqualify them self for any personal or financial interest in the matter. There was no one. Judge Ericksen asked if any audience member wished to challenge the right of any Court member to hear this matter or who wishes to question the jurisdiction of this body to act on behalf of Wasco County. There was no one. Judge Ericksen called on the claimant. Steven Anderson, Representative for Virgil and Frances Ellett, thanked the County Court for rescheduling the hearing to meet their schedule. They do not have any additional information to submit today. Mr. Anderson noted that they appreciate and support the recommendation of the Planning Department. Judge Ericksen called on staff to present the Staff Report from the Wasco County Planning and Development Department. Dawn Baird, Associate Planner, presented the staff report, as outlined in her staff presentation. [[[A copy of the staff presentation from Dawn Baird, Associate Planner, is hereto attached and made a part of this record.]]] Mrs. Baird stated that the County received a letter from the Oregon Department of Forestry dated March 23, 2007 from David J. Jacobs. A portion of the letter was read out loud at this time. Mrs. Baird noted that the County recently adopted the new fire standards for Wasco County. Any development under this claim will need to meet those standards. The property is located within the Mid-Columbia Fire and Rescue District. Judge Ericksen asked the Claimant's Representative for his comments on the staff's recommendation to deny the claim from Mrs. Ellett.

6 PAGES Mr. Anderson stated that they may come back at a later date to challenge the denial. There is a Court case that he is not sure how it turned out where the wife claimed that she has right to the property of her deceased husband. At 10:17 a.m. the Public Hearing was closed to further testimony. {{{Commissioner Holliday moved that the claim for compensation pursuant to Ballot Measure 37 by Virgil M. Ellett is determined by the Court to be valid; that the claim by Frances P. Ellett is determined by the Court to be invalid; existing zoning regulations implemented on September 16, 2005, which prohibit Virgil Ellett from applying for residential, commercial, commercial-recreational, and light industrial uses, such as agricultural produce, gift shop, wine tasting, bed & breakfast facilities, RV park & campground, manufacture home park/subdivision, mini-storage and outdoor storage are waived; and that Virgil Ellett is eligible to make application to the Wasco County Planning & Development Department for residential, commercial, commercial-recreational, and light industrial uses, such as agricultural produce, gift shop, wine tasting, bed & breakfast facilities, RV park & campground, manufacture home park/subdivision, mini-storage and outdoor storage on a parcel located in the RR(10) Rural Residential Zone, subject to the recommended conditions as outlined in the Staff Report; and that Staff Report and Findings are adopted. Commissioner Lennox seconded the motion; it was then passed unanimously.}}} At 10:18 a.m. the Public Hearing adjourned. A member of the audience asked the Court to explain to him what just happened at the Public Hearing. Judge Ericksen informed the gentleman of what was just approved for the Elletts. He was informed why public testimony is not taken on the Measure 37 Claim. Patty Delaney asked if the Court Packet for the Ellett Claim is available to the public. Court Packets that were going to be recycled were distributed to three members of the public in attendance. The unidentified gentlemen stated that they are concerned with congestion in the area, and the potential depletion of their water.

7 PAGE6 Discussion occurred regarding the Measure 37 Claims Process and the process for applying for a land use permit. At 1 0:26 a.m. the Court considered the approval of the Regular Session Consent Calendar of April 4, [[[A copy of the Regular Session Consent Calendar of April 4, 2007 is hereto attached and made a part of this record.]]] {{{Commissioner Holliday moved to approve the Regular Session Consent Calendar of April 4, 2007 as presented. Commissioner Lennox seconded the motion; it was then passed unanimously.}}} {{{Commissioner Holliday moved to approve the Order in the matter of a Public Hearing on a request by Virgil M. and Frances Pauline Ellett for a Measure 37 Compensation Claim, as authorized by Oregon Revised Statute 197, for uses restricted within the R-R (10) Rural Residential Zone of Wasco County, on property described as 1N 12E 1, Tax Lot 2000 (File #M ). Commissioner Lennox seconded the motion; it was then passed unanimously.}}} The Court returned to discussing items listed on the Discussion List of April 4, Item #6- The Court discussed the request from North-State Telephone Company for a Communications Line Right Of Way Easement on property owned by Wasco County in Sportsman Paradise North Subdivision. The Court is requesting that Dan Boldt, County Surveyor/Public Works Director, accompany them out to the property prior to the Court rendering a decision. Item #3- The Court discussed the request from Chris McNeel, Wasco County Sheriff's Department/MINT Supervisor, for the County to surplus out three desks to MINT. {{{Commissioner Lennox moved to declare as surplus and to donate to MINT three unused desks. Commissioner Holliday seconded the motion; it was then passed unanimously.}}} Kathy McBride, Administrative Assistant, informed the Court that no surplus computers are available for MINT's use due to various County requirements. Item #4 - The Court considered donating to the City of The Dalles an old surplus desk from out of the Assessor's Office.

Commissioner Lennox seconded the motion; it was then passed unanimously.}}} Item #5 -The Court discussed whether to issue a Request for Proposals for the Staffing Contract for the Economic Development Commission. ***It was the consensus of the County Court not to go out for Requests for Proposals for the Wasco County Economic Development Commission Staffing Contract. The Court is requesting that the Columbia Gorge Community College provide the County with a proposal for their consideration***. At 11 :03 a.m. the Court recessed. At 11:06 a.m. the Court reconvened. 9 PAGES Patrick Joseph, Claimant, stated where he lives for the record. Steven Anderson, Representative of Patrick Joseph, thanked the Court for rescheduling today's hearing. He appreciates the work of the Planning Department in getting this application moved forward. They have no comments or further testimony to submit. Judge Ericksen called on staff to present the Staff Report from the Wasco County Planning and Development Department. Dawn Baird, Associate Planner, presented the staff report, as outlined in her staff presentation. At 11:12 a.m. the Court read the letter from Kenneth Thomas, dated April 3, The Court was informed by Mrs. Baird that Mr. Thomas was unaware that he would be able to testify today. This letter is being entered into the record on his request. Staff has only seen the letter within the last half hour. Judge Ericksen stated that the Court will enter the letter of Kenneth Thomas, dated April 3, 2007 into the record. [[[A copy of the letter from Kenneth Thomas, dated April 3, 2007 is hereto attached and made a part of this record.]]] Mr. Anderson stated that they have no objections to the letter being entered into the record. Judge Ericksen stated that the Claimant needs to be aware of the rules as to public safety when they pursue a land use decision. The County Court will not preclude rights unless directed by higher authorities. The other issues address the amount of development that the County has allowed around his property. Commissioner Holliday stated that Mr. Thomas made the request of what happens to other claims after this one, if the Court makes any changes to the rules.

10 PAGE9 Judge Ericksen stated that it is not the Court's intent to treat anyone differently. Todd Cornett, Wasco County Planning & Development Director, stated that the County has our rules. This is not applicable to this particular hearing in that point of the letter. The County will address claims as dictated by higher authorities. Mrs. Baird stated that Kenneth Thomas' Claim has already been scheduled; his claim will be treated as any other claim is. The Public Hearing was closed to further testimony at 11:19 a.m. {{{Commissioner Lennox moved that the claim for compensation pursuant to Ballot Measure 37 by Patrick Joseph is determined by the Court to be valid; existing zoning regulations implemented on December 1, 2005, which prohibits Patrick Joseph from applying for the division of property into 10-acre residential parcels are waived; and that Patrick Joseph is eligible to make application to the Wasco County Planning & Development Department for the division of two parcels into 10-acre residential parcels in the F-2(80) Forest Zone, subject to the recommended Conditions as outlined in the Staff Report; and that Staff Report and Findings are adopted. Commissioner Holliday seconded the motion; it was then passed unanimously.}}} At 11 :20 a.m. the Public Hearing was adjourned. Tyler Stone, Wasco County Employee & Administrative Services Director, requested permission to have supervisory staff attend a mandatory Sexual Harassment Training on April 17th from 2 p.m. to 4 p.m., which will be conducted by City/County Insurance Services (CCIS). 11 PAGE10 At 11 :45 a.m. the Court considered the adoption of the Public Health Emergency Preparedness Plan. Present was Karel Smit, Environmental Health Specialist; Lynnette Benjamin, Incoming Public Health Director; Kathy Schwartz, Wasco Sherman Public Health Director; and Mike Davidson, Wasco County Emergency Management Services Director. Karel Smit, Environmental Health Specialist, stated that the proposed Emergency Preparedness Plan included an insert which shows the other plans that will be used in a time of emergency. Mr. Smit stated that the Plans that we had before were not practical. The contract we have with the state talks about specific timelines in regards to updating these plans. Some discussion occurred. Mr. Smit noted that he is working with Hood River County on communications. The two counties are trying to prepare similar plans in case each County needs to assist the other county during times of emergencies. Kathy Schwartz, Wasco Sherman Public Health Director, noted that they have used the plan in an outbreak situation. She requested that Department Heads be trained in the National Incident Management System. Mike Davidson, Wasco County Emergency Management Services Director, stated that he agrees with Mrs. Schwartz. Mr. Davidson noted that he has stated this verbally and in writing that Departments need to be trained. Some discussion occurred. Mr. Davidson noted that all of the emergency response people have had the required training. {{{Commissioner Holliday moved to adopt the Wasco County Public Health Emergency Preparedness Plan for the Counties of Wasco, Sherman and Gilliam. Commissioner Lennox seconded the motion; it was then passed unanimously.}}} The Court recessed for lunch at 12:07 p.m. At 1 :06 p.m. the Court reconvened.

12 PAGE 11 The Court discussed the replacement of the Chenowith Creek Bridge with Marty Matherly, Wasco County Roadmaster; Dan Boldt, Wasco County Public Works Director/County Surveyor; Arthur Smith, Wasco County Public Works Project Manager; and Andrea Klaas, Port of The Dalles Executive Director. Dan Boldt, Public Works Director, noted that Wasco County is eligible to rehabilitate three bridges; two were repaired. Art Smith, Public Works Project Manager, informed the Court that the Gatecreek and the Dam View Point Bridges both came under budget, which the County was then allowed to apply the unspent money to their remaining bridge. The Chenowith Creek Bridge was originally scoped out as a rehab bridge. With this additional unspent OTIA Funding they thought they should see if the bridge could be replaced and realigned instead. Anderson-Perry & Associates, Engineer of Record, prepared a Preliminary Estimates of Project Costs for the bridge. Art Smith presented the Court with three handouts, which are a map of the proposed realignment of the Chenowith Creek Bridge, the Preliminary Estimate of Project Costs from Anderson-Perry & Associates, Inc. for a 2-Lane Bridge on new alignment, and a new 1-Lane Concrete Deck Built Tee Girder Bridge. He noted that the County currently has available $670,000 in OTIA Funds. [[[A copy of the three handouts from Art Smith, Wasco County Project Manager, are hereto attached and made a part of this record.]]] Some discussion occurred. Mr. Smith expressed the need for the county to find other grant streams or partners to help with the funding of a realigned replacement bridge. Andrea Klaas, Port of The Dalles Executive Director, stated that this project has been on the Needs and Issues Inventory for many years. They are hopeful that there will be some Connect Rural Oregon Funds available for this project. Ms. Klaas stated that she has talked to some facility folks at 02 to see what their interests are. They feel we should move forward with the funds that we have to get the bridge widen. There has been no contribution from any other source. Judge Ericksen stated that his preference would be for the Public Works Department to make a presentation before the Port of The Dalles Board of Directors before the Court would make a decision as to what type of bridge should be constructed or rebuilt. The Court would like a recommendation from the Port's Board of Directors.

13 PAGE12 Ms. Klaas stated that the Port is meeting on Wednesday, April 11. Further discussion occurred. At approximately 1 :30 p.m. Gary and Linda Casady met with the Court to express their concerns regarding wind energy in Wasco County, Oregon. Also present was Steve Kelsey, Richard Murray, Ed Cox and Todd Cornett, Wasco County Planning & Development Director. Several handouts were presented to the Court by Gary Casady in regards to Wind Energy in Wasco County. [[[A copy of the handouts from Gary Casady are hereto attached and made a part of this record.]]] Linda Casady asked the Court several questions as outlined in their handout. Judge Ericksen responded by stating that the promotion of renewables provide some additional opportunities for the community. Wasco County has lead the state in unemployment. It provides additional employment opportunities. Judge Ericksen noted the technical training at the local Columbia Gorge Community College. Another advantage would be additional growth to the County's tax base. Commissioner Holliday stated that the Governor's Portfolio on Renewable Energy requires some alternative sources of power, such as wind energy. She noted that she was disappointed that hydro was not one of them. As to disadvantages, Judge Ericksen stated from a power standpoint the mandate from the Governor creates significant challenges to the power supply side of things. Another disadvantage is the impact to the local areas. Judge Ericksen stated that he does not see any important timelines or time constraints from a County standpoint other than processing applications when they are received. Wasco County handles only 25 megawatt or less projects. As to tax incentives, Judge Ericksen stated that the County has a Rural Renewable Energy Development Zone which offers tax incentives like the Enterprise Zone. Mrs. Casady went over the material listed on Pages 1 through 3.

14 PAGE13 Steve Kelsey stated that wind generation is not new. Mr. Kelsey is speaking out regarding the outdated plan. Mr. Kelsey is hoping we can convince the state when there is a right place or a wrong place for these facilities. He is hoping that the County can update the outdated 1982 energy plan. Mr. Kelsey had some things for the Court to think about. He has done some research, but he is not sure of the impact to bat species. There are two bat species in our area. Mr. Kelsey noted his concerns on how Cascade Wind Management will get the blades up Sevenmile Hill Road. He feels that the electric grid will not handle the power load since it is outdated. Some discussion occurred. Commissioner Lennox stated that he sees two complete issues here; the first is siting. The other is the value of the technology itself. We want to look at wind energy and how it will benefit or hurt the county overall. Then we want to look at where it is best suited. Todd Cornett, Wasco County Planning & Development Director, stated that the opportunity for public participation should be the same in both places (County and State levels). As to influence; Mr. Cornett does not know. He does not think any of us have an answer now. Mr. Casady went over Pages 4 through 7 at this time. A PowerPoint Presentation was shown, which showed photos of the Seven Mile Hill Landscape. Mr. Casady noted during his PowerPoint presentation that he has at his disposal all the wind data at Wasco Butte. Judge Ericksen stated that a lot of the financial and subsidy issues are federal issues. They are either there or not. It is a national policy issue. The main issues that concerns Wasco County is the concerns of the residents; how the local people will be affected. Those are by far the biggest issues. Judge Ericksen stated that the Rural Renewable Energy Development Zone (RREDZ) provides some financial tax incentives for small scale projects. The big incentive was the federal tax incentive. Mr. Cornett stated that the UPC Wind Management Project could apply under the RREDZ Process.

15 PAGE14 Judge Ericksen stated that the habitat issue, other than birds, is not a big concern. Fire is not a new concern. When we get a fire with the wind blowing west of here it is a major concern. Judge Ericksen stated that the things the County is most concerned with are those concerns of the local residents. Some discussion occurred between members of the Court, Linda and Gary Casady, and Steve Kelsey. At 2:50 p.m. Judge Ericksen called the Public Hearing to order on the proposed Annexation of a parcel of property to the Chenowith Water People's Utility District. Present were Tom Peachey, Attorney for the Chenowith Water People's Utility District, Julius Jepsen, Pastor of the Life in Christ Center, and Shirlene Bowen, Chenowith Water People's Utility District Manager. Tom Peachey stated that they are back to get the Life in Christ Center property annexed under ORS 198 to the Chenowith Water People's Utility District (PUD). Mr. Peachey has prepared an order for the Court's consideration. The Court will decide if the Life in Christ Center qualifies as the sole property owner in the annexation area. Mr. Peachey stated that Julius Jepsen is here today to confirm that they have requested the annexation of their property. They request that the Court approve the Order approving the annexation of the Church's property. {{{Commissioner Holliday moved to approve the annexation of the Life in Christ Center property to the Chenowith Water People's Utility District and that the Order in the matter of the annexation of a parcel of property to the Chenowith Water People's Utility District be approved. Commissioner Lennox seconded the motion; it was then passed unanimously.}}} The Public Hearing adjourned at 2:57 p.m. Some discussion occurred on the impact of wind turbines to residents in the Sevenmile Hill Area.
