1 PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, AT 5:35 P.M. The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, May 7, 2018 at 5:35 p.m., and was duly convened by Mr. Scotty Robinson, President. The invocation was given by Mr. Clampit. The Pledge of Allegiance was led by Mr. Clampit. Mr. Mitchell asked to add an item to authorize an amendment to the cooperative endeavor agreement with the Ouachita Parish Sheriff s Office for the women s work release. This item was inadvertently left off and action was needed so that the project would not be delayed. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to approve the agenda as amended. Motion passed without opposition. PUBLIC COMMENT PERIOD: The president asked for public comments on the agenda as approved. No one appeared or came forth to speak during this time. ADOPTION OF MINUTES: A motion to adopt the minutes of the regular Police Jury meeting including the committee meeting held on April 16, 2018 was offered by Mr. Caldwell, seconded by Mr. Smiley. No one appeared to speak in favor of or against said ordinance. Motion offered by Mr. Caldwell, seconded by Mr. Clampit to close the public hearing. Motion passed without opposition. The president convened a public hearing on Ordinance No An Ordinance to authorize an Act of Sale by the Parish of Ouachita to sell adjudicated property described as Parcel 76805: Lot 14, Glendale Addition, Ouachita Parish, Louisiana, in accordance with LA R.S. 47: 2202 et seq. and to authorize the Ouachita Parish Police Jury president to sign all necessary documents and to address the matters relative thereto. 3 VISITORS: The president recognized Warden Johnson, OCC. Warden Johnson and Mr. Mitchell spoke regarding the amendments to the cooperative endeavor agreement for the women s work release and recommended approval. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to approve the amendments to the cooperative endeavor agreement. Motion passed without opposition. The president recognized Stephanie Smith, Assessor and asked to take up the matter concerning the homestead exemption audit at this time. Mr. Mitchell spoke regarding the cooperative endeavor agreement for the homestead exemption audit and recommended approval. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to approve the cooperative endeavor agreement. Motion passed without opposition. The president recognized Joe Hall, 2605 South 6 th Street, Monroe. Mr. Hall spoke regarding the Swayze School ditch and asked the Jury to clean out the ditch to help with the flooding in that area. Discussion ensued. After discussion, motion offered by Ms. Moore, seconded by Mr. Caldwell to authorize Lazenby & Associates to work with the City of Monroe to evaluate the ditch. Motion passed without opposition. DEPARTMENT HEAD REPORTS: The following department heads presented monthly reports. ANIMAL CONTROL: Ms. Stephanie Mullins, Director Motion offered by Mr. Clampit, seconded by Mr. Robinson to authorize Lazenby & Associates to assist with a potential site for a new shelter. Motion passed without opposition. FEDERAL PROGRAMS: Ms. Doretha Bennett, Director Ms. Bennett stated that she did not have any items to add to her written report. FIRE DEPARTMENT: Chief Patrick Hemphill Chief Hemphill requested approval to advertise for bids for three generators. Motion offered by Mr. Clampit, seconded by Mr. Smiley to approve the advertisement of bids. Motion passed without opposition. HOMELAND SECURITY: Mr. Neal Brown, Director Mr. Brown stated that he did not have any items to add to his written report. LIBRARY: Ms. Robin Toms, Director Ms. Toms stated that she did not have any items to add to her written report. LSU AG CENTER: Ms. Cathy Agan Ms. Agan and Ms. Tara Garlington updated the Jury on the recent and upcoming events with the LSU Ag Center programs. PAGE 3 OF 26

A motion to recess the regular meeting in favor of the Personnel Committee meeting was offered by Ms. Moore, seconded by Mr. Clampit. Motion passed without opposition. PERSONNEL COMMITTEE MEETING The president called the Personnel Committee meeting to order at 6:10 p.m. The president recognized Chief Hemphill, Fire Department. Chief Hemphill recommended the following personnel actions for approval. Mr. Cammack requested approval of a non-accountable mileage plan for Robert Gaines of the IT department. Ms. Bennett requested approval of the office assistant job description. Motion offered by Ms. Moore, seconded by Mr. Clampit to approve the job description. Motion passed without opposition. Ms. Bennett requested to open the office assistant position. Motion offered by Ms. Moore, seconded by Mr. Clampit to open the position. Motion passed without opposition. The president recognized Ms. Smith, Human Resources. Ms. Smith informed the Jury that Ms. Bridges will be hiring a Maintenance Worker III through a staffing agency. No action was needed. Ms. Smith stated that Ms. Bridges has requested to open the Juvenile Detention Officer II female part-time position. Motion offered by Ms. Moore, seconded by Mr. Clampit to open the position. Motion passed without opposition. Ms. Smith stated that Ms. Bridges has requested to hire Wyneishia Randle for the position of Juvenile Detention Officer II female part-time. Motion offered by Mr. Clampit, seconded by Ms. Moore to hire Wyneishia Randle. Motion passed without opposition. There being no other business to come before this committee a motion to adjourn and enter into the Public Works Committee meeting was offered by Mr. Smiley, seconded by Mr. Clampit. Motion passed without opposition. PUBLIC WORKS COMMITTEE MEETING The president called the Public Works Committee meeting to order at 6:15 p.m. The president recognized Mr. Murray, Director. Mr. Murray spoke regarding preliminary subdivision approval for Chapel Hill Place and recommended approval. Motion offered by Mr. Robinson, seconded by Mr. Clampit to grant preliminary subdivision approval for Chapel Hill Place subject to comments from the Public Works Department and parish engineer being adequately answered. Motion passed without opposition. The president recognized Mr. Crosby, Engineer. Mr. Crosby requested ratification of the substantial completion for Brownlee Road. Motion offered by Mr. Clampit, seconded by Mr. Robinson to ratify the substantial completion. Motion passed without opposition. PAGE 5 OF 26

6 Mr. Crosby spoke regarding Change Order No. 3 for 40 Oaks Farm Road and requested approval. Motion offered by Mr. Robinson, seconded by Mr. Clampit to approve Change Order No. 3. Motion passed without opposition. Mr. Crosby spoke regarding Change Order No. 1 for Chadwick Drive Phase 1 and requested approval. Mr. Crosby explained that this change order was necessitated by soil conditions discovered during construction after removal of the existing pavement and by conditions related to the existing cross-drains. Motion offered by Mr. Robinson, seconded by Mr. Clampit to approve Change Order No. 1. Motion passed without opposition. Mr. Crosby requested approval to advertise Chadwick Drive Phase 2 for bids. Motion offered by Mr. Robinson, seconded by Mr. Clampit to authorize Lazenby & Associates to advertise the project for bids. Motion passed without opposition. Mr. Crosby updated the Jury on other ongoing projects in the parish. There being no other business to come before this committee a motion to adjourn and reconvene the regular meeting was offered by Mr. Smiley, seconded by Mr. Clampit. Motion passed without opposition. The Public Works Committee meeting was adjourned at 6:25 p.m. Motion offered by Mr. Clampit, seconded by Mr. Caldwell to ratify and adopt all actions taken in the committee meetings. Motion passed without opposition. MOTIONS * ORDINANCES * RESOLUTIONS: MR. SCOTTY ROBINSON, DISTRICT A: Motion offered by Mr. Robinson, seconded by Mr. Caldwell to ratify the Family Justice Center arrest grant extension. Motion passed without opposition. Mr. Robinson, seconded by Mr. Smiley offered the following resolution for adoption. RESOLUTION NO A RESOLUTION DESCRIBING THE ACTIONS WHICH WILL BE TAKEN BY THE PARISH REGARDING THE MUNICIPAL WATER POLLUTION PREVENTION ENVIRONMENTAL AUDIT REPORT IN ORDER TO MAINTAIN COMPLIANCE AND PREVENT EFFLUENT VIOLATION PER PERMIT REQUIREMENTS CONTAINED IN THE LOUISIANA WATER DISCHARGE PERMIT SYSTEM; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, the Ouachita Parish Police Jury (the Parish ) is required to inform the Louisiana Department of Environmental Quality ( LDEQ ) that certain actions will be taken by the Parish in order to maintain compliance and prevent effluent violations per permit PAGE 6 OF 26

7 requirements contained in the Louisiana Water Discharge Permit System under LWDPS Permit Number LA ; and, WHEREAS, the Parish created West Ouachita Sewerage District No. 9 to operate a sewerage treatment and collection in the Indian Lakes area of western Ouachita Parish and serves as the fiscal agent of said district, NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury: 1) In order to maintain compliance with permit requirements contained in the Louisiana Pollution Discharge Elimination System (LPDES) permit, number LA , the following actions will be taken: a) Continue to identify and correct line failures in the wastewater collection system to minimize the potential for excessive infiltration/inflow. b) Continue regularly scheduled maintenance of the wastewater pumping stations within the collection system to insure adequate transport of wastewater to the treatment facility. c) Continue in its efforts to operate and maintain the wastewater treatment facility in a manner so as to improve effluent quality. d) Continue long term planning/budgeting for the replacement and/or upgrade of the wastewater treatment facility as it nears its design life. 2) This resolution shall become effective upon adoption. The above resolution was adopted the 7 th day of May, No opposition. Mr. Robinson, seconded by Mr. Clampit offered the following resolution for adoption. 8 requirements contained in the Louisiana Water Discharge Permit System under LWDPS Permit Number LA ; and, WHEREAS, the Parish serves as the Board of Commissioners of the West Ouachita Industrial District and operates the sewerage system in the District s West Ouachita Industrial Park:, NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury: 1) In order to maintain compliance with permit requirements contained in the Louisiana Pollution Discharge Elimination System (LPDES) permit, number LA , the following actions will be taken: a) Continue to enforce the Industrial Waste and Sewer Use Ordinance for customers served by the West Ouachita Industrial Park wastewater collection and treatment system. b) Direct wastewater customers within the industrial park to correct potential sources of infiltration and inflow as identified by a recently completed smoke test of the collection system. c) Continue regularly scheduled maintenance of the wastewater pumping stations within the collection system to insure adequate transport of wastewater to the treatment facility. d) Continue in its efforts to operate and maintain the wastewater treatment facility in a manner so as to improve effluent quality. 2) This resolution shall become effective upon adoption. The above resolution was adopted the 7 th day of May, No opposition. Mr. Robinson, seconded by Mr. Caldwell offered the following resolution for adoption. RESOLUTION NO A RESOLUTION ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD IN THE FIRE PROTECTION DISTRICT NO. 1, PARISH OF OUACHITA, STATE OF LOUISIANA, TO AUTHORIZE THE RENEWAL OF THE LEVY AND COLLECTION OF SPECIAL TAXES THEREIN; MAKING APPLICATION TO THE STATE BOND COMMISSION AND PROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH. WHEREAS, the Police Jury of the Parish of Ouachita, State of Louisiana, acting as the governing authority (the Governing Authority ) of the Fire Protection District No. 1, Parish of PAGE 8 OF 26

9 Ouachita, State of Louisiana (the District ) has previously levied and has been collecting a special tax of, nineteen and eleven hundredths (19.11) mills ad valorem tax to maintain and operate the District s fire protection facilities and obtaining water for fire protection purposes, for a period of ten (10) years commencing with the year 2010 and ending with the year 2019 (the Tax ); and WHEREAS, Article VII, Section 23 of the Louisiana Constitution of 1974 (the Constitution ) requires all ad valorem taxes be adjusted according to the terms thereof; and WHEREAS, the Tax has been adjusted to eighteen and eighty-three hundredths (18.830) mills, in accordance with the terms of the Constitution; and WHEREAS, it is the desire of the Governing Authority to renew the Tax as set forth herein; and WHEREAS, the Governing Authority desires to call an election renewing the Tax and the levy thereof and to take all necessary actions ancillary thereto; that: NOW THEREFORE, BE IT RESOLVED by the Governing Authority of the District, SECTION 1. Election Call. Subject to the approval of the Louisiana State Bond Commission, and under the authority conferred by Article VI, Section 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6- A and Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, as amended and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on Tuesday, November 6, 2018 between the hours of six o clock (6:00) a.m., and eight o clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at said election there shall be submitted to all registered voters qualified and entitled to vote at said election under the Constitution and laws of this State and the Constitution of the United States, the following propositions, to-wit: FIRE PROTECTION DISTRICT NO. ONE PARISH OF OUACHITA, STATE OF LOUISIANA PROPOSITION (MILLAGE RENEWAL) Shall the Fire Protection District No. One, Parish of Ouachita, State of Louisiana (the "District"), under the provisions of Article VI, Section 30 and 32 of the Constitution of the State of Louisiana and other constitutional and statutory authority, be authorized to renew the levy of and collect a tax of mills on all the property subject to taxation in the District, authorized to be levied through the year 2019 pursuant to an election held on October 17, 2009 (an estimated $10,728,007 reasonably expected at this time to PAGE 9 OF 26

10 be collected from the levy of the tax for an entire year) for a period of ten (10) years, commencing with the year 2020 and ending with the year 2029, for the purposes of maintaining and operating the Fire Protection District s fire protection facilities and obtaining water for fire protection purposes? SECTION 2. Publication of Notice of Election. A Notice of Special Election (the Notice ) shall be published in The Ouachita Citizen, a weekly newspaper of general circulation within the District, published in Monroe, Louisiana, and being the official journal of the District, once a week for four consecutive weeks, with the first publication to be made not less than fortyfive (45) days nor more than ninety (90) days prior to the date fixed for the election, which Notice shall be substantially in the form attached hereto as Exhibit A and incorporated herein by reference the same as if it were set forth herein in full. SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, at the Police Jury Meeting Room (2 nd Floor Ouachita Parish Courthouse), 301 South Grand, Monroe, LA, on December 3, 2018, at FIVE THIRTY O CLOCK (5:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said election. SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law. SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on December 3, 2018, as provided in Section 3 hereof. All registered voters in the District are entitled to vote at said special election and voting machines shall be used. SECTION 6. Authorization of Officers. The President and Recording Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and Recording Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election. SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Louisiana Secretary of State, the Clerk of Court and Ex- Officio Parish Custodian of Voting Machines in and for the District, and the Registrar of Voters PAGE 10 OF 26

11 in and for said District, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as required by law. SECTION 8. Employment of Special Counsel. It is recognized, found and determined that a real necessity exists for the employment of Special Counsel in connection with the election; accordingly, Boles, Shafto & Leonard, LLC, located in Monroe, Louisiana, is hereby employed as legal counsel to perform comprehensive, legal and coordinate professional work with respect to the election. Special Counsel shall (i) prepare and submit to the District for adoption all the proceedings incidental to the election; and (ii) counsel and advise the District with respect to the election. The fee to be paid Special Counsel for work on this election shall be an amount equal to the Attorney General's then current Fee Schedule for hourly rate work only and other guidelines for comprehensive, legal and coordinate professional work, together with reimbursement of out-of-pocket expenses incurred and advanced in connection with the election, said fee to be payable by the District subject to the Attorney General's written approval of said employment and fee. SECTION 9. Application to State Bond Commission and Secretary of State. Application is made to the Louisiana State Bond Commission and the Secretary of State for consent and authority to hold the special election as herein provided, and in the event that election carries for further consent and authority to dedicate the proceeds of the Taxes, and a certified copy of this Resolution shall be forwarded to the Louisiana State Bond Commission and Secretary of State on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application. ORDINANCE NO AN ORDINANCE TO AUTHORIZE AN ACT OF SALE BY THE PARISH OF OUACHITA TO SELL ADJUDICATED PROPERTY DESCRIBED AS PARCEL 58072: LOT 4, SQ 17, RENWICKS ADDITION, OUACHITA PARISH, LOUISIANA, IN ACCORDANCE WITH LA R.S. 47: 2202 ET SEQ. AND TO AUTHORIZE THE OUACHITA PARISH POLICE JURY PRESIDENT TO SIGN ALL NECESSARY DOCUMENTS AND TO ADDRESS THE MATTERS RELATIVE THERETO WHEREAS, the immovable property described below was adjudicated to the Parish of Ouachita on June 17, 1999, for nonpayment of taxes; and WHEREAS, the three (3) year period for redemption provided by Art. 7, 25 of the Louisiana Constitution has elapsed, as well as the five (5) year redemption period established by Parish Ordinance No: 9016 and the owner of record has failed to redeem the adjudicated property; and WHEREAS, LA R.S. 47: 2202 et seq. provides that the Parish may sell adjudicated property in accordance with law after the expiration of the period for redemption; and WHEREAS, the Parish of Ouachita has declared the property described below surplus and not needed for a public purpose and to dispose of said property in accordance with LA R.S. 47:2202, et seq.; and WHEREAS, in accordance with L.A.
