1 PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, AT 5:30 P.M. The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, October 15, 2018 at 5:30 p.m., and was duly convened by Mr. Scotty Robinson, President. Mr. Smiley gave the invocation and led the Pledge of Allegiance. Members Present (5) Scotty Robinson District A Jack Clampit District B Walt Caldwell District C Shane Smiley District E Pat Moore District F Members Absent (1) Ollibeth Reddix District D APPROVAL OF AGENDA: The president asked if there were any additions or amendments to the agenda. The president asked to add the substantial completion for Parker Road to the agenda. This item was inadvertently left off of the agenda and action was needed before the next meeting of the Jury. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to approve the agenda as amended. Motion passed without opposition. PUBLIC COMMENT PERIOD: The president asked for public comments on the agenda as approved. No one appeared or came forth to speak during this time. ADOPTION OF MINUTES: A motion to adopt the minutes of the regular Police Jury meetings including the committee meetings held on October 1, 2018 was offered by Mr. Clampit, seconded by Mr. Caldwell. Motion passed with Ms. Moore abstaining. PUBLIC HEARINGS: The president convened a public hearing on Ordinance No An Ordinance revoking a portion of the right-of-way of Leon Russ Road; and, further providing with respect thereto. Justin Jacobs, 113 Leon Russ Road, spoke and stated his support of the ordinance. No one else appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to close the public hearing. Motion passed without opposition. PAGE 1 OF 16
2 The president convened a public hearing on Ordinance No An Ordinance amending Section 14-1 of the Compiled Ordinances of the Ouachita Parish Police Jury, to establish a speed limit of thirty-five miles per hour (35 m.p.h.) for Huey Lenard Loop; and, further providing with respect thereto. No one appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to close the public hearing. Motion passed without opposition. The president convened a public hearing on Ordinance No An Ordinance amending Section 14-1 of the Compiled Ordinances of the Ouachita Parish Police Jury, to establish a speed limit of forty-five miles per hour (45 m.p.h.) for Vocational Parkway; and, further providing with respect thereto. No one appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to close the public hearing. Motion passed without opposition. The president convened a public hearing on Ordinance No An Ordinance to authorize an Act of Sale by the Parish of Ouachita to sell certain adjudicated properties (Parcels 14885, 47244, 57411, 61803, 71682, 82039, 62503, 62506, 62514, 62516, 62539, & 62540) by public auction; and, further providing with respect thereto. No one appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to close the public hearing. Motion passed without opposition. The president convened a public hearing on Ordinance No An Ordinance revoking Falcon Drive; and, further providing with respect thereto. Mr. Mitchell stated that he had been contacted by the owner of the land along the entire southern boundary of the road asking that the Jury not take any action on this ordinance at this time. No one appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Ms. Moore to close the public hearing. Motion passed without opposition. The president convened a public hearing on Ordinance No An Ordinance supplementing and amending Chapter 2 of the Compiled Ordinances of Ouachita Parish, Louisiana, governing Alcoholic Beverages ; and, further providing with respect thereto. The president recognized Brian Bucote with Walmart Neighborhood Market. Mr. Bucote stated his support for Ordinance No The president recognized Randall Garvan with Randall s Fine Meats. Mr. Garvan stated that Ordinance No will allow businesses in the parish to be on equal footing with their competitors in the city limits. The president recognized Mike Holloway, a pastor. Rev. Holloway spoke and stated his opposition to the ordinance. Dr. Reddix entered the meeting at 5:49 p.m. The president recognized Mr. Manning. Mr. Manning spoke and stated his opposition to the ordinance. PAGE 2 OF 16
3 The president recognized Dana Hopkins. Ms. Hopkins spoke and stated her opposition to the ordinance. The president recognized Doug Lawrence, an attorney. Mr. Lawrence spoke and stated his clients support for the ordinance. The president recognized Charlie Heck, an attorney. Mr. Heck spoke and stated his clients support for the ordinance. Mr. Heck stated that it is not fair to prohibit businesses in the parish from selling alcohol on Sunday when their competitors in Monroe, Sterlington and Richwood do not face that limitation. The president recognized Jada Ali. Ms. Ali spoke and stated her support for the ordinance. The president recognized Eddie Holbrook. Mr. Holbrook asked why this matter couldn t be voted on by the people. Mr. Robinson stated that the law does not authorize the Police Jury to call an election on this matter. Mr. Holbrook stated he was against the ordinance. The president recognized Karl Daliwal. Mr. Daliwal spoke and stated his support for the ordinance. Mr. Caldwell stated that he was supporting the ordinance because the parish could lose tax dollars if businesses annex into the City. Ms. Moore stated that her constituents have asked her not to support the ordinance. No one else appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to close the public hearing. Motion passed without opposition. Mr. Clampit asked to take up Ordinance No at this time. Mr. Clampit, seconded by Mr. Smiley offered the following ordinance for adoption. ORDINANCE NO AN ORDINANCE SUPPLEMENTING AND AMENDING CHAPTER 2 OF THE COMPILED ORDINANCES OF OUACHITA PARISH, LOUISIANA, GOVERNING ALCOHOLIC BEVERAGES ; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, the local laws applicable to the sale of alcoholic beverages in the unincorporated area of Ouachita Parish are codified in Chapter 2 of the Compiled Ordinances of Ouachita Parish, Louisiana; WHEREAS, said Chapter 2 generally prohibits the sale or service of alcoholic beverages on Sunday; PAGE 3 OF 16
4 WHEREAS, the Louisiana Attorney General in Opinion No has confirmed the authority of the Ouachita Parish Police Jury to adopt ordinances regulating the sale of alcohol in the unincorporated area of Ouachita Parish, including ordinances proscribing whether such beverages may lawfully be sold beverages on Sunday, vel non; WHEREAS, three of the four municipalities in Ouachita Parish presently allow the sale of alcohol on Sunday, which places retailers in the unincorporated area of Ouachita Parish at a competitive disadvantage; WHEREAS, retailers have located in, or annexed into, the municipalities in order to take advantage of municipal ordinances allowing the sale of alcohol on Sunday, resulting in a loss of sales tax and ad valorem tax revenue to parish tax-recipient bodies; and, WHEREAS, the Ouachita Parish Police Jury has determined that a limited expansion of Sunday alcohol sales in the unincorporated area of Ouachita Parish is in order; NOW, THEREFORE: BE IT ORDAINED THAT Sec of the Compiled Ordinances of Ouachita Parish, Louisiana be, and is hereby, supplemented and amended, as follows: Section 1: Sec Closing hours Times stipulated. Subject to the exemptions set forth in Section 2-20:, all places of business where alcoholic beverages are kept, sold, stored for sale at retail, served or consumed, including without limitation thereto, bars, lounges, cabarets, nightclubs, road houses, saloons, bottle clubs and public dance halls where alcoholic beverages are kept, sold, stored for sale at retail, served or consumed, shall close their places of business at 12:00 midnight and remain so closed until 6:00 a.m. of the following morning, except that they shall be closed from 12:00 midnight Saturday until 6:00 a.m. on the following Monday morning; and, during the hours when same shall be closed, all business activities on the premises shall cease. Sec [REPEALED BY ORDINANCE 9145] Sec Same Exceptions; places of business not required to be closed during hours when alcohol sales are prohibited. A. The provisions of section 2-18(A) shall not apply to any bona fide cigar stand, newsstand, drugstore, restaurant, hotel, motel, convenience store, arcade, bowling alley, billiards center or grocery store; provided no such business herein exempted from the closing provisions of section 2-18 shall sell or serve, and is PAGE 4 OF 16
5 hereby prohibited from selling or serving, in, on or about such premises any alcoholic beverages from 12:00 midnight until 6:00 a.m. of the following morning, and from 12:00 midnight Saturday until 6:00 a.m. on the following Monday morning. For purposes of this section: an arcade shall have not less than twenty-four (24) bona fide arcade game devices such as pinball machines, air hockey tables, video games and the like; a bowling alley shall have not less than five (5) bona fide bowling lanes; and, a billiards center shall have not less than twenty-four (24) bona fide tables for billiards, pool, snooker, or similar games involving cues and balls. B. Notwithstanding the provisions of Paragraph A, any person holding a Class "R" restaurant establishment license shall be entitled to sell, serve, or allow the consumption of alcoholic beverages in conjunction with the service of meals to be consumed on the premises between the hours of 12:00 noon and 10:00 p.m. on Sundays. C. Notwithstanding the provisions of Paragraph A, any person holding a Class "B" and/or Class D license shall be entitled to sell alcoholic beverages at retail in bottles, cans or other sealed containers for consumption off the licensed premises between the hours of 12:00 noon and 10:00 p.m. on Sundays. Sec Same Frequenting places during such times. It shall be unlawful for any person, other than the proprietor or his employee, to stay or be found in any barroom, saloon or other place where alcoholic beverages are kept and sold between the hours when such places are required to be closed. Section 2: BE IT FURTHER ORDAINED that this Ordinance shall become effective upon its adoption by the Ouachita Parish Police Jury Section 3: BE IT FURTHER ORDAINED that a Public Hearing be held on October 15, 2018, to hear comments from all interested parties as to this proposed Ordinance and that notice of said Public Hearing be published in the Official Journal of the Ouachita Parish Police Jury. Mr. Crosby presented Change Order No. 5 for Parker Road and recommended approval. Motion offered by Ms. Moore, seconded by Mr. Caldwell to approve Change Order No. 5. Motion passed without opposition. Mr. Crosby spoke regarding the substantial completion for Parker Road and recommended approval. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to accept the substantial completion for Parker Road. Motion passed without opposition. Mr. Crosby presented Change Order No. 1 for Somerset Drive and recommended approval. Motion offered by Dr. Reddix, seconded by Mr. Caldwell to approve Change Order No. 1. Motion passed without opposition. Mr. Crosby spoke regarding the substantial completion for Melanie Drive and recommended approval. Motion offered by Mr. Caldwell, seconded by Dr. Reddix to accept the substantial completion for Melanie Drive. Motion passed without opposition. Mr. Crosby spoke regarding the substantial completion for Jones Road and recommended approval. Motion offered by Mr. Clampit, seconded by Dr. Reddix to accept the substantial completion for Jones Road. Motion passed without opposition. Mr. Crosby updated the Jury on other ongoing projects in the parish. Motion offered by Mr. Clampit, seconded by Mr. Smiley to recess the regular meeting in favor of the finance committee meeting. Motion passed without opposition. FINANCE COMMITTEE MEETING The chairman, Mr. Smiley, called the finance committee meeting to order at 6:18 p.m. The chairman recognized Mr. Cammack, Treasurer. Mr. Cammack presented the claim statement for the period of September 14, 2018 through October 10, 2018 and recommended approval. Motion offered by Mr. Robinson, seconded by Dr. Reddix to approve payment of the claims for the period stated as recommended by the treasurer. Motion passed without opposition. PAGE 6 OF 16
7 Mr. Cammack presented budget versus actual statements to the Jury. No action was needed. Mr. Cammack spoke regarding Cadeville Water and stated that the water district has asked to be placed on the Police Jury s liability and property insurance policy. Motion offered by Mr. Clampit, seconded by Dr. Reddix to add Cadeville Water to the Police Jury s liability and property insurance. Motion passed without opposition. Mrs. Smith spoke regarding the 2019 employee benefits and stated that there would not be an increase for dental, vision and life insurances. Mrs. Smith recommended approval. Motion offered by Dr. Reddix, seconded by Ms. Moore to renew the dental, vision, and life insurances. Motion passed without opposition. Mrs. Smith presented the quotes for the 2019 health insurance and stated that Vantage Health Plan presented a plan similar to what is currently in place and it would be a 4% increase. Blue Cross Blue Shield also presented a plan to what is currently in place and it would be a 2.02% increase. Motion offered by Mr. Smiley, seconded by Ms. Moore to accept the Blue Cross Blue Shield option 2 quote. Discussion ensued. Representatives from Vantage Health Plan and Blue Cross Blue Shield spoke on their respective plans. A substitute motion was offered by Mr. Clampit, seconded by Mr. Robinson to accept the Vantage Health Plan quote with a 2.93% increase and a $150 deductible. The substitute motion passed with Dr. Reddix and Mr. Smiley opposing and Mr. Caldwell abstaining. There being no further business to come before this committee, a motion to adjourn and reconvene the regular meeting was offered by Mr. Caldwell, seconded by Mr. Robinson. Motion passed without opposition. The finance committee meeting was adjourned at 6:48 p.m. * * * Motion offered by Mr. Clampit, seconded by Dr. Reddix to ratify and adopt all actions taken in the committee meeting. WHEREAS, the Parish offered these properties to the highest bidder at the time of sale WHEREAS, the property described herein above was offered at public auction on listed NOW BE IT ORDAINED by the Ouachita Parish Police Jury, that any Act of Sale of the below described property shall contain the following conditions and requirements: 1) The properties shall be sold in accordance with LS-R.S. 47:2201 et. seq., without any warranty, from either the Parish or Management Company, whatsoever, even as to the return of the purchase price. 2) The sale shall be on a form approved by the Parish Attorney and that the sales price is paid by certified funds at or near the time of the sale. 3) The sale shall include a reservation of all mineral rights to the Parish, but shall convey all surface rights. 4) The following shall be completed prior to closing of sale: a. E&P Consulting, LLC shall certify in writing to the Parish Attorney that they have examined the mortgage records, conveyance records, probate and civil suit records of the Parish of Ouachita and that attached to this certification will be a written list of names and last known addresses of all owners, mortgagees, and any other person who may have a vested or contingent interest in the property, or who has filed a request for notice as provided in the former provisions LS-R.S. 33: (B), as indicated in those records. b. E&P LLC has provided notice to those persons identified in accordance with LS- R.S. 47:2201 et. seq. Proof of said notice will be filed in the records of Ouachita Parish immediately after the Act of Sale. c. At the time of closing, the E&P LLC will certify in writing to Parish Attorney and Clerk of Court that the number of days mandated by LS-R.S. 47:2201 et. seq. has elapsed since the above required notice was made or attempted and that the property has not been redeemed by the payment of the taxes owed. ORDINANCE NO AN ORDINANCE REVOKING A PORTION OF THE RIGHT-OF-WAY OF LEON RUSS ROAD; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, Leon Russ Road is a public road of the Ouachita Parish Police Jury located within a right-of-way that begins at the western right-of-way line of La. Highway 136 and thence proceeds westerly a distance of approximately 650 to a dead end; WHEREAS, Leon Russ Road does not connect to any other public roads and serves only as a means of ingress and egress to three residential parcels; WHEREAS, the owners of all properties accessed by Leon Russ Road have made a written request that said road be revoked; and, WHEREAS, in view of the request of the affected landowners, the revocation of Leon Russ Road as a parish road serves the public interest. NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury at a Regular Meeting held on October 15, 2018, that Leon Russ Road be, and is hereby, revoked. BE IT FURTHER ORDAINED that the revocation of Leon Russ Road is made with a full reservation of all rights of ingress and egress to the owners of properties contiguous to said roadway. WHEREAS, the Parish Engineer has advised that the Parker Road project (State Project No. H ) has reached substantial completion; NOW, THEREFORE: BE IT RESOLVED that the Ouachita Parish Police Jury does hereby authorize the President to execute a Certificate of Substantial Completion for the Parker Road project and to take such other actions as are necessary in connection therewith. Motion passed without opposition. Mr. Murray spoke regarding re-subdivision approval for Woodmont Subdivision, Unit 2 and recommended approval. Motion offered by Mr. Clampit, seconded by Mr. Caldwell to grant resubdivision approval for Woodmont Subdivision, Unit 2 subject to comments from the Public Works Department and parish engineer being adequately answered.
